Abstract

Research Objective: This study aims to discuss the hierarchy of law in Islamic banking. A recurring issue is the effectiveness of the legal hierarchy in the framework of Islamic banking, which sometimes does not function significantly, consequently impacting the effectiveness of the law in Islamic banking. An examination of the issues regarding Islamic banking regulations becomes a discourse that requires finding solutions. Method: The research employs library research, which is a method of acquiring data and information by utilizing available library resources such as books, journals, documents, historical records, or pure literature related to the research object to gain a deeper understanding of the hierarchy of law in Islamic banking using a thematic approach.Results: The findings of this research reveal that Islamic banking in Indonesia is grounded in two legal foundations, namely Islamic law and positive law, supported by government regulations. The hierarchy of law in Islamic banking comprises various forms, including laws, Bank Indonesia regulations, Financial Services Authority (OJK) regulations, and National Sharia Council (DSN) fatwas.

Abstract

The growth of the Sharia banking system in Indonesia is considered a measure of Sharia's economic success. The Indonesian Sharia Banking Supervision is responsible for regulating sharia banking activities. It is important to note that this information is from a regulatory point of view. The regulation and supervision of sharia banking activities are based on amendments to Act No. 3 of 2004 on the Bank of Indonesia, No. 23 of 1999, and Law No. 21 of 2008. After the passing of OJK Act No. 21 in 2011, Indonesian banks were granted the authority to oversee Sharia banks, which were then transferred to the JSC. The Financial Services Authority was formed due to concerns from various parties about the supervisory function of Indonesian banks in regulating Sharia banking. The JSC does not directly monitor all activities of Sharia institutions, but rather ensures that certain aspects are overseen by other institutions, such as the DPS (Dewan Pengawas Syariah).  The DPS is responsible for overseeing Sharia Financial Institutions, and is registered based on the approval of the National Sharia Council (DSN). The objective of the OJK is to meet and protect the needs and interests of the public, create a stable and sustainable financial system, and implement a financial system based on the principles of good governance, which include accountability, transparency, and independence.

Abstract

Indonesia's economy is driven by various sectors, with the banking sector playing a very important role. Indonesian banking has been operating since colonial times until today, functioning as a liaison between capital owners and capital managers. Capital owners often do not have sufficient skills to manage funds professionally, while banks have these abilities, so they can manage funds optimally and foster trust. In management, banks place the use of funds as assets and the source of funds as liabilities, which is in accordance with macro monetary policy in a country's asset management. The main purpose of this management is to monitor the financial position, which is important for planning, organizing, and supervising, as well as for capital, fund raising, fund use, and financing in liquidity management. Interest rates greatly affect liquidity management, because they have a difference or difference to sensitive assets and liabilities. Good liquidity management maintains a balance between assets and liabilities to meet various financial obligations, including debt repayments and employee salaries. The case of Silicon Valley Bank, which collapsed in March 2023, shows the importance of healthy liquidity ratios. A rapid rise in interest rates lowers the value of bonds in the portfolio and increases the cost of credit, which creates a GAP in profit returns. In contrast to conventional banking, Islamic banking uses a profit-sharing system that is more flexible in profit returns. This phenomenon attracts the author's attention to further discuss liquidity management and GAP management in Islamic banking listed on the Indonesia Stock Exchange for the 2019-2022 period, where there are four Islamic banks that have been listed on the Islamic stock exchange.

Abstract

Writing this article wants to describe, related to Yemeni legal regulations, namely the marriage of Muslim women in Yemen. Discussing the annulment of marriages for men who adhere to Islam or Muslims who do not marry Muslim women and women of the book in Yemen. As for the women of the People of the Book who can be married to Muslim men in Yemen, it is necessary to elaborate on the permissibility of marrying women who are not Muslim. Yemen itself fully takes the source of law in the text of the Koran where marriage regulations in Yemen between Muslim men and women of the book are permissible and regulated in Yemen's legal laws. On the other hand, interfaith marriages in other regions related to women of the book cannot be found, in Indonesia, for example, interfaith marriages only describe marriages between Muslims and those who are not Muslim or are not Muslim, there is absolutely no mention of women of the book. For this reason, this article wants to elaborate on the explanation regarding women of the People of the Book, amidst the debate whether or not it is permissible to marry women of the People of the Book, Yemen still adheres to the Al-Quran text which allows Muslim men to marry women of the People of the Book until now.

Abstract

This research is motivated by the ups and downs in the quality of employee performance at PT Enseval Putera Megatrading Pekanbaru Branch from 2020 to 2022. Based on the formulation of the problems that have been made, this study aims to determine the effect of compensation and work environment on employee performance at PT Enseval Putera Megatrading Pekanbaru Branch This research is a type of quantitative research. The sample used in this study were employees of PT Enseval Putera Megatrading Pekanbaru Branch as many as approximately 52 people. Sampling technique by means of Simple Random Sampling. With data collection through observation, interviews, questionnaires and literature studies. The analysis technique in this study uses Multiple Linear Regression Analysis. This study uses multiple linear regression with the help of the SPSS Ver program. 21.00. The results of this study, compensation has a positive effect on employee performance. This is evident from the results of the t test which obtained t count X1 greater than t table, namely the value of t count (7.467) greater than t table (2.010) accepted at a significance level of 5%. The work environment has a positive effect on employee performance. This is evident from the results of the t test which obtained the t count X2 greater than the t table, namely the t value (7.484) greater than the t table (2.010), accepted at the 5% significance level. Compensation and work environment together have a positive effect on employee performance. This is evident from the results of the F test which shows the results of the F count of (415.672) greater than the F table of (3.19) accepted at the 5% significance level. Islamic economic review of the effect of compensation and work environment on employee performance at PT Enseval Putera Megatrading Pekanbaru branch can be categorized as sharia based on ijarah contract.

Abstract

Marketing strategy is an effort to market a product, both in the form of goods and services, using certain plans and tactics to increase sales volume. One of the business development strategies is the implementation of a marketing mix strategy. Marketing is one of the most important factors in the continuity of a business, so it is very important for business people to pay attention to the marketing mix in their business. The purpose of this study was to determine how D'besto Fried Chicken Pekanbaru applies sales promotion. The data analysis technique used is market mix analysis. The marketing mix variables studied were product, price, place and promotion. The results of this study indicate that consumer decisions in purchasing D'besto Fried Chicken Pekanbaru are strategic location selection and products that are acceptable to the public. The recommendation of this research is that D'besto Fried Chicken Pekanbaru products should be more diverse and innovative in terms of packaging and online marketing and improve brand quality.

Abstract

This article seeks to explore the application of the halal industry in the production of Salai Patin fish in the Kampung Patin Koto Masjid Tourism village, Kampar Regency. Many factors can influence the successful implementation of the halal industry, including understanding the concept of halal, the urgent need to develop the Islamic economy, and the profile of Kampung Patin Tourism Village as the center of Patin Fish production. The process of implementing the halal industry begins with awareness and training. Ensuring that catfish business actors understand the sharia principles underlying halal products. Halal certification is an important step to convince consumers that Salai Patin fish products meet the standards of purity and halalness. Collaboration with halal certification bodies and authorized government agencies is also a key factor in maintaining product integrity and quality. The prospect of the halal industry promises sustainable economic growth in Kampung Patin Tourism Village, with the expectation that salai patin fish products can present wider business opportunities, both in local and international markets. This development will support the increasingly globalized idea of sharia economy, changing people's perception of Islam as a religion that is rahmatan lil alamin.

Abstract

A will is a legal document that outlines how a person's assets will be distributed after their death.   In some countries, the distribution of assets is regulated by law and not solely based on the wishes of the deceased. This is known as a mandatory will, which limits the amount that can be given to certain parties to no more than one-third of the total assets. Indonesia and Malaysia are countries that regulate the matter of mandatory wills. The purpose of this journal is to identify the similarities and differences in the provisions of mandatory wills in Indonesia and Malaysia, to determine the Islamic legal basis for mandatory wills, and to examine the development of mandatory wills in both countries.

Abstract

This research states that in Islamic law adopting a child is a good act, which helps adopted children get a proper education. The right to a proper education for adopted children is one of the main goals of adoption, this welfare is one of the rights that must be provided by adoptive parents. In general, implementing the above rights of children is an obligation and joint responsibility of the government and society. The phenomenon that occurs in Indonesia is that the educational rights of adopted children have shifted to utilization, due to several factors, one of which is economic. The aim of this research is to strengthen previous research, and examine further the shift in the educational rights of adopted children and look at the factors that result in non-fulfillment of adopted children's rights in Indonesia. This research uses an approachsociological normative  with the nature of the researchanalytical descriptive. The results of this research found several factors that resulted in a shift, even not being given the rights of adopted children, such as: f In fact, in Islam, adopting a child is a good act but over time it becomes exploitative.

Abstract

An asset management system cannot do without liability management. These two systems are like two sides of a coin, connected to each other. The reason is that most sources of bank assets are obtained from deposits, even though the bank has its own capital, its liabilities are more profitable than its own capital. Therefore, the development of assets is influenced by the increase in liabilities. Judging from the composition of the bank's balance sheet, the left side is the assets owned, and the right side is the liabilities to stakeholders. To balance these two aspects, banks need an effective and efficient management system. Therefore, banks implement ALMA (Asset Liability Management). This writing uses a type/approach method in the form of library research. ALMA is a series of actions and procedures designed to control financial positions. Asset and Liability Management is also to manage risks that may arise in daily business activities which are then specifically designed so that they can optimize income while limiting asset and liability risks by complying with monetary policy and bank supervision. The implementation of asset and liability management in banking institutions, both Islamic and conventional banks, must go through the stages of budget assessment, making income plans, assessing past investment performance, monitoring the distribution of bank assets and liabilities and implementing asset and liability strategies.
