Abstract

Anak sebagai generasi penerus bangsa memiliki hak konstitusional untuk memperoleh perlindungan, termasuk ketika berhadapan dengan hukum. Sistem Peradilan Pidana Anak di Indonesia melalui Undang-Undang Nomor 11 Tahun 2012 menegaskan pendekatan keadilan restoratif dan diversi sebagai prinsip utama, serta menempatkan terpencil sebagai upaya paksa yang bersifat eksepsional dan ultimum remedium. Penelitian ini bertujuan untuk menganalisis prinsip perlindungan anak dalam SPPA, kedudukan tersingkir sebagai upaya paksa yang bersifat terbatas, serta syarat normatif tersingkirkan anak menurut ketentuan peraturan-undangan. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan peraturan-undangan dan pendekatan kontekstual, menggunakan bahan hukum primer, sekunder, dan tersier yang dianalisis secara kualitatif melalui penafsiran hukum. Hasil penelitian menunjukkan bahwa SPPA membangun konstruksi perlindungan anak melalui pengawasan ketat terhadap penggunaan terpencil, baik dari segi usia minimum, ancaman pidana, penilaian risiko, maupun kewajiban mempertimbangkan Laporan Penelitian Kemasyarakatan. Penahanan anak hanya dapat dilakukan apabila syarat terpenuhinya persyaratan dan tidak tersedia alternatif lain yang lebih melindungi kepentingan terbaik anak. Dengan demikian, kebijakan normatif tersingkir merupakan instrumen penting untuk menjaga konsistensi prinsip perlindungan anak, mencegah perlindungan upaya paksa, serta menjamin keadilan yang berorientasi pada rehabilitasi dan masa depan anak.

Abstract

This study examines the regulation and implementation of Supreme Court Regulation (PERMA) No. 5 of 2019 on Guidelines for Adjudicating Marriage Dispensation Requests and its implications for child rights protection in Indonesian marriage law. Employing a normative juridical approach with statutory and conceptual analysis, the study reviews Law No. 16 of 2019, PERMA 5/2019, and Law No. 35 of 2014 through library research and descriptive-analytical methods. The findings indicate that PERMA 5/2019 provides comprehensive guidelines for judges through the best interests of the child principle, including age verification, child-friendly examinations, and expert involvement to assess health, education, psychological, and family economic aspects. Its implementation shifts the judicial paradigm toward child-centered justice. However, challenges such as socio-cultural pressures, variations in judicial competence, and limited access to experts lead to inconsistent decisions that potentially perpetuate child marriage. Key implications include strengthening children's rights to participation, education, and development, yet field practices show dispensations often rely on emergency reasons like premarital pregnancy without long-term considerations. The study recommends enhancing judicial capacity, institutional synergy, digital monitoring, and regulatory revisions to position dispensation as a limited exception, effectively preventing early marriage.

Abstract

The enforcement of criminal law in electoral processes constitutes a fundamental pillar in safeguarding democratic integrity and ensuring the realization of free and fair elections. However, in practice, a significant number of electoral crime cases fail to reach the prosecution stage or are terminated during investigation.  This suggests that the criminal justice process regarding electoral offenses is not yet fully effective. The findings reveal that stagnation in handling these cases is not merely attributable to technical constraints but reflects deeper structural and systemic issues within the law enforcement framework. Weak inter-institutional coordination within Sentra Gakkumdu has been shown to hinder procedural synchronization and increase the risk of enforcement discontinuity. Furthermore, insufficient evidence and limited investigative capacity significantly constrain juridical proof. These challenges are exacerbated by the relatively short time frame for case handling, which precludes comprehensive investigations. Additionally, shortcomings in regulatory systems and low levels of public participation in monitoring and reporting violations further undermine case continuity and weaken oversight. Therefore, a comprehensive and integrative reformulation of the electoral law enforcement system is urgently required. This includes strengthening institutional coordination, updating regulatory frameworks, and enhancing public participation to improve the effectiveness of the crime process and ensuring elections that are not only credible and accountable,  but also just and democratic.

Abstract

Litigation has long been regarded as the primary method of dispute resolution. However, in practice, it is often criticized for its lengthy procedures, high costs, and adversarial (win–lose) nature, which limit its effectiveness in restoring relationships and accommodating the parties’ interests. As a result, non-litigation alternatives such as negotiation, mediation, and arbitration are increasingly considered more flexible, faster, and better able to preserve relationships between the parties. This study examines the effectiveness of dispute resolution methods: litigation, mediation, arbitration, and negotiation, by focusing on key aspects, including procedure, cost, time, flexibility, and legal certainty. This approach is used to identify the characteristics of each method in responding to various types of disputes, particularly within complex business and civil law contexts. The findings indicate that no single method can be considered universally effective for all types of disputes. Litigation remains relevant as an ultimum remedium in the enforcement of formal law, especially when binding and enforceable decisions are required. Meanwhile, negotiation serves as the simplest, fastest, and most cost-efficient initial option, allowing parties greater autonomy in reaching agreements. Mediation has proven effective in producing collaborative, consensus-based solutions that support long-term relationships, while arbitration offers a balance between efficiency and legal certainty through final and confidential decisions.

Abstract

This study aims to analyze the implications of sentencing decisions for children from the perspective of restorative justice and rehabilitation in the juvenile justice system in Indonesia. Children in conflict with the law require special protection because they are still developing psychologically and socially, so the sentencing process is not only oriented towards punishment, but also towards recovery and guidance. This study uses a normative juridical method with a statutory regulatory approach and a conceptual approach referring to Law Number 11 of 2012 concerning the Juvenile Criminal Justice System. The results show that sentencing decisions for children have a significant impact on the psychological, social, and future conditions of children. The application of restorative justice principles through diversion and rehabilitation is considered more effective in encouraging child recovery, improving social relationships, and reducing the likelihood of recurrence of criminal acts. However, the implementation of restorative justice still faces various obstacles, such as a lack of understanding among law enforcement officials, limited rehabilitation facilities, and minimal post-sentencing supervision. Therefore, it is necessary to strengthen coordination between institutions, improve the quality of guidance, and optimize the rehabilitative approach so that the juvenile criminal justice system can provide protection and best interests for children.

Abstract

The practice of adoption (tabanni) is a social reality that is culturally embedded in Indonesian Muslim society, but often experiences normative clashes with classical Islamic inheritance law which requires blood relations (nasab) as the basis for inheritance. This gap has the potential to trigger distributive injustice for adopted children who do not have inheritance rights despite having emotional closeness and economic dependence. This study aims to analyze the legal status of adopted children and the application of Article 209 of the Compilation of Islamic Law (KHI) concerning Mandatory Wills as a legal solution. This study is a normative legal research with library research methods that use a statutory approach and a conceptual approach. The analysis was conducted descriptively qualitatively using analytical tools of Maqashid Syariah theory, Maslahah Mursalah, and the theory of Mandatory Wills. The results of the study indicate that Article 209 of the KHI reconstructs the status of adopted children not as Heirs, but as Recipients of Wills, in order to maintain the purity of lineage according to sharia principles. This article transforms the paradigm of wills from voluntary (tabarru’) to mandatory (ijbari) through an ex-officio state mechanism. Philosophically, this application is validated by the principle of Maslahah Mursalah to fill the legal vacuum for the protection of children (hifz al-nafs) and Maqashid Syariah in realizing justice in the distribution of assets (hifz al-mal) without violating the principle of descent (hifz al-nasl). The limitation of a mandatory will of a maximum of one-third (1/3) functions as an instrument of distributive justice (al-’adalah) and a safety valve to protect the rights of lineage heirs (dzawil furud) from being oppressed. It is concluded that Article 209 of the KHI is a form of social engineering and ijtihad typical of Nusantara Islam that applies a middle path (wasatiyah) in family law.

Abstract

This study aims to analyze a digital transparency strategy based on big data analytics in detecting village fund corruption in Indonesia. The increasing number of corruption cases indicates weaknesses in conventional monitoring systems that fail to integrate data comprehensively. This research employs a qualitative approach using literature review and document analysis of official reports from the Corruption Eradication Commission and Indonesia Corruption Watch. The findings reveal that big data analytics enables the detection of transactional anomalies, cross-sectoral data integration, and improved accountability in village fund management. Furthermore, this strategy enhances technology-based transparency through government digital systems. Therefore, the integration of digital transparency and big data analytics offers an innovative model for more effective and efficient prevention and early detection of village fund corruption. thus, the integration of digital transparency and big data analytics has the potential to become an innovative model for the prevention and early detection of village fund corruption in a more effective and efficient manner, while also supporting the strengthening of a data-integrated early warning system and adaptive public policy.

Abstract

Mangrove forests play an important role in maintaining the stability of coastal ecosystems, reducing coastal abrasion, and supporting the socio-economic life of coastal communities. However, the sustainability of the mangrove ecosystem in Kayu Ara Permai Village, Siak Regency, faces various threats originating from natural factors and human activities. This study aims to evaluate the policy of mangrove forest protection and preservation in Kayu Ara Permai Village and identify obstacles in its implementation. This research used a descriptive qualitative method with data collection techniques through observation, interviews, and documentation. The results showed that the implementation of Village Regulation Number 07 of 2018 succeeded in reducing illegal logging activities and increasing public awareness regarding mangrove conservation. Policy evaluation was analyzed using indicators of effectiveness, efficiency, adequacy, equity, responsiveness, and accuracy. The findings indicate that the policy has been fairly effective in controlling illegal exploitation, but has not been optimal in addressing coastal abrasion and providing rehabilitation support facilities. The main obstacles include increasing coastal abrasion, limited wave-breaking equipment, lack of operational patrol facilities, and limited institutional support. Therefore, stronger collaboration between the village government, local communities, and regional government is needed to improve the sustainability of mangrove protection and preservation policies.

Abstract

Family resilience in Indonesia faces multidimensional pressures reflected in increasing divorce rates, violence against children, and youth involvement in drug abuse and promiscuity. Bukittinggi City, despite having strong cultural traditions based on local wisdom and religious values, has also experienced an increase in divorce cases and domestic violence. In response, the Bukittinggi City Government launched the Family School Program aimed at strengthening the eight functions of the family: religious, cultural, affection, protection, reproductive, educational, economic, and environmental. This study aims to analyze the best practices of this program using five UN-Habitat indicators: impact, partnership, sustainability, leadership, and transferability. The research method used is qualitative exploratory with data collection through in-depth interviews with informants consisting of alumni, active participants, program managers, and sub-district coordinators, as well as participatory observation and documentation. The results show that the program successfully improved emotional control, family communication, and child-rearing patterns significantly. Multi-stakeholder partnerships with technical agencies, religious institutions, and academics are strong, but the private sector has not yet been involved. Program sustainability is supported by the Mayor's Decree and alumni enthusiasm, but funding remains vulnerable as it is entirely dependent on the local budget. Leadership is distributive from the political level to the community level, but is female-dominated with very low male participation. The program has high replication potential and has attracted many regions for comparative studies. In conclusion, this program falls into the category of good practice approaching best practice, but requires strengthening economic impact, diversifying funding, and increasing male participation.

Abstract

This study examines the structural weaknesses of public participation in Indonesia’s legislative process and evaluates the feasibility of adopting a public inquiry mechanism to strengthen Evidence-Based lawmaking. Although the 1945 Constitution and Law Number 13 of 2022 formally guarantee public involvement, existing parliamentary hearings and public consultations remain largely procedural and fail to meet deliberative democratic standards. This condition raises urgent concerns regarding legislative legitimacy, transparency, and the substantive use of public input. The research employs a normative-comparative approach combined with juridical-empirical analysis. It analyzes Indonesia’s participatory legal framework and compares it with public inquiry models in the United Kingdom, Australia, and New Zealand, focusing on institutional independence, transparency, and investigative authority. Empirical assessment of legislative practices reveals a persistent gap between normative guarantees and practical implementation, resulting in symbolic participation with limited policy impact. Comparative findings demonstrate that public inquiry mechanisms can enhance deliberative quality and accountability through systematic evaluation of evidence. The study concludes that a hybrid public inquiry model integrating parliamentary procedures with independent expert panels is legally and institutionally feasible, provided that regulatory reform, institutional capacity building, and political safeguards are effectively implemented.
