Abstract

In 2016, China built its first overseas military base in Djibouti, East Africa. The base was established to prevent the rise of Somali pirates and piracy in the Gulf of Aden and the waters of Somalia. However, China was not the only country that had built military bases in the region. Previously, the United States, France, Italy, and Japan had also established military bases in the area. This article will explain China's motives for building a military base in Djibouti in relation to other countries, aside from preventing piracy. In this article, the authors use the concepts of balance of power and national interests to analyze it. The authors use qualitative research methods and secondary data collection techniques from relevant books, journal articles, and websites. The research results show that China's military base estabishment is an effort to soft balance against the United States' power in Djibouti. In addition, China also has economic motives, which is to facilitate and secure China's international trade, considering the location of the Chinese base is close to the Doraleh port, gateway to trade with Africa and Europe.

Abstract

The purpose of this study is to examine foreign investment owned by individual companies. This study uses normative legal research methods. Legal and conceptual approaches are the approaches used in this research. The collection of legal materials in this journal uses library research. The legal material analysis method used in this journal refers to deductive, namely drawing conclusions from a problem that is general in nature to the concrete problems faced. Namely explaining things that are general to matters that are specific in order to draw conclusions that can provide answers to the problem of this research, namely regarding investment in the establishment of individual PT in UUPT and UU Cipta Kerja. The results of this study show that after the promulgation of the Job Creation Law which changed several provisions in the Company Law, one of them introduced a new form of legal entity, namely an Individual Company which is specifically for MSEs with the aim of forming it to facilitate the development of micro and small businesses by being able to form legal entity business entities. only with 1 (one) founder or shareholder. Investment is basically an activity for a fairly long period of time, so that when investors' investment interest declines, the role of the government in inviting investors to invest in Indonesia will be able to help attract investors' interest and the impact will be felt when the process of economic activity has been running and there has been an increase in economic value.

Abstract

A Limited Liability Company is a form of business that has been regulated in the Limited Liability Company Law which has one important organ, namely the annual general meeting of shareholders. RUPS has a very important role in making strategic decisions, overseeing company performance, and maintaining transparency and accountability. Therefore, the arrangement of RUPS as an important organ in the company. The method used is normative legal research using statute approach and case approach. The legal consequences of companies not holding RUPS are in the form of sanctions which are not listed in Law Number 40 of 2007 Concerning PT so that the government should pay more attention to the importance of RUPS and be able to see this legal loophole to be corrected so that the RUPS can maximize its function for the benefit of the company as well as for the government as a reference for economic growth.

Abstract

Article 1 of the 1945 Constitution of the Republic of Indonesia states that the State of Indonesia is a legal state which has sovereignty in the hands of the people and is implemented according to the Constitution. In order to implement the principles of the State of Indonesia in accordance with the 1945 Constitution of the Republic of Indonesia, there is a guiding instrument, namely the provisions for the formation of laws in Law Number 12 of 2011 and their amendments which maintain legal certainty in Indonesia. However, the existence of the Job Creation Law which was followed by a Government Regulation in Lieu of a Job Creation Law (Perppu) is in fact not in accordance with the Constitution and Law Number 12 of 2011 so that this research examines the benchmarks regarding compelling interest circumstances in Perppu and the relationship between the formation of Perppu with the principles of the Unitary State of the Republic of Indonesia. Because this research is legal research, the approach used is a statutory approach related to the formation of Indonesian laws and regulations supported by the concept of a rule of law and a democratic state based on Pancasila.

Abstract

Penelitian ini akan mengkaji serta menganalisa terkait upaya perlindungan hukum terhadap merk industri UMKM di Indonesia berdasarkan undang-undang hak cipta. UMKM sebagai salah satu penggerak roda perekonomian negara belakangan sangat berkembang, namun nyatanya dibalik semua usaha pengembangan yang dilakukan oleh pemerintah, stigma bahwa UMKM merupakan bisnis tradisional menjadi alasan minimnya payung hukum bagi pelaku industri UMKM. Kebanyakan pelaku UMKM kurang memperhatikan pentingnya aspek perlindungan hukum bagi usaha mereka, terutama terkait dengan perlindungan merk yang sangat krusial bagi pelaku bisnis. Maka dari itu, diperlukan upaya yang harus dilakukan untuk mengedukasi pada pelaku industri UMKM agar mengamankan merk dalam bisnis yang sedang digeluti untuk melindungi merk dagangnya. Sehingga dalam penelitian ini akan dibahas mengenai upaya perlindungan hukum terhadap merk yang merupakan hak pelaku UMKM di Indonesia, dengan penelitian yuridis normatif.

Abstract

Protection of the rights of indigenous peoples in Indonesia has not been able to protect all of their rights. Although there have been many government products regarding the protection of indigenous peoples' rights in the form of 158 regional legal products on indigenous peoples, consisting of 11 provincial regulations, 57 regional regulations, 2 district head regulations, and 87 district head decisions. However, in reality there are still various conflicts and problems related to the rights of indigenous peoples. Using Ulber Silalahi's concept of government communication, this paper answers the question of how government communication influences regulations on indigenous peoples. However, what happens in Indonesia is not a mistake in government communication, but a failure of messages related to regulations and policies conveyed by the government as a sender to other receivers.

Abstract

Sexual violence is a serious crime that violates human rights and adversely affects the well-being of victims. Protecting the rights of victims of sexual violence is crucial to ensuring justice and recovery for victims. Therefore, the purpose of this study is to investigate the realization of the rights of victims of sexual violence according to the current legislation. This study uses legal analysis techniques Yuridis-Empiris in relation to legislation applicable to sexual violence. Various aspects related to the exercise of victims' rights, such as protection, rehabilitation and compensation, are analyzed in detail. In addition, the study also addresses related issues such as public awareness, education and access to support services. The results of the study show that the law on sexual violence recognizes the importance of protecting the rights of victims. Victim protection is governed by a number of mechanisms, including the provision of physical protection and access to effective legal systems. Victim rehabilitation is also considered an important part of recovery, along with psychological support, medical care and education. Protection of the rights of victims of sexual violence is an important part of legislation on sexual violence. This law provides an important framework for the protection, rehabilitation and compensation of victims. However, issues such as public awareness and access to services remain to be addressed. Better protection of victims' rights in the future will require cooperation between governments, community groups and individuals.

Abstract

The law that applies to mixed nationality marriages can be seen based on the principles of Indonesian International Civil Law, including the principle of lex loci celebrationis, nationality or joint residence, where the marriage is held, where the husband and wife become citizens after marriage or where the husband and wife live. However, mixed marriages that are not recorded according to applicable regulations do not deprive children of their inheritance rights, especially from their fathers as long as there is recognition with an authentic deed. The fact that the marriage is not recorded does not mean that the marriage is void, but only that it has not been recognized so that the inheritance rights of the children are not obtained properly. Decision.of.the.Constitutional.Court.No.46/PUU-VIII/2010 is the latest legal breakthrough in which children outside the marriage of an unregistered marriage still have civil rights from both parents.

Abstract

This article analyzes the criminal law aspects in combating drug trafficking through a case study of the verdict of South Jakarta District Court Number 133/Pid.Sus/2023/PN JKT.SEL. Juridical-normative and qualitative approaches are employed to analyze the case facts, legal arguments, sentencing considerations, and social impacts of the court's decision. Case study, descriptive, comparative, and content analysis methods are utilized to gain a comprehensive understanding of the legal and social aspects involved in addressing drug trafficking cases. The research findings provide insights into the implementation of criminal law, social influences, and countermeasures against drug trafficking crimes. Recommendations can be made for the improvement of handling similar cases in the future.

Abstract

Indomaret and alfamart are franchise minimarket chains in Indonesia. This minimarket provides a variety of basic necessities and daily necessities. Indomaret and Alfamart are very easy to find in residential areas, office buildings and public facilities. Law enforcement is aimed at improving order and legal certainty in society. This is done, among others, by regulating the functions, duties and authorities of institutions in charge of enforcing the law according to the proportion of their respective scopes, and is based on a good cooperation system and supports the goals to be achieved. Parking is a stop that is also one of the public facilities that can be used by anyone while traveling, parking lots are very important for temporarily store your vehicles such as motorbikes and cars when you are going to activities. The practice of illegal levies is rife once implemented. The form that is easiest to find is what often occurs in various public places, where we often find irresponsible people who ask for parking money illegally. This action is clearly troubling because it is contrary to regulations in the place which actually does not charge parking fees to visitors. Hereby the case is regulated in the Law, Article 1 number 64 of Law No. 28 of 2009 mentions the issue of parking levies which are payments for certain services or permits provided specifically or given from local governments as in the interest of private persons or entities. So that this parking attendant can be subject to extortion and threats in articles 368-371 of the Criminal Code is part of Chapter XXIII of the Criminal Code which contains "Whoever, with intent to benefit himself or others by contravening rights, coerces a person by force, threats of violence, so that that person gives goods, which wholly or partly include the person's own property to another person or so that the person makes a debt or write off receivables, punishable for extortion with imprisonment for not more than nine years. In regional regulation Number 03 of 2011 concerning Regional Taxes in Chapter III Article 69 Number 1 which reads "Tax Collection is prohibited from being bought"
