Abstract

The purpose of this study is to examine the views of Islamic law and positive law on husbands who impregnate their wives' younger siblings, and to find out the position of children born from the husband's relationship with his wife's younger siblings according to Islamic law and positive law in Indonesia. This research uses descriptive qualitative methods to understand social phenomena in depth. With this approach, researchers can collect accurate and factual descriptive data about observed behavior and social interactions. Qualitative methods allow researchers to gain a more complex and complete insight into the phenomenon under study, so as to provide a clearer and more comprehensive picture of the observed social reality. This research uses primary and secondary data. Primary data is collected directly from the original source, while secondary data comes from supporting literature. Data collection methods include observation, interviews, and document studies. Data analysis was conducted systematically to produce accurate and comprehensive findings. This study concludes that both Islamic law and Indonesian positive law prohibit and sanction the actions of husbands who impregnate their wives' younger siblings, with severe legal consequences in the perspective of Islamic law and criminal sanctions in positive law. Children born from this forbidden relationship have a special status, namely only having a nasab relationship with their mother and not having the same rights as legitimate children, both in Islamic law and Indonesian positive law. Therefore, it is important for the community to understand the legal and social consequences of these illicit relationships and protect the rights of children born in these conditions.

Abstract

This study aims to determine how the implementation of policies and regulations of the Bima Regency Government in the management of protected forests, as well as the obstacles faced, and to determine the extent of community participation in protecting protected forests in Bima Regency, as well as factors that influence community involvement. This research uses empirical legal methods with a qualitative approach and a case study in Bima District. Data was collected through in-depth interviews with stakeholders, field observations, and document studies (primary and secondary data) to analyze the implementation of protected forest management policies. This combination of approaches allows for an in-depth understanding of practices on the ground while producing contextualized policy recommendations. The results of this study indicate that the implementation of protected forest policy in Bima District faces challenges due to the imbalance between economic development and conservation. The focus on maize production in the RPJMD 2021-2026 triggered forest conversion, with 57% of the area degraded. Community participation is still limited at the implementation stage due to lack of incentives and dependence on forest products. Solutions are needed through: (1) economic-ecological policy balancing, (2) strengthening supervision, (3) alternative economic empowerment, and (4) community-based collaborative approaches. Without these measures, pressure on forests will continue to threaten environmental sustainability.

Abstract

This study aims to determine the regulations governing marine businesses and Blue Economy in Indonesia and analyze the implementation of marine business development for coastal communities based on Blue Economy in Kolo Village, Bima City. This research uses normative legal methods with statutory and conceptual approaches to analyze regulations and legal values related to blue economy-based marine business development in Kolo Village. Data is sourced from primary, secondary, and tertiary legal materials, which are collected through systematic literature studies to answer problem formulations. The results show that the development of the marine sector in Kolo Village, which adopts blue economy principles, has a solid legal basis, both nationally through Law No. 32/2014 and internationally through UNCLOS and SDGs. The region holds strategic potential in three main areas: environmentally friendly fisheries, marine tourism and the marine product processing industry. However, implementation is still faced with structural constraints such as regulatory complexity and limited human resources. Achieving sustainable development in the region requires a comprehensive collaboration that integrates three fundamental elements: environmental protection, strengthening the local economy and structuring the legal system. This holistic approach will create an ideal coastal management model - capable of improving the welfare of local communities while ensuring the preservation of marine resources for the future. Kolo Village has the potential to become a model for implementing ecologically sound and socially just marine development concepts.

Abstract

This thesis discusses the views of husbands and wives on family responsibilities, analyzes the factors that lead women to work, and analyzes the perspectives of Islamic family law on working women. This research employs a library research method, employing a normative approach, linking the issues encountered to Islamic legal norms. The primary sources in this research are journals, books, and articles. The literature was compiled by searching for reading materials relevant to the issues discussed, namely working women. The results of this study indicate that women who make the decision to work do so to help ease their husband's burden in providing for their family. They also fulfill their right to develop a career in a specific field. The researcher's research reveals that, with the development of the times and changes in lifestyle, many women are participating in the public sector to contribute to the economy or simply to advance their careers. There are several reasons for women to become working women, namely because of the main factors of economics, self-existence, education, social, culture, as well as the interests and talents they have, when viewed from Islamic family law there are no verses that prohibit women from working and from this research, working women when viewed from the perspective of Islamic family law do not conflict with Islamic law if carried out by women with conditions that do not deviate from Islamic law and with the permission of their husband or family.

Abstract

This research aims to find out the legal regulations governing the protection of Fashion Industry Product designs in Indonesia and the obstacles faced in the implementation of legal protection of Fashion Industry Product Designs in Indonesia. This research uses a normative approach to examine legal protection of fashion industry product designs in Indonesia. The focus of this research is on the system of legal norms and the concept of justice based on public views on changes in the purpose of punishment in the Criminal Code (KUHP). The approach used includes conceptual, statutory, and comparative analysis to understand related legal concepts and principles. Secondary data sources used include legislation, literature, journals, and research results. Data collection was conducted through a literature study by analyzing written documents and related electronic sources. Thus, this research aims to understand the legal protection of fashion industry product designs in Indonesia and related concepts of justice. The results showed that the legal protection of fashion product designs in Indonesia is based on three pillars, namely the Industrial Design Law regulated in Law Number 31 of 2000 concerning Industrial Design, Copyright regulated in Law Number 28 of 2014 concerning Copyright, and Trademarks regulated in Law Number 20 of 2016 concerning Trademarks and Geographical Indications. Although comprehensive, its implementation still faces challenges such as the complexity of registration and piracy. To optimize protection, regulatory harmonization, increased IPR awareness, and effective law enforcement are needed. Thus, Indonesia's fashion industry can develop sustainably and increase global competitiveness.

Abstract

The advancement of information technology and the widespread adoption of social media have significantly influenced the practice of the legal profession, particularly among advocates. While technology offers new avenues for disseminating legal knowledge and enhancing access to justice, it also introduces complex ethical challenges. This paper explores various ethical breaches committed by advocates via social media platforms, including excessive self-promotion, making guarantees of legal success to clients, and potential breaches of client confidentiality. Adopting a normative legal approach, this study examines the legal framework provided by Law No. 18 of 2003 on Advocates and the Indonesian Advocate Code of Ethics (KEAI), and highlights the persistent weaknesses in ethical oversight within professional advocate organizations. The findings underscore the urgent need to modernize supervisory mechanisms, develop ethical guidelines for digital conduct, and reinforce the role of professional bodies in educating and disciplining members. To preserve the dignity and integrity of the legal profession in the digital era, the use of technology by advocates must align with ethical principles, professional standards, and a commitment to public responsibility.

Abstract

The enactment of Law Number 27 of 2022 on Personal Data Protection (PDP Law) marks a significant milestone in safeguarding individual human rights in the digital sphere in Indonesia. This law responds to the urgent need for a comprehensive and unified regulatory framework to replace the previously fragmented sectoral approach that lacked standardization and legal certainty. The PDP Law establishes clear principles for data processing, defines the rights of data subjects, imposes obligations on data controllers and processors, and outlines systematic mechanisms for supervision and law enforcement. This legal framework provides legal certainty not only for individuals as data owners but also for institutions managing personal data, emphasizing transparency, accountability, and data security. However, the implementation of the PDP Law still faces several challenges, including the formation of an independent supervisory authority, institutional readiness, and the public’s limited awareness of data protection rights. Therefore, synergy among the government, private sector, and civil society is essential to ensure effective enforcement. The PDP Law is not merely a normative instrument but also reflects the state’s commitment to upholding citizens' privacy rights as part of broader human rights protection in the digital era.

Abstract

                The development of digital technology brings new challenges to the practice of the legal profession, particularly for advocates. Professional ethics, previously established within the context of conventional practice, are now faced with new issues, such as the use of social media for self-promotion and the risk of client personal data leaks. This paper discusses violations of the advocate code of ethics in the digital context and the importance of protecting personal data as part of the principle of legal professional confidentiality. Using normative methods and a literature review, this article analyzes the legal provisions governing the advocate code of ethics, including legal foundations such as Law No. 18/2003 concerning Advocates, the Indonesian Financial and Investment Commission (KEAAI), and Law No. 27/2022 concerning data privacy and security. This study highlights the importance of strengthening the oversight system for professional ethics, encouraging increased digital literacy capacity among advocates, and urging the establishment of a responsive and effective oversight mechanism to address the dynamics of professional ethics in the digital era. Efforts to maintain the integrity of the legal profession and build public trust are inseparable from a commitment to protecting personal data and enforcing ethical norms.

Abstract

This research aims to develop a thematic learning model for early childhood that is integrated with the Independent Curriculum and supported by an interactive Learning Management System (LMS) platform. The background of this research is the need for an adaptive, fun, and technology-based learning approach in supporting early childhood learning characteristics. The method used is a Research and Development (R&D) approach with the ADDIE development model, which includes the stages of Analysis, Design, Development, and Implementation. At the analysis stage, a study of teacher needs and children's learning characteristics was carried out through observation, interviews, and document studies. The design stage includes designing learning models, theme structures, LMS interactive features, and play-based assessment strategies. The development stage produces an interactive thematic LMS prototype that contains learning videos, digital activities, and child development reporting. The initial implementation was carried out on a limited basis in several partner PAUDs to see the response of teachers and children. The results of the study show that this model is able to increase children's involvement in learning activities, facilitate contextual and fun learning, and make it easier for teachers to plan and monitor children's learning development. This model is expected to be an innovative solution in the implementation of the Independent Curriculum in technology-based early childhood education.

Abstract

This article examines the strategic role of information technology in strengthening legal ethics enforcement amid Indonesia’s ongoing efforts to combat corruption. In the digital era, addressing corruption can no longer rely solely on repressive legal mechanisms but requires a transparent, accountable, and participatory system. Using a normative-qualitative approach, this study explores how digital innovations such as e-procurement, whistleblowing systems, the JAGA platform developed by the Corruption Eradication Commission (KPK), and blockchain technology have become crucial tools in promoting openness and public accountability. However, the effectiveness of these technologies depends greatly on adaptive regulations and active public engagement. Collaboration between legal frameworks, technological systems, and a culture of civic reporting forms the foundation for a more robust and responsive legal ethics system. The article concludes that the success of legal ethics enforcement in the digital age can only be achieved through continuous synergy between innovation, regulation, and citizen participation.
