Abstract

This paper examines the existence of Parsulukan Babul Falah in Simaninggir Village as a spiritual center that survives amidst the current of modernization. The purpose of this paper is to understand the background of the interest of outsiders in the activities of the tarekat and to identify the unique cultural identities and values that have developed within it. This paper uses a descriptive qualitative method with an ethnographic approach through observation, interviews, and literature studies. The author involved 10 informants from various circles, including murshid, congregation, caliph of parsulukan, and the local community. The results show that the main attraction of Parsulukan Babul Falah lies in the combination of two major tarekats, namely Naqsabandiyah and Sammaniyah, which provide a profound spiritual experience through the practice of suluk, zikir khafi, and regular religious studies. Parsulukan Babul Falah has seven unique identities that distinguish it from other tarekat centers and make it popular in Mandailing Natal. The identity includes the lineage of scholars, the role of the mursyid in treating people, the certificate of the lineage of Sheikh H. Arifin Hasibuan as a caliph, religious studies every Monday, the tradition of aek tawajuh, language adjustments by the mursyid and the principle of no change in teachings. This paper provides an important contribution in understanding the relationship between the tarekat, local culture and collective identity in the context of the Islam of the Mandailing Natal community.

Abstract

In organising the government administration system in Indonesia, it is known as the appointment of the Acting (Plt) Head of the Religious Affairs Office who is a Temporary Official because the Definitive Official has permanent obstacles. The position of Executive has a term of office of 3 months and can be extended for 3 months based on the mandate given by his Superior. Plt is not authorised to make decisions and/or strategic actions that have an impact on changes in legal status in aspects of personnel organisation and budget allocation. However, in filling the position of Acting Head of KUA, it is often done when there is a definitive vacancy due to the previous official's retirement, mutation, death, or dismissal. The appointment of Plt is a valid administrative solution as long as it is done by complying with the provisions of time and applicable authority. However, when the implementation of the filling of the Plt position deviates from the normative provisions, there are legal issues that need to receive serious attention. The regulations regarding the Acting Head of KUA are regulated based on the Regulation of the Minister of Religion Number 34 of 2016. However, this PMA does not explicitly regulate the mechanism of filling the position of Acting Head of KUA when there is a vacancy, so the regulation space refers to the general provisions that apply in state personnel and government administration provisions. Therefore, the internal regulations of the Ministry of Religion also play a role in filling the gaps in technical regulations related to the appointment of Executives in the field. The type of research used is normative juridis.

Abstract

Adolescents growing up in families experiencing violence and infidelity face complex emotional challenges. An unsafe family environment can create traumatic experiences that influence social behavior, such as tendencies to withdraw, fear of interaction, and difficulties in building interpersonal relationships. This research aims to explore more deeply the emotional trauma experienced by adolescents living in families with violence and infidelity. The study uses a qualitative approach with a phenomenological method, and the data is analyzed using Interpretative Phenomenological Analysis (IPA) techniques. The participant is a university student in the late stage of adolescence living in the city of Padang. Data was collected through semi-structured interviews. The research findings reveal three main themes: (1) experiences of emotional violence from the father, (2) the impact of infidelity in the family on the adolescent’s psychological condition, and (3) the adolescent’s efforts to build resilience amid emotional pressure. This study emphasizes that emotional trauma resulting from harsh parenting and experiences of betrayal within the family can significantly affect the social and emotional development of adolescents.

Abstract

The Village Head Election (Pilkades) is a concrete manifestation of the implementation of democracy at the local level as stipulated in Law Number 6 of 2014 concerning Villages. However, in practice, the dynamics of the Pilkades often show a tendency for political regime intervention, which has an impact on reducing the principle of people's sovereignty in the village. This research examines Huta Tinggi Village as a case study to examine how Pilkades regulations are implemented and to assess the extent to which local political practices are influenced by the regime's interests. Using qualitative methods through case studies, in-depth interviews, observations, and legal document analysis, this study aims to analyze political tendencies in the implementation of the Pilkades, assess the effectiveness of the implementation of the Village Law, and examine its suitability with the perspective of siyasah dusturiyah which emphasizes justice, openness, and public participation. The results show that the implementation of the Pilkades in Huta Tinggi Village shows a pattern of dominance of the local political regime that influences the nomination mechanism, mass mobilization, and the voting process. This gives rise to problems in the form of money politics, social divisions, and the weakening of the legitimacy of village leadership. From a political and economic perspective, this phenomenon reflects a deviation from the fundamental values ​​of village governance, which should be oriented toward the public interest (al-mashlahah), justice ('adl), and public participation (shura). Therefore, the Village Head Election (Pilkada) can be understood not only as an administrative process but also as an arena for political contestation fraught with regime interests. Therefore, strengthening regulations and internalizing the values ​​of political and economic governance are necessary to ensure that village democracy truly operates in accordance with the principle of popular sovereignty.

Abstract

This article aims to examine how philosophical perspectives or paradigms define the status and meaning of “victims” in human trafficking crimes, and how these paradigms shape ideal protection models beyond purely instrumental and repressive positive law approaches. This study applies a normative legal research method with a conceptual and philosophical approach. The daya is analyzed qualitatively through a process of interpretation and critical evaluation to explore the meaning, values, and paradigms contained in the legal text. It can be concluded that positive law in Indonesia, through the PTPPO Law, has defined victims in a progressive manner, not only as objects of crime but also as legal subject who have rights to be protected and restored. However, ontologically, in the formal process (KUHAP), the position of victims is still often marginalized by the criminal justice mechanism, which prioritizes the perpetrator (offender-oriented). A philosophical analysis of substantive legal constructs reflects high axiological values, namely restorative justice and the protection of human dignity. However, formal legal construct have not fully adopted epistemological values that are empathetic to the trauma of victims, thereby creatin the risk of re-victimization. The paradigm underlying this regulation is in tension between the retributive paradigm (imposition of sanctions) and the restorative paradigm (protection and recovery of victims). Therefore, it is recommended that the implementing regulations be clarified to be in line with the philosophical values contained in the PTPPO Law, and that in-depth socialization and training be provided to law enforcement officials regarding the paradigm of victims as subjects who are entitled to a trauma-informed justice process.

Abstract

Every parent has their own parenting style in educating their children, and this affects the child's development. Children's negative behavior can occur as a result of broken home parenting applied by their parents. Broken home parenting applied by parents can have a negative effect on children, including making them more free. Adolescence is a transitional period from childhood to adulthood or it can be said that adolescence is an extension of childhood, a transitional period where adolescents are in the process of fostering themselves while obtaining support and care from parents, the environment, society, and being independently responsible. This study aims to determine whether there is an influence of parenting patterns in broken home children on juvenile delinquency at MTs BIPDA SUKAJADI. The method in this study is quantitative research with the population being all students in grades VII and IX MTs. BIPDA SUKAJADI totaling 148 students. Sampling using random sampling technique which amounted to 50 students. This study uses a simple linear regression test. Based on the results of the study, it is known from the results of the regression coefficient value of -075 and a significant value of 0.611. This shows that there is an influence of parenting patterns in broken home children on juvenile delinquency at MTs BIPDA SUKAJADI.

Abstract

This study examines the concept of joint property division after divorce within the semenda marriage system of the Lampung Saibatin customary community, where the husband resides in the wife’s family environment. This socio-cultural arrangement influences ownership, control, and distribution of marital assets, often creating imbalances when separation occurs. Using a qualitative socio-legal approach and the framework of maqāshid al-sharīʿah, this research analyzes how Islamic legal principles align with or diverge from customary practices. Data were collected through field observations, interviews with customary and religious leaders, and analysis of secondary literature and legal documents. The findings reveal that Lampung Saibatin’s semenda practice recognizes shared property but lacks standardized procedures for its division after divorce. The maqāshid al-sharīʿah perspective particularly hifẓ al-māl (protection of wealth), hifẓ al-nasl (protection of lineage), and hifẓ al-ʿirdh (protection of dignity) offers an integrative solution to ensure fairness and gender equity. It recommends that property distribution should not be strictly equal but proportional to each party’s contribution and social responsibility. Harmonizing Islamic law and local custom through mediation, prenuptial agreements, and recognition of non-monetary contributions can achieve substantive justice and preserve social harmony in the Lampung Saibatin community.

Abstract

The Suspension of Debt Payment Obligations (PKPU) is a legal mechanism aimed at providing debtors the opportunity to restructure their financial obligations through a settlement agreement with creditors. In practice, however, PKPU is often misused by parties acting in bad faith either debtors seeking to delay payments or creditors aiming to pressure debtors. Violation of the principle of good faith in PKPU may lead to legal consequences in the form of bankruptcy, as stipulated in Law Number 37 of 2004 concerning Bankruptcy and PKPU. This study aims to analyze the application of the principle of good faith in PKPU proceedings and to examine the legal considerations of the Commercial Court and the Supreme Court in declaring bankruptcy as a result of such violations. The research employs a normative juridical method with statutory and case approaches, focusing particularly on Supreme Court Decision Number 704 K/Pdt.Sus-Pailit/2017. The findings indicate that violations of the good faith principle serve as a valid ground for the court to declare a debtor bankrupt due to abuse of PKPU proceedings. Therefore, the principle of good faith plays a crucial role in maintaining integrity, fairness, and balance between debtors and creditors in Indonesia’s debt settlement process.

Abstract

The prohibition on marriage resulting from the Akken Waghei Bedamei oath in the Lampung Sai Batin tradition. This tradition gives rise to social and customary legal prohibitions, namely the prohibition on marriage between descendants of those who have taken the customary oath. Using a philosophical and sociological perspective, the values of the prohibition on marriage resulting from the Akken Waghei Bedamei oath can be examined. The purpose of this study is to analyze the philosophical and sociological perspectives on the prohibition on marriage resulting from the Akken Waghei Bedamei oath. This research is qualitative, using empirical juridical methods with a philosophical and sociological legal approach. From a philosophical perspective, noble values such as family honor, long-term peace, and the prevention of recurrent conflict are emphasized, but their implementation conflicts with the values of justice and the freedom of individual rights to choose a partner as long as they do not violate norms.

Abstract

The absence of specific legislation regulating Artificial Intelligence has resulted in the lack of a special criminal offense qualification that can serve as a legal basis for imposing criminal liability on perpetrators. This condition creates a legal dilemma when the Principle of Legality is confronted with criminal acts such as the sale of Deepfake Porn on the social media platform X, which utilizes Artificial Intelligence-based technology. This research aims to examine the relevant criminal offense qualifications applicable to such acts and determine the appropriate statutory provisions for imposing criminal liability on perpetrators. The research employs a doctrinal legal research method with a statutory approach and a conceptual approach. The findings indicate that the Cybercrime Criminal Offense Qualification is more relevant than the Pornography Criminal Offense Qualification due to the principle of lex consumen derogat legi consumte, based on the locus and characteristics of the Deepfake Porn sale. Perpetrators may be held criminally liable with a maximum imprisonment sentence of 16 years and/or a maximum fine of sixteen billion Rupiah pursuant to the criminal provisions of Article 35 in conjunction with Article 51 paragraph (1) of Law Number 11 of 2008 concerning Electronic Information and Transactions (ITE Law) as the primary provision, along with other criminal provisions from the amendments to the ITE Law (Law Number 19 of 2016 and Law Number 1 of 2024), Law Number 27 of 2022 concerning Personal Data Protection, and Law Number 44 of 2008 concerning Pornography.
