Abstract

Tradition is an essential element of Indonesian society, rich in cultural heritage and local values. One tradition that continues to be preserved by the community in Bahaur Tengah Village, Kahayan Kuala District, Pulang Pisau Regency, is the Batumbang Apam tradition. This practice is carried out as an expression of gratitude following the completion of a significant event, particularly a wedding ceremony, with the hope that the newlywed couple will receive blessings, protection, and be spared from future hardships in their marital life. This study employs an empirical legal research method with a socio-legal approach to explore community perceptions of the Batumbang Apam tradition and examine it through the lens of Islamic legal maxims (Qawaid Fiqhiyyah). The findings indicate that the Batumbang Apam tradition holds strong spiritual, social, and cultural values. It is regarded as a form of prayer, a way to preserve ancestral heritage, and a means to establish a harmonious and blessed family life. From the perspective of Islamic law, this tradition falls under the category of ‘urf fi’li (practiced customs) and ‘urf sahih (valid customs) that do not contradict Islamic principles. Furthermore, it embodies maslahah mursalah—a type of public interest not explicitly supported or rejected by Islamic texts but recognized for its benefits. Therefore, the Batumbang Apam tradition is acknowledged as a legitimate local wisdom in Islamic law, as long as it aligns with shariah values and does not contain elements contrary to Islamic teachings. Abstract

This study examines the legal analysis of the fulfillment of formal and material requirements in the voluntary petition for Suspension of Debt Payment Obligations filed by PT Alamsari Lestari. The research is based on the decision of the Commercial Court at the Central Jakarta District Court Number 137/Pdt.Sus-PKPU/2023/PN Niaga Jkt.Pst and the provisions of Law Number 37 of 2004 concerning Bankruptcy and the Suspension of Debt Payment Obligations. The findings indicate that PT Alamsari Lestari has fulfilled both formal and material requirements for submitting a voluntary petition. Formally, the company obtained approval from the General Meeting of Shareholders (RUPS) and submitted the petition in accordance with procedural rules. Materially, PT Alamsari Lestari was proven to have debts to more than one creditor, with obligations that had fallen due and could be claimed. The court’s consideration in granting the petition serves as a preventive measure to avoid bankruptcy and allows the company to restructure its debts through a legally supervised peace plan. This case reflects how the Suspension of Debt Payment Obligations functions as an instrument to balance the interests of debtors and creditors under Indonesian bankruptcy law.

Abstract

The Constitutional Court (MK) is one of the state institutions established under the amended 1945 Constitution, with the primary authority of upholding the constitution as the highest law in Indonesia. The presence of the Constitutional Court marks the strengthening of the principles of the rule of law and democracy, particularly in the mechanism of checks and balances between state institutions. This study aims to describe the role of the MK in the Indonesian constitutional system, from judicial, political, and social perspectives. The method used is a literature study with a descriptive qualitative approach, through analysis of literature, legislation, and relevant MK decisions. The results of the study show that the Constitutional Court has a strategic role in upholding constitutional justice, including through the authority of state institutions, dissolving political parties, resolving election result disputes, and ruling on the House of Representatives' opinion regarding alleged violations of the law by the President/Vice President. In addition, the Constitutional Court also functions as the guardian of the constitution, guardian of democracy, and protector of citizens' constitutional rights. Thus, the Constitutional Court not only acts as the guardian of the constitution, but also as an important pillar in maintaining the balance of power and consolidating democracy in Indonesia.

Abstract

The explanation above indicates that this research is a qualitative study with a descriptive approach, namely an approach that aims to describe each of the main topics used in this article. The researcher will describe the implementation of royalty payments by MSMEs and its impact on MSME income, the implementation of the royalty payment system that has not been optimally absorbed from the perspective of songwriters, and clarity on who pays royalties, whether the singer or the event organizer. The data used in this article is secondary data obtained by the researcher from credible sources such as scientific articles, websites, books, and so on. This data is analyzed through the stages of data collection, data reduction, data selection, and drawing conclusions. The Conclusion in this article show that this can affect MSMEs that do not have a good MSME and do not include royalty payments in routine expenses. Conversely, this does not affect MSMEs that have included royalty payments in routine expenses. Regarding the right to freedom of communication, the researcher believes that this right can be limited if other community rights are violated. Furthermore, it has been confirmed that royalty payments are not optimal and will be improved as soon as possible by the government. The government has also emphasized that the party responsible for paying royalties is the event organizer, not the singer.

Abstract

The quasi-experimental method of providing entrepreneurial services is a strategy for developing the level of independence of teenagers in the millennium era. Currently, the strategy is being implemented to develop the entrepreneurial spirit of teenagers which aims to provide opportunities to become young entrepreneurs. In the current millennial era, there are many opportunities to earn income through independent entrepreneurship. This entrepreneurial service is provided to millennial teenagers not only to foster a spirit of independence but also to shape teenagers' creativity in entrepreneurship. Providing entrepreneurial services to teenagers in the current millennial era is very influential for the future, such as when teenagers are still studying at university, by providing entrepreneurial services it is able to foster the creative spirit of teenagers in creating small businesses that can generate financial coffers.

Abstract

Corporations are legal entities that play a role in the economy and also have the potential to commit criminal offense, including corruption. Bribery commited by corporation constitutes corporate crime, which can harm the state, undermine integrity, and violate applicable law. One case of corporate crime that occurred was the corporate crime committed by PT Merial Esa. Decision No. 23/PID.SUS-TPK/2022/PT.DKI, PT Merial Esa was proven to have satisfied the subjective and objective elements of the crime of bribery. In this case, PT Merial Esa may be subject to legal consequences for the actions it takes. The research is grounded normative legal research. This research uses an legislative approach, which involves analyzing various relevant data sources, combined with a conceptual approach.

Abstract

This study aims to deeply analyze the status, function, and legal implications of the President of the Republic of Indonesia's right to abolish, particularly in the context of criminal and constitutional law. Abolition, as an instrument of pardon, amnesty, and abolition (GNA), enshrined in Article 14 of the 1945 Constitution of the Republic of Indonesia (UUD NRI 1945), is the prerogative of the head of state to abolish a criminal offense or halt the prosecution of a person suspected of or having committed a crime, before the trial process is complete. The strength of this right lies in its character as an instrument of judicial discretion that transcends judicial decisions, and its implementation must take into account the considerations of the House of Representatives (DPR). The study focuses on the case study of Thomas Trikasih Lembong (Tom Lembong), who, in the public narrative, has been linked to potential involvement in controversial cases. This case was chosen as a model to test the limits of the use of abolition in Indonesia. Normatively, the use of abolition in Indonesia is rare compared to pardons and amnesties, making it a gray area in constitutional practice. This study uses a juridical-normative and philosophical approach, enriched with a qualitative analysis of the relevant legal framework and constitutional law doctrine. From the perspective of Maqashid Syari'ah (Objectives of Islamic Law), abolition is analyzed based on its purpose in preserving the five basic pillars (al-Kulliyat al-Khams): preserving religion (hifz ad-din), preserving the soul (hifz an-nafs), preserving reason (hifz al-'aql), preserving descendants (hifz an-nasl), and preserving property (hifz al-mal). The appropriate use of abolition should contribute to the achievement of substantial justice and the protection of greater public interests, going beyond mere formal legal certainty. Meanwhile, from the perspective of Legal Benefit (Rechtssicherheit and Zweckmässigkeit), this study examines the extent to which the application of abolition, particularly in sensitive cases such as those involving public figures or economic interests, can provide sociological benefits, namely restoring order, preventing greater harm, or supporting national stability, without sacrificing the public's sense of justice. The study's findings indicate that although abolition is a legitimate prerogative, its use must be based on the ultra petita principles of justice and the pressing public interest, in line with the values of Maqasid Sharia and the principle of expediency. A balance between legal certainty, justice, and expediency is key to legitimizing the exercise of the president's right to abolition.

Abstract

The crime of counterfeiting money is a formal crime, namely a crime that is considered to have been committed if a prohibited act has been carried out. In the criminal law system, the crime of counterfeiting currency is a very serious crime because the criminal threat for the perpetrators of this crime is an average maximum of 10 years in prison and a maximum fine of 10 billion rupiah, this provision has been regulated in Law No. 7 of 2011 concerning currency. This study aims to explain the criminal sanctions against perpetrators of counterfeiting money as reviewed from positive law and Islamic criminal law (Study of Decision Number 1266 / Pid.B / 2023 / Pn Mdn). The research method used can be classified as a type of qualitative research with a research procedure that will produce descriptive data in the form of written data from document data, laws and articles that can be reviewed. From the research that has been conducted, the results of the analysis of Islamic criminal law on the decision of the Medan District Court Number 1266/Pid.B/2023/Pn.Mdn regarding the crime of distributing counterfeit currency is a crime related to assets that can be subject to ta'zir sanctions. The determination of the imposition of ta'zir sanctions given by the judge is based on the level of crime committed by the defendant as the perpetrator directly committing the crime.

Abstract

In 2018, Indonesia recorded 2,992 suicide cases, with adolescents and the elderly being the most affected groups. The 2022 I-NAMHS data revealed that 1.4% of adolescents had suicidal thoughts, 0.5% planned suicide, and 0.2% attempted suicide. Despite counselors being a profession that directly interacts with adolescents, discussions about the role of Islamic guidance and counseling in adolescent suicidal behavior are still very limited. Therefore, this study was conducted to reveal the role of counselors in adolescent suicide cases. This study employed a qualitative method with a systematic literature review approach. Journal searches were conducted through Publish or Perish, resulting in 369 journals, with 66 journals from Scopus, 103 journals from PubMed, and 200 journals from Google Scholar. After filtering using Covidence, 25 journals were selected for analysis. The results indicated that in handling suicide cases, counselors act as Suicide Gatekeepers.

Abstract

Inheritance is a fundamental aspect of the Indonesian civil law system that regulates the transfer of rights and obligations from a deceased person to their heirs. According to Article 830 of the Indonesian Civil Code (KUH Perdata), inheritance can only occur upon death. In practice, problems often arise when one of the heirs sells the inherited property before the official distribution takes place. Such unilateral sale of an inheritance that is still considered part of the boedel waris (undivided estate) often leads to legal disputes, as it is carried out without the consent of all heirs and may cause losses to bona fide purchasers. The research method used is normative juridical, employing statutory and conceptual approaches. This study is descriptive-analytical in nature, aiming to examine the legal regulations concerning inheritance, sale and purchase agreements, and legal protection for bona fide buyers in the sale of undivided inheritance property. The data used consist of secondary data, including primary, secondary, and tertiary legal materials. The analysis is conducted qualitatively through legal interpretation of provisions in the Indonesian Civil Code (KUH Perdata), such as Articles 1320, 833, and 1365, to obtain a comprehensive understanding of legal protection for bona fide buyers. The research findings indicate that the sale of an undivided inheritance results in a legal consequence of being null and void, as the property remains part of the boedel waris (joint estate) collectively owned by all heirs. Conducting a sale without the consent of all heirs constitutes a violation of Article 1320 of the Indonesian Civil Code (KUH Perdata) concerning the validity requirements of an agreement, particularly regarding a specific object and a lawful cause. However, a bona fide purchaser is still entitled to legal protection under Article 1365 of the Civil Code, in the form of the right to claim reimbursement or compensation from the seller. Thus, such legal protection is compensatory in nature, aiming to maintain a balance between the heirs’ rights and the interests of third parties. It is therefore recommended that the division of inheritance be lawfully completed before any sale transaction takes place, and that prospective buyers verify whether the inheritance property has been properly divided or not.
