Abstract

This research analyzes the application of criminal sanctions for the offense of obstructing lawful mining activities in Indonesia through a study of Supreme Court Decision Number 5690 K/Pid.Sus/2025. Mining activities are a strategic sector that significantly contribute to national economic development and regional growth, yet they are often accompanied by social conflicts that lead to criminal charges against individuals or communities under Article 162 of Law Number 3 of 2020 on Mineral and Coal Mining. In practice, the proportionality and effectiveness of criminal sanctions imposed by the courts remain debatable, particularly when compared to the substantial economic losses suffered by mining companies and the broader objectives of criminal law enforcement. This study aims to examine the judges’ ratio decidendi in imposing criminal sanctions and to formulate a more appropriate and future-oriented sanction model that ensures legal certainty, justice, and legal utility. The research employs a normative juridical method using a statutory approach, a case approach, and a futuristic approach. Primary legal materials consist of legislation and court decisions, while secondary legal materials include legal doctrines, academic journals, and relevant scholarly literature. The results indicate that although the Supreme Court consistently applies Article 162 as the legal basis for criminal liability, the sanctions imposed tend to be relatively lenient and insufficiently proportional to the magnitude of the losses incurred by mining companies. Such leniency weakens the deterrent effect of criminal law and may undermine the credibility of law enforcement. Therefore, this study proposes that future criminal sanctions should adopt a more proportional, multidimensional, and restorative approach, balancing the protection of lawful mining investments with the protection of community rights and environmental sustainability to achieve substantive justice in mining criminal law enforcement.

Abstract

This study aims to analyze the procedures and implementation of law enforcement for corruption crimes against the misuse of Village Credit Institution (LPD) finances by the Indonesian National Police. This study uses an empirical legal research method with a sociological approach, which focuses on the study of the application of legal norms in law enforcement practices in society. The results of the study indicate that law enforcement against corruption crimes in LPDs is carried out through the stages of public complaints, investigations, inquiries, filing of Stage I and Stage II which in principle are in accordance with the provisions of laws and regulations, especially the Corruption Eradication Law, the Criminal Procedure Code, and the Law on the Indonesian National Police, and is guided by the internal Standard Operating Procedure (SOP) of the Indonesian National Police. However, the implementation of law enforcement has not been running optimally because it is faced with various obstacles, including differences in interpretation regarding the financial status of LPDs, limited resources of law enforcement officers, and the strong influence of social and cultural factors of indigenous village communities. Furthermore, the characteristics of LPD financial management, which is integrated with customary systems, create its own complexities in proving elements of state financial losses, thus requiring caution and professionalism from law enforcement officials and the support of authorized auditors. Therefore, law enforcement against corruption in LPDs should not only be oriented towards legal certainty and firm action, but must also consider the social context and local wisdom to achieve substantive justice, increase the deterrent effect, and encourage the realization of transparent, accountable, and equitable LPD governance for village communities.

Abstract

Environmental protection and management in the context of residential communities cannot be separated from the relationship between the rights and obligations of citizens. The right to a good and healthy environment, as guaranteed in the 1945 Constitution of the Republic of Indonesia and Law Number 32 of 2009 concerning Environmental Protection and Management, must go hand in hand with the obligation of society to maintain and preserve the environment. This article aims to analyze the relationship between environmental rights and obligations in neighborhood life through an empirical study in RT 08 RW 04 Malaka Jaya, East Jakarta. This study employs an empirical legal research method with a socio-juridical approach. The results show that the balance between environmental rights and obligations is a key factor in creating social and ecological harmony at the community level. Environmental practices developed in RT 08 demonstrate that environmental law functions not only as an instrument of enforcement but also as a means of fostering collective awareness and preventing environmental conflicts at an early stage.

Abstract

The enactment of Law Number 11 of 2020 Job Creation has fundamentally transformed Indonesia’s business licensing system through the implementation of a risk-based business licensing regime, as regulated under Government Regulation Number 5 of 2021. This regulatory shift requires regional governments to realign local regulations and administrative practices to ensure legal certainty, procedural consistency, and effective investment facilitation. Central Java represents a relevant case as a non-mining province that relies heavily on manufacturing industries such as textiles, footwear, automotive, furniture, and electronics as the backbone of regional investment and employment creation. In 2023, Central Java recorded investment realization of IDR 77.02 trillion, exceeding its target and demonstrating strong competitiveness among regions. This study examines the role of Central Java Provincial Regulation Number 12 of 2022 on investment as a legal instrument supporting the transformation of regional investment governance in the post-Job Creation Law era. Using normative legal research with a statute and conceptual approach, this study analyses the harmonization of regional regulations with national investment policies and evaluates their implementation through a case study of the Integrated Industrial Estate of Batang (KITB). The findings indicate that Provincial Regulations No. 12 of 2022 provides a normative foundation for investment facilitation, risk-based licensing, and integrated one-stop services, which contribute to accelerating industrial development in KITB. The study concludes that the integration of regional legal frameworks, risk-based licensing mechanisms, and institutional readiness is essential to maintaining regional investment competitiveness and supporting sustainable industrial growth.

Abstract

Disputes over the results of the Regional Head Election (Pilkada) are a consequence of the dynamics of democracy in Indonesia, which demands a fair and constitutional resolution mechanism. One prominent case is the Constitutional Court Decision Number 313/PHPU-BUP.XXIII/2025 concerning the 2024 Regent and Deputy Regent Election of North Barito Regency, which involved alleged vote buying practices in the revote (PSU). This study aims to analyze the Constitutional Court's legal considerations in deciding the case, particularly regarding violations of vote buying, consistency with democratic principles, and its implications for legal certainty. The method used is normative legal research with an approach of legislation, doctrine, and analysis of court decisions. The results show that the Constitutional Court prioritizes a substantive approach by assessing not only the vote count results but also the integrity of the election process. The practice of money politics that is proven to be structured, systematic, and massive (TSM) is considered to undermine democratic principles, so the Constitutional Court imposed sanctions on the candidate pairs and ordered a revote. This ruling affirms the Constitutional Court's role as the guardian of the constitution and democracy and strengthens legal certainty, although it still raises debate regarding the proportionality of sanctions and the protection of political rights.

Abstract

Amphibious operations represent one of the most complex military maneuvers, demanding high-precision coordination between land, sea, and air elements. The success of such operations is heavily dictated by the effectiveness of Tactical Communication Systems (TCS). This study aims to analyze the readiness level of the Marine Communication and Electronics (Komlek) units in facing the challenges of modern warfare and to formulate strategies for upgrading TCS capabilities. The research employs a descriptive qualitative method, evaluating three primary pillars: human resources (personnel), hardware infrastructure (materiel), and existing communication doctrines. Analysis reveals that while current field communication fundamentals remain functional, there is a critical urgency for technological modernization to mitigate Electronic Warfare (EW) threats, jamming attempts, and bandwidth limitations in difficult operational terrains. This article recommends a transition toward IP-based (Internet Protocol) communication systems, the strengthening of high-level data encryption, and the integration of military satellite communication systems to ensure continuity of Command and Control (C2). Enhancing communication readiness to be adaptive toward digital and cyber technologies is projected to increase the efficiency of real-time operational orders and intelligence reporting, ultimately bolstering the striking power and success rate of future Amphibious Operations.

Abstract

Children are the most vulnerable because they do not have the power to determine their own future. Legal protection for children is crucial within the legal framework of a country that plays an important role in guaranteeing children's rights and welfare, especially children who are victims of divorce. Article 41 letter (b) of Law No. 1 of 1974 concerning Marriage and Article 105 letter (c) of the Compilation of Islamic Law stipulate that in the event of divorce, all costs of child maintenance and education are the responsibility of the father. If the petition for divorce does not include a claim for child support, the judge may determine it ex officio based on the instructions of Supreme Court Circular Letter (SEMA) No. 4 of 2016. However, in religious court practice, this regulation has not been consistently applied by judges in divorce cases where children are victims. This study aims to analyze legal protection for children after divorce from the perspective of the best interests of the child in the practice of Religious Courts in Indonesia. The methodology used is juridical-normative through a review of Islamic legal doctrine, legislation, and other positive laws, which will be studied systematically to provide answers to the issues under investigation. The findings indicate that ex officio authority is an essential instrument for fulfilling children’s rights, particularly child support, even when not explicitly requested in the petition. However, the use of this authority must remain proportional to prevent decisions that exceed the scope of the claims. The study shows that judges possess legitimate discretion to safeguard children’s rights, but more detailed guidelines and an enhanced understanding of the best interests of the child principle are needed to ensure consistent application of ex officio authority. In conclusion, optimizing child rights protection after divorce can be achieved when ex officio authority is applied appropriately, proportionally, and with a strong commitment to the child’s best interests.

Abstract

This study aims to analyze the regulation of legal protection for customers regarding the loss of credit collateral in banking institutions in Indonesia and the legal implications arising from the credit agreement between customers and banks. The results of the study indicate that the regulation of legal protection for customers in the event of the loss of credit collateral has not been explicitly regulated in Indonesian legislation. Law Number 10 of 1998 concerning Banking places greater emphasis on protecting depositors compared to debtor customers, while the Deposit Insurance Corporation only guarantees customer deposits and does not cover credit collateral. Consequently, when the loss of credit collateral occurs, dispute resolution often depends on judicial interpretation by applying general provisions of the Civil Code such as breach of contract and unlawful acts. The legal implications of the loss of credit collateral by banks indicate that banks may be held liable under civil, administrative, and even criminal law if the loss occurs due to negligence. The loss of collateral documents constitutes a violation of the prudential principle in banking activities and may result in the obligation for banks to compensate customers for the losses incurred. Therefore, regulatory reform is necessary to establish clearer and more comprehensive provisions regarding bank liability, mechanisms for replacing lost collateral documents, and forms of legal protection for customers in order to ensure legal certainty in credit agreement relationships.

Abstract

The People's Representative Council of the Republic of Indonesia (DPR RI) is a state institution that holds legislative, budgetary, and oversight functions. In its development, the DPR RI enacted DPR RI Regulation Number 1 of 2025 concerning the Rules of Procedure, which contains provisions regarding evaluative authority over state officials. This authority has sparked constitutional debate, as it was established through an internal institutional regulation and is not explicitly mandated by statute or the 1945 Constitution of the Republic of Indonesia. This study aims to examine and analyze the legal politics behind the formation of the DPR RI's evaluative authority over state officials through the DPR RI. The research method employed is normative legal research, utilizing statutory, conceptual, and historical approaches. The findings indicate that the evaluative authority embedded in the DPR RI Rules of Procedure constitutes a form of legislative authority expansion that lacks constitutional attribution or statutory delegation. From a legal-political standpoint, such regulation reflects a tendency toward the institutional strengthening of the DPR RI that potentially exceeds the boundaries of the oversight function as stipulated in the constitution.

Abstract

This research aims to analyze the relevance of the use of Constitutional Court Decision Number 01/PHPU-Pres/XVII/2019 in the legal considerations of judges in the Supreme Court Decision Number 121 K/Pid.Sus/2020, as well as to examine the authority of directors in making investment decisions in State-Owned Enterprises (BUMN). This research uses a normative legal method with statutory, case, and conceptual approaches. The results show that the Constitutional Court Decision is dominantly used as an initial basis in determining elements of state financial losses, thus forming a legal reasoning construction that tends to be formalistic, focusing on the principle of separate legal entity. This approach has implications for the suboptimal examination of aspects of good faith, due care, and potential abuse of authority in the actions of directors, and causes the application of the business judgment rule doctrine not to be carried out strictly. In addition, this approach has the potential to ignore the concept of beneficial ownership and opens up space for weakening accountability in the management of BUMN. Therefore, a balance is needed between protection of business discretion and enforcement of legal accountability to maintain consistency and legal certainty.
