Abstract

 Refillable perfumes, commonly known as perfumes without distribution permits, differ from official refills provided by well-known brands such as LV, Dior, or Hermès. In practice, perfumes without distribution permits do not yet have full permits from the BPOM (Indonesian Food and Drug Authority), as permits are only granted for perfume essences. The blending process, which takes place directly in front of consumers, creates uncertainty, as consumers are unaware of the additional ingredients used by the seller. These blended products should be sent to the BPOM to obtain an official distribution permit, so that the composition, including the methanol content, can be stated in detail. This study aims to analyze the legality of perfumes without distribution permits from the perspective of health law and consumer protection. The method used is a normative juridical approach with a statutory and conceptual approach. The results indicate that refillable perfumes are classified as products without distribution permits because the blending process is not supervised by the BPOM. The main problem is the weak oversight of additional ingredients, including the potential use of methanol, which is harmful to health. The growing stigma that perfumes without a marketing authorization are better used on clothing stems from consumer experiences of skin irritation or burning. The implications of this research emphasize the importance of restricting or even banning the use of methanol in perfumes without a marketing authorization, given its long-term impact on public health. The authors recommend that Indonesia follow the example of European countries that have declared methanol an illegal ingredient in cosmetics. Therefore, this research serves to strengthen BPOM regulations and provide greater protection under health and consumer law, leading to better legal standards for the supervision of perfume products in Indonesia.

Abstract

This research, titled “Legal Protection For Victims Who Use Liquid Narcotics In Indonesia”. aims to provide a clearer understanding of the evolving forms and distribution methods of narcotics in Indonesia, including the increasing use of narcotics in liquid form, which poses the risk of accidental exposure to the public. The study examines the mechanisms of legal protection available for individuals unintentionally exposed to liquid narcotics by analyzing Law Number 35 of 2009 on Narcotics, its implementing regulations, as well as law enforcement practices in the field. The research adopts a normative juridical method, relying on library-based research through a review of legislation, legal doctrines, and other relevant legal materials. The analysis is further enriched by examining court decisions and ethical standards to obtain a comprehensive understanding of legal accountability and potential violations committed by law enforcement officers. The findings indicate that although the regulation recognizes the category of “victims of narcotics abuse,” its implementation often leads to criminalization due to difficulties in proving the element of lack of intent. Legal protection should instead be provided through a victimological approach, integrated assessment mechanisms, medical and social rehabilitation, as well as guarantees that victims will not be subjected to criminal sanctions as long as it can be proven that they had no intention of misusing narcotics.

Abstract

The rapid development of crypto assets characterized by decentralization, anonymity, and high transaction speed has increased the risk of money laundering, which is not yet fully addressed by Indonesia’s current legal framework. This study aims to analyze the ratio legis of the existing regulatory formulation concerning crypto asset transactions involving Notaries in preventing money laundering and to propose an ius constituendum to strengthen future legal protection. This research employs a normative juridical method using statutory, conceptual, and comparative approaches. The findings indicate that Indonesia’s regulations cover economic aspects and AML measures, however the preventive framework remains sectoral because AML obligations are imposed only on crypto asset traders, resulting in an incomplete preventive protection mechanism. The discussion highlights that involving Notaries as authentic deed officials has the potential to reinforce due diligence, enhance legal certainty, and prevent the misuse of crypto assets for money laundering in accordance with FATF standards. The study concludes that revisions to the Financial Sector Development and Strengthening Law, the Anti-Money Laundering Law, and related regulations are necessary to mandate Notary involvement in every crypto asset transaction as part of a national AML strategy.

Abstract

Banking credit agreements are generally accompanied by fiduciary security as a means of legal protection for creditors, particularly with respect to movable objects that remain under the control of the debtor. However, in practice, the destruction of the object of fiduciary security during the term of the credit agreement is not uncommon, whether due to force majeure, negligence, or unlawful acts committed by the debtor. Such circumstances have the potential to create legal uncertainty regarding the status of the credit agreement as well as the fulfillment of the rights and obligations of the parties. This research aims to analyze the legal position of credit agreements in the event of the destruction of the object of fiduciary security, as well as the forms of legal protection available to creditors in bank credit agreements. The research method employed is normative juridical research using statutory and conceptual approaches, with secondary data analyzed qualitatively. The results of the study indicate that the destruction of the object of fiduciary security does not extinguish the credit agreement nor the debtor’s obligation to repay the debt. Legal protection for creditors is realized through the provisions of the credit agreement, the obligation to insure the secured object, the registration of fiduciary security, the creditor’s preferential rights, and execution mechanisms as regulated under Law Number 42 of 1999 concerning Fiduciary Security. The fiduciary security legal system has provided adequate legal protection for creditors, provided that its implementation is carried out in accordance with the applicable laws and regulations.

Abstract

The development of information technology has fundamentally changed business transaction patterns through the use of electronic contracts, digital platforms, and online transaction systems. This transformation has not only increased the efficiency of business activities but also created new complexities in business dispute resolution, which civil courts must address. This research is motivated by the suboptimal performance of civil courts in handling IT-based business disputes, particularly regarding procedural law, electronic evidence, and institutional readiness. The purpose of this research is to analyze how civil courts can optimize their handling of IT-based business disputes. The method used is normative legal research with statutory, conceptual, case-based, comparative, and historical approaches. The results show that although national regulations have recognized the validity of electronic transactions and evidence, judicial practice still faces normative and technical obstacles. This research concludes that optimizing civil justice requires procedural law reform, increased judicial capacity, and the integration of information technology to ensure legal certainty, justice, and the effectiveness of digital business dispute resolution.

Abstract

The development of democracy in Indonesia requires the active participation of all layers of society; however, the low level of political communication awareness poses a major obstacle to achieving quality democratic participation, especially at the village level. This community service aims to increase political communication awareness and democratic participation among the people of Ileboli Village, Nagawutung Subdistrict, Lembata Regency, through the use of poster media. The research method employed interviews and direct observation of eligible voters aged 17 and above. The socialization event held on May 14, 2025, at the Ileboli village office hall demonstrated that posters with attractive visual designs and simple language effectively enhanced the community’s knowledge and awareness regarding their rights, obligations, and the importance of involvement in the local democratic process. As a result, political participation among the community began to increase despite initially low levels of knowledge. In conclusion, posters as a political communication medium are a strategic tool to strengthen democratic participation at the village level. It is recommended to develop more varied socialization media and encourage broader community participation to sustainably improve political awareness.

Abstract

This study aims to examine the legal status of animated works in Indonesia and to formulate a regulatory framework for animation in the era of Artificial Intelligence. The background of this research is based on the increasing circulation of anomalous AI-generated animated content containing violence and violations of moral norms, particularly on the TikTok platform, which has the potential to disrupt children’s development. This study employs a doctrinal legal research method using a statutory approach and a conceptual approach. The findings indicate that the current positive law regime has not provided clear and explicit normative regulation regarding the production and distribution of AI-based animated works, nor has it established juridical limits on the use of AI in the animation creation process. This legal vacuum has resulted in ineffective supervision and takedown mechanisms by Electronic System Providers and the Government, allowing such harmful animated content to continue circulating widely. This study emphasizes the urgency of establishing specific regulations in Indonesia to restrict the use of AI and to classify animated works as one of the legal objects subject to regulation, to strengthen supervision of AI-generated animated works that pose risks to children, and to clarify responsibility for preventing the dissemination of animated content that violates moral norms.

Abstract

This study examines the issue of premarital pregnancy being used as an urgent justification for polygamy in the Majalengka Religious Court Decision Number 2903/Pdt.G/2022/PA.Mjl. The research employs a normative juridical method with a case approach to assess whether the judges’ considerations align with the Marriage Law, Government Regulation No. 9 of 1975, the Compilation of Islamic Law, and principles of gender justice. The findings indicate that the judges granted the polygamy request based on the fulfillment of administrative requirements, the economic capability of the applicant, and the consent of the first wife. The pregnancy of the prospective second wife was treated as a factual urgent condition used to legitimize the marriage through polygamy. However, from a gender perspective, relying on a non-marital pregnancy as a justification for polygamy may overlook women’s protection and reinforce unequal power relations. The judges’ considerations emphasized procedural compliance rather than a substantive evaluation of legal propriety, fairness, and the social implications for women. This study highlights the need for integrating gender-sensitive perspectives and stricter standards of legal propriety to prevent the misuse of pregnancy as a basis for authorizing polygamy.

Abstract

Permission for polygamy is regulated in Law No. 1 of 1974 on Marriage, which affirms the principle of monogamy but provides for exceptions subject to obtaining permission from the court. This provision forms the basis for the examination of applications for permission for polygamy in the Palembang Religious Court. The results of the study show that in practice, judges do not only refer to the fulfilment of normative requirements as stipulated in laws and regulations, but also focus on sociological considerations, such as household conditions, the impact on wives and children, and aspects of public interest. A decision granting permission for polygamy provides legal legitimacy for the marriage to take place and creates new rights and obligations for the parties, while a decision to reject the application reinforces the principle of monogamy and serves as legal protection for the wife and children from potential injustice.

Abstract

The implementation of Supreme Court decisions in reviewing regulations below statutes constitutes a crucial mechanism to uphold the rule of law and maintain normative hierarchy. However, in practice, the enforcement of material judicial review decisions frequently encounters structural and normative obstacles. This study aims to analyze the problems surrounding the implementation of Supreme Court Decision Number 57/P/HUM/2019 and its implications for legal certainty and the effectiveness of judicial review in Indonesia. This research employs a normative juridical method using statutory and case approaches. The findings reveal that weak execution mechanisms, absence of sanctions for non-compliance, and the dualism of judicial review authority between the Supreme Court and the Constitutional Court contribute to the ineffectiveness of such decisions. Strengthening the binding force of Supreme Court rulings requires harmonization of the judicial review system and the establishment of supervisory enforcement mechanisms.
