Abstract

Underage marriage is still a big legal and social problem in Indonesia. In the perspective of Islamic family law, marriage validity depends on fulfilling the legal pillars and conditions without a strict age limit, Law No. 16 of 2019 says that the bride and groom must be at least 19 years old. This study seeks to examine Islamic family law and safeguarding children viewpoints about underage marriage and to delineate their areas of convergence. Using descriptive-comparative analysis of main and secondary legal texts, the study takes a normative-juridical approach. The findings show that while Islamic law does not specifically restrict marriage age, the maqasid syariah prioritizes the protection of life and lineage (hifz an-nafs and hifz an-nasl), which is consistent with national law's best interests of the kid premise. Therefore, within the contemporary framework of child protection, the age restriction in marriage is an embodiment of sharia values.

Abstract

This study examines the legal consequences of defective consent in marriage arising from fraud and coercion during the formation of the ijab kabul, as well as the forms of legal protection afforded to victims—particularly wives or female spouses—under Islamic law and Indonesian positive law. Using a normative juridical method and analysis of Law Number 1 of 1974, the Compilation of Islamic Law (KHI), the Civil Code, and the Kendari Religious Court Decision Number 0375/Pdt.G/2017/PA.Kdi, the research finds that fraud and coercion eliminate the element of free consent (ridha), which is a fundamental requirement for a valid marriage contract, thus allowing the marriage to be annulled by a final and binding court decision. Although the marriage is deemed never to have existed, the KHI ensures that children remain legitimate and that jointly acquired property is still legally recognized. Female victims receive specific legal protection, including rights to dowry, iddah maintenance, mut'ah, a portion of joint property, and the ability to claim material and immaterial damages resulting from fraud or coercion. Beyond legal remedies, women are also entitled to social protection such as counseling, psychological support, safe houses, and economic recovery assistance. These findings demonstrate a strong alignment between Islamic law and Indonesian positive law in upholding justice and providing comprehensive protection for women and children as the most vulnerable parties in marriage annulment cases caused by defective consent.

Abstract

The misuse of the donation feature on streaming platforms as a means of promoting online gambling shows a deviation from the original function of the feature, which should be a place for appreciation and voluntary support for streamers. This phenomenon raises legal issues because the practice of promoting online gambling is carried out through donation mechanisms in various ways, such as inserting hidden promotional messages, using account names related to gambling, and sending repeated donations as spam. This situation causes streamers to suffer moral, social, and legal harm, thus necessitating legal protection for streamers who are used as a means of promoting online gambling through the donation feature. This study uses a normative juridical method with a legislative and conceptual approach. The nature of the research used is descriptive and analytical. In this study, the author uses secondary data consisting of primary legal materials, secondary legal materials, and tertiary legal materials. The misuse of the donation feature on streaming platforms is generally carried out by promoters who join live broadcasts as ordinary viewers, then send donations accompanied by hidden promotional messages containing gambling content. This action causes streamers to suffer losses, both morally and socially. This condition shows that streamers need legal protection. Legal protection for streamers can be divided into two forms, namely preventive, which is realized through the implementation of policies that emphasize the state's responsibility in monitoring the misuse of donation features and the formation of regulations that are in line with developments in digital technology. Meanwhile, repressive measures are carried out through law enforcement against perpetrators of the dissemination of gambling content and illegal promotions in the digital space. Based on the results of the study, the Indonesian legal system has provided a sufficient normative framework to protect streamers, but there are no specific rules governing the form of legal protection for streamers who are victims of donation feature abuse. Therefore, more stringent and responsive regulations are needed in response to developments in digital technology to provide legal certainty and comprehensive legal protection for streamers.

Abstract

This study aims to analyze the relationship between the practice of khulu’ and the potential emergence of domestic violence (KDRT) as a criminal act from the perspective of Islamic law and positive law in Indonesia. The phenomenon of khulu’ frequently arises as a consequence of domestic violence, whether physical or psychological, which drives a wife to seek divorce by offering compensation to her husband. In Islamic law, khulu’ constitutes a woman’s right to free herself from a marital bond by returning the dowry or a certain amount of property to her husband. However, in positive law, acts of violence underlying such a case may be categorized as criminal offenses under Law Number 23 of 2004 concerning the Elimination of Domestic Violence. Therefore, examining the relationship between khulu’ and domestic violence is crucial to understanding the correlation between religious norms and legal norms in protecting women’s rights.

Abstract

The establishment and existence of Danantara as a state investment management institution is grounded in the provisions of Law Number 1 of 2025 and Government Regulation Number 10 of 2025, representing the government’s effort to realize a more centralized and professional governance of state investments. However, the practice of multiple office holdings involving several strategic officials within Danantara raises legal concerns, particularly regarding potential conflicts of interest and the effectiveness of implementing the principles of Good Corporate Governance (GCG). The emerging legal issues focus on the compatibility of such practices with the principles of independence and accountability, which serve as core pillars of GCG in the management of state assets. This study adopts a normative juridical approach supported by statutory and conceptual approaches. The analysis is conducted qualitatively and descriptively based on the provisions contained in Government Regulation Number 10 of 2025, Law Number 1 of 2025, and PER-2/MBU/03/2023. The findings indicate that multiple office holdings within Danantara create overlapping authorities and potential conflicts of interest, thereby rendering them inconsistent with the principles of independence and accountability under GCG.Based on these findings, it can be concluded that the practice of multiple office holdings in Danantara has the potential to hinder the optimal implementation of GCG principles. Therefore, there is a need for strengthened implementing regulations, explicit prohibitions on multiple office holdings, and the development of more comprehensive operational guidelines to ensure that state investment governance is carried out professionally, transparently, and free from conflicts of interest.

Abstract

The Constitution of the Republic of Indonesia guarantees protection for all Indonesian citizens, particularly in ensuring the right to obtain employment and receive fair wages. Article 27 paragraph (2) of the 1945 Constitution of the Republic of Indonesia provides the fundamental principle that every person has the right to work and to earn a livelihood that is decent for humanity. However, in reality, many violations still occur, especially against domestic workers (PRT). Based on the author’s findings, many domestic workers continue to experience unfair treatment such as discrimination, physical and sexual violence, as well as inadequate wages. This reality becomes the responsibility of the state to provide protection for domestic workers. Therefore, the Government of the Republic of Indonesia, together with the House of Representatives, has initiated discussions on the Draft Law concerning the Protection of Domestic Workers. In this research, the author analyzes the Draft Law on the Protection of Domestic Workers from the perspective of the values of justice and legal utility. The method used in this research is descriptive analysis, which describes and illustrates the realities that occur in society and connects them with the prevailing laws and regulations. This study also applies a normative juridical approach, which uses legislation and legal literature as the main sources of data. The results of this study indicate that Indonesian society, especially domestic workers, urgently needs a legal framework as a form of protection and legal certainty to guarantee their safety and welfare. Therefore, the enactment of the Law on the Protection of Domestic Workers must be prioritized.

Abstract

The 1998 Rome Statute of the International Criminal Court (ICC) has been ratified by more than 120 UN member states to date. The establishment of the ICC is the result of the struggle of nations to form an international court for permanent serious human rights violations, including genocide, crimes against humanity, war crimes, and crimes of aggression. Unfortunately, although Indonesia is a signatory to the Rome Statute, it has not yet ratified it. The reason for the delay is concern that the ICC will replace national courts and prosecute national patriots on charges of serious human rights violations. This is an inappropriate reason because the ICC adheres to the principle of complementarity whereby national courts are the primary courts. The ICC also adheres to the principle of non-retroactivity, does not apply retroactively, and provides a 7-year deferral option and “opt-in” and “opt-out” options. As a result, ratification of the Rome Statute actually brings many benefits to Indonesia, especially strengthening Indonesia's position in the international community as a democratic country that supports world order, upholds independence, eternal peace, and social justice.

Abstract

The activities of political buzzers in the digital space play a role in shaping and influencing public opinion through the dissemination of manipulative and organized information. This phenomenon raises legal issues because Indonesian positive law does not explicitly regulate the status and qualifications of political buzzer offenses. This study aims to analyze the criminal liability for political buzzer activities from the perspective of the New Criminal Code, the Electronic Information and Transactions Law, and the Broadcasting Law. The method used is normative juridical with a statutory and conceptual approach. The results show that although political buzzers have not been classified as a separate offense, their actions can still be held criminally liable as long as they meet the elements of an act, fault, unlawful nature, and cause harm to the public interest. The difficulty of proving and the anonymity of the perpetrators do not negate the criminal nature of these acts, but rather demonstrate the need for strengthened regulations and adaptive legal interpretation.

Abstract

This study examines the legal status of children resulting from an annulled marriage from the perspective of human rights and child protection. This study aims to analyze the legal status of children resulting from an annulled marriage from the perspective of human rights and child protection. In judicial practice, annulment decisions often omit the status of children born from the marriage. Judges generally focus solely on the validity of the marriage, rather than on fulfilling the rights of children born from the relationship. This situation creates a legal gap because, even though the child is not at fault for the annulment of their parents' marriage, their legal status is often unclear, impacting the protection of their rights. The purpose of this study is to examine the extent to which human rights and child protection principles are integrated into judges' legal considerations when deciding annulment cases. This research uses a normative legal method with a statutory approach and case studies of several relevant court decisions. The research results show that the omission of the child's status in the verdict has the potential to conflict with the principles of non-discrimination and the best interests of the child as stipulated in the Convention on the Rights of the Child (CRC), which Indonesia has ratified through Presidential Decree No. 36 of 1990, and Law No. 35 of 2014 concerning Child Protection. From a human rights perspective, children born from an annulled marriage still have a civil relationship with their mother and their mother's family as stipulated in Article 43 paragraph (1) of the Marriage Law and the Constitutional Court Decision, No. 46/PUU-VII/2010.

Abstract

This research examines the contribution and relevance of natural law in establishing a just legal system in Indonesia, particularly within the framework of human rights protection. Using a normative juridical approach and a literature review of both classical and modern legal philosophy, this article explores natural law principles as a universal and timeless moral foundation. The research findings demonstrate that natural law, both in its irrational form derived from divine values and its rational form rooted in human reason, has significant capacity to strengthen the legitimacy of Indonesian positive law. Integrating natural law values into the national legal system faces structural and cultural challenges, but still presents opportunities through strengthening regulations based on substantive justice, recognizing customary law, and implementing the principle of restorative justice. This research recommends harmonizing positive law and natural law principles as a strategy for more inclusive legal reform oriented toward respect for human dignity.
