Abstract

The rapid growth of e-commerce has increased the urgency of personal data protection, especially in cases of corporate bankruptcy. Legal uncertainty regarding the status of personal data in bankruptcy assets poses privacy risks. This study examines regulatory gaps in the Bankruptcy and PKPU Law (UU KPKPU) and the Personal Data Protection Law (UU PDP) concerning consumer personal data protection in bankrupt e-commerce companies. This research employs a normative juridical method by analyzing applicable legal norms. This approach reviews legislation, jurisprudence, and other legal documents to understand and evaluate the legal application of personal data protection in e-commerce bankruptcy. The study finds that personal data protection remains a legal obligation for bankrupt e-commerce companies under the UU PDP. However, legal gaps in the UU PDP and UU KPKPU regarding bankruptcy require regulatory harmonization to safeguard consumer privacy rights.

Abstract

The application of diversion in the juvenile criminal justice system aims to prevent children from undergoing formal legal proceedings that could negatively impact their development. This study analyzes the implementation of diversion in Decision Number 5/Pen.Div/2023/PN Kot Jo and Number 18/Pid.Sus-Anak/2023/PN Kot, involving a 15-year-old minor as the perpetrator of a minor offense. The study highlights the judge's considerations in determining diversion, including the child's age, the type of offense, and the offender's social background. Furthermore, this research examines how the principles of restorative justice are applied through diversion deliberations involving the offender, the victim, their families, and other relevant parties. The findings indicate that diversion in this case successfully reached a voluntary agreement, requiring the offender to return the item and compensate the victim. This agreement not only aims to prevent the negative impact of formal judicial proceedings but also provides an opportunity for the child to rehabilitate and reintegrate into society. These findings emphasize that when implemented effectively, diversion mechanisms can serve as an efficient solution for resolving juvenile delinquency cases without resorting to litigation.

Abstract

Marriage is a physical and spiritual bond between a man and a woman, aimed at forming a happy and lasting family. In marriage, property plays a crucial role and is legally classified as either joint property or personal property, as regulated in Law No. 1 of 1974 and the Compilation of Islamic Law (KHI). However, property ownership often becomes a source of conflict, sometimes leading to divorce. The legal status of property after divorce depends on the applicable legal framework, whether Islamic law, customary law, or the Civil Code (KUHPerdata). To prevent disputes, couples may establish a prenuptial agreement to regulate property ownership and division. This study employs a normative juridical method by analyzing primary, secondary, and tertiary legal materials. The research aims to provide an understanding of the legal status of property in marriage and the importance of prenuptial agreements in avoiding conflicts and ensuring a harmonious household.

Abstract

The East Java Provincial Government established the East Java Super Corridor (EJSC) in five regions, including Bojonegoro Regency, to provide coworking spaces for the public. EJSC Bakorwil Bojonegoro is the only coworking space in the area, making it essential to offer high-quality services. This study aims to describe the service quality of the coworking space at EJSC Bakorwil Bojonegoro using a descriptive qualitative method. This research focuses on the five service quality indicators proposed by Kotler and Keller (2016): reliability, responsiveness, assurance, empathy, and tangibles. Data were collected through interviews, observations, documentation, and literature studies, with data analysis involving collection, reduction, presentation, and conclusion drawing. The findings indicate that the service quality of the coworking space at EJSC Bakorwil Bojonegoro is generally satisfactory. Reliability is reflected in the provision of free facilities that support user productivity. However, responsiveness still faces challenges in terms of timely responses to complaints and the flexibility of operating hours. Assurance has been established through effective communication, although staff professionalism needs improvement. Empathy is demonstrated through warm and responsive interactions between management and users. Tangibles indicate that the available facilities are adequate, but some shortcomings remain, such as limited parking space and suboptimal workspace arrangement.

Abstract

This study aims to analyze the legal consequences of non-registration or late registration of receivables owned by creditors in the bankruptcy process. Law Number 37 of 2004 concerning Bankruptcy and Suspension of Debt Payment Obligations (PKPU) stipulates that in bankruptcy proceedings, the fulfillment of rights over the bankrupt estate can only be obtained if the creditor registers their receivables for verification. However, there are no specific provisions that explicitly regulate the legal consequences of receivables that are not registered at all or those registered late and thus cannot be verified. This legal uncertainty creates problems in practice, particularly regarding legal protection for creditors and legal certainty in the resolution of bankruptcy cases. Using a normative juridical approach and analyzing relevant legislation and court decisions, this research finds that creditors who fail to register their receivables or register them late lose their rights to receive payments from the bankrupt estate. In other words, receivables that are not verified—either due to non-registration or late registration—are not recognized in the bankruptcy process. This conclusion highlights the importance of creditors understanding the procedures for registering receivables in bankruptcy in order to protect their rights. The study also recommends that existing legal regulations provide clearer guidance regarding the consequences of delayed or unregistered receivables to ensure legal certainty and fair protection for all parties involved in bankruptcy proceedings.

Abstract

In everyday life, the practice of making agreements is often done simply without written form, especially in social interactions and informal economic activities. This raises legal questions about whether agreements made orally have valid legal force. This study aims to understand the legal position of oral agreements from the perspective of Indonesian civil law, especially regarding the requirements for the validity of an agreement based on the provisions of Article 1320 of the Civil Code (KUHPerdata). This study uses a normative juridical method, with an approach to laws and legal doctrine. The results of the study show that even though they are not made in writing, oral agreements are still valid as long as they meet the applicable legal requirements. However, the problem that often arises lies in the difficulty of proof when peace occurs. Therefore, it is important for parties to consider written records as a form of legal protection.

Abstract

This study aims to analyze the legal protection of Land Deed Officials (PPAT) in the transfer of rights over residential land parcels that become objects of disputes. Residential land parcels are often involved in disputes that include claims from parties who feel aggrieved, even though the transfer of rights has been carried out legally by PPAT. In this research, the author explores the role of PPAT, the factors causing disputes, and the legal protection for PPAT in cases of land disputes. The methodology used is a normative juridical approach with descriptive analysis of the applicable laws and regulations, as well as a case study of land disputes involving PPAT. The findings of this study highlight the importance of clear legal protection for PPAT in dealing with land disputes, even though they have followed the procedures as prescribed by the law.

Abstract

The termination of employment agreement by mutual consent is a form of agreement between an employer and an employee to end the employment relationship based on the will of both parties. This agreement has significant legal implications in ensuring workers' rights and preventing industrial disputes. This study aims to analyze the role of a notary in drafting mutual termination of employment agreements and the legal strength of notarial deeds as written evidence. The research method used is normative juridical with a statutory and conceptual approach. The results show that a notary plays an essential role in ensuring that agreements are made voluntarily, do not violate workers' rights, and comply with applicable laws and regulations. A notarial deed also provides stronger evidentiary power in the resolution of industrial disputes.
