Abstract

The Islamic capital market is currently growing rapidly as an investment alternative that is in accordance with Islamic principles. However, this growth is also accompanied by the rampant cases of fraudulent investments that harm investors and threaten the credibility of the Islamic capital market. This article discusses the challenges of regulation and strategies for optimizing investor protection in dealing with fraudulent investments in the Islamic capital market. Using a juridical-normative approach, this study analyzes the applicable regulations, weaknesses in supervision, and prevention efforts that have been carried out by relevant authorities such as the Financial Services Authority (OJK), the Indonesia Stock Exchange (IDX), and the National Sharia Council-Indonesian Ulema Council (DSN-MUI). The results of the study indicate that although Islamic capital market regulations in Indonesia have developed, there are still gaps in supervision and investor protection mechanisms, especially in terms of early detection and law enforcement against illegal investments. Therefore, it is necessary to optimize regulations by strengthening supervision mechanisms, increasing Islamic financial literacy, and utilizing technology such as Regulatory Technology (RegTech) in detecting and preventing fraudulent investments. With these steps, it is expected that the Islamic capital market can be more trusted, transparent, and able to provide better protection for investors.

Abstract

Penelitian ini mengeksplorasi pelaksanaan layanan financial technology (fintech) berbasis peer to peer lending (P2P lending) dalam kerangka hukum yang berlaku di Indonesia. Di tengah pesatnya perkembangan digital, P2P lending muncul sebagai alternatif pembiayaan yang praktis dan efisien. Namun, model ini juga memunculkan berbagai isu hukum, terutama menyangkut aspek perlindungan bagi investor (lender) maupun penerima dana (borrower). Tujuan dari penelitian ini adalah untuk mengkaji keberlanjutan praktik P2P lending, dampaknya terhadap para pemodal, serta bentuk perlindungan hukum yang tersedia bagi kedua belah pihak. Dengan menggunakan pendekatan yuridis normatif dan metode deskriptif kualitatif melalui studi literatur, penelitian ini menemukan bahwa meskipun telah terdapat regulasi dari OJK, masih terdapat berbagai kelemahan seperti risiko gagal bayar, penyalahgunaan data, dan minimnya transparansi informasi. Oleh karena itu, diperlukan peningkatan regulasi dan pengawasan agar perlindungan hukum terhadap seluruh pihak dalam transaksi fintech dapat terlaksana secara menyeluruh dan efektif.

Abstract

This study discusses the implementation of the Code of Ethics and Guidelines for Judges' Conduct (KEPPH) as the main instrument in suppressing abuse of authority in the Indonesian judiciary. Using normative legal research methods, this study analyzes legal norms, doctrines, and court decisions related to supervision and enforcement of discipline against judges. The results of the study indicate that the mechanism of supervision and enforcement of discipline has been running structurally through the role of the Supreme Court (MA) and the Judicial Commission (KY), although it still faces challenges such as limited resources, less than optimal coordination, and an unstable legal culture. The most frequent violations of the code of ethics include abuse of authority, bribery, and gratification, which have a serious impact on public trust in the judicial institution. Effective enforcement of the KEPPH is considered very important to strengthen the integrity of judges, improve the quality of decisions, and build a clean, transparent, and accountable judicial system in Indonesia.

Abstract

The Financial Services Authority (OJK) is an independent institution established under Law Number 21 of 2011. Its primary purpose is to implement an integrated system of regulation and supervision over all activities within the financial services sector. This study employs a normative legal research method through literature review and document analysis. The findings indicate that OJK's main duties include regulating, supervising, inspecting, and investigating activities across the financial services sector, which covers banking, capital markets, and non-bank financial institutions. OJK’s authority includes formulating policies, granting business licenses, monitoring compliance, and protecting the rights of consumers in the financial services industry.

Abstract

As a basic guideline, the code of ethics of the advocate profession regulates the behavior and integrity of advocates, especially when carrying out their duties in the courtroom. Advocates have an important role in upholding justice, so they are required to uphold professional ethics in order to maintain the authority of the judiciary. However, in reality, violations of the code of ethics continue to occur, as seen in the incident of the beating of a judge by advocate Desrizal Chaniago which has drawn public attention and tarnished the image of the judicial world. This study aims to examine the provisions of the code of ethics of the advocate profession that regulate the behavior of advocates in the courtroom, as well as to analyze the mechanism for enforcing the code of ethics against violations committed by advocates, focusing on the case of the beating of a judge by Desrizal. This study uses a normative juridical method with a statutory approach and case studies. The results of the study show that Law Number 18 of 2003 concerning Advocates and the Indonesian Advocate Code of Ethics stipulate strict regulations on the behavior of advocates in the courtroom. Desrizal's actions in committing violence against a judge are subject to criminal penalties under Article 212 Jo. Article 351 paragraph (1) of the Criminal Code and sentenced to six months in prison.

Abstract

in this fast-paced digital era, online concert ticket purchases have become a common practice among music enthusiasts. However, this convenience is often accompanied by a surge in fraud cases, such as concert ticket fraud and other digital transaction frauds. These crimes target individuals who are less vigilant or lack knowledge of digital security, and often occur on e-commerce platforms or social media. This research analyzes the law enforcement against digital transaction fraud, especially concert ticket fraud, and highlights the importance of law enforcement by authorized parties to ensure citizen compliance. Based on Article 378 of the Criminal Code (KUHP), fraud is punishable by a maximum imprisonment of four years. Law enforcement, according to Soerjono Soekanto, focuses on harmonizing values manifested in norms to create, maintain, and preserve peace in social life

Abstract

Legal protection for contract workers in Indonesia still faces various challenges despite being regulated under the Manpower Law and the Job Creation Law. In practice, there is suboptimal fulfillment of contract workers’ rights, such as fair wages, social security, and fair treatment in termination of employment. This study uses a literature review method to examine the regulations and their implementation within the context of industrial relations. The findings emphasize the important roles of the government, legislative, and judiciary in ensuring effective legal protection for contract workers. There is a need to enhance legal socialization, labor supervision, and policy adjustments that are responsive to realize justice and welfare in employment relationships in Indonesia.

Abstract

The emergence of cryptocurrencies as a new financial instrument challenging the established financial system has been aided by advances in digital technology. By examining how well cryptocurrency transactions comply with sharia principles such as gharar, maysir, and riba, this study seeks to assess the idea from the perspective of Islamic Economic Law. A conceptual study based on literature analysis from several academic sources, rulings, and fatwas of scholars is the research methodology used. Thus, the results of the study indicate that cryptocurrencies have characteristics that raise legal questions in Islam, especially regarding their extreme volatility and speculative potential. While some scholars define them as digital assets that can be traded under certain conditions, others consider them haram because they contain elements of gharar and maysir. Therefore, to ensure that bitcoin transactions comply with the principles of Islamic Economic Law, more appropriate laws and sharia-based strategies are needed.

Abstract

Sasando is a traditional musical instrument originating from East Nusa Tenggara that holds significant cultural and historical value, serving as a symbol of Indonesia’s national identity. In 2021, reports emerged that Sri Lanka attempted to register Sasando as part of its cultural heritage with the World Intellectual Property Organization (WIPO), raising concerns over transnational cultural claims. This case highlights the urgency of protecting cultural heritage through international legal instruments, particularly within the framework of Intellectual Property Rights (IPR). This study aims to examine how international law can safeguard traditional cultural expressions such as Sasando and to what extent international IPR mechanisms can prevent unilateral claims by other countries. Using a normative juridical approach supported by case studies and analysis of international conventions—particularly the 2003 UNESCO Convention and WIPO’s role—the findings reveal that while legal frameworks exist, cultural heritage protection remains suboptimal without active registration, documentation, and diplomatic efforts by the country of origin. Therefore, countries like Indonesia must proactively engage in international mechanisms to protect and uphold their cultural heritage against illegitimate claims at the global level.

Abstract

Tourism is a strategic sector in driving regional economic growth through increasing local revenue, job creation, and community empowerment. One of the leading destinations in Bojonegoro Regency is Kayangan Api, famous for its unique eternal fire natural phenomenon and high historical and cultural value. However, the development of this area still faces challenges such as limited accessibility, inadequate supporting facilities, and minimal additional attractions. This study aims to describe the Kayangan Api tourism development strategy to increase its contribution to local revenue, using Cooper's 4A theory (1995): attraction, accessibility, amenity, and ancillary services. The study was conducted qualitatively descriptively through interviews with the Tourism Office, business actors, and visitors, as well as observation and documentation. The results of the study showed that the main attraction of Kayangan Api is the eternal fire which has geological and spiritual value, reinforced by Air Blukutuk, the Love Tree, and the legend of Empu Kriyokusumo. In terms of accessibility, the road to the location has been repaired, but public transportation is not yet available. Public facilities such as toilets and souvenir centers are already available, but interactive and educational rides are still lacking. Meanwhile, additional service support is still limited and community participation is not optimal. This study concludes that there is an imbalance between tourism potential and management. Therefore, an integrated development strategy is needed, such as the addition of educational attractions, public transportation, and community involvement to increase the competitiveness and contribution of Kayangan Api to the original income of the Bojonegoro region
