Abstract

Penelitian ini berfokus pada bentuk-bentuk pelanggaran dan akibat hukum yang diterapkan oleh Pemerintah Kota Surabaya terhadap bangunan pemukiman di sempadan sungai yang melanggar Rencana Tata Ruang Wilayah (RTRW). Penelitian ini menggunakan metode normatif dengan pendekatan yuridis normatif (statute approach), yang menelaah peraturan perundang-undangan terkait. Sumber data primer meliputi Undang-Undang Nomor 26 Tahun 2007 tentang Penataan Ruang, Peraturan Pemerintah Nomor 38 Tahun 2011 tentang Sungai, serta Peraturan Daerah Kota Surabaya Nomor 12 Tahun 2014 mengenai Rencana Tata Ruang Wilayah Kota Surabaya Tahun 2014-2034. Sumber data sekunder mencakup jurnal ilmiah, literatur hukum,  buku, hasil penelitian terdahulu, serta pendapat ahli hukum yang relevan. Pengumpulan data melalui studi dokumen dengan menghimpun, membaca, dan menganalisis berbagai peraturan, dokumen hukum, serta referensi ilmiah yang mendukung. Metode analisis data yang diterapkan adalah analisis kualitatif dengan pendekatan deskriptif-analitis. Hasil penelitian menunjukkan bahwa bentuk pelanggaran hukum pada pemukiman di sempadan sungai Kota Surabaya meliputi: 1) pendirian bangunan permanen di area sempadan tanpa izin resmi, baik berupa rumah tinggal, warung, hingga bangunan usaha; 2) alih fungsi lahan sempadan menjadi area komersial atau hunian yang seharusnya berperan sebagai area hijau terbuka atau wilayah penyerapan air; dan 3) pemanfaatan sempadan sungai untuk aktivitas ekonomi yang merusak ekosistem, seperti pembuangan limbah rumah tangga dan usaha ke badan sungai. Akibat hukum dari pelanggaran tersebut mencakup sanksi administratif berupa pembongkaran bangunan, pencabutan izin, denda, dan pemulihan fungsi lahan; sanksi pidana berupa hukuman penjara hingga 3 tahun atau denda maksimal Rp500 juta; serta sanksi perdata yang meliputi gugatan ganti rugi, tuntutan pemulihan lahan, dan pembatalan perjanjian terkait bangunan ilegal.

Abstract

This study discusses how to apply the principle of prudence in credit agreement deeds and the legal implications of credit agreement deeds made using false identities, with a case study of Decision Number 952/Pid.B/2019/PN.Jkt.Brt. The focus of the study lies in the application of the principle of prudence by banks and notaries in the process of making credit deeds. In this case, the debtor used a false identity to obtain credit, which then caused financial losses for the bank. The research method used in this study is a normative legal approach with secondary data. The results of the analysis show that identity falsification not only undermines the legal validity of credit deeds, but can also trigger criminal liability for notaries and administrative sanctions against banks. In addition, the application of the principle of prudence is important in providing credit and preventing losses for the bank as a creditor due to falsification of identity by the debtor.

Abstract

This study examines the dynamics of Indonesia’s ratification of the Geneva Conventions in relation to the development of human rights (HAM). Since the national movement era, the spirit of human rights recognition had emerged, later reinforced through Indonesia's ratification of the 1949 Geneva Conventions and the Additional Protocols in 1958. However, implementation at the national level has encountered obstacles, including slow legal harmonization and limited understanding of humanitarian law principles among state actors. The study employs a normative juridical method through a literature-based approach, focusing on developments from pre-independence to the reform era. Findings reveal that Indonesia’s cautious stance toward international obligations, institutional disagreements, and political dynamics have significantly influenced both the ratification process and its execution. The research recommends strengthening national legal frameworks and enhancing institutional capacity through training to ensure effective implementation of the Geneva Conventions' principle

Abstract

Land and Building Tax (PBB) is one type of tax that plays an important role in supporting funding for national and regional development. Since the implementation of fiscal decentralization through Law No. 28 of 2009, the management of PBB for the urban and rural sectors (PBB-P2) has been handed over to local governments, so that PBB has become an important component of Regional Original Income (PAD). This article reviews the definition, legal basis, objectives, collection mechanisms, as well as issues and efforts to improve the PBB system. Despite its strategic role, the implementation of PBB still encounters obstacles in the form of low levels of tax compliance, inaccurate taxable object sales value (NJOP), and weak administrative systems. Innovations such as digitalization of services, data updates, and public education are important solutions in optimizing PBB as a fair and sustainable fiscal tool.

Abstract

Human rights (HAM) guarantee protection and justice for every individual, including in organizing sporting events. Although regulated in national and international regulations, human rights violations still often occur, especially in excessive crowd control. The Kanjuruhan tragedy on October 1, 2022 is clear evidence of this negligence. The incident caused 135 fatalities and hundreds more were injured due to mass panic triggered by the use of tear gas in the stadium. This incident highlighted the weakness of the security system and the lack of protection for supporters. The actions of the authorities in the Kanjuruhan tragedy were considered excessive and violated FIFA regulations, especially the use of tear gas which actually worsened the situation. In response, the government formed an Independent Joint Fact-Finding Team (TGIPF) to investigate this incident and take action against those responsible. However, many consider that the verdict against the defendant does not reflect justice for the victims and their families. This tragedy is a bitter reminder of the weakness of security in stadiums, encouraging reform and improvement of regulations for the safety of spectators. This study emphasizes the importance of a more humane security policy, where security is not only effective but also respects human rights. Comprehensive reform and strong commitment to human rights protection are important steps to prevent similar incidents from happening again in the future.

Abstract

General elections are the main pillar of democracy that guarantees the political participation of every citizen, including the President. However, in the context of the 2024 elections, President Joko Widodo's statement claiming the right to campaign and take sides has caused public polemics. This is considered contrary to the principle of neutrality stipulated in Law Number 7 of 2017 and has the potential to disrupt election integrity, especially when the President uses state facilities in campaign activities. This study uses a normative juridical method with a statutory and conceptual approach to analyze the effectiveness of the application of the principle of Presidential neutrality and the role of election supervisory institutions. The results of the study show that individual integrity determines the effectiveness of neutrality in elections. When the President does not show a neutral attitude, public trust in democracy and electoral institutions decreases. Therefore, supervision by Bawaslu, KPU, and DKPP, as well as the enforcement of the code of ethics are important in ensuring the neutrality of public officials in order to maintain justice, honesty, and legitimacy in the electoral democratic process.

Abstract

This study discusses the implementation of the Code of Ethics and Guidelines for Judges' Conduct (KEPPH) as the main instrument in suppressing abuse of authority in the Indonesian judiciary. Using normative legal research methods, this study analyzes legal norms, doctrines, and court decisions related to supervision and enforcement of discipline against judges. The results of the study indicate that the mechanism of supervision and enforcement of discipline has been running structurally through the role of the Supreme Court (MA) and the Judicial Commission (KY), although it still faces challenges such as limited resources, less than optimal coordination, and an unstable legal culture. The most frequent violations of the code of ethics include abuse of authority, bribery, and gratification, which have a serious impact on public trust in the judicial institution. Effective enforcement of the KEPPH is considered very important to strengthen the integrity of judges, improve the quality of decisions, and build a clean, transparent, and accountable judicial system in Indonesia.

Abstract

Sharia Pawnshop plays a strategic role in strengthening national economic resilience by providing fair, transparent, and interest-free Sharia-based financing access. Through rahn and ijarah contracts, it helps communities, especially SMEs, obtain capital without the burden of interest, thereby supporting sustainable economic growth. Digitalization of services further expands financial inclusion and facilitates public access to Sharia-compliant financing. The findings show that Sharia Pawnshop serves as a crucial instrument in building an economy based on Islamic values, emphasizing justice, welfare, and blessings in financial transactions.

Abstract

Enforcement of the code of ethics in the legal profession is the main foundation for maintaining integrity and public trust in the law. This study examines the types of violations of the code of ethics committed by an advocate with the initials BIY in handling a case of resistance to execution, as well as the method of enforcing ethics by professional institutions. The analysis shows that BIY has exceeded the limits of the power granted by the client by unilaterally handing over the object of execution to a third party without the client's consent. This action is contrary to the principles of loyalty, honesty, and professionalism contained in the Indonesian Advocates Code of Ethics. The mechanism for enforcing ethics is carried out by the Regional Honorary Council (DKD) of PERADI South Sumatra through various stages, starting from complaints, examinations, to imposing sanctions in the form of temporary suspension for 12 months. This study shows how important objective and transparent internal supervision is to maintain the dignity of the legal profession, while also providing a deterrent effect and education for members of professional organizations. It is hoped that this process can strengthen a legal culture that has integrity and responsibility among advocates in Indonesia.

Abstract

A transfer deed made before a notary is a guarantee of rights to shares. There are still many problems with transfer deeds being submitted to the court by the heirs of the share giver when the transfer is carried out without the knowledge of the other heirs. This is detrimental to the rights the heirs should receive. The validity of a conservation deed that is not guided by applicable regulations can result in the conservation deed becoming invalid. This research method is normative using a statutory and regulatory approach and a contextual approach. The results of the research in this study are that a transition is an agreement that must be guided by Article 1320 of the Civil Code regarding the conditions for the validity of an agreement, a transition in the case of not fulfilling all the elements of the agreement including agreement, skills, a certain thing and a lawful cause. This results in the deed of transfer being invalid. People who are no longer competent to carry out legal actions need forgiveness from their biological children and the purpose of all heirs because biological children also have rights to the object of preserving shares. The notary who makes the deed of transfer can be held responsible for his negligence which results in losses for heirs based on Article 1365 of the Civil Code. Responsibilities imposed on maintenance include professional responsibility, civil responsibility and administrative responsibility.
