Abstract

The digital economy era has fundamentally transformed the landscape of the Indonesian banking industry, presenting new challenges in the application of the banking prudential principle. This study explores the dynamics of regulatory compliance in the digital era, with a particular focus on the implementation of Regulatory Technology (RegTech) and the role of regulatory sandboxes in mitigating the risks of financial innovation. Through a comprehensive analysis of Bank Indonesia and Financial Services Authority policies, this study reveals how regulators adapt their supervisory frameworks to accommodate technological developments such as mobile banking and financial technology (fintech), while maintaining the integrity of the financial system.The findings show that RegTech has become a vital instrument in bridging the gap between digital innovation and regulatory compliance. The implementation of regulatory sandboxes as testing laboratories for financial innovation provides a balance between encouraging innovation and protecting system stability. The study finds that the success of adapting the prudential principle in the digital era depends on three main pillars: (1) effective implementation of RegTech, (2) a robust regulatory sandbox framework, and (3) comprehensive digital security standardization. Through the integration of these three elements, regulators have succeeded in creating an ecosystem that supports innovation while minimizing systemic risk. However, challenges such as the technological gap between institutions and the need to improve digital competencies still require special attention.

Abstract

Unlawful acts are an obligation arising from the law and their impact on determining compensation. In an increasingly complex era of globalization, individuals are often involved in cooperation that requires a strong understanding of the law of obligations regulated in the Civil code. The legal relationship between the parties must be legally recognized by fulfilling the requirements for the validity of the agreement. The purpose of this study is to analyze how to determine the amount of compensation arising from Unlawful Acts, as well as the variables that influence the application of the principle of propriety in court decisions. By using a normative legal approach, this study found that determining compensation requires four important elements: the existence of an Unlawful Act, losses, a causal relationship between the loss and the Unlawful Act, and an error by the party committing the Unlawful Act. These findings are expected to contribute to legal practice and the court's handling of cases related to Unlawful Acts.

Abstract

Revenge porn, or the distribution of intimate content without permission for the purpose of revenge, is a form of crime that is growing along with rapid technological advances. This phenomenon is not only a serious violation of privacy, but also falls into the category of technology-based sexual violence. In the context of Indonesian law, Revenge Porn is classified as a criminal act and is regulated in various legal instruments such as the Information and Electronic Transactions Law (UU ITE), the Sexual Violence Crime Law (TPKS Law), and the Criminal Code (UU TPKS). Criminal Code). However, the application of the law in this case still faces challenges, ranging from inconsistent legal interpretation to public prejudice which often harms victims. As a form of technology-induced sexual violence, revenge porn has far-reaching psychological, social and legal consequences. Victims often suffer deep trauma, loss of reputation, and ongoing social pressure. In addition, the distribution of content through digital platforms broadens its scope and further worsens the situation of victims. Abstract

This research was conducted with the aim of examining legal protection for creators of cinematographic films working in wire applications. preparation for robbery, and legal activities for film copyright holders whose work is taken without the right to be distributed by someone via the Wire application. The investigation strategy used is juridical standardization using a statutory approach and a conceptual approach. From the results of this search, it can be seen that until now there are still many haram films circulating in society and there is no awareness among the public and there is no awareness that watching haram films can be a form of violation. The government must take firmer action in checking and blocking these informal or illegal online sites so that the government needs to carry out outreach to the public. Even though there are regulations regarding copyright, violations continue to occur due to weak law enforcement and lack of public awareness. Currently, film piracy on the Telegram application has developed into a big enough problem that it is detrimental to film creators and the film industry as a whole.

Abstract

Globalisasi berasal dari kata globe dan ization. Globe diartikan sebagai bola bumi atau peta bumi yang bulat. Kata globe kemudian berubah menjadi global. Artinya, secara umum dan keseluruhan, secara bulat atau bersangkut paut mengenai dan meliputi seluruh dunia (mengglobal atau mendunia).  Globalisasi didefinisikan sebagai semua proses yang mengarah pada penyatuan seluruh warga dunia menjadi sebuah kelompok masyarakat global. Globalisasi merupakan suatu proses yang terbentuk dari tatanan, aturan, atau sistem tertentu. Aturan tersebut diberlakukan bagi seluruh bangsa di dunia sehingga batas wilayah suatu negara dan globalisasi juga merupakan bagian proses dalam penyebaran atau perluasan sosial budaya, sistem ekonomi dan pola kehidupan. Dalam globalisasi tentu akan mengalami beberapa gejala yang nyata dan sangat cepat mempengaruhi seluruh dunia. Proses dalam Globalisasi akan terjadinya penyebaran secara meluas dan interaksi berbagai media sosial di antaranya ialah : Sosial Budaya, Ekonomi, Keamanan dll. Koperasi merupakan salah satu kegiatan perekonomian dalam kehidupan yang telah berkembang mengikuti perkembangan era globalisasi. Koperasi biasanya dipimpin oleh Pemilik koperasi itu sendiri dan memiliki beberapa anggota setiap bagiannya dengan modal dan untung dinikmati secara kebersamaan dalam penggajian, namun ada juga koperasi yang dijalankan sendiri yang artinya tanpa adanya anggota dengan modal dan untung yang dirasakan sendiri. Menurut Said Hamid Hasan koperasi merupakan kumpulan dari orang yang secara bersama-sama bergotong royong berdasarkan persamaan, bekerja untuk memajukan kepentingan ekonomi mereka dan kepentingan masyarakat banyak. Sedangkan menurut “UU No. 17 Tahun 2012 tentang Perkoperasian dalam pasal 1 ayat (1) bahwa  Koperasi adalah badan hukum yang didirikan oleh orang perseorangan atau badan hukum Koperasi, dengan pemisahan kekayaan para anggotanya sebagai modal untuk menjalankan usaha, yang memenuhi aspirasi dan kebutuhan bersama di bidang ekonomi, sosial, dan budaya sesuai dengan nilai dan prinsip Koperasi”. Meskipun koperasi merupakan salah satu kegiatan perekonomian dalam ekonomi lokal warga harus mampu menjamin kesejahteraan berdasarkan era globalisasi ditengah adanya tantangan dan peluang yang ditawarkan secara perkembangan zaman yang semakin modern. Dan meskipun koperasi masih termasuk perekonomian secara lokal maka dari itu sistem perkoperasian harus mampu menyusun strategis bersaing dengan perusahaan multinasional dengan berdasarkan peraturan yang berlaku.

Abstract

This paper provides an in-depth analysis of the Indosurya Savings and Loan Cooperative (KSP) scandal, one of the most notable cases in Indonesia’s cooperative history. A cooperative, which is fundamentally based on principles of mutual cooperation and family values, became entangled in issues of non-transparent fund management, suspected Ponzi schemes, weak regulatory oversight, and high-risk investments. The scandal led to significant financial losses, amounting to trillions of rupiah, and severely eroded public trust in cooperatives as business entities. Legally, the lack of robust regulations and inadequate supervision of large cooperatives were identified as key problems. This study examines the background, principles, types, and legal foundations of cooperatives, while also analyzing the impacts and resolutions of this case. Findings highlight the urgent need for regulatory reform, enhanced education and awareness among members, and stronger oversight by regulators to prevent similar incidents in the future.

Abstract

A franchise is a business system that involves two parties, namely the Franchise Owner (franchisor) and the Franchisee (franchisee), where the Franchise Owner grants licensing rights to the Franchisee based on a written agreement. In order for a business to be categorized as a franchise, the business must meet several criteria, including registering a franchise agreement prospectus and having a Franchise Registration Certificate. However, in the case of Neynis Food, the business has not registered its franchise with the state even though it has claimed to be a franchise business. This research aims to analyze the legal consequences if the Franchise Owner does not register their business, as well as legal protection for the Franchisee. This research uses normative juridical methods, which examine the laws that apply in society and their application in practice. The research results show that the Neynis Food business does not meet the requirements to be categorized as a franchise, and if it continues to claim so, the business can be considered illegal because it does not comply with the provisions in Minister of Trade Regulation No. 71 Years 2019.

Abstract

An agreement or other legal event that results in an obligation gives rise to this legal relationship. In the practice of treaty law, problems often arise relating to the debtor's failure to fulfill his obligations to the creditor or his failure to keep his promise. Default, which comes from the Dutch meaning “bad performance”, occurs when a debtor fails to fulfill a promise, whereas performance occurs when a debtor fulfills a contract under civil law. Default means not fulfilling obligations that have been agreed upon in an engagement. Research on default and its settlement in a car rental agreement at Wawa Rental, Sragen Regency, aims to identify various forms of default and how to resolve them in the practice of car rental agreements at Wawa Rental. The results show that there are several forms of default, namely not performing obligations at all, not being able to carry out obligations as promised, being late in carrying out obligations, and taking actions prohibited in the agreement. The settlement of defaults is carried out through deliberation, while court settlement has never been chosen. The default cases discussed in this paper are examples of many similar cases that have occurred in Indonesia. This shows that there are still many Indonesians who ignore the provisions in the agreement that has been agreed upon by both parties.

Abstract

The capital market acts as a source of financing for businesses and an investment vehicle for the community, demanding transparency of information so that investors can make the right decisions. Unfortunately, this principle is often disrupted by insider trading, which is detrimental to transparency. This study, using normative and analytical descriptive legal methods, found that criminal law enforcement against insider trading is hampered by evidence, lack of Bapepam-LK's ability to identify, and a tendency to only impose administrative sanctions. Efforts to overcome this by Bapepam-LK are considered ineffective and need to be improved, both penally and non-penally, to minimize insider trading.

Abstract

Named agreements (noominat) are a type of agreement that has been explicitly regulated in laws and regulations, especially in the Civil Code (KUHPer). This study aims to analyze the basic concept of named agreements, their legal characteristics, and their implementation in contractual relations in Indonesia. This study uses a normative legal approach with a descriptive legal analysis method. The results of the study indicate that named agreements have a significant position in the civil law system because they include important agreements such as buying and selling, renting, and lending. The characteristic of named agreements lies in the clarity of the norms that regulate the rights and obligations of the parties, thus providing legal certainty. However, amidst the development of community needs, challenges arise regarding the flexibility and adaptation of named agreements to the dynamics of modern law. This study highlights the importance of regulatory reform to increase the relevance of named agreements in the digital era and globalization.
