Abstract

The 2024 Serang Regional Election (Pilkada) drew significant attention due to allegations of electoral violations committed in a structured, systematic, and massive (TSM) manner, which led to a dispute in the Constitutional Court over the Election Results Dispute (PHPU). The purpose of this study is to examine how such TSM violations impact the principles of direct, general, free, confidential, honest, and fair elections (luber-jurdil), as well as how these violations affect the legitimacy of the election results. A normative and empirical juridical method is used in this research to explore the classification of violations, the effectiveness of relevant institutions in enforcing electoral law, and the challenges in proving and addressing organized violations within the existing legal framework.

Abstract

Merek merupakan identitas hukum yang berfungsi melindungi reputasi serta membedakan produk di pasar. Penelitian ini mengkaji Putusan Pengadilan Niaga Semarang Nomor 3/Pdt.Sus-HKI-Merek/2024/PN Niaga Smg terkait gugatan pembatalan merek “CHANTIQUE.ID” milik PT. Chantique Inti Decor (Tergugat), yang dinilai memiliki persamaan pada pokoknya dengan merek “CHANTIQUE” milik PT. Vitragraha Interia (Penggugat). Meskipun merek milik Penggugat telah digunakan lebih dahulu, Majelis Hakim menolak gugatan dengan alasan bahwa tambahan unsur “.ID” dianggap cukup sebagai pembeda. Melalui pendekatan hukum normatif, penelitian ini menyimpulkan bahwa putusan tersebut belum sepenuhnya mencerminkan penerapan asas kepastian hukum dan asas keadilan.

Abstract

This study examines the time limitation on collateral execution by secured creditors under Law Number 37 of 2004 on Bankruptcy and its implications for legal protection. Secured creditors are entitled to independently execute their security rights, but this right is restricted by a 90-day moratorium and a two-month time limit after insolvency is declared. Using a normative juridical method with statutory and conceptual approaches, the study finds that such restrictions contradict the absolute nature of property rights and potentially downgrade the secured creditor’s status to that of a concurrent creditor. This causes legal uncertainty and financial disadvantage. Therefore, legislative reform and clear procedural guidelines are necessary to ensure the optimal legal protection of secured creditors.

Abstract

The development of financial technology, particularly Peer-to-Peer (P2P) lending services, has brought significant innovation in access to financing in Indonesia. However, conventional P2P lending practices that still use interest-based systems and contain elements of uncertainty (gharar) pose challenges from an Islamic law perspective. This article aims to analyze the application of Islamic economic law principles in the fintech P2P lending business in Indonesia, examine regulations issued by the Financial Services Authority (OJK) and fatwas from the National Sharia Council of the Indonesian Ulema Council (DSN-MUI), and evaluate the challenges and opportunities in implementing sharia-compliant fintech P2P lending. The research employs a qualitative approach through literature studies from various primary and secondary sources. The findings indicate that although regulatory frameworks and sharia fatwas exist, gaps remain in operational practices, particularly regarding sharia supervision, transparency, and Islamic financial literacy. Therefore, harmonization of regulations, strengthening of Sharia Supervisory Boards, and enhancement of sharia literacy are necessary for fintech P2P lending to function as a fair, transparent, and Islamically compliant financing instrument.

Abstract

Copyright is part of intellectual property rights that provide legal protection to creators for original works they produce, including songs. In today's digital era, copyright infringement of songs is increasingly common, especially through sites that provide free song download services without permission. This study aims to examine the forms of legal protection available to songwriters in dealing with copyright infringement, as well as the effectiveness of law enforcement in Indonesia. The approach used is a normative juridical analysis with respect to laws and regulations such as Law Number 28 of 2014 concerning Copyright and a study of copyright infringement cases in the digital realm. The results of the study indicate that legal protection for songwriters has been strictly regulated, both through preventive protection (creation registration, licenses, and cooperation contracts) and repressive (civil lawsuits and criminal charges). However, implementation in the field still faces challenges, especially in terms of supervision and law enforcement against illegal sites. Therefore, synergy between the government, law enforcement officers, and public awareness is needed to ensure that the rights of songwriters are optimally protected.

Abstract

Murabahah insurance is one of the main contracts carried out by Islamic banking, which is used to finance various customer needs, such as asset purchases, business financing, and others. In this case, there was a sharia economic dispute case at the Sungailiat Religious Court involving the Al-Murabahah financing agreement by the customer with PT Bangka Belitung Sharia People's Financing Bank (Defendant I), as well as the involvement of PT Jiwasraya Insurance (Defendant II) in providing credit life insurance. The purpose of the research in writing this article is to find out whether the Defendant is proven to have committed PMH seeing the existence of an unclear clause related to diseases that can disburse claims. The results of the analysis stated that Defendant II as having received premium payments and issued policies, but Defendant II rejected the claims submitted. So in this case Defendant II has committed a tortious act and must be responsible for the loss of customers.

Abstract

Pelanggaran hak asasi manusia yang serius dapat meninggalkan luka mendalam yang memerlukan pertanggungjawaban hukum. Makalah ini memberikan analisis rinci tentang bagaimana pengadilan hak asasi manusia di Indonesia telah berkembang dan berevolusi seiring waktu. Pengadilan hak asasi manusia ini merupakan komponen penting dari sistem hukum Indonesia. Mereka didirikan untuk menangani kejahatan hak asasi manusia yang sulit. Mahkamah Kriminal Internasional (ICC) memiliki yurisdiksi atas peristiwa sebelum tahun 1998, tetapi penerapan retroaktif tidak diperbolehkan. Oleh karena itu, pembentukan pengadilan yang menggabungkan hukum nasional dan internasional merupakan tugas mendesak. Makalah ini membahas kekuatan dasar hukum pengadilan hak asasi manusia dari perspektif perjanjian internasional dan hukum nasional. Makalah ini juga menjelaskan tugas dan wewenang pengadilan hak asasi manusia, termasuk pemantauan dan pengadilan atas kejahatan serius seperti genosida dan kejahatan seksual. Peran Komisi Hak Asasi Manusia (Komnas HAM) dalam proses penyelidikan awal juga dijelaskan. Ulasan ini juga menyebutkan jenis kejahatan yang ditangani oleh pengadilan hak asasi manusia dan bagaimana Kitab Undang-Undang Hukum Acara Pidana (KUHAP) memastikan proses hukum yang adil dan jelas. Analisis ini menunjukkan bahwa Pengadilan Hak Asasi Manusia Indonesia lebih dari sekadar lembaga hukum. Pengadilan ini berfungsi sebagai pembela keadilan di garis depan, pelindung martabat manusia, dan pencegah impunitas dalam lingkungan hukum yang terus berubah.

Abstract

The establishment of the Financial Services Authority (OJK) in Indonesia marks an important step in the effort to strengthen banking law and financial sector supervision. This paper examines the role of the OJK as a supervisory agency in the context of Indonesian banking law, with an emphasis on its contribution to regulatory reform and consumer protection. This study uses a normative juridical approach, supported by a comprehensive literature review, to analyze the functioning of the OJK based on Law Number 21 of 2011 and its impact on banking governance. One of the OJK’s main responsibilities is overseeing compliance with sound banking practices and ensuring compliance with regulatory frameworks among financial institutions. The organization is also proactive in adapting regulations to new financial technologies, so it can address challenges arising from the rapid development of the fintech industry. Despite achieving progress, OJK still faces challenges in effective enforcement, resource allocation, and interagency collaboration. The paper concludes that although the OJK has made significant strides in improving the stability and integrity of the Indonesian banking system, additional measures are needed to strengthen its monitoring capabilities and address emerging risks. Recommendations include strengthening human resources, utilization of technology for greater efficiency, and increased public participation to ensure financial literacy. By strengthening its role as a regulator, the OJK can effectively navigate Indonesia’s complex and dynamic financial services landscape, ultimately protecting consumers’ interests and driving economic growth.

Abstract

This case shows how three judges of the Surabaya District Court were involved in bribery practices in the case of Gregorius Ronald Tannur's release. This article examines the bribery case of Judge Ronald Tannur as a reflection of ethical and professional issues in the legal field in Indonesia. The focus of this research is on how the ethical violations and breaches of the legal profession's code of ethics in that case have undermined the integrity of the Indonesian judicial system. This violates the principles of judicial independence and integrity regulated in Law No. 48/2009 on Judicial Power. This research shows the systemic consequences of such violations, such as a decline in public trust in the judicial system, an increase in perceptions of injustice, and challenges to the advancement of democracy and the rule of law. In addition, this article offers solutions to prevent the issues. This includes improving the internal-external oversight system, implementing a meritocracy system for the appointment of judges, and incorporating continuous professional ethics education. The results of this study indicate that structural reforms in the Indonesian judicial system are crucial for restoring public trust and ensuring the integrity of law enforcement.

Abstract

The unlawful detention case involving former Regent of Langkat, Terbit Rencana Perangin-angin, exemplifies a severe abuse of power leading to significant human rights violations. This article identifies various forms of this abuse and analyzes them from a human rights perspective, referencing national laws, such as Law No. 39 of 1999, and international instruments like the Convention Against Torture and ILO Convention No. 29 on forced labor. Using a qualitative approach and literature review, the study finds that the practices of unlawful detention, torture, and labor exploitation in the private prison constitute serious human rights violations, including potential human trafficking. This case highlights the inadequacies in oversight and accountability among local officials and underscores the urgent need for a comprehensive evaluation of Indonesia's human rights protection systems. The article recommends strengthening supervisory institutions, enforcing strict legal actions against offenders, and formulating policies to prevent similar abuses in the future.
