Abstract

The dualism between military courts and general courts in Indonesia presents a serious issue within the legal system, especially regarding the administration of justice for military personnel who commit general criminal offenses. Military courts still hold the authority to try soldiers for crimes committed outside of official duties, creating a potential space for impunity and human rights violations. This research aims to examine the problems caused by this jurisdictional dualism and explore the urgency of reforming the military justice system in Indonesia. This study uses normative legal research methods with a statutory approach, conceptual approach, and case study approach. The findings indicate that the authority of military courts to handle general crimes contradicts the principle of equality before the law and the spirit of legal reform. The Constitutional Court Decision No. 106/PUU-X/2012 serves as a critical foundation in pushing for military justice reform. Therefore, revising Law Number 31 of 1997 is urgently needed to ensure justice, transparency, and accountability within Indonesia’s judicial system

Abstract

The growth of online lending services in Indonesia faces a dilemma between expanding financial access and the proliferation of exploitative practices, such as unilateral interest rate hikes and unauthorized modifications of repayment deadlines. This study analyzes the regulations by the Financial Services Authority (OJK), specifically OJK Regulation No. 77/2016 (POJK 77/2016) and OJK Regulation No. 10/2022 (POJK 10/2022), in protecting consumers from unfair practices. It also examines the disharmony between OJK’s sectoral legal framework and Indonesia’s Civil Code (KUHPerdata) and Law No. 8/1999 on Consumer Protection. Using a normative legal research method, this study integrates legal analyses of conflicts between the principle of contractual freedom (Article 1338 of the Civil Code) and the prohibition of inequitable clauses under the Consumer Protection Law.The findings reveal that while OJK regulations normatively prohibit exploitative clauses, inconsistencies with national law create legal loopholes exploited by online lenders. Unilateral clauses, such as interest rate increases and repayment deadline alterations, remain widespread due to the lack of harmonization between contractual freedom and the principle of consumer rights balance. OJK’s administrative sanctions are deemed ineffective, as they are disproportionate to the economic gains of lending platforms, while disguised fee practices result in effective interest rates exceeding legal limits. An analysis of court rulings shows that abusive clauses are more frequently invalidated under the Consumer Protection Law than under OJK regulations, indicating weak enforceability of OJK’s sectoral rules.This study recommends regulatory harmonization by strengthening consumer protection principles in OJK regulations, enhancing corporate criminal sanctions, and adopting artificial intelligence-based audit technologies. The academic contribution lies in critiquing the paradox of contractual freedom in Indonesia’s fintech ecosystem, while policy recommendations aim to balance digital financial innovation with consumer.

Abstract

Hong Kong International Arbitration Centre is an urgent study in the context of the Out-of-Court Dispute Resolution course, because it represents the practice of implementing international arbitration that meets the principles of fairness, speed, efficiency, and accountability. The study of HKIAC also reflects a paradigm shift in the legal world, from the dominance of litigation to alternative dispute resolution that is more adaptive to the dynamics of global business. The study in this study covers the working mechanism of HKIAC in handling international arbitration and the dispute resolution procedures at HKIAC as well as the requirements that must be met by the parties. This study uses a qualitative research method, namely an approach that focuses on understanding the phenomenon of the dispute resolution process, including the appointment of arbitrators, handling case administration, and ensuring compliance with arbitration rules. The results of the study are that the existence and role of HKIAC are very important not only in the context of resolving international business disputes, but also as a symbol of the transition from the dominance of the litigation system to a more progressive non-litigative dispute resolution system. With all these characteristics, HKIAC can be considered as a modern institutional arbitration institution that responds to the needs of global trade and the dynamics of the international business world with a professional, adaptive and trustworthy approach

Abstract

Penelitian ini bertujuan untuk mengeksplorasi secara mendalam mengenai pelanggaran etika dalam ruang sidang dengan menyoroti kasus Firdaus Oiwobo sebagai studi kasus. Fokus utama penelitian ini adalah untuk memahami faktor-faktor yang menyebabkan terjadinya pelanggaran, dampaknya terhadap kepercayaan publik, serta langkah-langkah yang dapat diambil untuk memperkuat mekanisme pengawasan kode etik di lingkungan peradilan. Pendekatan yuridis dan analisis empiris akan digunakan untuk mengevaluasi efektivitas regulasi yang ada serta menawarkan rekomendasi kebijakan yang dapat meningkatkan kualitas penegakan kode etik profesi hukum. Penelitian ini menggunakan metode studi kasus normatif, yaitu metode yang menitikberatkan analisis pada norma hukum yang berlaku serta penerapannya dalam kasus konkret. Fokus penelitian ini adalah pelanggaran etika dalam ruang sidang yang terjadi pada kasus Firdaus Oiwobo serta bagaimana implikasinya terhadap sistem peradilan di Indonesia. Hasil kajian menunjukkan bahwa Kasus Firdaus Oiwobo menjadi contoh konkret bagaimana pelanggaran etika dapat berdampak serius terhadap karier seorang advokat serta kepercayaan publik terhadap profesi hukum.

Abstract

The growth of Over The Top (OTT) services has made it more difficult to protect press companies' economic rights over their news content. OTT News Aggregators often distribute news without proper permission or fair compensation, leading to financial harm for news publishers. This situation raises legal concerns about the protection mechanisms and liability of OTT News Aggregators in Indonesia. This study uses a normative juridical approach, analyzing laws, legal doctrines, and scholarly opinions related to violations of economic rights by OTT platforms. According to this study, online news content is safeguarded by the Press Law, the Copyright Law, and the Electronic Information and Transactions Law (ITE Law). Presidential Regulation No. 32 of 2024 on Publisher Rights, specifically Articles 5(f) and 7, which mandate that digital platforms collaborate with press institutions, strengthens these safeguards. However, only the non-binding Circular Letter of the Minister of Communication and Informatics No. 3 of 2016 addresses the legal obligation of OTT News Aggregators, so leaving it weak. Therefore, there is a need to update the ITE Law, PP PSTE, and Ministerial Regulation No. 5 of 2020, and to introduce strict liability to ensure better accountability and protection of economic rights.

Abstract

This research discusses legal protection for investors in the bankruptcy case of PT Apa Tobacco Nusantara based on the perspective of bankruptcy law in Indonesia. Legal protection for investors is divided into two main forms, namely preventive and repressive, which aim to provide a sense of security, certainty, justice, and restoration of investor rights when a violation or dispute occurs. This study uses a descriptive analysis method with a qualitative approach, aiming to describe in depth the characteristics of the bankruptcy phenomenon and the legal protection applied. The results showed that in the bankruptcy process of PT Apa Tobacco Nusantara, all creditors' rights, including investors who have receivables, are strictly regulated under the Bankruptcy Law and the Postponement of Debt Payment Obligations (UUKPKPU). Bondholder investors have protection as creditors and get payment rights in order of priority, while shareholder investors are in the last position in the distribution of remaining assets after all obligations to other creditors are paid. The Financial Services Authority (OJK) plays an important role in the supervision and protection of investors in the capital market, although the risk of loss remains inherent due to the limitations of the bankruptcy mechanism. This research confirms that the bankruptcy process is complex and requires transparency, judge supervision, and information disclosure so that all investor rights can be optimally protected in accordance with applicable legal provisions.

Abstract

This study analyzes the decision of the Pemalang District Court Number 9/Pid.B/2024/PN Pml in a premeditated murder case. This study aims to assess the suitability of the decision with the elements of Article 340 of the Criminal Code and Article 181 of the Criminal Code which are the basis for the judge's considerations. The method used is a normative legal analysis of the trial facts, evidence, and legal considerations taken by the panel of judges. The results of the study indicate that this decision has fulfilled the elements in Article 340 of the Criminal Code and Article 181 of the Criminal Code, including the existence of planning before carrying out the crime. However, there are several aspects that can be used as evaluation material in enforcing similar cases in the future. This case not only shows how the legal system works in dealing with serious crimes, but also reveals new social dynamics due to the development of information technology, especially social media. Online acquaintances through platforms such as Facebook and Instagram have become the starting point for criminal acts, including murder. This phenomenon poses new challenges in the legal evidence process, especially regarding the perpetrator's intentions, motives, and planning. The low Human Development Index (HDI) in Pemalang Regency, especially in the aspects of education and health, also exacerbates the vulnerability of society to crimes that originate from online interactions. Low digital literacy and legal understanding are the main contributing factors. The results of this study are expected to contribute to the development of criminal law and better legal protection efforts for victims of crime, both in domestic and digital context

Abstract

The role of interviews in talk shows as a medium for shaping public awareness of civic values is an effective way to convey values from various aspects and experiences of the interviewees with the talk show host through casual conversation, but still within the scope of the discussion. The study employed a qualitative method with a content analysis approach on various talk show episodes covering social, legal, educational, and cultural themes. Data collection was conducted using the observation-recording method from a total of 33 talk show episodes across 11 national television programs and digital platforms. The research results indicate that talk shows have strong educational potential in conveying moral messages, national values, and encouraging active community participation in national and state life. The civic values that emerge in the programs include: integrity, justice, equality, inclusivity, environmental awareness, legal compliance, and social participation. The inclusive representation of sources reflects the diversity and involvement of various elements of society in building civic values. The findings and recommendations discussed in this article emphasize the importance of monitoring and developing the quality of talk show content as an effective non-formal civic education tool.

Abstract

The Constitutional Court (MK) has a crucial role in upholding the supremacy of law and the constitution in Indonesia. However, the independence and integrity of MK judges are in the spotlight in MK Decision Number 90/PUU-XXI/2023 which changes the provisions on the age limit for presidential and vice presidential candidates. This decision has sparked controversy due to allegations of violations of the code of ethics by one of the MK judges who has a conflict of interest with the party benefiting from the decision. This study aims to analyze the effect of violations of the code of ethics by MK judges on the legitimacy and acceptance of MK decisions. The research method used is juridical-normative with a statutory regulatory approach and analysis of decisions and their impacts. The results of the study show that violations of the code of ethics can damage public trust in the MK and give rise to debate about the validity of the resulting decisions. In addition, non-compliance with the code of ethics has the potential to weaken the independence of the judiciary and create a bad precedent for the enforcement of constitutional law in the future. Therefore, a stricter oversight mechanism is needed for MK judges as well as strict enforcement of sanctions to ensure that the resulting decisions remain objective and based on the principle of justice.

Abstract

Tax evasion offenses involving amounts under IDR 500 million often present a dilemma between criminal law enforcement and the efficiency of recovering state losses. The conventional retributive justice system frequently fails to provide optimal outcomes in terms of legal certainty and financial recovery. This study aims to explore the potential implementation of restorative justice as an alternative approach for resolving minor tax evasion cases and to evaluate how well this approach aligns with the principles of substantive justice. The research employs a normative and empirical legal method, analyzing existing regulations and drawing comparisons with practices in other jurisdictions. The findings indicate that restorative justice offers a more equitable and efficient solution, provided that strict case selection criteria are applied, offenders are willing to take responsibility, and a transparent oversight mechanism is in place. It concludes that adopting restorative justice in low-scale tax evasion cases may help restore state losses without compromising the values of justice and legal certainty.
