Abstract

The misuse of firearms by members of the Indonesian National Armed Forces (TNI) constitutes a serious violation that not only breaches military discipline but also poses a threat to civilian security and public trust. This study aims to analyze the legal considerations in military court decisions involving soldiers who have misused firearms, as well as to assess the effectiveness of verdict implementation, the forms of legal accountability imposed, and the impact of public pressure on judicial proceedings. Using a normative juridical approach and case studies of several military court rulings, the findings indicate inconsistencies in sentencing, the influence of the defendants’ relationships with superiors, and a lack of transparency and internal oversight. Moreover, public pressure plays a significant role in shaping judicial outcomes—both as a driver of justice and as a potential threat to judicial independence. Reform of the military justice system is needed through strengthened oversight mechanisms, improved disciplinary training, and safeguarding judicial independence in order to achieve substantive justice and uphold public confidence

Abstract

Kasus penemuan mayat wanita korban mutilasi dalam koper di Ngawi menjadi perhatian publik karena unsur kekerasan dan kejahatan yang mengerikan. Mayat korban ditemukan pada 23 Januari 2025 di sebuah selokan di Desa Dadapan, Ngawi. Identitas korban diungkap sebagai Uswatun Khasanah (29), yang tubuhnya ditemukan tanpa kepala dan kaki. Investigasi mengarah pada tersangka utama, Rohmad Tri Hartanto alias Antok (32), yang memiliki hubungan dekat dengan korban. Motif kejahatan diduga terkait dengan kecemburuan dan permasalahan pribadi. Potongan tubuh korban ditemukan di beberapa lokasi terpisah, menunjukkan tindakan terencana dari pelaku. Kasus ini menyoroti urgensi pencegahan kekerasan dalam hubungan personal serta pentingnya penegakan hukum yang ketat terhadap kejahatan mutilasi.

Abstract

Tulisan ini membahas tanggung jawab negara atas pelanggaran hak asasi manusia (HAM) dari perspektif hukum internasional. Dalam hukum internasional, negara bukan hanya wajib menghormati HAM, tetapi juga bertanggung jawab apabila melanggar atau gagal mencegah pelanggaran tersebut. Artikel ini mengulas aspek normatif dan institusional dari tanggung jawab negara, mulai dari sumber hukum, yurisdiksi, hinggamekanisme reparasi. Pembahasan mencakup peran lembaga internasional, pengaruh aktor non-negara, dan dinamika implementasi di negara-negara berkembang. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan deskriptif-analitis, dan merekomendasikan penguatan sistem internasional untuk penegakan tanggung jawab negara atas pelanggaran HAM

Abstract

Penelitian ini berfokus pada bentuk-bentuk pelanggaran dan akibat hukum yang diterapkan oleh Pemerintah Kota Surabaya terhadap bangunan pemukiman di sempadan sungai yang melanggar Rencana Tata Ruang Wilayah (RTRW). Penelitian ini menggunakan metode normatif dengan pendekatan yuridis normatif (statute approach), yang menelaah peraturan perundang-undangan terkait. Sumber data primer meliputi Undang-Undang Nomor 26 Tahun 2007 tentang Penataan Ruang, Peraturan Pemerintah Nomor 38 Tahun 2011 tentang Sungai, serta Peraturan Daerah Kota Surabaya Nomor 12 Tahun 2014 mengenai Rencana Tata Ruang Wilayah Kota Surabaya Tahun 2014-2034. Sumber data sekunder mencakup jurnal ilmiah, literatur hukum,  buku, hasil penelitian terdahulu, serta pendapat ahli hukum yang relevan. Pengumpulan data melalui studi dokumen dengan menghimpun, membaca, dan menganalisis berbagai peraturan, dokumen hukum, serta referensi ilmiah yang mendukung. Metode analisis data yang diterapkan adalah analisis kualitatif dengan pendekatan deskriptif-analitis. Hasil penelitian menunjukkan bahwa bentuk pelanggaran hukum pada pemukiman di sempadan sungai Kota Surabaya meliputi: 1) pendirian bangunan permanen di area sempadan tanpa izin resmi, baik berupa rumah tinggal, warung, hingga bangunan usaha; 2) alih fungsi lahan sempadan menjadi area komersial atau hunian yang seharusnya berperan sebagai area hijau terbuka atau wilayah penyerapan air; dan 3) pemanfaatan sempadan sungai untuk aktivitas ekonomi yang merusak ekosistem, seperti pembuangan limbah rumah tangga dan usaha ke badan sungai. Akibat hukum dari pelanggaran tersebut mencakup sanksi administratif berupa pembongkaran bangunan, pencabutan izin, denda, dan pemulihan fungsi lahan; sanksi pidana berupa hukuman penjara hingga 3 tahun atau denda maksimal Rp500 juta; serta sanksi perdata yang meliputi gugatan ganti rugi, tuntutan pemulihan lahan, dan pembatalan perjanjian terkait bangunan ilegal.

Abstract

Human trafficking poses a serious challenge in the modern world and requires serious attention from the international community. This journal discusses the role of international law in efforts to combat human trafficking through a review of literature studies. By analyzing various prior studies and related reports, this article investigates on how international legal developments seek to address this issue of human trafficking. Through a literature study, this article identifies the various international legal approaches that have been taken to address human trafficking as well as evaluates the effectiveness of measures as well as the challenges faced by the international community in combating human trafficking. The results of this literature review provide an understanding of the international legal landscape related to human trafficking, as well as identify areas where further efforts are needed. This article concludes the importance of interstate cooperation and effective implementation of laws in efforts to combat human trafficking effectively worldwide.

Abstract

This study discusses how to apply the principle of prudence in credit agreement deeds and the legal implications of credit agreement deeds made using false identities, with a case study of Decision Number 952/Pid.B/2019/PN.Jkt.Brt. The focus of the study lies in the application of the principle of prudence by banks and notaries in the process of making credit deeds. In this case, the debtor used a false identity to obtain credit, which then caused financial losses for the bank. The research method used in this study is a normative legal approach with secondary data. The results of the analysis show that identity falsification not only undermines the legal validity of credit deeds, but can also trigger criminal liability for notaries and administrative sanctions against banks. In addition, the application of the principle of prudence is important in providing credit and preventing losses for the bank as a creditor due to falsification of identity by the debtor.

Abstract

The kawin tangkap tradition in Sumba is a customary practice still upheld by some communities as part of their cultural heritage. However, from a civil law perspective, this tradition poses legal dilemmas due to its coercive nature in forming civil relations, particularly marriage, which should be based on the free consent of both parties. This practice ofte n contradicts key principles of civil law such as consent, free will, and the protection of individual rights, especially for women as legal subjects. this research examines how civil law interprets the legality of the kawin tangkap tradition and analyzes the conflict between customary norms and the national legal system. Using a normative and socio-juridical approach, this study proposes solutions to harmonize customary law and civil law through state intervention that ensures legal protection while respecting local wisdom.

Abstract

This study examines the dynamics of Indonesia’s ratification of the Geneva Conventions in relation to the development of human rights (HAM). Since the national movement era, the spirit of human rights recognition had emerged, later reinforced through Indonesia's ratification of the 1949 Geneva Conventions and the Additional Protocols in 1958. However, implementation at the national level has encountered obstacles, including slow legal harmonization and limited understanding of humanitarian law principles among state actors. The study employs a normative juridical method through a literature-based approach, focusing on developments from pre-independence to the reform era. Findings reveal that Indonesia’s cautious stance toward international obligations, institutional disagreements, and political dynamics have significantly influenced both the ratification process and its execution. The research recommends strengthening national legal frameworks and enhancing institutional capacity through training to ensure effective implementation of the Geneva Conventions' principle

Abstract

Land and Building Tax (PBB) is one type of tax that plays an important role in supporting funding for national and regional development. Since the implementation of fiscal decentralization through Law No. 28 of 2009, the management of PBB for the urban and rural sectors (PBB-P2) has been handed over to local governments, so that PBB has become an important component of Regional Original Income (PAD). This article reviews the definition, legal basis, objectives, collection mechanisms, as well as issues and efforts to improve the PBB system. Despite its strategic role, the implementation of PBB still encounters obstacles in the form of low levels of tax compliance, inaccurate taxable object sales value (NJOP), and weak administrative systems. Innovations such as digitalization of services, data updates, and public education are important solutions in optimizing PBB as a fair and sustainable fiscal tool.
