Abstract

The purpose of this study is to find out criminal sanctions for criminal acts of smuggling of export goods and imported goods in Indonesia. This research is normative juridical research. This research is descriptive. Data sources use primary legal material and secondary legal material. In Law No. 17 of 2006 concerning changes to the Republic of Indonesia Law No. 10 of 1995 concerning Customs (State Gazette of Indonesia No. 2006 Number 93 and Supplement to the State Gazette of the Republic of Indonesia Number 4661) criminal sanctions for smuggling as regulated in Article 102 have been regulated. , Article 102 A, and Article 102 B.  Keywords: Criminal Actions, Smuggling, Imported Used Clothes.

Abstract

Few times ago, the Indonesian people shocked by sexual abuse case that occurred in educational institutions which was incidentally very trusted institution in building the children’s characters and the parental expectations for their children's academic future. Cases that occurred outside the educational institution also very surprising, it was claimed more than 100 (one hundred) children were sodomized by a person who has well known by the victims. By promising cheap prize and by giving treatment so that they would not report as the victims of sexual violence to anyone. Victims and families delay in reporting to the police because they thought that sexual violence is considered a family disgrace, so there are a lot of victims.Keywords: Sexual Abuse, Victim, Child, and Family Disgrace.

Abstract

Implementation of social and Environmental Responsibility is the obligation of the company that should be budgeted and accounted for as expenses the company conducted with attention to propriety and obligation. Program of social responsibility and the environment must be included in the annual work plan and budget a limited liability company according to Law Number 40 of the year 2007 On limited liability company and Act No. 25 of the year 2007. The problem how form the implementation of social and Environmental Responsibility at the PT. Freeport Indonesia as PT. Planter foreign capital in mining?, and whether Act No. 40 Year 2007 On limited liability company and Act No. 25 of the year 2007 to give legal certainty to the implementation of social and Environmental Responsibility (TJSL) on PT. Freeport Indonesia?. The method of the approach used in this study using normative juridical approach, with the main focus is the implementation of TJSL on PT. Freeport Indonesia with the data acquired and analyzed using the methods of normative qualitative. Results of the study showed a real form of legal certainty is the implementation or enforcement of the law against an act regardless of who is doing. With the certainty of the law. and Act No. 40 Year 2007 On limited liability company and Act No. 25-year 2007 has not been able to guarantee the legal certainty of implementation of TJSL/CSR. Abstract

Corruption eradication in Indonesia is still not optimal and still prioritizes repressive actions against corruption cases that have occurred. The implementation of such efforts is ineffective in eradicating corruption because corruption has taken root in the legal culture of society. One of the ways that can be implemented in efforts to eradicate corruption is to prevent corruption which can be done by providing anti-corruption education, especially for students at the primary education level. Primary education is the focus of providing anti-corruption education because it is at this level that the character building of a person, and anti-corruption education is actually character education.                             Keywords : Corruption Prevention, Corruption Crime, Anti-Corruption Education.

Abstract

Law No. 1 of 2021 mentions that there are basic materials stipulated in the IE-CEPA Agreement, among others, dispute resolution. This paper aims to explain the implementation of economic dispute resolution in the approval of a comprehensive economic partnership between Indonesia and EFTA countries perspective of the Arbitration Law. This research uses a library approach, where the data collection technique uses literature and document studies. Meanwhile, the data analysis used is a triangulation technique. The results showed that the approval of a comprehensive economic partnership between Indonesia and the EFTA country as stipulated in Law No. 1 of 2021 does not clash with Law No. 30 of 1999 on Arbitration. This is because there is an accompanying Arbitration Event Law, especially concerning the selection of arbitration panels. In all, there are 8 (eight) perspectives that show the similarity of the two Laws, namely: Written application in choosing dispute resolution through Arbitration; Conciliation and Mediation; Selection of arbitrators; Examination by the Arbitrator; Language of Arbitration; Determination is final and binding; Peaceful efforts; And not willing a person to be elected as an arbitrator.Keywords: Arbitration, Disputes, EFTA.

Abstract

Tax amnesty is often used as a media in gathering state revenues from the tax sectors ina relatively short period of time. This program is implemented because of the taxworsening evasion effort. This policy create benefits funds, especially the returning ofoverseas deposits, and this policy has long term bad effect. The voluntary compliancefrom taxpayers decrease, when tax amnesty is implemented inappropriately, and givesan idea that the implementation of tax amnesty in some countries is relatively successfulin implementing tax forgiveness. Abstract

Komunitas Masyarakat Ekonomi ASEAN (MEA) sudah tidak dapat ditolak lagi, karena saat ini pelaksanaannya sudah berjalan sejak tahun 2015 yang lalu. MEA merupakan bentuk integrasi ekonomi ASEAN, dalam hal ini semua negara-negara yang berada di kawasan Asia Tenggara sudah sepakat menerapkan sistem perdagangan bebas dengan tujuan menjadikan kawasan ASEAN menjadi kawasan yang lebih stabil, makmur dan kompetitif dalam pembangunan ekonomi.Karakteristik MEA yang berbasis pada pasar tunggal dan produksi, ekonomi yang kompetitif, pembangunan ekonomi yang adil, dan kawasan yang terintegrasi dalam hal ekonomi global sudah seharusnya membawa negara-negara yang berada di kawasan Asia Tenggara khususnya Indonesia mampu meningkatkan kesejahteraan ekonomi bagi warga negaranya, bukan sebaliknya malah menjadi ancaman bagi perekonomian Indonesia khususnya dalam bidang Hak Kekayaan Intelektual dimana pasca ratifikasi kesepakatan WTO/TRIPs Hak Kekayaan Intelektual ini sangat erat sekali dengan dunia perdagangan/bisnis (ekonomi).Indonesia yang sangat kaya akan sumber daya alam dan sumber daya manusia sebagai faktor produksi yang sangat penting dalam pembangunan, perlu diarahkan dan dikembangkan ke arah yang positif khususnya dalam bidang hak kekayaan intelektual, karena ke depan persaingan dengan bangsa lain tidak cukup hanya mengandalkan kekayaan sumber daya alam saja, mengingat sumber daya alam tersebut akan dan pasti habis. Oleh karena itu Indonesia sudah seharusnya merespon pelaksanaan MEA ini secara positif dan dijadikan peluang yang bagus dalam upaya meningkatkan kesejahteraan masyarakat dengan menerapkan sistem hak kekayaan intelektual sebagaimana yang telah dilakukan oleh negara-negara maju seperti Amerika, Jepang dan lain-lain.   Kata kunci : Masyarakat Ekonomi Asean (MEA), Cita Negara Hukum   Berkesejahteraan, Sistem Hukum Hak Kekayaan Intelektual Indonesia.

Abstract

As a staple food in Indonesia, the availability of rice are needed to continue until whenever. Because agriculture is still the source of livelihood of the majority of the workforce in Indonesia. Hence the presence of the government is necessary, governments can differentiate into central government and local governments. In UUD 1945 Pasal 18A ayat (1) mentions the relationship of authority between the central government and provincial government, counties, and cities, or between provinces and districts and cities, regulated by law with due regard to the specificity and diversity of the area. Regional autonomy is one manifestation of freedom for the regions to be involved in designing the activity of politics and government at the local level in order to strengthen the power of national government. Thus the role of local government is very important to the affairs of the availability of rice in the presence of local autonomy. The local government and regional autonomy can be free to design a territory in support of the central government towards food security.Undang-Undang No. 18 tahun 2012 tentang Pangan mentions the issue of food intended to achieve three things at once, namely food sovereignty, food self-sufficiency and food security. President Jokowi that: "Food security is distinct from food sovereignty. Food security is simply the availability of foodstuffs (logistics) in the warehouse and on the market irrespective of origin whether imported or locally produced. Food sovereignty means that we manufacture and market our own groceries, while surplus production is exported ". Here we can see that food sovereignty is significantly deeper than food security. thus, the optimization of local governments in order to achieve food sovereignty can be: 1. the agrarian reform (land protection by performing a spatial planning regulations); 2. the legal protection to farmers (by making regulations that aim the welfare of farmers); 3. the availability of seeds, fertilizers and tools supporting production; 4. Registering brands and geographical indications of agricultural products to the Directorate General of Intellectual Property Ministry of law and Human Rights Republic of Indonesia; 5. setting the price, product quality and market share of an agricultural product. Keywords: Food Security; Food Sovereignty; Rice; Regional Government.

Abstract

Entering the era of disruption of artificial intelligence (AI) does not rule out the possibility of increasing lysophisticated criminal acts carried out using virtual media. Cyber crime refers to a crime related to cyber space and crimes that use computers. Cyber criminals or data hacker salso take advantage of AI technology to steal personal data. There fore, information regarding personal data is very important tobe protected, so that data leak age does not occur, because it contains a lot of information related to a person. This study used normative legal research method with statutory and conceptual approach. This study reveals that Indonesia currently don’t have a legal umbrella that particularly regulates personal data protection, however, the regulation on personal data protection has been spread in various law sand regulation salthoughit does not clearly or specifically mention personal data protection.Keywords : Legal Reform, Personal Data, Artificial Intelligence.

Abstract

Indonesia has experienced rapid growth in the technology sector and digital economy. However, traditional contract transactions still often face problems such as legal uncertainty, fraud and complicated bureaucracy. The blockchain technology system brings major changes in various sectors, including in the context of security and legal certainty in contract transactions in Indonesia. The problem that will be discussed in this research is, How can blockchain technology be used to increase transparency and data integrity in contract transactions in Indonesia? Are there any legal regulations governing the use of blockchain technology in contract transactions in Indonesia? How does the application of blockchain technology in contract transactions in Indonesia affect the resolution of contract disputes? The approach method that the author uses in this research is a normative juridical approach. In this research, the author studies legal rules by examining statutory regulations and legal concepts that are related to this research. Based on the research results, it can be seen that in general, the role of blockchain technology in increasing security and legal certainty in contract transactions in Indonesia is very important in facing challenges related to reliability, security and legal certainty that are often faced in conventional systems.Keywords: Blockchain; Contract; Security.
