Abstract

Bullying or harassment in educational environments is a form of violence that threatens children's basic rights to live, grow, and develop safely as guaranteed by Article 28B paragraph (2) of the 1945 Constitution. This phenomenon not only shows weak institutional supervision, but also reflects the failure of legal and social culture in protecting students from physical, verbal, and psychological violence. The purpose of this study is to increase public awareness about the importance of creating a child-friendly and bullying-free school environment and to reduce the incidence of bullying in schools in Gorontalo City. This study uses an empirical legal approach supported by a normative approach, by examining bullying practices at State Senior High School 7, Gorontalo City through field observations, interviews, and documentation. The results of the study show that bullying occurs systematically and repeatedly, driven by psychological factors of the perpetrators, the social environment of peers, weak enforcement of school rules, and a culture of seniority. Bullying has a serious impact on the mental development of victims, such as decreased self-confidence, anxiety, and even the desire to end their lives. Efforts to overcome this are carried out through penal and non-penal strategies, including the implementation of the Child Protection Law and Permendikbudristek No. 46 of 2023. The conclusion of this study emphasizes the importance of collaboration between schools, parents, BK teachers, and law enforcement in creating a safe and inclusive learning space. Recommendations include strengthening supervision, counseling, character education, and the application of academic sanctions against perpetrators of bullying to create a deterrent effect. With a holistic approach, bullying can be prevented as a real step towards fulfilling children's rights and transforming a civilized education culture.

Abstract

The development of online buying and selling transactions has also given rise to a rise in fraud cases that are detrimental to consumers. Article 28 paragraph (1) of Law Number 19 of 2016 concerning ITE needs to be legally reviewed to determine the extent to which these provisions are able to provide protection for consumers from fraudulent acts in online transactions. Therefore, this study aims to legally analyze the provisions of Article 28 paragraph (1) of Law Number 19 of 2016 concerning Information and Electronic Transactions (UU ITE) as a form of legal protection for consumers in dealing with the rampant fraud in online buying and selling transactions. The main problems in this study include how the concept of legal protection for consumers is formulated in the article and what are the legal implications for perpetrators of fraud. This study uses a normative method with a legislative, conceptual, and case approach. Data were obtained from primary, secondary, and tertiary legal materials through literature studies. The results of the study indicate that Article 28 paragraph (1) of the ITE Law provides legal protection through a prohibition on the dissemination of false information that is detrimental to consumers in electronic transactions, with a maximum prison sentence of six years and/or a fine of up to one billion rupiah as regulated in Article 45A paragraph (1). In addition to being a repressive instrument, this provision is also preventive in nature by demanding that sellers be responsible for conveying honest and accurate information. This study emphasizes the urgency of law enforcement and digital literacy in strengthening consumer protection amidst the rapid growth of e-commerce.

Abstract

The legal protection of trademarks for Micro, Small, and Medium Enterprises (MSMEs) in Pohuwato is an increasingly urgent issue in light of the sector’s rapid growth and contribution to the local economy. Despite the existence of Law No. 20 of 2016 on Trademarks and Geographical Indications, which provides a clear legal framework for trademark registration and protection, a large number of MSME actors in the region have not registered their trademarks. This is largely due to a lack of legal awareness, the perception that registration costs are too high, and the belief that the process is too complex or unnecessary for small businesses. The objective of this research is to analyze how trademark protection for MSMEs is implemented in Pohuwato, to understand the legal consequences of unregistered trademarks, and to evaluate the role of government institutions in facilitating registration. The research employs an empirical legal method with a qualitative approach, using data gathered through interviews, field observations, and questionnaires distributed to 100 MSME respondents. The findings reveal that although the local government and the Regional Office of the Ministry of Law and Human Rights in Gorontalo have made substantial efforts such as door-to-door socialization campaigns and registration facilitation the overall rate of trademark registration remains low. The legal consequence of not registering a trademark is the absence of exclusive rights and the inability to take legal action against infringement, which may result in financial loss and reputational damage. This research concludes that consistent legal education and expanded outreach programs across all districts in Pohuwato are essential to enhance MSMEs' legal awareness and strengthen their legal protection.

Abstract

Indonesia continues to face an increasing number of agrarian conflicts that are complex, multidimensional, and rooted in structural inequality in land control and use. The current litigation-based mechanisms, both in the General Court and the State Administrative Court, are often unable to provide quick, fair, and inclusive resolutions due to procedural rigidity, high costs, and public distrust. Nonlitigation efforts led by government agencies such as the National Land Agency (BPN) also tend to be ineffective due to a lack of neutrality and professional mediation capacity. In response, this study proposes the urgent establishment of an Alternative Dispute Resolution Institution (LAPS) specifically for agrarian disputes. LAPS aims to institutionalize mechanisms such as mediation, negotiation, and conciliation within a professional, independent, and participatory framework. Using a normative juridical method with statutory and conceptual approaches, this research argues that LAPS not only enhances legal certainty and access to justice but also aligns with progressive legal theories, distributive justice, and the sociolegal needs of marginalized communities. The institutionalization of ADR in agrarian law is a transformative step to achieve substantive justice and long-term social stability in land governance in Indonesia. This study found that the current litigation and non-litigation mechanisms are not yet effective in resolving agrarian conflicts fairly and inclusively. Therefore, the establishment of an independent and participatory Agrarian Dispute Resolution Alternative Institution (LAPS) is needed to realize substantive justice and legal certainty in land governance in Indonesia.

Abstract

The widespread use of electric bicycles on the highway by the public, including children and teenagers, without complying with legal provisions has the potential for serious traffic accidents. Therefore, the role of the police in law enforcement and enforcement is important to ensure that the use of electric bicycles is in accordance with applicable regulations in the Gorontalo City area. This study aims to analyze the role of the police in handling and regulating the use of electric bicycles on the highway, especially in the Gorontalo City area, within the framework of traffic law enforcement based on Law Number 22 of 2009 concerning Traffic and Road Transportation and Regulation of the Minister of Transportation Number 45 of 2020. Electric bicycles as an alternative mode of transportation that uses battery power and electric motors are increasingly in demand by the public, including children and adolescents. However, the widespread use of electric bicycles that do not comply with legal provisions has the potential for traffic accidents, which is a serious concern for the police. This study uses an empirical legal approach by collecting data through interviews and observations of the Gorontalo City Police Traffic Unit. The results of the study show that the police have an important role in educating the public, conducting outreach, and taking firm action against traffic violations by electric bicycle users. However, limited infrastructure such as special bicycle lanes, minimal technical regulations, and lack of public legal awareness are significant obstacles in the law enforcement process. Therefore, special regulations are needed at the regional level that comprehensively regulate the use of electric bicycles, as well as collaboration between the police, local governments, and the community in building a safe, orderly, and equitable traffic system. This study recommends strengthening the supervision function and improving infrastructure as the main strategy in reducing the risk of traffic accidents due to the use of electric bicycles that do not comply with the rules.

Abstract

The practice of illegal levies against street food UMKM actors in the campus area of ​​Gorontalo State University has become a serious problem because it is carried out without a clear legal basis and is coercive. In fact, the area is not included in the official retribution zone according to the Gorontalo City Regulation, so a legal study and active role of the police are needed to overcome extortion that is detrimental to small business actors. This study aims to examine the regulation of levies and the practice of extortion against Micro, Small, and Medium Enterprises (MSMEs) in the street food model in the Gorontalo State University campus area and to analyze the role of the police in handling these problems. This study uses an empirical method with a normative legal approach. The results of the study show that the Gorontalo State University campus area is not included in the official locations subject to levies based on Gorontalo City Regional Regulation Number 6 of 2020 concerning Business Service Levies, because it is not classified as a place for recreation and sports. However, in practice, MSME actors in the area are subject to levies by parties who do not have legal authority, under the pretext of security and cleanliness. These levies are coercive and are not based on a valid legal basis, thus fulfilling the elements of the crime of extortion as regulated in Article 368 of the Criminal Code. In terms of law enforcement, the Kota Tengah Police as the police in charge in the area have not been able to act actively because there have been no official reports from the public. This shows the weak courage of MSME actors in reporting, which is the main obstacle in eradicating extortion. Therefore, proactive steps are needed from the local government to re-regulate the legal zone of retribution, as well as active involvement of the police in taking a preventive approach to the community in order to prevent and overcome the practice of extortion that is detrimental to small business actors.

Abstract

This study discusses in depth the legal provisions for the provision of remuneration to Foundation administrators in Indonesia and the related dispute resolution mechanisms, based on Law No. 28 of 2004 concerning Amendments to Law No. 16 of 2001 concerning Foundations. As a non-profit legal entity, a Foundation has unique characteristics that emphasize the principle of non-profit, where the use of the Foundation's assets must be fully directed to achieving social, religious, or humanitarian goals. However, in practice, the need for professionalism and high workloads often require Foundation administrators to receive reasonable compensation. This study aims to analyze the legal provisions regarding the provision of remuneration for Foundation administrators in Indonesia and to evaluate the dispute resolution mechanisms that may arise, by referring to Law No. 28 of 2004 concerning Amendments to Law No. 16 of 2001 concerning Foundations. This study uses a normative legal approach with a prescriptive analysis method, and finds that remuneration is permitted as long as the administrator is not a founder, patron, or supervisor; carries out his duties directly and fully; and is regulated transparently in the Articles of Association. In the event of a dispute, the resolution can be reached through deliberation, mediation, arbitration, or court. This study also highlights the importance of accountability, internal supervision, and regulatory intervention from the government in maintaining the integrity of Foundation governance. Thus, the law on foundations in Indonesia needs to be continuously strengthened to remain relevant to social dynamics and the practical needs of professional management of non-profit organizations. Remuneration for Foundation administrators is permitted on the condition that the administrators are not founders, advisors, or supervisors, carry out their duties directly and fully, and are regulated transparently in the Articles of Association. Dispute resolution can be carried out through deliberation, mediation, arbitration, or court, with an emphasis on accountability, internal supervision, and the need for government regulation to strengthen Foundation governance.

Abstract

Konsolidasi BPR/BPR Syariah dalam satu kepemilikan dan/atau pengendalian yang sama merupakan suatu bentuk kewajiban yang harus dijalankan oleh bank sebagaimana amanat dari Peraturan Otoritas Jasa Keuangan Nomor 7 Tahun 2024. Konsolidasi BPR/BPR Syariah sebagaimana ketentuan yang berlaku dapat ditempuh melalui mekanisme penggabungan/peleburan yang terlebih dahulu perlu mendapatkan persetujuan dari Otoritas Jasa Keuangan. Namun dalam melakukan impelementasi kewajiban konsolidasi ini, tentunya tidak selalu berjalan sesuai dengan ketentuan, terkadang terdapat tantangan/hambatan yang ditemui diantaranya Pemegang Saham Pengendali (PSP) telah setuju adanya penggabungan, namun para pemegang saham lainnya tidak menyetujui adanya penggabungan/peleburan sehingga proses permohonan perizinan penggabungan/peleburan menjadi terhambat dan memerlukan strategi penyelesaian permasalahan agar penggabungan/peleburan tetap dapat dijalankan. Metode penelitian yang digunakan dalam penelitian ini yaitu yuridis normatif dengan menggunakan bahan hukum primer dan sekunder. Hasil penelitian ini menyimpulkan bahwa dalam proses penyelesaian terhadap pemegang saham yang tidak menyetujui kewajiban konsolidasi melalui penggabungan/peleburan memerlukan peran dari Pemegang Saham Pengendali dan Otoritas Jasa Keuangan untuk proses penyelesaian permasalahannya sehingga kewajiban konsolidasi BPR dan BPR Syariah nantinya tetap dapat dijalankan. Abstract

Marriage is one of the religious orders and also the only way to channel the desires of a person's biological needs that are permitted by religion. Seen from this point of view, then when someone gets married at that time he does not only have the desire to fulfill his biological needs which by nature must be channeled. People with disabilities, both in institutions and outside institutions, have basic rights that must be fulfilled and protected. These basic rights include criminal and citizen rights. Citizen rights include the ability to make employment contracts and get married. The possibility of the desire of people with mental disabilities to get married remains. This study aims to analyze the legal status of marriage of people with disabilities from the perspective of Islamic family law and evaluate its validity based on the pillars and conditions of marriage. In addition, this study also aims to examine the marriage through the approach of the concept of maslahah and mafsadah to see its positive and negative impacts on the household life of people with disabilities. This type of research is qualitative research with a normative approach (normative juridical), namely examining primary and secondary legal materials related to Islamic family law and marriage of people with disabilities. The marriage process carried out by people with disabilities is valid as long as it fulfills the pillars of marriage while still having to adjust to the type of disability inherent in both bride and groom. So that a solution can be found for the process or implementation of the ijab qobul which is the core of the marriage process, either by words, writing or gestures. In marriage of people with disabilities, there are various considerations between the decision to marry or not. Marriage of disabilities is a consideration based on whether there is maslahah or not. In this case, the clear maslahah is to protect a person with disabilities from committing adultery, while on the other hand, there are still doubts about their ability to live a household life.

Abstract

The issue of domestic violence is one of the phenomena of various types of violence that occur today. As with other cases of violence that continue to increase, domestic violence is increasing from year to year. The purpose of this writing is to examine kFiqh and Legal Provisions on Domestic Violence in Indonesia Andanalyzing the provisions of Fiqh and Law Number 23 of 2004 reviewed from the theoretical perspectiveZawajir And Speech. The method used is a normative legal method with a qualitative approach that refers to Fiqh and legal norms contained in laws and regulations and legal norms that apply in society. The type of research that will be used is literature, by conducting a study of primary and secondary legal materials. The results of this study are the Zawajir and Jawabir Theory of Domestic Violence in Islamic law and Law Number 23 of 2004 concerning Domestic Violence are seen as Preventive and Repressive efforts, including in Islamic law as Preventive efforts can be done with Early Religious Education, Marriage as a Sacred Bond, Premarital Guidance, Tarbiyah and Da'wah through sermons. While in Law Number 23 of 2004 concerning Domestic Violence can be done with Education and Socialization, Family Guidance, Training and Capacity Building of Law Enforcement Officers, Increasing Access to Services. As a Repressive effort in Islamic law can be through Advice and Stages of Settlement, Bringing in a Mediator, Divorce as a Last Resort, and Criminal Sanctions in Islamic Law. Meanwhile according to Law Number 23 of 2004 concerning Domestic Violence can be done with Reporting and Handling of Cases, Temporary and Long-Term Protection, Prosecution and Criminalization and Rehabilitation of Perpetrators. This study found that the zawajir andjawabir approaches in fiqh and Law Number 23 of 2004 both emphasize preventive and repressive efforts in dealing with domestic violence.
