Abstract

Community participation in village development planning is often only symbolic and does not reflect substantive involvement. This study aims to examine the level of community participation in the process of preparing the Village Medium-Term Development Plan (RPJMDes) in Mutiara Village, Paguyaman District, Boalemo Regency, and to identify factors that influence the low level of community involvement in the planning stage. The approach used is empirical law with qualitative methods. Data were obtained through direct interviews with village officials, community leaders, and community groups, as well as field observations of the dynamics of the preparation of the RPJMDes document. This study is also supported by secondary data in the form of laws and regulations and village planning documents. The results of the study indicate that community participation in the preparation of the RPJMDes in Mutiara Village is still a formality and has minimal substantive involvement. Planning meetings are generally only attended by limited representatives, with residents tending to be passive and not actively involved in the program review process. The main factors influencing low participation include the lack of understanding of the community and village government regarding the urgency of participation, limited involvement of community groups as a whole, and time constraints because activities are carried out when the majority of residents are working. Therefore, an adaptive and inclusive participatory approach is needed, as well as a more effective communication strategy so that the village development planning process truly reflects the needs and aspirations of the community. The results found that community participation in Mutiara Village was still low due to minimal understanding, time constraints, and lack of comprehensive group involvement.

Abstract

Unregistered marriages are still common practice in rural areas of Indonesia, resulting in weak legal protection for women and children within the family structure. Ignorance of the law, local culture, and limited access to marriage registration institutions are the main factors behind this. This study aims to analyze the legal and social impacts of early marriage practices that are not registered at the Religious Affairs Office (KUA), with a case study in Tombolikat Village, Tutuyan District, East Bolaang Mongondow Regency. The method used is a juridical-empirical approach with data collection through interviews with village officials, KUA officials, and couples who have unregistered marriages. The results of the study indicate that the absence of marriage registration causes women to lose their legal legitimacy as wives, so they have no basis for demanding maintenance, inheritance rights, or legal protection in the household. Children born from unregistered marriages also experience losses in legal status, such as the father's name not being listed on the birth certificate, and having no guarantee of inheritance rights and maintenance. In addition, this condition strengthens gender inequality and opens up opportunities for neglect and polygamy without a legitimate legal mechanism. This study recommends the need to strengthen the marriage registration system through community legal education and an integrated marriage confirmation program as a form of inclusive legal protection. The results found that the absence of marriage registration has a serious impact on the loss of legal rights of wives and children, including the right to maintenance, inheritance, and legal recognition. This condition also opens up space for gender inequality, neglect, and the practice of polygamy without legal supervision.

Abstract

Land buying and selling transactions without certificates still occur frequently in society due to limited access to formal land certification processes. This study aims to analyze the form of legal protection for buyers in land sale and purchase transactions that have not been certified, and to offer a new approach model in the form of intermediate legal recognition to overcome limited access to the formal land registration process. This study uses a normative legal research method with a statutory approach, a conceptual approach, and a case approach, and refers to primary legal materials such as UUPA No. 5 of 1960 and PP No. 24 of 1997. The results of the study indicate that although land sale and purchase transactions without certificates can be declared valid in civil law, the absence of a certificate weakens the legal position of the buyer, especially in terms of proving ownership rights before the law. The temporary legal recognition model based on village administrative documents is considered to be a transitional solution that provides preventive protection while strengthening the drive to follow the land certification process in full. This approach also reflects the need for land law reform that is more responsive to the social and economic conditions of the community. The results found that the absence of a certificate weakens the legal position of the buyer, so a temporary legal recognition model based on village administrative documents is needed as transitional protection.

Abstract

Law enforcement against Indonesian citizens (WNI) who commit serious crimes abroad, particularly murder in Saudi Arabia, poses challenges in implementing the principle of aut dedere aut punire and protection under the 1963 Vienna Convention on Consular Relations. This study aims to analyze the discrepancy between judicial practices in Saudi Arabia and the consular protection obligations of the sending state (Indonesia). Using normative juridical methods and a case-based approach, this study finds that Saudi Arabia prioritizes territorial jurisdiction and sharia law in prosecuting perpetrators, without considering extradition. Meanwhile, the implementation of consular protection is often suboptimal due to delays in information and diplomatic obstacles. This study recommends strengthening legal diplomacy and increasing bilateral cooperation for more effective protection of Indonesian citizens involved in serious legal cases abroad.

Abstract

Tujuan penelitian ini adalah untuk menganalisis peran negosiasi dalam Alternatif Penyelesaian Sengketa (APS) di Indonesia, dengan fokus pada kedudukannya sebagai salah satu mekanisme non-litigasi yang diakui oleh hukum positif. Penelitian ini menggunakan pendekatan kualitatif dengan metode studi literatur. Hasil kajian menunjukkan bahwa negosiasi merupakan bentuk APS yang paling sederhana dan fleksibel, karena memungkinkan para pihak untuk berkomunikasi secara langsung tanpa melibatkan pihak ketiga. Negosiasi tidak hanya menghasilkan solusi yang saling menguntungkan (win-win solution), tetapi juga menjaga hubungan baik antar pihak yang bersengketa, berbeda dengan proses litigasi yang cenderung menghasilkan pihak menang dan kalah. Lebih lanjut, hasil negosiasi dapat memperoleh kekuatan hukum apabila dituangkan dalam akta perdamaian dan disahkan oleh pengadilan, sehingga memiliki kedudukan yang sama dengan putusan pengadilan. Dengan demikian, negosiasi memiliki peran strategis dalam menyelesaikan sengketa secara damai, efisien, dan tetap menjaga hubungan jangka panjang antar pihak.

Abstract

The increasingly rampant conversion of agricultural land in Gorontalo City poses a threat to the sustainability of Sustainable Food Agricultural Land (LP2B), so a legal study is needed from a land use perspective. This study aims to analyze the protection of Sustainable Food Agricultural Land (LP2B) in Gorontalo City from a land use perspective. This study uses an empirical legal approach with qualitative methods, through interviews with technical agencies and farmers and analysis of policy documents. The results show that LP2B protection in Gorontalo City has not been optimally implemented due to the absence of specific regional regulations that regulate LP2B protection in detail. This regulatory weakness is exacerbated by the vulnerable socioeconomic conditions of farmers, high urban development pressures, and weak inter-agency coordination in monitoring and controlling land use conversion. Although there are land replacement policies and outreach to farmers, these steps have not been able to address the structural challenges of LP2B protection. Therefore, it is necessary to formulate regional regulations on LP2B protection, integrate spatial data into the RTRW (Regional Spatial Plan), strengthen land use monitoring, and provide incentives to agricultural actors to maintain food security and agrarian sustainability in Gorontalo City.

Abstract

The rampant circulation of illegal cosmetics through social media, which is difficult to monitor, poses a serious challenge to consumer protection and the effectiveness of law enforcement in Indonesia. This study aims to analyze the positive legal regulations regarding the sale and purchase of illegal cosmetics via social media and identify factors that hinder law enforcement in Gorontalo City. The phenomenon of the rampant circulation of illegal cosmetics via social media poses a serious challenge, primarily due to the dynamic and difficult-to-monitor nature of digital media. The research method used is an empirical legal approach, with data collection through observation and interviews with Gorontalo BPOM officers and a review of relevant laws and regulations such as the Health Law, the Consumer Protection Law, the ITE Law, and BPOM Regulation No. 18 of 2015. The results of the study indicate that although regulations are available, implementation in the field still faces various obstacles such as a weak deterrent effect, limited human resources and technology, and low public awareness. The conclusion of this study emphasizes the importance of regulatory reform, strengthening the digital capacity of regulatory agencies, and cross-sector collaboration to create more effective legal protection for consumers in the era of digital commerce.

Abstract

Construction contract conflicts often arise due to default and unlawful acts that cause losses to the parties, so a legal analysis is needed to strengthen legal certainty and justice. This study examines the issue of breach of contract and unlawful acts in construction contracts through a legal analysis of two court decisions: Decision Number 433/Pdt.G/2021/PN Jkt.Pst and Decision Number 46/Pdt.G/2018/PN Bgr. These two cases illustrate two forms of legal violations in the implementation of construction contracts that result in losses for both the service provider and the service user. In the first case, the breach occurred due to the debtor's negligence in fulfilling the agreed-upon performance, resulting in a claim for compensation. In the second case, the violation of the initial agreement led to delays in work completion, which then resulted in the provider being blacklisted and the contract termination by the service user. This study highlights the importance of contractual understanding, strengthening construction regulations, and effective dispute resolution mechanisms in preventing similar conflicts in the future. This study also emphasizes that work delays are not always the fault of the service provider but can be caused by changes on the part of the service user without an official extension. Therefore, efforts to improve the construction contractual system need to be strengthened to ensure legal certainty, justice, and efficiency in the implementation of construction projects in Indonesia.

Abstract

The case of the death of a student at IAIN Sultan Amai Gorontalo due to cadre training has raised legal problems related to the application of Article 359 of the Criminal Code, which is considered less appropriate than Article 354 of the Criminal Code. This study aims to examine the legal investigation in the application of Article 359 of the Criminal Code (KUHP) against five suspects in the case of the death of a student at IAIN Sultan Amai Gorontalo which occurred during a cadre training activity by a student organization. This study uses an empirical method with a qualitative approach, which relies on primary data in the form of interviews with investigators and secondary data from official documents and trial facts. The preparation of Article 359 of the Criminal Code after conducting a case title with the prosecutor's office with the consideration that the violence that occurred was only in the form of selling using sandals, so it was deemed not to fulfill the elements of seriousness. In addition, other considerations include the condition of the victim who was already sick, the negligence of the committee in providing first aid, not immediately taking the victim to the hospital, and the absence of professional medical personnel during the activity. However, the trial facts indicate that there was real, systematic, and fatal physical violence against the victim, as evidenced by witness testimony and the results of a medical autopsy. Therefore, the application of Article 359 of the Criminal Code in this case raises legal problems because there are strong indications that the element of serious assault as regulated in Article 354 of the Criminal Code is more appropriate to be applied. This study emphasizes the importance of thoroughness and professionalism of investigators in determining the construction of articles based on complete legal facts, as well as the need for a law enforcement approach that reflects substantive justice for the victim and their family.

Abstract

The implementation of regional autonomy in Indonesia faces complex challenges in creating effective coordination between central and regional governments. This study aims to analyze the legal position of co-administration as a coordination instrument in the regional autonomy system, evaluate the effectiveness of coordination mechanisms, and identify juridical and implementative constraints. The research method uses a qualitative approach with library research to examine the legal construction of co-administration based on Law Number 23 of 2014 concerning Regional Government and its implementing regulations. The results show that co-administration has a strategic position as a bridging mechanism in the regional autonomy system with hybrid characteristics between centralization and decentralization. The juridical construction of co-administration contains four constitutive elements: assignment of partial government affairs, implementation by regional government, not full delegation of authority, and accountability to the assigning party. The effectiveness of coordination through co-administration is hampered by unclear division of authority, normative conflicts between regulations, resource limitations, and vertical-horizontal coordination barriers. The study concludes that optimizing the coordination function of co-administration requires reconstruction of the legal framework through regulatory improvement, strengthening coordination capacity, developing integrated monitoring evaluation systems, and establishing special dispute resolution mechanisms to create sustainable coordination in Indonesia's regional autonomy system.
