Abstract

المحور الأساسي في هذا البحث يناقش حكم الطلاق العاطفي في الفقه الإسلامي. و الطلاق العاطفي هو حالة تعتري العلاقة الزوجية يشعر فيها الزوج والزوجة بخواء المشاعر بينهما، وينعكس ذلك على جميع التفاءلات داخل الأسرة. وحيث إن الطلاق العاطفي يعتبر ظاهرة خطيرة تهدد العديد من الأسر بمجتمعتنا اليوم، بل وقد يؤدي إلى تدميرها، فتضطر الباحثة لمحاولة كشف حفيفة الطلاق العاطفي وآثاره في الحياة الزوجية من منظور الفقه الإسلامي.  و يحتوي هذا البحث على مسألتين أساسيتين، وهما: 1) ما حكم الطلاق العاطفي في الفقه الإسلامي، 2) ما آثار الطلاق العاطفي في العلاقة بين الزوج والزوجة. وقد قامت الباحثة في كتابة هذا البحث بأخذ البيانات من الدراسة المكتبية في إعداده. أولاً: تم أخذ بيانات هذا البحث من كتب الفقه الإسلامي، والمقالات، والمجلات، والعديد من الأوراق العلمية التي تناقش المشكلة الرئيسية لهذا البحث. و ثانياً، يتم بعد ذلك تجميع البيانات التي تم الوصول إليها ومعالجتها بحيث تكون متوافقة مع موضوع البحث. ومن نتائج هذا البحث ما يلي: 1) حكم الطلاق العاطفي الذي يقصد هنا هو مجرد مجازي  و الحقيقة هو الانفصال العاطفي بين الزوجين، وإذا كان متعلقا بالفقه الإسلامي فيصعب تحديده بسبب هذا الطلاق ليس الطلاق في نظر الشريعة الإسلامية. 2) للطلاق العاطفي هو عدد من الآثار السلبية التي لا تقتصر على العلاقات الزوجية فحسب، بل لها تأثير كبير أيضا على الحياة الاجتماعية، من زيادة عدد الطلاق في المجتمع وزيادة مشاكل في رعاية الطفل وغيرها من الآثار السلبية على الأجيال القادمة

Abstract

One of the obligations of parents to their children is to be an educator to grow and develop their children. The problem is, both parents who work and are busy to take care of and educate children, then take steps to entrust their children. The main problems of this study are divided into 2 main problems, namely: 1. How is the law to entrust children according to Islamic law? 2. What is the impact of entrusting children on harmony in the family? This research uses a type of library research (Library Research) with analysis of juridical-normative method research methods. The sources of this research data are the Qur'an, hadith, books of salaf (former) and khalaf (contemporary) scholars, and journals related to the subject matter. Furthermore, the method of data collection by reading books and scientific papers, studying, translating, and analyzing data related to the subject matter. Then draw conclusions. The results of this study show that the law delegates care by entrusting it to daycare, or babysitter, or to the child's grandparents, depending on the reason for the busy life of parents (especially the mother). If the reason is because of looking for wealth to help the family economy, it is permissible with the conditions that have been prepared by Fukaha. As for if the reason is because of pursuing a career, then in terms of benefit, it is not allowed especially if there is no time with family. There are several positive and negative impacts of entrusting children to family harmony. The negative effects are; Children who are less close to their parents, children will become closed, parents also miss important moments with their children, children's mindsets will be different, lack of religious education, and not awakened akhlak karimah (good ethics). The positive effects are; The task of parents will be helped in the midst of their busy lives, socialization and communication of children increases, and parenting is more experienced.

Abstract

This research aims to understand the law of adopting children in Islamic Jurisprudence and the law of adopting children in the Compilation of Islamic Law. This type of research is library research with a qualitative approach. The primary data sources used in this research are Islamic jurisprudence books and the Compilation of Islamic Law (KHI). Meanwhile, secondary data sources are books, journals and textbooks that are related to what the author discusses. The data collection technique in this research is documentation. Then analyzed using content analysis techniques. The results of this research are that adoption in Islamic jurisprudence is prohibited if the adopted child's lineage is attributed to his or her adoptive parents. Because Islamic jurisprudence scholars agree that a child's fate is determined by three things, namely a valid marriage, a fasid marriage, and wathi' syubah. However, adopting a child with the aim of caring for, nurturing and educating with love without changing the child's lineage is a commendable act and is a pious deed recommended by the Islamic religion. In Islamic jurisprudence, adopted children do not inherit from their adoptive parents, but can only obtain property from their parents through a gift or will and their adoptive parents cannot act as guardians for their marriage. Apart from that, adopted children are not mahram to their adoptive parents, so they must pay attention to the boundaries in interacting between the two. As for the adoption of children in the Compilation of Islamic Law, it is permissible, provided it is limited to transferring responsibility from the child's parents to the adoptive parents. This transfer of responsibility includes paying for daily living, caring for him with love and fulfilling all his needs, without changing the child's fate. Apart from that, adopted children do not become heirs of their adoptive parents, but have the right to obtain a mandatory will as regulated in article 209 and adoptive parents do not have the right to become marriage guardians for their adopted children

Abstract

This research explores the legal aspects of non-verbal marriage contracts (akad nikah tunawicara) from the perspectives of Islamic law and the Shafi'i school of thought. The marriage contract is an agreement between two parties who enter into matrimony through the process of ijab (proposal) and qabul (acceptance). Generally, a marriage contract is deemed valid if it meets the necessary conditions and pillars. However, for individuals with special needs, particularly those who are non-verbal, there are specific methods for conducting the marriage contract. The objectives of this research are: 1. To understand the procedures of a non-verbal marriage contract according to Islamic law. 2. To determine the legal aspects of a non-verbal marriage contract according to the Shafi'i school of thought. This research adopts the library research method, involving the examination of relevant books and literature related to the discussed issues. The findings of this study indicate that: 1. Non-verbal marriage contracts, from an Islamic legal perspective, must adhere to the pillars and conditions of marriage, similar to marriages involving individuals who can communicate verbally. Non-verbal communication can be through understandable gestures, writing, or representation by a proxy. If the individual can write, the marriage contract is valid using that written form, just as it is valid using gestures. This opinion has been agreed upon by scholars. 2. Imam Shafi‘i asserts that a marriage contract in written form is valid, provided there is someone who reads it on behalf of the party involved. If no one reads it on their behalf, the contract is considered invalid. Additionally, Imam Shafi‘i deems a marriage contract valid through gestures for those unable to write, although he suggests combining gestures with written representation if possible.

Abstract

هذا البحث يهدف إلى كشف حكم العلاقة الزوجية حين ارتد أحد الزوجين عند الفقهاء المعاصرين ، وهو يدور على المشكلتين رئيستين، وهما: 1) كيف حكم العلاقة الزوجية حين ارتد أحد الزوجين عند الفقهاء المعاصرين ، 2) ما هي الآثر المترتبة حين ارتد أحد الزوجين. كتابة هذا البحث تعتمد على منحج دراسة مكتبية على مرحلتين في إعداده. أما المرحلة الأولى فهي جمع المواد المتعلقة به من كتب الملعاء والمقالات والأوراق العلمية التي تكلمت في الموضوع. وأما المرحلة الثانية فهي تنظيم المواد بطريق نقل الكلام وترتيبه بعد المطالعة والاستقراء في مناسبته في معضوع البحث.ونتيجة البحث هي: 1) أن لا تحل لمسلمة أن تتزوج كافرًا، وإذا ارتد الزوج قبل الدخول، يُبطل النكاح. كما أن الارتداد بعد الدخول، فينتظر حتى انقضاء العدة، وإذا عاد الزوج إلى الإسلام بعد ذلك، يمكن استئناف الحياة الزوجية، وجواز تزويج المسلمة من غير المسلمين الذين ينتمون إلى الكتاب، وأن ارتداد أحد الزوجين سببا للفرقة بينهما، لأن ردة الزوج تُعتبر طلاقا بائنا، وعند عودته إلى الإسلام، يتعين عليه عقد زواج جديد، ويمنع عن تزويجه من امرأة أخرى  إذا لم يكن مسلمًا.2) أن الآثار المترتبة في ارتدد أحد الزوجين منها : أثر اختلاف الدين في نفقة الزوجية، أثر اختلاف الدين في عقيدة الأولاد، وأثر اختلاف الدين في الميراث بينهما

Abstract

Marriage in Islam as worship, follows the Sunnah of the Prophet. In modern society, high costs drive the Marriage in Islam as worship follows the Sunnah of the Prophet. In modern society, high costs drive the demand for loans, to be considered according to the principles of Islamic jurisprudence. This research explores the law of lending for marriage needs in the perspective of Islamic jurisprudence, focusing on financial solutions for new couples. Qualitative research methods with data sources from libraries, online databases, official websites of religious organizations, and electronic journals. The results showed that in the perspective of Islamic jurisprudence, taking a loan for marriage is permissible on the condition of good faith, emergency, and the ability to pay off debts. The views of scholars vary, but the main principle is to maintain chastity and build an Islamic family by avoiding usury. The implementation of loan law emphasizes clear agreements and intentions, without interest or usury, as well as transparency of terms and conditions. Good intentions, halal fulfillment, ability to pay back, and fairness in transactions are key. Maintaining these principles ensures community involvement in lending that adheres to Islamic values, supports financial policies that are in accordance with Islamic ethics and morals, provides long-term benefits to Islamic families and communities. In conclusion, marriage loans in Islamic jurisprudence are permissible on condition of good faith, emergency, and ability to repay. Implementation requires agreement and clear intentions, no interest, upholding Islamic values, and ensuring long-term benefits for Islamic families and communities

Abstract

This study aims to find out the Law and Impact of divorce for pregnant women according to the perspective of Islamic jurisprudence and what will be described in this study based on two formulations of the problem, namely: 1) How the law divorces pregnant women in the perspective of Islamic jurisprudence. 2) What is the impact of divorcing a pregnant woman in the perspective of Islamic jurisprudence. In this study, the method used is the library research method, namely research by reviewing and examining data obtained from literature sources such as books, papers, articles and so on related to legal issues and the impact of divorce for pregnant women, so that precise and clear data will be obtained which then the data is compiled after going through in-depth research. The results of this study show: 1) Divorcing a wife while pregnant is permissible. The majority of scholars agree with this view, including the four imams of the madhhab namely, Imam Hanafi, Maliki, Shafi'i and Hanbali. Referring to the hadith of Ibn Umar. When he rejected his menstruating wife. Then the Prophet (peace be upon him) ordered to refer to her and then divorce when she was chaste or when pregnant and who was not allowed to divorce a pregnant woman was during menstruation, not during pregnancy. 2) The impact caused by the law, pregnant women still get a living when divorced and the iddah period is over when giving birth. As for the psychology of pregnant women losing a sense of security and comfort, discomfort is a form of guilt for leaving a partner who has been coloring her life. After divorce they tend to feel feelings such as uncertainty and loss of identity. From a social perspective, some societies consider divorce as a violation of existing moral norms, so pregnant women may experience social isolation. And from an economic point of view, pregnant women experience changes in economic status, if pregnant women depend financially on their ex-husbands.

Abstract

Marriage is an inner birth bond between a man and a woman as husband and wife with the aim of forming a happy and eternal family (household) based on the One True Godhead. Marriage must be carried out in accordance with the Shari'a and comply with its conditions and harmony. And if it does not meet the conditions and get along well, then the marriage will be void. The formulation of the problem in this study is how the picture of identity forgery in marriage and how the Islamic legal perspective related to marriage annulment due to identity forgery. This research is classified as Library Research research with a qualitative approach, meaning that this research does not go directly into the field in finding data sources. Library research is used to obtain written data relating to the object of research with the intention of being able to analyze identity forgery. The data sources used by researchers are primary data and secondary data then analyzed to obtain conclusions and aim to reveal describing the data obtained. The results of this study are, first: Based on the Law on Marriage No.1 of 1974 Article 2 paragraph 1 where "Marriage is valid, if it is carried out according to the law of each religion and belief", but the marriage will be annulled if it gives false information, false testimony, false letters and other false provisions.  Second: In the perspective of Islamic law and in the eyes of the state falsification of identity in marriage is not justified (legalized), because it is not in accordance with the Shari'a and does not fulfill its pillars and conditions. It can be seen in article 22 of the UUP which reads "Marriage can be annulled if the parties do not meet the conditions for consummating the marriage". Likewise with the hadiths and postulates of shahih and the rules of fiqhiyah that indicate the annulment of the marriage.

Abstract

شهدت السنوات الأخيرة ظهور العملات الرقمية المشفرة، وعلى رأسها "البتكوين"، التي أصبحت من أبرز الابتكارات في عالم المال والتكنولوجيا. هذه العملات، التي تعتمد على تقنيات مثل "البلوك تشين"، تجذب اهتمامًا متزايدًا من المستثمرين على مستوى العالم، نظرًا للفرص التي توفرها في مجالات الاستثمار والتحويلات المالية عبر الحدود. من الناحية الاقتصادية، يُنظر إلى البتكوين كأداة مبتكرة تتمتع بمزايا كبيرة مثل سرعة المعاملات وانخفاض التكلفة مقارنة بالأنظمة المالية التقليدية، بالإضافة إلى كونها وسيلة للتحوط ضد التضخم. ومع ذلك، فإن البتكوين يعاني من تقلبات شديدة في قيمته، مما يعرضه للمخاطر الاقتصادية. كما أن تزايد الاهتمام بالبتكوين يواجه تحديات تنظيمية من الحكومات، التي تسعى لتنظيم تداولاته ومنع استخدامه في الأنشطة غير المشروعة. أما من الناحية الشرعية، فقد أثار البتكوين جدلاً واسعًا في الأوساط الإسلامية. فبينما يرى البعض أنه لا يتعارض مع الشريعة الإسلامية من حيث المبدأ، يعتبره آخرون مخالفًا لبعض أحكام الشريعة مثل الربا أو الغرر بسبب التقلبات الحادة في قيمته وعدم وجود رقابة مركزية. لكن هناك من يرى أن استخدام البتكوين قد يكون مشروعًا إذا تم ضمن إطار قانوني وتنظيمي مناسب. بناءً على ذلك، يتطلب فهم الرؤية الاقتصادية والشرعية للعملات الرقمية المشفرة دراسة شاملة لتأثيراتها على النظام المالي المعاصر ومدى توافقها مع القيم والمبادئ الشرعية، مما يفتح المجال للنقاش حول كيفية التعامل مع هذه العملات في المستقبل.

Abstract

This thesis discusses the Pemmali of Twin Marriages in Sibling Relationships Case Study of Cenning Village, West Malangke District, North Luwu Regency. This study aims to determine and understand the implementation and review of Islamic law in the twin marriage contract of sibling relationships. This type of research is qualitative research with an an empirical and historical juridical approac approach. The data sources used in this research are primary and secondary data. Then the data collection techniques in this research are observation, interviews, and documentation, data management techniques, namely using inductive methods, deductive methods, comparative methods and drawing conclusions. The results of the study found that the implementation of a twin marriage contract in a sibling relationship is the same as a marriage contract general; the only difference is that one of the brides does the marriage contract one day before the reception, and the other bride does the contract on the day of the reception because the people of Cenning village believe that if the marriage contract is carried out simultaneously, it will result in problems from for one of the twin marriage brides. Meanwhile, in the review of Islamic law, pemmali twin marriages in sibling relationships are permissible, because based on the results of research in their implementation.
