Abstract

The purpose of this study is to know and examine matters as follows: Factors that affect the employee job satisfaction in Sub Division Treasury Finance Division Regional Secretariat Kutai Kartanegara and know the most dominant factors affect employee job satisfactionTo analyze the data obtained by researchers using multiple regression analysis tools and SPSS application (Statistic Product and Service Solution) Based on the results of data analysis using SPSS and discussion then the conclusions can be put forward are:The resulting regression equation is Y = 2.779 + 0.030X1 + 0.136 X2. The resulting value is marked positive which means having a direct relationship. The constant value (a) of 2.779 states that if X1 and X2 are equal to zero. Then the satisfaction of cooperation with 2.779 or can be said if there is no variable of employee factor (X1) and job factor (X2) then job satisfaction (Y) equal to 2,779.Result of F test calculation, Fcount value is 4,303 with significance level 0,000. Since probability (0,000) is less than 0.05, regression model can be used to predict job satisfaction, or it can be said that the variable of employee factor and work factor that applied together have an effect on job satisfaction.The value of R Square (Determination R or R2) shows the number of 0.806 from 8982, thus it can be said that the independent variables of employee and occupational factors have an influence of 0.806 or 8.06% have the level of variable relations factor employee and job factors against job satisfaction is very strong. Based on the above description, the first hypothesis has been presented.Result of t test calculation between employee with job satisfaction, it can be seen that thitung> ttable or 2,815> 2,021 with significance level 0,000 <0,005, indicate that tcount> ttable or 2,743> 2,021 with significance level 0,001 <0,005 meaning work variable variable partially significantly indicating its effect on job satisfaction. So variable of employee factor have the most dominant influence influence job satisfaction compare of work factor variable. Thus the second hypothesis that the researcher submitted was accepted.

Abstract

The Covid-19 pandemic does bring a variety of phenomena that occurs in the community, ranging from the social, economic, health, and others. One of the phenomena that occurs in the community is in the north Sumatra area. According to the news published, the North Sumatra Regional Police has appointed five employees at PT Kimia Farma Diagnostika as suspects in the case of recycling covid-19 antigen rapid test equipment at Kualanamu Airport.The method which was used in this Scholar Paper was Qualitative Research Method, a kind of Normative Legal Writing which was based on prescriptive library research concerning study of positive law. For the Primary Legal Materials, Scholar used references such as Act Number 8 Year 1999 regarding to Consumer Protection, etc. And for Secondary Legal Material, Scholar uses books, journals, papers, newspapers, and report of legal writing. Then, for Tertiary Legal Materials, Scholar used references such as legal dictionary, dictionary Indonesian-English dictionary and vice versa, etc.Consumer has rights that must be protected from legal perspectives.  Law Number 8 of 1999 concerning Consumer Protection Article 1 point (2) states that consumers are every user of goods and or services available in society, whether for the benefit of themselves, family, others, or other living beings and not for trading. It is crystal clear as regulated by our legislation, Consumer Protection must have a guarantee of legal certainty given to consumers in this case is passengers as consumers of covid-19 antigen rapid test equipment recycling does not get guaranteed legal certainty because the Covid-19 antigen rapid test tool they receive is used goods, unhygienic anymore.Try to imagine if the rapid test tool that has been used is used by passengers whose health condition is not good (in a sick condition orcarrying certain viruses or bacteria) and it transmits to the next passenger who uses the recycling of the Covid-19 antigen rapid test tool. No one can guarantee this because it is the act of selling recycling tools rapid test antigen Covid-19 is an illegal act (unlawful or not justified according to the law).Related to this case, the Government should internalize the production and distribution process of the swab tool in order to ensure the quality of its products so as not to defect or used. Moreover, this product is distributed in large quantities and in the pandemic period also so that it must be extra supervision so as not to be misused by irresponsible parties so that points can be met properly.

Abstract

Konflik pertanahan yang terjadi di Indonesia yaitu penyerobotan tanah. Penyerobotan tanah terdiri dari dua kata yaitu penyerobotan dan tanah. Menurut kamus besar bahasa indonesia (KBBI) kata penyerobotan berasal dari kata dasar serobot yang artinya sebuah tindakan mengambil hak dengan tidak mengindahkan hukum atau aturan. Penyerobotan tanah adalah praktik menggunakan harta benda atau hak orang lain tanpa persetujuan orang tersebut atau melanggar hukum, seperti ketika seseorang menempati harta milik orang lain tanpa izin. Perampasan tanah merupakan perilaku ilegal yang termasuk dalam kategori kejahatan. Menurut pengertian di atas, penyerobotan tanah adalah perampasan hak orang lain secara tidak sah. Hal ini dapat mencakup perambahan terhadap properti, memasang pagar, mengusir pemilik tanah yang sah, dan taktik lainnya. Perampasan tanah akan menimbulkan kerugian bagi pihak lain, sehingga pelanggar dapat diadili. jenis penelitian yang digunakan adalah jenis penelitian hukum normatif atau penelitian hukum kepustakaan dikarenakan yang berupa data sekunder seperti Perundang- VOLUME 9 No. 1 JUNI 2024 ISSN CETAK 2597-968X ISSN ONLINE 2548-8244 114 Undangan dan buku-buku literatur. Dalam hukum pidana positif, penyerobotan tanah merupakan tindakan stellionaat atau kejahatan yang berkaitan dengan penggelapan harta tidak bergerak milik orang lain seperti tanah, sawah, rumah, dan sebagainya. Sementara penyerobotan tanah bisa didefinisikan sebagai perbuatan merebut atau menguasai tanah milik orang lain. Sanksi mengenai tindak pidana penyerobotan tanah dalam hukum pidana positif diatur dalam pasal 385 KUHP dimana diancam dengan pidana penjara maksimal 4 tahun.

Abstract

Penelitian ini dilakukan di Samarinda, Kalimantan Timur dengan metodeperpustakaan. Tujuan dari itu bersedia untuk mengetahui donor korupsi oleh AnasUrbaningrum, mantan ketua partai Demokrat. Hal ini diambil pada tahun 2014 dariKaltimpost. Hasilnya bahwa ada beberapa proyek di Indonesia rusak oleh Anas danteman-temannya di antara adalah: proyek Hamblang Youth Centre, e-KTP, pesawatMerpati, bangunan pajak, East Kaltim listrik, pendidikan dan pelatihan dengan anggarantryliun. Proyek-proyek melibatkan beberapa petugas. (1). Beberapa suara dari korupsipenerimaan ilegal uang dan materi, (2). Untuk memenangkan pengadilan adalahkesempatan kecil (3). suatu akuntabilitas dedikasi untuk negara, kelompok atau individuluar biasa (4). bersalah akan terbukti di pengadilan. (5). Jika terbukti benar itu adalahtindakan yang buruk dari Anas. Saran-saran (1). The komisi korupsi harus memecahkanbenar-benar dengan mengambil bersalah dengan aktor, (2). Uang rusak harus diberikankembali ke negara tersebut, (3). Lembaga kontrol harus bekerja keras, (4). Para aktorharus dikirim ke penjara dan dihukum sekeras mungkin. (5). Jika ada bukti ia harusdirehabilitasi.

Abstract

Liability in sea transportation concerning loading and unloading of goodsis very important and is closely related to the rights and obligations of theparties. Therefore, separate regulations regarding sea transportation areneeded, both regulated by the international world and nationalregulations.One of the disputes that often arise in sea transportation is the damage togoods which raises the right of claim for compensation from the owner ofthe goods to the carrier. The emergence of claims from the owner of thegoods in the form of damage to the goods, it is important to pay attentionto the parties involved in the transportation process to be able todetermine which party is really responsible for claims for compensationfor damage to the goods.The purpose of this study is to determine the implementation of loadingand unloading of goods carried out in the Port of Samarinda and todetermine the responsibility of employers for losses incurred in theprocess of loading and unloading at the Port of Samarinda.The study uses normative juridical research methods and techniquesnamely library research and document research.The results of this study are (1) The loading and unloading business atports as an integral part of the port management system in Indonesia isstated in PP No. 2 of 2010 concerning Transportation on Water. Based onthis PP, loading and unloading activities from and to ships are carried outby shipping companies through the loading and unloading business units.(2) In Article 180 Paragraph 1 states that the transport company in thewater transport company is responsible for the safety and security of thepassengers and / or the goods they transport. Then Article 180 Paragraph2 states that the water transport company is responsible for the cargo ofthe ship in accordance with the type and amount stated in the cargo document and / or the agreed transportation agreement or contract. Thisform of protection is intended to protect and maintain the integrity andsecurity of transported goods during loading and unloading activities

Abstract

UUK dan PKPU sudah mengatur tentang kepailitan BUMN namun hal tersebut masih terbatas pada BUMN yang bergerak dibang kepentingan publik. Pengertian BUMN yang bergerak dibidang kepentingan publik hampir sama dengan pengertian Perum. Terlepas dari hal tersebut, BUMN Persero sangat berbeda dangan Perum. BUMN Persero sebagimana disebutkan dalam Pasal 1 angka 2, adalah BUMN yang berbentuk Perseroan Terbatas yang modalnya terbagi dalam saham yang seluruhnya atau paling sedikit 51% sahamnya dimiliki oleh negara yang tujuan utamanya mengejar keuntungan. Rumusan masalah dalam penelitian ini, bagaimana landasan yuridis terkait dengan permohonan pailit terhadap perusahaan BUMN yang berbentuk Perseroan Terbatas dan bagaimana akibat hukum jika perusahaan BUMN yang berbentuk Perseroan Terbatas dipailitkan. Metode penelitian yang penulis gunakan merupakan jenis penelitian yuridis normatif. Hasil penelitian menunjukan bahwa bila BUMN tersebut berbentuk Persero adalah tidak harus Menteri Keuangan yang mengajukan permohonan pailit akan tetapi dapat oleh debitor itu sendiri atau kreditornya sebagaimana ketentuan Pasal 2 Ayat (1) UUK dan PKPU. Akibat hukum yang timbul dari kepailitan adalah debitor kehilangan hak menguasai kekayaannya tetapi terhadap perbuatan hukum dalam bidang keperdataan tidak berhenti.

Abstract

Dalam menanggulangi kejahatan cybercrime dalam bentuk pornografi melalui duniamaya, Indonesia telah mengeluarkan suatu kebijakan hukum dalam bentuk Undang-Undang yaitu Undang-Undang Nomor 44 Tahun 2008 tentang pornografi dan Undang-Undang Nomor 19 Tahun 2016 tentang Informasi dan Transaksi Elektronik perubahan atas Undang-Undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik. Indonesia telah mengeluarkan suatu kebijakan hukum yang mengatur tentang sanksi pidana, tidak berarti bahwa kejahatan pornografi dalam dunia maya hilang begitu saja. Dalam menanggulangi kejahatan cybercrime dalam bentuk pornografi melalui dunia maya, Indonesia telah mengeluarkan suatu kebijakan hukum dalam bentuk Undang-Undang yaitu Undang-Undang Nomor 44 Tahun 2008 tentang pornografi dan Undang-Undang Nomor 19 Tahun 2016 tentang Informasi dan Transaksi Elektronik perubahan atas Undang-Undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik. Indonesia telah mengeluarkan suatu kebijakan hukum yang mengatur tentang sanksi pidana, tidak berarti bahwa kejahatan pornografi dalam dunia maya hilang begitu saja. Jenis penelitian ini adalah penelitian hukum normatif dengan pendekatan Undang-Undang dan konseptual. Menggunakan sumber bahan hukum primer, sekunder dan bahan non hukum. kemudian bahan hukum diolah dengan cara deduktif lalu menariknya menjadi kesimpulan yang lebih khusus dan disusun secara sistematis. Hasil dari penelitian bahwa sebelum Undang-Undang Pornografi dan Undang-Undang Informasi dan Transaksi Elektronik diterbitkan kejahatan tentang kesusilaan diatur dalam pasal 281, pasal 282 ayat (1), Pasal 283 ayat (1) KUHP. Akan tetapi setelah lahirnya Undang-Undang Republik Indonesia Nomor 44 tahun 2008 tentang pornografi maka aturan kesusilaan seperti di dalam KUHP diatas telah dikesampingkan sebagaimana asas hukum lex specialis derogat, lex specialis generalis. Dan Upaya pemerintah dalam menanggulangi pornografi dalam dunia maya di Indonesia adalah menutup dan mencekalkonten-konten pornografi dalam dunia maya khususnya internet dan pemberi sanksikepada pihak-pihak yang dengan sengaja mepertontonkan dan/atau memuat tentang pornografi dalam dunia maya. Saran dari penulis adalah Pemerintah seharusnya melakukan upaya harmonisasi/merevisi diantara Undang-Undang yang mengatur tindak pidana pornografi dunia maya, seperti Undang-Undang Republik Indonesia Nomor 44 Tahun 2008 tentang pornografi dan Undang-Undang Republik Indonesia Nomor 19 tahun 2016 tentang Informasi dan Transaksi Elektronik.

Abstract

The aim of this research is willing to know the proof of the corruption action at theDepartment of Health.  The location is at department concerned almost in Indonesia in2016  by  taking  news  from  the  newspapers  such  as  television,  radio  and  daily newspapers local and national as well.  The results of it are (1).The corruption at the health service is very cruel and unhuman because the ill persons were being the object of it,(2). The corruptors are all any levels of the officers,(3).The way of corruption is very complicated and creative,(4). Fortunately the staffs   f the corruption staff are intelligent,(5).The officers who corrupt  cleverly are in the regional areas,(6). The sum of the corruption is fantastic.The suggestions are (1). To give the staffs in the health departments more welfare,(2).To control the projects seriously,(3).To limit the occasion for corrupting ,(4).To give tauziah to the officers.

Abstract

The problem in this study is the position of children born from marriageunder the hands and how the rights of children to inheritance frommarriage under the hands based on Law Number 1 of 1974 concerningMarriage. Underhand marriage is still happening in Indonesian society.Submarine marriage is a marriage that does not register the marriage tothe authorized institution, namely the Office of Religious Affairs forMuslims and the Civil Registry for non-Muslims. In Article 2 paragraph(2) of Law Num ber 1 of 1974 it is stated that a new marriage is valid if itis carried out according to the laws of each religion and its beliefs.However, the validity of marriage in the eyes of religion and public trustneeds to be ratified by the state in order to have legal force.The consequences of marriage under the hands are very bad forthe wife and for children born both legally, socially and psychologically.Other problems that can be caused from marriage under the hands are therights and obligations of husband and wife who are not guaranteed in fullfrom the State. The provisions in Article 42 paragraph (1) of Law Number1 Year 1974 concerning Marriage state that a legitimate child is a childborn from or as a result of a legal marriage. So it can be concluded thatchildren born from underage marriages are illegitimate children or out ofwedlock children. From the results of the research discussion it is knownthat Based on the Decision of the Constitutional Court Number 46 / PUUVIII/ 2010 Testing of Law Number 1 of 1974 concerning Marriage to theState Constitution of the Republic of Indonesia Year 194. It is said thatchildren born outside marriage have a civil relationship with his motherand his mother's family and with his man as his father that can be provenbased on science and technology and / or other evidence so according tothe law he has a blood relationship, including a civil relationship with hisfather's family

Abstract

During its development, a house sale and purchase agreement made by the parties by a notary public creates rights and obligations as well as risks for the parties later. Before the agreement is agreed upon, the parties express their wishes or wishes so that the objectives of the house sale and purchase agreement are achieved, so that when the agreement is implemented, all of these rights and obligations must be fulfilled by the parties to fulfill each other's wishes. The House Sale and Purchase Agreement when viewed from the latest legal rules, namely, the Regulation of the Minister of Public Works and Public Housing (PUPR) of the Republic of Indonesia, issued a Ministerial Regulation (Permen) PUPR Number 11 / PRT / M / 2019 concerning the Preliminary House Buying Agreement System. This regulation was signed by the Minister of PUPR, M. Basuki Hadimuljono, on July 12, 2019. This regulation regulates the sale of houses or flats by developers to the community. The issues raised in this paper are how the legal protection for home buyers is based on the Ministerial Regulation (Permen) PUPR Number 11 / PRT / M / 2019 and what are the legal requirements that home developers must have in selling their products based on Ministerial Regulation (Permen) PUPR Number 11 / PRT / M / 2019. The type of research used is juridical normative, which is research conducted based on legal materials and by collecting data, studying books in the library and the laws and regulations related to this research. The results of research by developers or housing developers that are legal entities who sell single houses, row houses and flats that are sold to the community by means of cash or credit, in terms of credit, there are many problems caused in terms of payments, broken promises, and inadequacy of development.
