Komunikasi merupakan elemen fundamental dalam proses pendidikan karena melalui komunikasi terjadi penyampaian informasi, pembentukan pemahaman, dan interaksi edukatif antara pendidik dan peserta didik. Namun dalam praktiknya, proses komunikasi sering menghadapi berbagai hambatan yang berdampak pada efektivitas pembelajaran. Artikel ini bertujuan untuk menganalisis bentuk-bentuk hambatan komunikasi dalam pendidikan, seperti hambatan psikologis, linguistik, lingkungan, budaya, serta hambatan penggunaan teknologi pada era digital. Selain itu, artikel ini membahas strategi alternatif untuk mengatasi hambatan tersebut melalui pendekatan pedagogis, penggunaan media pembelajaran, peningkatan kompetensi komunikasi guru, serta penguatan hubungan interpersonal dalam lingkungan sekolah. Dengan memahami hambatan komunikasi dan cara mengatasinya, diharapkan proses pembelajaran dapat berjalan lebih efektif, komunikatif, dan berpusat pada peserta didik.

Abstract

This study discusses the rampant spread of online gambling advertisements in Indonesia, which contravenes the Criminal Code (KUHP) and Law No. 11 of 2008 on Electronic Information and Transactions (UU ITE) and its amendments, which prohibit gambling. Law enforcement faces significant challenges, one of which stems from the self-regulatory policies of Electronic System Operators (ESOs) for User-Generated Content (UGC), which do not fully prohibit online gambling advertisements. The objective of this study is to analyze the spread of such advertisements and the legal framework governing ESOs for UGC based on cyberlaw provisions. The methods used include a normative legal approach to examine principles, theories, and legal history, as well as a sociological legal approach utilizing secondary data through the integration of legal and social sciences. This research is descriptive-analytical, using data from literature reviews and semi-structured interviews. The results of the study indicate that the spread of online gambling advertisements is driven by the advertising features of PSE UGC and the weak effectiveness of existing self-regulatory policies. Additionally, the government is deemed to have been lenient in imposing administrative, criminal, or civil sanctions on PSE UGC, exacerbated by the ambiguous provisions of the Criminal Code (KUHP) and the ITE Law regarding gambling regulations. The research recommendations are for the government to pressure PSE UGC to strengthen internal policies regarding the prohibition of online gambling content, enforce administrative sanctions strictly, and revise ambiguous phrases in the Criminal Code and ITE Law to clarify regulations and strengthen law enforcement efforts against the spread of online gambling advertisements in Indonesia.

Abstract

The practice of naming rights through trademark licensing agreements on public facilities has become a common commercialisation strategy in Indonesia. However, when the object of naming rights is a public facility with cultural heritage status, legal uncertainty arises due to the absence of specific regulations governing the intersection between Law No. 20 of 2016 concerning Trademarks and Geographical Indications and Law No. 11 of 2010 concerning Cultural Heritage. The objective of this study is to analyse the regulation of naming rights on public facilities with cultural heritage status and to identify any differences in the application of trademark law in the cases of Semarang Tawang Station and Cirebon Kejaksan Station. The study employs a normative juridical method, utilising secondary data collection techniques and is supported by tertiary legal materials, employing a legislative, analytical and comparative approach. The results of the study indicate a discrepancy in the regulatory framework for naming rights concerning cultural heritage, leading to legal ambiguity due to inconsistent implementation. This is exemplified by the contrasting outcomes at Semarang Tawang Station, where the naming rights agreement with Bank Jateng was successfully executed, and at Cirebon Kejaksan Station, where the agreement was terminated despite both stations possessing cultural heritage status. The study recommends the introduction of comprehensive special regulations to harmonise the protection of exclusive trademark rights with the preservation of the identity and historical value of cultural heritage sites.

Abstract

The digital transformation of education in Indonesia presents both strategic opportunities and significant ethical challenges. On the one hand, technological innovation expands access, effectiveness, and quality of learning; on the other hand, it risks creating social disparities, the commercialization of education, and the reduction of human values. In this context, Pancasila is considered relevant as an ethical paradigm that guides the direction of digital transformation to remain grounded in humanity, social justice, and sustainability. This study aims to analyze Pancasila as an ethical framework for directing the development of educational technology in Indonesia. The method employed is a literature review with a qualitative-descriptive approach, drawing on philosophical sources, educational policy documents, and practices of digital technology implementation at various educational levels. The analysis reveals that the values of Pancasila, particularly the second and fifth principles, can serve as normative foundations for shaping policies, design, and practices of educational technology that are humanistic, inclusive, and equitable. The study concludes that integrating the Pancasila paradigm is not only ideologically essential but also strategically significant in ensuring that the digital transformation of education in Indonesia aligns with national objectives and human dignity.

Abstract

The rapid growth of global digital technology has significantly reshaped social, economic, and legal systems. This transformation presents new challenges for states in fulfilling their legal responsibilities toward digital consumer protection amid the emergence of global citizenship. This study aims to analyze the forms of state responsibility in protecting digital consumer rights through legal and transnational ethical perspectives. Using a normative juridical method with conceptual and statutory approaches, this research focuses on national legal instruments such as Indonesia’s Personal Data Protection Act No. 27 of 2022 and regional policies such as the ASEAN Digital Framework Agreement 2025. The findings reveal that states bear dual responsibilities: protecting citizens’ digital rights domestically and adhering to international norms globally. This responsibility involves law enforcement against data violations, policy harmonization, and the strengthening of digital ethics. The study concludes that cross-border cooperation and ethical integration are essential to ensure fair and sustainable digital governance.

Abstract

The film "Ranah 3 Warna" (Ranah 3 Warna) is adapted from the novel "Ranah 3 Warna" by Ahmad Fuadi. "Ranah 3 Warna" explores various aspects of human life. It depicts how differences in social class can lead to conflict. The researcher aimed to determine how social class is portrayed in the film. The purpose of this study was to determine how the film "Ranah 3 Warna" represents, displays, and conveys messages about social class. Based on this, the researcher chose this film for research and analysis using Karl Marx's class theory. This research method employed a qualitative research design with a descriptive study approach. Data collection in this study utilized library research. The approach used in this study was content analysis, with the researcher employing purposive sampling to obtain more in-depth data. The results of this analysis show scenes in the film that present social conflict through scenes and conflicts, particularly those involving the main characters. The Randai family represents the upper class and the Alif family represents the lower class, leading to several social inequalities.

Abstract

This study discusses Ahmad Muhammad Mustain Nasoha’s perspective on Human Rights (HAM) and the Democratic Rule of Law, emphasizing the relationship between national law and Islamic law in ensuring human dignity and justice. Using a qualitative method and literature study approach, this research analyzes the interaction between citizenship, human rights, and democracy within Indonesia’s legal framework. The study reveals that both national and Islamic law aim to protect individual rights and maintain justice, though they differ in philosophical foundations and application. National law defines citizenship and human rights through constitutional and legal frameworks, while Islamic law bases them on divine principles emphasizing moral and social responsibility. The integration of these two legal systems is essential to realize a democratic state that upholds human values, social justice, and equality. The study concludes that harmonizing Islamic law with Indonesia’s national law strengthens the implementation of human rights and supports the development of a just and democratic legal state.

Abstract

The rise of the phenomenon of early marriage in Indonesia is the background to the birth of Republic of Indonesia Law number 16 of 2019 concerning marriage and the compilation of Islamic law, which sets the age limit for marriage to 19 years. The reality is that in society there are many cases asking to be able to get married and have it officially registered, which has led to the existence of a marriage dispensation. Marriage dispensation is permitted by law by considering positive matters. The aim of this study is to determine the long-term impact of early marriage on the welfare of individuals, families and society. The method used is qualitative, data collection is carried out by interviews, direct observation and also data related to the theme. Using this method will make it easier to observe phenomena in society regarding marriage dispensations. The data analysis used was an inductive method (Creswell, 1994). The results obtained were that the marriage dispensation from a legal perspective did not conflict with Law 16 of 2019. The granting of marriage dispensations was carried out by considering the impact. From a sociological perspective, our society views early marriage as something normal and often forgets the impact of child marriage. Marriage dispensation is a rational choice, even though the risks faced are very high. Therefore, it is necessary to increase public awareness of promiscuity and return to the essence of marriage.
