Abstract

Corruption is a global issue that significantly impacts social, economic, and political aspects, particularly in developing countries like Indonesia. It undermines public trust in government institutions and contributes to social injustice, slowing economic growth and hindering overall welfare. This paper focuses on preventing corruption among the younger generation, highlighting key measures such as anti-corruption education in schools, the effective use of social media campaigns, and necessary reforms in law enforcement. By instilling values of integrity and responsibility early on, educational institutions can help shape future leaders who are prepared to combat corruption. Additionally, the effective use of social media platforms like Instagram, TikTok, and YouTube can engage the younger generation through creative and interactive content, fostering awareness and encouraging active participation in anti-corruption efforts. Reforming law enforcement to impose stricter penalties on corrupt individuals and providing protection for whistleblowers are crucial to creating a deterrent effect. Ultimately, a comprehensive approach involving education, technology, and legal reform can empower the younger generation to promote transparency and integrity, contributing to a corruption-free society and a stronger foundation for the nation’s future

Abstract

Preventing acts of corruption in the office environment involves a series of strategic steps to create a culture of transparency and accountability. These efforts include implementing a code of ethics, training on integrity, and strict supervision of the decision-making process. In addition, the application of information technology to monitor financial transactions and reports can help detect potential fraud. By building awareness and commitment of all employees towards preventing corruption, organizations can increase public trust and create a healthier work environment. Preventing acts of corruption in the office environment is a crucial step in creating good governance and improving institutional integrity. Corruption can hinder economic growth and damage public trust. To prevent this, a comprehensive approach is needed, including implementing transparency policies, strengthening supervisory systems, and ethical education for employees. In addition, an organizational culture that supports openness and accountability must be built. This research discusses effective strategies that can be implemented to minimize the risk of corruption, including the use of information technology and participation in community oversight. The results are expected to provide recommendations for government and private agencies in strengthening efforts to prevent corruption

Abstract

This study seeks to examine the legal vacuum surrounding regional head elections that feature only a single candidate, as well as the legal implications that arise from this scenario. In a democratic system, the principle of popular sovereignty necessitates a fair and free electoral process; however, the absence of clear regulations for regional head elections with a solitary candidate can jeopardize the integrity of this principle. Employing a normative legal methodology with both legislative and conceptual approaches, this study investigates various regulations that govern regional head elections and assesses how this legal vacuum impacts the electoral process and the constitutional rights of citizens. Additionally, the study identifies several strategies to address the legal vacuum, which include establishing clear legal provisions for the election process involving a single candidate, implementing a plebiscite mechanism, and enhancing transparency throughout the electoral process. The findings suggest that a more definitive and explicit legal framework is essential to uphold the principle of popular sovereignty in regional head elections featuring a single candidate.

Abstract

This study aims to compare the bankruptcy application procedures between State-Owned Enterprises (BUMN) and Regional-Owned Enterprises (BUMD). Bankruptcy is a condition that significantly impacts economic stability, both nationally and regionally. In this case, both types of enterprises are regulated by different regulations but with similar underlying principles. Therefore, this research examines the differences and similarities in bankruptcy procedures for BUMN and BUMD, as well as the authority each possesses in the bankruptcy application process. Additionally, this study highlights the importance of harmonizing regulations governing bankruptcy procedures to ensure the coherence of the prevailing legal system. The research method used is normative legal research with a legislative approach and a conceptual approach. This research reveals that although there are similarities in objectives, significant procedural differences require adjustments to create uniformity and legal certainty in resolving bankruptcy issues for both types of enterprises.

Abstract

This study explores the intersection of citizenship and land tenure, examining how legal frameworks influence access to land and impact social identities within agrarian contexts. Employing doctrinal legal research, this research synthesizes literature and analyzes primary legal sources to uncover the principles governing land rights as they relate to citizenship status. The study utilizes a combination of statutory, case, conceptual, historical, and comparative approaches to provide a comprehensive view of land tenure systems across different regions and cultures. Findings indicate that citizenship status significantly affects land ownership and tenure security, often marginalizing certain groups such as women, indigenous communities, and non-citizens. The results underscore the need for legal reforms that recognize equitable land rights and address social disparities within land governance frameworks. This research contributes to the ongoing discourse on agrarian law, advocating for policies that prioritize social justice and inclusivity, thereby enhancing sustainable development and resource management.Keywords: agrarian law, land ownership rights, citizenship dynamics, Indonesian citizens, legal framework.

Abstract

This study explores the social perceptions of dual citizenship in Indonesia from the perspectives of both Indonesian citizens and non-citizens, and compares these views with practices in other countries. Employing a descriptive qualitative approach, the research utilizes in-depth interviews, focus group discussions (FGDs), and surveys to gather data from diverse stakeholders. The findings reveal that in Indonesia, dual citizenship is often perceived as a threat to national identity and unity, primarily due to concerns about divided loyalties. Conversely, non-citizens view dual citizenship as advantageous for accessing various services and opportunities. Comparative analysis with countries such as Germany and Canada shows that dual citizenship policies can be accepted and even considered beneficial for social integration and international relations. Based on these findings, policy recommendations include reforming citizenship laws, adjusting legal and regulatory frameworks, enhancing public awareness, providing support for individuals with dual citizenship, and conducting further research to explore the long-term impacts of dual citizenship.

Abstract

This research aims to determine the process of canceling a land sale and purchase by the seller because the buyer defaulted, the legal consequences of canceling the land sale and purchase agreement by the seller because the buyer defaulted. The research method used in this research is descriptive analytical. The research results of the sale and purchase agreement process are valid and have binding force since an agreement is reached between the seller and the buyer. The sale and purchase agreement is based on the validity of the contract and other agreement principles. An agreement can be null and void (van rechtswege neiting) or can be canceled (vernietigbaar), if an agreement does not meet the requirements specified in accordance with Article 1320 of the Civil Code, namely if it does not fulfill subjective requirements (they agree to bind themselves, are competent to make an agreement) and objective conditions (a certain thing, a lawful cause). The legal consequences that arise for the buyer if they default, the buyer is required to pay compensation for losses suffered by the seller, pay court costs if sued in court, and fulfill the agreement if it continues.

Abstract

This research examines the issue of contract marriages in Indonesia, focusing on the legal gaps that result in uncertainty and negative impacts on women and children. Despite the increasing prevalence of contract marriages, there is no clear regulation in the Marriage Law or criminal law governing this practice, placing individuals involved in vulnerable positions, especially women who are often victims of exploitation and violence. Through an analysis of existing regulations and their impact on social structures, this study highlights the need for legal reform, including the revision of Law No. 1 of 1974 on Marriage and the formulation of specific legislation to prohibit contract marriages. This research also recommends strengthening the oversight system, law enforcement, and providing protection services for women and children to create a safer and more equitable environment.

Abstract

This research aims to explore and reconstruct the legal protection policy for justice collaborators in corruption crimes in Indonesia. Although their existence is vital in combating corruption, many perpetrators are reluctant to come forward due to uncertainty in protection and the potential risks they face. Weaknesses in the existing policies, including a lack of transparency and adequate security guarantees, hinder perpetrators from collaborating with law enforcement. Therefore, this research identifies various challenges faced by justice collaborators and highlights the importance of comprehensive legal protection reform. This study offers recommendations for appropriate and effective legal protection efforts for justice collaborators in handling corruption cases. By analyzing protection practices in other countries and applying restorative justice principles, this research aims to provide solutions that not only protect justice collaborators but also enhance public trust in the justice system. It is hoped that the results of this research can contribute to formulating more effective and responsive policies to meet the protection needs of justice collaborators in Indonesia, encouraging more perpetrators to bravely come forward in the fight against corruption.

Abstract

The sustainability of the agribusiness sector is very dependent on the certainty of land rights, which is the main asset for business actors in this sector. Land registration is an important instrument in providing legal certainty for land ownership, which can ultimately encourage stable and sustainable agribusiness development. This article discusses the role of land registration in protecting ownership rights for agribusiness actors in Indonesia and analyzes the role of government policies, such as the Complete Systematic Land Registration Program (PTSL), in speeding up the land certification process. With legal certainty obtained through land certificates, agribusiness actors can avoid agrarian conflicts, gain access to financing, and run businesses more safely and in a planned manner. Apart from that, land registration policies also have the potential to support regional economic development, reduce agrarian conflicts, and encourage sustainable management of land resources. However, implementing this policy still faces challenges, including bureaucratic obstacles and low public understanding. Therefore, the government's role in improving policies and overcoming existing obstacles is very necessary to create an inclusive, competitive and sustainable agribusiness sector in Indonesia.
