Tasyri Jurnal Muamalah dan Ekonomi Syariah is a scientific journal published by the Faculty of Economic and Islamic Law, Institut Agama Islam Pangeran Dharma Kusuma Indramayu, twice a year in January and July. The journal will focus on providing quality research in the areas of Islamic economics and muamalah. Specifically, the journal will deal with topics, including (but not limited to): Islamic economics law, Islamic banking law, Islamic finance law, Islamic accounting law, Islamic microfinance law, Zakah, waqf, and philanthropy.

Abstract

Islamic ethics play a crucial role as a foundation for inclusive and just economic development. Concepts such as justice, honesty, and balance in Islamic teachings form the basis for economic principles that prioritize social interests and fair distribution. This research examines how Islamic ethical principles can be implemented in the context of modern economic development to create social inclusion and justice. The study uses a qualitative approach to delve into the understanding of the foundations of inclusive and just economic development based on Islamic ethical principles. Through theoretical analysis and case studies, the research shows that the application of Islamic ethics in economic policy can enhance accessibility, equality, and community participation in the economic process. Islamic ethics provide a holistic and sustainable perspective on economic development. The principle of justice in Islam encompasses not only equality of opportunity but also emphasizes fair distribution of wealth and economic outcomes. Community empowerment is emphasized as a means to ensure active participation in economic decision-making and equitable distribution of economic benefits. Additionally, the concept of social responsibility and the harmony between spirituality and materialism offer a comprehensive view of the relationship between humans, the environment, and the economy. Abstract

Ethics and Islamic law play a crucial role in shaping morality and legal order within Muslim societies. In the context of corruption and nation-building, effective strategies that integrate ethical values and principles of Islamic law are pertinent. This article explores key concepts in Islamic ethics and law, analyzing how the implementation of such strategies can combat corruption and advance national development. By considering ethical and legal aspects in Islam, this research underscores the importance of a holistic approach involving education, law enforcement, and institutional development in fostering a just and integrity-driven society.The findings indicate that integrating Islamic ethical values and law is effective in combating corruption by promoting honesty, integrity, and accountability. These values reduce corrupt practices and foster public trust, while Islamic law imposes stringent sanctions on corrupt individuals. However, implementation faces challenges such as resistance, societal awareness deficits, and legal complexities. The solution lies in collaborative efforts among governments, anti-corruption agencies, religious institutions, academics, and communities to address these challenges effectively.

Abstract

This research aims to explore the potential for enhancing socio-economic justice through the implementation of ethics in Islamic law. Using a qualitative approach, the study analyzes concepts of ethics and principles of Islamic law relevant to economic contexts. The findings indicate that principles such as justice, honesty, and social responsibility play a crucial role in creating a fairer and more inclusive economic system. The research also identifies several challenges in implementing ethics within Islamic legal practices, including societal misunderstanding and awareness gaps regarding these concepts, as well as complexities in adapting them to modern economic contexts. Therefore, collaborative efforts are necessary from various stakeholders, including governments, civil society, and the private sector, to address these challenges and promote the implementation of ethical principles in Islamic law in everyday economic life. The research underscores that implementing ethics in Islamic law holds significant potential for enhancing socio-economic justice. Identifying challenges in implementing ethical principles in Islamic law, including lack of awareness and understanding, implementation difficulties, regulatory challenges, and lack of stakeholder cooperation, underscores the complexity yet importance of enhancing socio-economic justice through the implementation of ethics in Islamic law. Abstract

The transformation of the economy through the approach of Islamic ethics and law has been a central focus in contemporary economic discourse. This research explores the impacts of incorporating moral values and principles of Islamic law in reshaping economic paradigms. This approach emphasizes the importance of justice, transparency, and social responsibility within the economic system. In-depth analysis of Islamic economic concepts reveals the potential to address economic inequalities and promote sustainable development. Furthermore, the application of Islamic ethics and law can provide an ethical foundation for responsible and sustainable business practices. The findings suggest that sustainable economic transformation requires the integration of Islamic values with modern economic practices. Relevant policy implications are also discussed to support the implementation of these concepts within the current global economic context. Abstract

This research delves into the crucial role of Islamic morals (Akhlaq Islami) in the legislative process aimed at creating justice in society. The concept of Akhlaq Islami serves as a moral foundation that guides the creation of fair and inclusive laws. This study highlights the importance of values such as honesty, justice, and empathy in the legislative process. By analyzing the cultural and social context of Indonesia, this research identifies how Islamic moral values are reflected in the national legal framework. The study illustrates that the role of Akhlaq Islami in forming just legislation has a significant impact both in the context of Indonesia and globally. Various findings and analyses show that Islamic moral values, such as justice, equality, and humanity, have a strong influence on the policymaking and legislative process. However, the implementation of Akhlaq Islami values still faces several challenges, including discrepancies between Islamic moral principles and the complex political and social realities. Abstract

The integration of Islamic morals (akhlaq Islami) into the national legal system aims to enhance public morality through the enforcement of Islamic moral and ethical values. Akhlaq Islami, which includes principles of honesty, justice, and social responsibility, is considered crucial for application in various aspects of societal life, including the legal system. The implementation of akhlaq Islami in law can strengthen the moral foundation of society, increase legal awareness, and reduce crime rates. This integration also promotes the creation of a more harmonious and just social environment. This research is a qualitative study with a descriptive-analytical approach. The qualitative approach is used because this study focuses on an in-depth exploration of concepts, perceptions, and experiences related to the integration of akhlaq Islami in the national legal system. The research findings indicate that Indonesian society generally supports the integration of Islamic values into the legal system, as they believe that the principles of akhlaq Islami can improve individual morality and legal justice. Although there are concerns about inconsistency and discrimination, public support remains important. Legal education that integrates Islamic values can shape more ethical students, although its implementation is still limited. The main challenges are differences in interpretation, resistance from secular groups, and lack of political support, which require dialogue and cooperation. The role of religious scholars (ulama) and religious institutions is crucial in shaping legal policies that align with Islamic values.

Abstract

Building an Economy Based on Akhlaq and Shariah presents significant challenges and opportunities in the context of current economic globalization. This paper explains the importance of integrating akhlaq and shariah principles in developing a sustainable and just economy. This research uses both qualitative and quantitative approaches to investigate the challenges and opportunities in building an economy based on akhlaq and shariah. The findings indicate that an economy model based on akhlaq and shariah offers a significant alternative to conventional models with principles of distributive justice, environmental sustainability, and financial inclusion that are relevant for building a more just and inclusive society. However, its implementation faces challenges such as a lack of understanding, resistance to change, legal uncertainty, and infrastructure deficiencies. Institutional and regulatory transformation, including the development of shariah-compliant financial institutions and policy reforms, is crucial for creating a supportive environment. Technology, such as fintech and blockchain, can enhance access and efficiency of shariah-compliant financial services. Abstract

Sustainable national economic development requires a strong foundation, not only technically and policy-wise but also ethically. This article discusses the importance of building a national economy based on Islamic morals and laws. The application of Islamic moral values in economic practices can create a more inclusive and sustainable economy. Similarly, Islamic law provides guidelines for transactions and fair wealth distribution. By integrating these principles, society can create a balanced and just economic environment, where blessings and prosperity are evenly distributed. The research findings indicate that Islamic moral and legal economic concepts, such as joint ownership, distributive justice, and prohibition of usury, are highly relevant in the context of national economic development. Some countries have attempted to implement Islamic economic principles in their national policies, though challenges remain. These challenges include mismatches with the dominant global economic system, lack of public understanding and awareness of Islamic moral values, and difficulties in balancing Islamic economic principles with modern economic needs. Despite these challenges, building a national economy on Islamic morals and laws holds significant potential benefits, including a more stable and sustainable financial system, reduced economic inequality, improved public welfare, and strengthened social and moral bonds within society.

Abstract

This research delves into the analysis of the pillars and conditions of ijarah in the multi-service financing of Islamic banks. The primary focus is on implementing Sharia principles in ijarah contracts, which includes identifying the pillars of ijarah such as the contracting parties, leased objects, leased benefits, and conditions to be fulfilled such as clarity of leased objects and agreement on rental prices. The study also highlights challenges faced, such as legal uncertainty, regulatory changes, and customer understanding of ijarah contracts. Proposed solutions include enhancing customer education, refining contract documentation, stricter supervision, collaboration with Sharia legal experts, and product innovation. Based on the analysis of the pillars and conditions of ijarah in multi-service financing at Islamic banks, it is concluded that implementing Sharia principles in financial practices is crucial to ensure compliance with Islamic values. The pillars of ijarah involving the contracting parties (mu’jir and musta’jir), leased objects, leased benefits, as well as the ijab and qabul, and ijarah conditions such as clarity of leased objects, permissible benefits, and agreed rental prices, serve as the primary foundation for maintaining fairness and transparency in transactions.

Abstract

This paper presents an analysis of the validity of Ijarah contracts in multi-service financing within Islamic banking. Ijarah, as a prominent Islamic finance mechanism, serves as a crucial tool in providing financial solutions adhering to Sharia principles. The study examines the applicability and compliance of Ijarah contracts in various multi-service financing scenarios, highlighting their effectiveness in maintaining ethical standards and financial stability.The research identifies several challenges that affect the sustainability and adherence to Sharia principles in Ijarah contracts, including regulatory changes, market fluctuations, and customer awareness of Sharia-compliant products. These challenges necessitate strategic measures to ensure the continued validity and ethical soundness of Ijarah practices in Islamic banking. Recommendations are proposed to enhance the implementation of Ijarah contracts, including increased customer education, flexibility in contract structuring, rigorous internal oversight, collaboration with regulatory authorities, and continuous innovation in product development. These measures aim to strengthen the integrity and viability of Ijarah contracts in multi-service financing, contributing to the sustainable growth of Islamic banking while upholding Sharia principles.
