Abstract

This study discusses consumer protection within the framework of business law in Indonesia, focusing on the imbalance of legal positions between consumers and business actors in modern economic activities. Rapid business development, including conventional and digital transactions, often places consumers in a vulnerable position due to limited information, unequal bargaining power, and the use of standard contracts imposed unilaterally by business actors. The purpose of this research is to analyze the concept and regulation of consumer protection, identify forms of legal protection provided to consumers, and examine the role of consumer protection law in creating a balance of interests between consumers and business actors. This research employs a normative juridical method with a descriptive-analytical approach, using statutory regulations, legal literature, and previous studies as sources of data. The results show that consumer protection in Indonesia is comprehensively regulated under Law Number 8 of 1999 concerning Consumer Protection, which guarantees consumer rights, regulates business actors’ obligations, and provides dispute resolution mechanisms. Effective implementation of consumer protection law is essential to ensure legal certainty, enhance consumer trust, and promote fair and sustainable business practices.

Abstract

The rapid development of the business world driven by globalization and technological advancement has significantly transformed business activities, including the emergence of digital transactions and electronic contracts. These changes demand legal certainty to ensure fairness, order, and protection for all parties involved. This paper aims to analyze the role of business law in providing legal protection for business actors, regulating business agreements, resolving business disputes, and responding to challenges in digital business practices in Indonesia. The method used in this study is a normative juridical approach through the analysis of laws and regulations, legal doctrines, and relevant literature related to business law. The results show that business law plays a crucial role in ensuring legal certainty through contract regulation, promoting good faith and trust between parties, and providing dispute resolution mechanisms through litigation and non-litigation channels. Furthermore, business law has adapted to digital business developments by recognizing the legal validity of electronic contracts and emphasizing consumer protection and data security. Therefore, effective implementation of business law is essential to create a healthy, secure, and sustainable business environment in Indonesia.

Abstract

This research analyzes property law under the Civil Code, property rights and the principles that underlie them, the position of ownership rights as the most complete form of property rights, and pledge rights as one form of security rights. Property law is an important part of civil law because it regulates legal relations between legal subjects and the objects of rights. Property rights aim to create legal certainty, order, and protection for the parties in civil legal relations. This study uses a normative legal method with statute and conceptual approaches to analyze ownership and property rights. The results of the research show that the classification of objects greatly affects legal status and proof of ownership. Property rights are absolute in nature and are protected by the principle of publicity, the principle of totality, and the principle of legal certainty. Ownership rights form the basis for other property rights, with mechanisms for acquiring and losing rights regulated by law. In addition, pledge rights give priority to creditors and provide ease in the execution process, thus playing an important role in maintaining a balance of interests and legal certainty in civil legal relations.

Abstract

Sistem hukum Indonesia membatasi kepemilikan tanah bagi Warga Negara Asing (WNA) untuk menjaga kedaulatan negara atas sumber daya agraria. Namun, negara tetap menyediakan ruang bagi kebutuhan investasi dan hunian jangka panjang melalui pemberian hak pakai. Pengaturan utama terdapat dalam PP No. 103 Tahun 2015 dan PP No. 18 Tahun 2021, yang sama-sama menetapkan jangka waktu hak pakai bagi WNA selama 30 tahun, dapat diperpanjang 20 tahun, dan diperbarui 30 tahun, dengan total maksimum 80 tahun. Meskipun durasi yang diatur serupa, terdapat perbedaan tingkat kepastian hukum antara kedua peraturan tersebut sehingga menimbulkan kebutuhan harmonisasi. Rumusan masalah skripsi mencakup pengaturan jangka waktu hak pakai yang paling memberikan kepastian hukum serta pembaruan regulasi yang diperlukan. Menggunakan metode yuridis normatif dengan pendekatan perundang-undangan dan konseptual, penelitian ini menganalisis kesesuaian kedua regulasi tersebut. Kesimpulannya, kepastian hukum dapat dicapai dengan mempertahankan total jangka waktu 80 tahun dan memastikan prosedur pemberian, perpanjangan, dan pembaruan hak pakai diatur secara jelas. Rekomendasi utama adalah merevisi Pasal 52 PP No. 18 Tahun 2021 agar prosedur evaluasi dan pengawasan diperjelas serta selaras dengan PP No. 103 Tahun 2015 sehingga penguasaan tanah oleh WNA lebih terkontrol dan tetap menjamin kepastian hukum.

Abstract

Jurnal ini menganalisis penyalahgunaan kekuasaan oleh pejabat tinggi di Indonesia, dikaitkan dengan kedudukan Pancasila dan ketentuan Undang-Undang Tindak Pidana Korupsi (UU Tipikor). Sebagai negara hukum yang demokratis Indonesia mewajibkan para pejabat tinggi untuk melaksanakan tugas serta fungsi mereka secara maksimal untuk menciptakan keadilan dan ketertiban. Meskipun demikian, praktik penyalahguaan kekuasaan terutama korupsi masih sering dilakukan oleh pejabat tinggi, bahkan Indonesia dinyatakan sebagai salah satu negara dengan tingkat penyalahgunaan tertinggi di kawasan Asia. Kasus ini dipilih karena telah memiliki putusan hukum yang final, sehingga memungkinkan analisis yang lebih komprehensif. Selain itu, ketersediaan informasi yang luas dan mudah diakses melalui berbagai sumber di internet mendukung pengumpulan data yang akurat dan relevan untuk keperluan penelitian. Fokus utama jurnal ini adalah menganalisis kasus korupsi yang dilakukan oleh Edhy Prabowo, mantan Menteri Kelautan dan Perikanan Republik Indonesia, terkait ekspor benih lobster. Kebijakan Peraturan Menteri Kelautan dan Perikanan Nomor 12/PERMEN-KP/2020 yang seharusnya dikeluarkan untuk menyejahterakan nelayan dan mengembangkan sektor pembudidayaan lobster, namun malah disalahgunakan untuk kepentingan pribadi, termasuk penerimaan gratifikasi dan suap hingga Rp 25,7 miliar. Secara keseluruhan,jurnal ini menyimpulkan bahwa penyalahgunaan kekuasaan dari pejabat negara, seperti yang dilakukan oleh Edhy Prabowo, merupakan tantangan nyata bagi penegakan negara hukum dan demokrasi di Indonesia, bertentangan secara fundamental dengan nilai-nilai Pancasila dan ketentuan UU Tipikor.

Abstract

The management of imported goods in the Batam Free Trade Zone and Free Port (KPBPB Batam) plays a strategic role in sustaining industrial activities; however, its implementation continues to face recurring administrative and coordination constraints despite an established regulatory framework, prompting this study to analyze policy implementation, identify operational barriers, and examine BP Batam’s strategies using the Van Meter and Van Horn policy implementation theory focusing on inter-organizational communication, resources, and implementing agency characteristics through a qualitative descriptive approach based on regulatory documents, policy records, and business complaint data from the BP Batam B-Care system, with findings indicating that import management has generally complied with regulations and is supported by the I-BOSS system, yet persistent challenges remain due to administrative complexity, technical system issues, limited understanding among business actors, and insufficiently integrated inter-agency coordination, highlighting an implementation gap at the operational level.

Abstract

The purpose of this study is to analyze the legal consequences of default in business agreements and the mechanisms for settling business disputes. Default occurs when a party fails to fulfill their contractual obligations. This research uses a case study approach, specifically the decision of the Bengkulu District Court No. 17/Pdt.G/2025/PN Bgl regarding an insurance claim dispute. The results show that the insurer's refusal to pay a claim without adequate proof is categorized as an unlawful act. The court ordered the defendant to pay material damages of IDR 200,000,000. This study concludes that transparency and good faith are essential in maintaining legal certainty in business.

Abstract

This study examines the strategic role of students in safeguarding and strengthening democracy in Indonesia amid the challenges of disinformation, identity politics, and the decline of substantive political participation. Students are positioned as agents of change who possess the intellectual and moral capacity to enhance public political literacy. This research employs a qualitative method using a literature review approach, drawing on books and scholarly articles relevant to democracy and student movements. The findings indicate that students have significant potential to increase public participation through digital activism and community-based engagement. However, this role is confronted by challenges such as political apathy, movement fragmentation, and disruptions in the digital era. Therefore, revitalizing student movements through the strengthening of digital literacy, organizational solidarity, and institutional collaboration is essential to ensuring the sustainability of democracy in Indonesia.

Abstract

Public policy is the government's responsibility in carrying out its duties. Public policy is closely related to the welfare and survival of the people. Public policy implemented properly and correctly by the government will impact society and the progress of the nation.The method used in writing this article is a literature review, which involves collecting and analyzing various scientific articles, journals, and other sources discussing public policyIndonesia implements public policy models that take into account the context of decentralization, social diversity, and political dynamics in Indonesia. This implementation often faces challenges related to data, resources, and diverse interests. Public policies in Indonesia are very diverse, covering the health sector (JKN), education (APBN fund allocation), transportation (Traffic Law), the environment (paid plastic bags), the economy (tax incentives, product protection), and public services (taxes, administration) to regulate national life, improve welfare, and create social order in accordance with the mandate of the law and the needs of the times. Furthermore, supporting factors for public policy implementation include aspects of communication, authority/bureaucratic structure, resources, and the disposition or attitude of the implementer. Meanwhile, inhibiting factors consist of internal factors such as corruption, external factors such as lack of public participation, and policy factors such as policy ambiguity.

Abstract

This study analyzes the dynamics of the voting process of members of the Palu City Regional People's Representative Council (DPRD) in the formation of Regional Regulations (Perda). Using a juridical-empirical research method, this study found that although the DPRD's Rules of Procedure provide for open and closed voting mechanisms, decision-making practices are dominated by consensus (acclamation) as a result of political consolidation at the faction level. This voting behavior is significantly influenced by the discipline of party instructions, the validity of technical data in the Academic Paper, and the sociological aspirations of the community regarding spatial planning and land ownership issues. In addition, political instruments such as delays due to quorum and walkouts are identified as bargaining strategies in legislative-executive relations. The study concludes that the direction of council members' votes is the result of negotiations of political interests and considerations of technical rationality of data, which demands strengthened transparency in every stage of legislation.
