Abstract

Legal certainty in civil disputes depends heavily on the accuracy of determining the legal basis of a claim. In practice, however, the conflation of breach of contract (wanprestasi) and unlawful act (onrechtmatige daad) claims remains a recurring problem in Indonesian civil courts. Despite sharing surface similarities, these two causes of action are fundamentally distinct in terms of their legal concept, statutory basis, and juridical consequences. Misclassification of either claim directly affects the burden of proof, the construction of the petitum, the form of compensation sought, and the legal standing of the parties involved. This article seeks to analyze how judges differentiate between these two types of claims based on court decisions, while also mapping the patterns of judicial reasoning and their implications in achieving legal certainty in civil law. This article employs a normative juridical method with a descriptive-analytical approach, examining relevant provisions of the Indonesian Civil Code (Burgerlijk Wetboek) and pertinent jurisprudence as the primary legal materials. The findings of this study are expected to contribute to the development of civil procedural law in Indonesia and serve as a reference for legal practitioners in accurately constructing civil claims, thereby avoiding misclassification that may prejudice their clients' legal interests in court proceedings.

Abstract

The purpose of this research is to find out and analyze the evidentiary mechanism in Indonesian  civil procedure and the application of the passive and active judge principles within civil adjudication. The study departs from the doctrinal tension between the principles of verhandlungs maxime, dominus litis, and ultra petita partium, which emphasize judicial passivity, and the normative mandates requiring judges to ensure legal certainty (rechtssicherheit), justice (gerechtigkeit), dan usefulness (zweckmassigkeit). The objective of this research is to construct a systematic conceptual reconciliation between judicial passivity in determining the scope of disputes and judicial activism in managing and evaluating the evidentiary process. This research applies a normative juridical method through statutory, conceptual, and principle approaches, analysing the HIR , RBg , Rv, the Civil Code, and Law No. 48 of 2009 on Judicial Power, supported by relevant legal doctrines. The findings show that Indonesian civil procedure is grounded in the pursuit of formal truth under the principle of actori incumbit probatio, whereby judges are bound by the claims and evidence presented by the parties. Nevertheless, judges inevitably exercise an active role in procedural control, evidentiary assessment, and limited fact clarification. The study concludes that judicial passivity and activism function complementarily within a proportional framework to balance legal certainty, justice, and usefulness in civil proceedings.

Abstract

Penelitian ini bertujuan untuk menganalisis efektivitas penyelesaian sengketa perdata melalui litigasi dalam sistem peradilan di Indonesia dan membandingkannya dengan sistem peradilan yang ada di Belanda. Penelitian ini menggunakan metode hukum normatif dengan pendekatan deskriptif-komparatif. Data yang digunakan berupa bahan hukum primer, sekunder, dan tersier yang dianalisis secara kualitatif. Hasil penelitian menunjukkan bahwa secara normatif sistem litigasi perdata di Indonesia telah memiliki kerangka hukum yang memadai tetapi dalam praktiknya masih mengalami hambatan struktural dan prosedural, terutama pada aspek durasi penyelesaian perkara, konsistensi putusan, dan efektivitas pelaksanaan eksekusi. Proses yang berlapis serta terbukanya berbagai upaya hukum menyebabkan penyelesaian sengketa sering berlangsung lama dan berakhir berbiaya tinggi walaupun biaya yang pada awalnya terjangkau dengan estimasi waktu penyelesaian sengketa lima sampai enam bulan. Di sisi lain, sistem peradilan di Belanda menunjukkan efektivitas yang lebih tinggi melalui modernisasi hukum acara, peran aktif hakim dalam penyelesaian sengketa perdata, digitalisasi yang terintegrasi, serta budaya hukum masyarakat yang lebih patuh terhadap putusan pengadilan. Perbandingan tersebut menunjukkan bahwa peningkatan efektivitas litigasi di Indonesia memerlukan reformasi hukum acara perdata, penguatan mekanisme eksekusi, optimalisasi digitalisasi peradilan, dan meningkatkan budaya hukum masyarakat yang bertujuan untuk mewujudkan peradilan yang lebih efisien, berkepastian hukum, dan berkeadilan.

Abstract

This research aims to analyze one of the works produced by artificial intelligence, specifically Italian Brainrot, in the field of image-based creations. The use of artificial intelligence technology brings its own challenges in the field of copyright law, as it gives rise to a fundamental legal uncertainty regarding whether works generated by artificial intelligence can be categorized as "creations" protected by copyright under Law Number 28 of 2014 on Copyright. The method used is normative juridical with a literature study approach, referring to Law Number 28 of 2014 on Copyright and other related regulations. The research findings indicate that works produced entirely by the Italian Brainrot artificial intelligence cannot obtain copyright protection in Indonesia. This is because Italian Brainrot's AI-generated works do not meet the requirements for a creation to be eligible for copyright protection, namely originality, creativity, and embodiment. Italian Brainrot has not fulfilled the requirement of human authorship and human creativity, and therefore cannot yet obtain copyright protection.

Abstract

Criminal sanctions in Indonesian criminal law are regulated in Article 10 of the Criminal Code (KUHP), which includes the death penalty as one of the principal punishments. However, its implementation has long generated serious debate, as the execution of the death penalty is often viewed as lacking legal certainty. A significant change emerged with the enactment of Law Number 1 of 2023 concerning the Criminal Code, which repositions the death penalty from a principal punishment to a special sanction imposed alternatively through a conditional death penalty mechanism with a 10-year probation period. This study, using a normative juridical approach and literature review, aims to analyze the urgency of this regulation. The findings indicate that if the convicted person demonstrates good behavior during the probation period, the death sentence may be commuted to life imprisonment with the approval of the President after considering the opinion of the Supreme Court. Although this mechanism is presented as a form of humanization and reform of the criminal justice system, the provision in Article 100 paragraph (4), which uses the phrase “may,” creates legal uncertainty regarding whether the sentence will actually be converted. This uncertainty is further compounded by the lengthy probation period and the absence of a clear time limit for the President to issue such a decision. Consequently, this framework reflects both philosophical and juridical ambiguity: while it is framed as a reform, it simultaneously preserves the existence of the death penalty, which may conflict with the principle of the right to life as an absolute human right.

Abstract

The rapid expansion of digital technology in Southeast Asia has intensified online interactions while simultaneously increasing cases of online defamation. This development creates tension between the need to protect individual reputation and the guarantee of freedom of expression, particularly in light of differing regulatory approaches between Indonesia and Singapore. This study aims to analyze the criminal regulation of online defamation in both jurisdictions, identify their similarities and differences, and formulate recommendations for a more proportionate legal framework. The research employs normative legal research using statute, comparative, conceptual, and case approaches, analyzed qualitatively through grammatical, systematic, and teleological interpretation. The findings indicate that Indonesia still faces issues of normative ambiguity and relatively expansive criminalization, whereas Singapore adopts a more selective approach with civil remedies as the primary mechanism and criminal law positioned as ultimum remedium. These results highlight the need for normative reformulation, strengthened enforcement guidelines, and harmonization with international human rights standards. In conclusion, Indonesia’s cyber defamation regime should move toward a more proportionate, precise, and balanced model that protects reputation without undermining freedom of expression.

Abstract

The development of information technology has driven significant transformation in the financial sector through the presence of digital banking services and electronic wallets (e-wallets). Although these innovations improve efficiency and financial inclusion, the use of personal data in their operations poses serious risks such as misuse, illegal access, and data breaches that can harm customers. This study aims to analyze the regulation of personal data protection in Indonesia, the forms of responsibility of service providers, as well as the obstacles and efforts to strengthen its protection. The research method used is normative juridical with a legislative and comparative approach. The discussion results show that although regulations such as the Personal Data Protection Law (UU PDP) and Financial Services Authority Regulations (POJK) exist, personal data protection still faces challenges, including low digital literacy among the public, cyberattack risks, system security weaknesses, and insufficient supervision. Efforts to strengthen protection need to be carried out through massive public education, implementation of global security standards (Security by Design), strict law enforcement, and cross-sector collaboration to create a safe and trusted digital financial ecosystem.

Abstract

The flash flood disaster that struck Aceh, North Sumatra, and West Sumatra in November-December 2025 resulted in 1,053 fatalities, 572,000 displaced persons, over 100,000 damaged housing units, and 90,601 hectares of affected rice fields. The existing agrarian legal framework has failed to provide adequate legal protection. Articles 27, 34, and 40 of Law Number 5 of 1960 (BAL) stipulate that destroyed land results in the extinguishment of land rights, reinforced by Article 1 paragraph 12 of Government Regulation Number 18 of 2021. Meanwhile, Article 1 paragraph 8 of Ministerial Regulation 17/2016 and Article 1 paragraph 7 of Ministerial Regulation 12/2021 stipulate that emerging land is directly controlled by the state. This normative ambiguity creates legal uncertainty. This study aims to analyze the discrepancy of agrarian legal norms in handling destroyed land and formulate an ideal model reconstruction adaptive to disaster management. This normative legal research employs statutory, conceptual, and comparative law approaches, using primary legal materials including the BAL, Law Number 24 of 2007, Presidential Regulation Number 86 of 2018, Presidential Regulation Number 62 of 2023, and relevant ministerial regulations, analyzed qualitatively and comparatively. The findings reveal discrepancies across three dimensions: normative ambiguity in land legal status, implementation obstacles in re-legalization, land redistribution, and religious assistance fund policies due to complex cross-sector coordination and the absence of standard operating procedures for emergency situations, and limited institutional capacity. This study formulates an ideal model reconstruction through legal status reformulation using the “disaster-affected land” concept, procedural simplification through “emergency land procedures”, and corporate responsibility integration based on the polluter pays principle.
