The scope of the writings published in the journal Media of law and Sharia covers all aspects of positive law, including sharia law in Indonesia: Criminal Law This scope contains regulations that determine what actions are prohibited and are included in criminal acts, as well as determine what penalties can be imposed on those who commit them. Civil Law Studying humans as subjects in law, laws that arise from kinship, the law relating to the valuation of money/wealth and inheritance law. Constitutional Law Examine the ins and outs of the birth of the state, concepts and theories of sovereignty and state power, and the system and governance of the state and government, including examining the pattern of power-sharing and the formation of state equipment. State Administrative Law Picturing the system of governance, actions and behavior of officials or state administrative bodies in carrying out their duties and responsibilities, including the consequences and solutions for resolving administrative and state administrative disputes. Laws and Regulations Reviewing the system for the formation of laws and regulations from understanding basic principles or formal material principles. Definition and types of legal norms, the types and legal implications of the hierarchy of laws and regulations, the mechanism for the formation of laws and regulations, and how the system and mechanism for testing legislation.

Abstract

Adoption is one way of obtaining offspring for married couples who are not blessed with biological children. However, the adoption of this child raises questions in the field of inheritance according to Islamic law, whether the adopted child inherits property or not from his adoptive parents. This research is normative legal research using primary, secondary and tertiary legal materials. The research materials were analyzed descriptively qualitatively. The conclusion is that adopted children can be given inheritance rights by means of an obligatory will from their adoptive parents, a maximum of 1/3 of the available inheritance before being distributed to other heirs. This is in accordance with the provisions of Article 209 KHI

Abstract

Penelitian ini di latar belakangi dengan adanya surat gugatan yang diajukan oleh debitur dengan nomor perkara 381/Pdt.G/2023/PA.YK karena merasa dirugikan oleh kreditur atas pelaksanaan parate eksekusi yang dianggap tidak sesuai dengan SOP sehingga merugikan pihak debitur. Penelitian hukum ini menggunakan penelitian empiris yaitu mengkaji kaidah-kaidah hukum positif yang dipadukan dengan data yang diperoleh melalui penelitian lapangan. Parate eksekusi merupakan eksekusi jaminan tanpa adanya putusan pengadilan yang didasarkan pada Pasal 6 Undang-Undag nomor 4 Tahun 1996 tentang Hak Tanggungan, yang menjelaskan bahwa kreditur dapat melakukan eksekusi jaminan atas kekuasaan sendiri melalui pelelangan apabila debitur cidera janji. Namun pada pelaksanannya tidak selalu berhasil, terdapat hambatan yang menyebabkan kegagalan dalam pelaksanaan parate eksekusi, yakni dalam hal pengosongan objek jaminan. Berdasarkan hasil penelitian Bank Syariah Indonesia dalam penyelesaian nasabah cidera janji salah satunya melakukan parate eksekusi, dalam pelaksanaan parate eksekusi tersebut terdapat SOP yang harus dipenuhi oleh Bank Syariah Indonesia untuk melakukan parate eksekusi melalui pelelangan pada KPKNL. .

Abstract

Government authority and governance in Indonesia are governed by Law No. 30 of 2014, which is titled "Government Administration." Following the implementation of this law, however, a problem arose regarding the government's abuse of authority. The objective of this study is to examine specific instances in which the government has improperly exercised its authority subsequent to the implementation of Law No. 30 of 2014. This investigation employs a normative methodology. This study examines established legal norms or regulations in order to comprehend and evaluate a legal phenomenon. As evidenced by the research findings, instances of governmental authority abuse abound, encompassing the implementation of detrimental policies, human rights violations, and the manipulation of data to advance political objectives. This abuse of authority is exacerbated by transparent practices, inadequate government accountability, and ineffective oversight mechanisms.

Abstract

Abstrak Mahkamah Agung melakukan suatu upaya untuk mengatasi hambatan penyelesaian perkara di Pengadilan dengan membuat suatu mekanisme baru yang disebut dengan gugatan sederhana. Prosedur tentang gugatan sederhana diterbitkan dalam PERMA Nomor 2 Tahun 2015 sebagaimana diubah dengan PERMA Nomor 4 Tahun 2019 tentang Tata Cara Gugatan Sederhana. Gugatan sederhana hanya diperuntukan khusus bagi perkara yang memenuhi syarat-syarat yang ditentukan dalam PERMA tersebut. Salah satu perkara yang menggunakan prosedur gugatan sederhana dalam proses beracara terdapat dalam kasus dengan Nomor Putusan 1/Pdt.G.S/2020/PA.Cms yang pada intinya Tergugat melakukan wanprestasi kepada penggugat PT. Bank BRI Syariah Cabang Ciamis. Penelitian ini bertujuan untuk mengetahui bagaimana prosedur sengketa gugatan sederhana pada akad murabahah serta untuk mengetahui bagaimana pertimbangan hakim dalam memberikan putusan di Pengadilan Agama Ciamis. Metode yang digunakan dalam penelitian ini adalah penelitian normatif, kemudian dilanjutkan dengan menganalisis bahan hukum dengan analisis kualitatif yang menghasilkan data deskriptif-kualitatif. Hasil dari penelitian ini menyimpulkan bahwa penerapan PERMA dalam putusan di Pengadilan Ciamis belum sesuai dengan ketentuan jangka waktu yang telah diberikan. Namun, pertimbangan hukum hakim sudah tepat dalam memutus perkara. Pertimbangan hukum hakim mengacu pada pembuktian secara tertulis yang diberikan oleh Penggugat sehingga Penggugat dapat memenangkan perkara ini dengan mendapatkan hak untuk menjual jaminan yang telah diajukan oleh Tergugat. Kata kunci: gugatan sederhana; putusan; pembuktian Abstract The Supreme Court made an effort to overcome obstacles to resolving cases in court by creating a new mechanism called a small claims court. Procedures regarding small claims courts issued in PERMA Number 2 of 2015 as amended by PERMA Number 4 of 2019 on Procedures for Small claims courts. Small claims courts are only specifically intended for cases that meet the requirements specified in the PERMA. One of the cases that uses the small claims court procedure in the proceedings is in case with Decision Number 1/Pdt.G.S/2020/PA.Cms where in essence the Defendant committed a breach of contract against the plaintiff PT. Bank BRI Syariah Ciamis Branch. This research aims to find out the procedure for settling small claims courts in murabahah contracts and to find out how judges consider when making decisions at the Ciamis Religious Court. The method used in this research is normative research, then continued by analyzing legal materials with qualitative analysis which produces descriptive-qualitative data. The results of this research conclude that the application of PERMA in the Ciamis Court decision is not in accordance with the provisions of the time period that has been given. However, the judge's legal considerations were correct in deciding the case. The judge's legal considerations refer to the written evidence provided by the Plaintiff so that the Plaintiff can win this case by getting the right to sell the collateral that has been submitted by the Defendant. Abstract

The widening economic gap and the domination of wealth by a small number of individuals in Indonesia highlight key challenges in realizing an inclusive and equitable democracy. Popular sovereignty reflects democracy, which represents the majority's voice. However, in reality, the people's voice is degraded by the voice of the oligarchs who own the majority of wealth in Indonesia. This research explores economic oligarchy's implications on the Indonesian democratic system. The used is juridical-normative legal research or also called document research with secondary data as the main source. Researchers conduct legislative studies to see synchronization between legislation. Data were collected using literature review techniques, such as perusing, analyzing, and drawing conclusions from relevant documents. The research results confirm that the dominance of oligarchs grows and develops due to the high political costs of elections, so power relations are formed between the rulers and the oligarchs. As a result, oligarchs become regulators and executors in the state administration system, which has implications for the difficulty of achieving the ideals of a more inclusive democracy. Therefore, to limit oligarchy, policy reform is needed that is more oriented towards social justice, economic equality, and meaningful participation in realizing checks and balances

Abstract

This writing aims to find out how the strength of expert testimony on electronic evidence in court, the method used in writing is normative juridical or literature, which is carried out by literature study of legal materials. with the development of the times electronic products are increasingly sophisticated and developed, humans can find applications or web editing easily so it is very possible to falsify electronic information. Electronic evidence must be recognised in order to have binding legal force, if it is not recognised, other evidence is needed as stated in article 1866 of the Civil Code / article 164 HIR regarding types of evidence including expert testimony. Expert testimony is still very much needed to provide an understanding of a civil case, especially in situations that are beyond the expertise or scientific knowledge of the judge. It can be concluded with certainty that the information provided by an expert is not considered as evidence, but rather serves to strengthen the strength of existing evidence. Therefore, it cannot determine the outcome of a civil court decision. The Panel of Judges can still consider and make decisions on existing issues even without expert opinion.

Abstract

This research aimed to examine the position of the Supreme Court Circular Letter, or hereinafter referred to SEMA, Number 2 of 2023 regarding the principle of Judges’ freedom in deciding cases. The method used normative juridical with a statutory approach. The primary, secondary and tertiary legal materials obtained analyzed using legal searches. The research results showed that SEMA’s legal position in the hierarchy of statutory regulations is below the law. Considering that the contents are contrary to the principle of freedom of judges in deciding cases in accordance with Article 3 Paragraph (1) and Elucidation of Article 3 Paragraph (1) of Law Number 48 of 2009 concerning Judicial Power, the existence of SEMA will also cause Judges to lose their freedom in deciding cases in the case of applications for registration of interfaith marriages, this will further be a dilemma for the judge when handling this case considering that the legal regulations regarding applications for interfaith marriages are also still valid and in force

Abstract

The community's paradigm of sponging activities in Bali certainly points to Muntigunung Hamlet as a sponger-producing hamlet. The problem of Gepeng in Muntigunung Hamlet is one of the anomalies in the response to customs and traditions (meurup-urup) which then develops into an antinomy and takes root to make a new reality in meurup-urup, exacerbated by the economic crush, and the existing ecology makes this problem like uprooting old teak roots. This research uses analysis with anthropological, juridical, logical, and systematic approaches. The results found that the trend of human error capacity that occurs is trying to be handled by the state in the sense of the Regional Government of Karangasem by taking technical measures which in the opinion of the author is a futile step, therefore the government must carry out a model of handling spongers in terms of direct involvement with the handling of camp assessment and social work for adult spongers and in child spongers is given education and the rights attached to it as a society so as not to violate the right to live properly, be educated, free of discrimination and degrading treatment, especially in this case spongers.   Keywords: Tradisi, Meurup-urup, Gepeng, Hukum, Negara.

Abstract

This research focuses on the regulation of residential ownership by foreigners after the Job Creation Law and the challenges of implementing the policy. The Researcher used statutory and conceptual approaches with secondary data in the form of legal primary, secondary, and non-legal materials, obtained through a literature study. The research found that the regulation of residential ownership by foreigners after the Job Creation Law can be seen in the Job Creation Law 2023, PP 18/2021, Permen ATR/KBPN 18/2021, and Kepmen ATR/KPBN 1241/SK-HK.02/IX/2022. Foreigners who possess immigration documents can own a house or residence, either in the form of a landed house or an apartment unit on a certain land. There are specific restrictions regarding land plots’ size, amount of land plots, land rights types, and the minimum price foreigners may own. However, in implementing existing policies, the Indonesian government must act swiftly to overcome several challenges such as double standards in calculating NPP for apartment units, violations of principles and several articles of UUPA, and the absence of a supervisory institution for foreign residential ownership. Collaboration with relevant ministries, organizations, notaries, and land deed officials is necessary so that the legal corridor established by the government can be jointly maintained and enforced.

Abstract

The cancellation of fidusia guarantee is an important process in consumer financing transactions. Fidusia guarantee is regulated by Law Number 42 of 1999 on Fidusia Guarantee. The cancellation of fidusia guarantee aims to provide legal certainty and remove the secured object once the debt is settled. However, many fidusia recipients fail to cancel the guarantee as required, resulting in negative consequences. The purpose of this research is to understand the consequences of not canceling the fidusia guarantee. The research method used is normative legal research with a legislative, conceptual, and case approach. The results of this research show that fidusia recipients who do not cancel the guarantee are caused by the lack of strict sanctions governing the cancellation of fidusia guarantee certificates, the recipients' or providers' lack of knowledge about the obligation to cancel the guarantee, and the cancellation of the guarantee not being a requirement for subsequent fidusia guarantee registration. The conclusion is that the consequences of not canceling the fidusia guarantee are that the debtor cannot re-pledge their property and the same or other creditors cannot re-register the fidusia guarantee, resulting in repeated fidusia registration or double fidusia, and the fidusia guarantee data on the AHU Directorate's database becomes inaccurate, invalid, and lacks legal certainty.
