Abstract

The protection of traditional cultural expressions within the concept of Communal Intellectual Property is an effort to preserve cultural aspects. One such expression needing protection is the Genggong Art of Sumedang. This research aims to understand the issues related to the Genggong Art of Sumedang, which has not yet received defensive protection as a Communal Intellectual Property object, and the legal provisions that can support its protection. Using a normative juridical and sociological juridical approach, the research collects primary data through field studies and interviews, and secondary data through literature studies, including relevant regulations and other secondary legal materials. The findings indicate that normative provisions on intellectual property in Indonesia have not been optimally implemented. This is due to a lack of socialization about the importance of communal intellectual property protection and an understanding of registration procedures. Therefore, optimal cooperation and coordination are needed both in the registration context between the originating community and the Sumedang Regency Government, as well as in promoting the importance of defensive protection of traditional cultural expressions between the Sumedang Regency Government and the Ministry of Law and Human Rights.

Abstract

This article aim to description about mubadalah interpretation can be an alternative solution for judges in an effort to present a verdict in a gender-just Islamic family law dispute. Mubadalah interpretation is the interaction between text and reality, which is expected to give constructive meaning to the fact of life and raise the principles of relations between men and women. The findings of this research is there are three steps that the judge can take in interpreting the mubadalah, namely finding the principal value, then looking for the main idea or moral suitable, and finally lowering the moral ideal to the type of calamine that is not mentioned in the text.

Abstract

Digital technology in Indonesia has significantly impacted sectors such as government, finance, education, and healthcare, offering numerous benefits. However, it has also led to increased cybercrime, including hacking, digital fraud, identity theft, and ransomware, posing threats to national security and public welfare. Regulations like the ITE and PDP Laws have been implemented, yet challenges persist in enforcement and technological adaptation. Indonesia faces challenges in cyber law enforcement, including insufficient technical capacity among law enforcement officers. This study employs a qualitative descriptive approach with an exploratory focus. Data were collected from legal documents, government reports, case studies, journal articles, and academic literature. Thematic analysis was used to identify patterns, challenges, and the effectiveness of cybercrime policies. The findings reveal that Indonesia’s cybersecurity policies need reinforcement, particularly in implementation, public education, and technological adaptation. Examples from the United States and the European Union highlight that collaboration between governments and the private sector, stringent data protection regulations, and public education campaigns significantly enhance resilience against cyber threats. This study recommends strengthening the ITE and PDP Laws, promoting digital literacy among the public, enhancing law enforcement capacities, fostering international collaboration, and establishing cyber information-sharing networks to create a robust, effective, and adaptive digital security ecosystem for Indonesia.

Abstract

With the advancement of time and technology, society has become increasingly dependent on social media, which offers various features to facilitate activities, including entertainment. One popular application used for entertainment is Telegram, which hosts numerous illegal films distributed by irresponsible individuals. This situation causes losses for filmmakers, who are entitled to moral and economic rights over their creations as stipulated in the Copyright Law (UUHC). This study aims to examine whether the distribution of illegal films violates economic rights under Article 9 (1) b of the UUHC and whether it can be categorized as piracy under Article 113 (4) of the UUHC. Furthermore, this research analyzes the mechanisms for copyright protection for filmmakers and the accountability of individuals distributing pirated films through civil and criminal lawsuits, which arise due to negligence in monitoring user activities in accordance with applicable regulations. The findings of this study indicate that the distribution of illegal films on Telegram infringes on the economic rights of filmmakers and is subject to sanctions under the UUHC. Legal protection of copyright can be pursued through legal actions, including civil and criminal lawsuits, against violators.

Abstract

Spatial Planning is a system of spatial planning, spatial utilization, and control of spatial utilization. Based on of Law Number 26 of 2007 concerning Spatial Planning, the Public Works and Spatial Planning (PWSP) of Bima City has the authority to realize the implementation of spatial planning. In its implementation, Bima City still has space utilization that is not in accordance with what has been determined by the government. As for the identification of the problem, how is the authority of the PWSP Office of Bima City in realizing the implementation of spatial planning based on Law Number 26 of 2007 concerning Spatial Planning? and how are the obstacles faced by the PUPR Office of Bima City in realizing the implementation of spatial planning based on Law Number 26 of 2007 concerning Spatial Planning? The theory used is the theory of authority and spatial planning theory. The method used is empirical juridical method with data analysis through a qualitative approach using primary data in the form of interviews with resource persons from the Spatial Planning Division of the PWSP Office of Bima City, and secondary data. The results of the research, the PWSP Office of Bima City exercises its authority in realizing the implementation of spatial planning in accordance with the provisions in Article 11 paragraph (1) and paragraph (2) of Law Number 26 of 2007 concerning Spatial Planning. The conclusion of this research is that the authority of the PWSP Office of Bima City is obtained by delegation and exercises its authority in the form of regulation, guidance, planning, utilization, and control of space. Its activities are in the form of issuing Regional Regulations and Mayor Regulations, as well as socialization to the community. They are also responsible for the preparation of spatial plans, coordination of spatial utilization, zoning, licensing, and supervision through monitoring and evaluation, and reporting. There are 4 obstacle factors, namely the inadequate competence of human resources organizing spatial planning, there are still laws and regulations related to space that need to be synchronized, limited budgets that do not support the implementation of spatial planning, and limited spatial planning information systems. The suggestion is that the PWSP Office of Bima City needs to improve socialization and spatial information systems.

Abstract

Studi ini mengkaji hukum positif dan hukum Islam tentang hak pasien terhadap akses dan kerahasiaan rekam medis. Kesehatan adalah komponen penting dari kehidupan manusia yang memerlukan perhatian khusus, baik dari segi pelayanan kesehatan maupun perlindungan hak-hak pasien. Hak terhadap akses dan kerahasiaan rekam medis adalah salah satu hak penting yang dimiliki oleh pasien. Rekaman medis mencakup semua riwayat medis pasien, termasuk diagnosis, pengobatan, dan kondisi kesehatannya. Karena subjek penelitian ini sangat unik, jenis metode yang digunakan adalah analisis deskriptif yuridis normatif. Penelitian ini menggunakan pendekatan komparatif dan berfokus pada bahan hukum utama, yaitu teori, konsep, asas, dan peraturan hukum yang relevan. Dikenal sebagai pendekatan kepustakaan, yang mencakup pengumpulan data pustaka, peraturan perundang-undangan, dan studi buku Menurut hukum Islam, kerahasiaan yang kuat diperlukan untuk hak pasien untuk mengakses rekam medis mereka. Meskipun pasien memiliki hak untuk mengetahui apa yang tertulis dalam rekam medis mereka, dokter dan tenaga medis harus memastikan bahwa informasi tersebut tidak akan digunakan secara tidak etis atau melanggar privasi pasien. Di antara nilai-nilai kemanusiaan yang universal adalah hak pasien untuk mengakses rekam medis mereka dan perlindungan kerahasiaan mereka. Baik hukum Islam maupun hukum positif sama-sama menekankan pentingnya menjaga keseimbangan antara hak pasien untuk mengetahui informasi medisnya dengan kewajiban tenaga medis untuk menjaga kerahasiaan informasi tersebut. Prinsip ini bertujuan untuk melindungi hak-hak pasien, menjaga kehormatan mereka, dan membangun kepercayaan antara pasien dan tenaga kesehatan

Abstract

Constitutional Court Decision No. 91/PUU-XVIII/2020 provides legal certainty regarding the validity of the Job Creation Law with a conditional unconstitutional decision for two years. This means that within a period of two years, lawmakers are expected to make improvements to the Job Creation Law. If not, the law will automatically be invalid. Using a juridical-normative method, this study examines various legal products that were born after Constitutional Court Decision No. 91/PUU-XVIII/2020, as well as various challenges in the follow-up process. The results of the study show that Law No. 13 of 2022 and Law No. 6 of 2023, as a follow-up to Constitutional Court Decision No. 91/PUU-XVIII/2020, have not fully met public expectations. Law No. 13 of 2022, which was produced through a fast track legislation process, and Law No. 6 of 2023, which is an amendment to the Job Creation Law, raises questions regarding the fulfillment of the principle of meaningful public participation, which was previously identified as a problem.

Abstract

Indonesia's membership in BRICS and ASEAN provides great opportunities in trade, investment, and diplomacy, but faces the challenge of economic law harmonization between the two blocs. BRICS focuses on protectionism and infrastructure, while ASEAN promotes free market integration creating complexity for Indonesia in maintaining the balance of national and international policies. The development of a flexible yet robust legal framework is necessary to manage the dynamics of regulatory differences in the two organizations without compromising Indonesia's sovereignty. This research aims to analyze the legal strategies that Indonesia can implement to overcome the challenges of international economic regulatory harmonization between BRICS and ASEAN. The method used in this research is juridical-normative research, by analyzing secondary data from primary, secondary, and tertiary legal materials.  The results show that Indonesia plays a strategic role in bridging economic law conflicts between BRICS and ASEAN which have different economic principles where BRICS supports protectionism, while ASEAN encourages market liberalization. Indonesia's membership in both blocs creates challenges in regulatory harmonization, especially when Indonesia is also involved in multilateral agreements such as WTO and G20. By capitalizing on its position, Indonesia can strengthen its economy and influence global policies while maintaining national economic legal sovereignty.

Abstract

The growth of e-commerce and online transactions has changed the trade landscape, but has also raised a number of legal challenges regarding consumer rights. Through a juridical approach, this research explores various aspects of legal protection provided to consumers in online transactions, including applicable regulations, obligations of business actors, and dispute resolution mechanisms. The aim of this study is to analyze juridically the legal protection of consumers in online transactions and steps to prevent illegal practice procedures. Method The research was conducted qualitatively with normative juridical and utilized journals and relevant books. The study results show that Indonesia has several foundations laws that protect consumer rights in online transactions, namely legislation consumer protection, trade legislation, Ministerial Regulations Trade Number 53 of 2018 concerning Procedures for Resolving Consumer Disputes Electronically and Government Regulation Number 99 of 2018 concerning Protection Consumers Through Electronic Commerce. Consumers who feel disadvantaged online transactions can take legal steps to protect their rights, including reporting the case to the Consumer Dispute Resolution Agency (BPSK) or the online platform used. It is recommended for consumers to understand, understand their rights when making online purchases, and read the terms and conditionsonline transaction terms before making a purchase.

Abstract

The enjoyment and utilization of the environment is the right of the people of Indonesia as guaranteed under the 1945 Constitution of the Republic of Indonesia. Therefore, the Government of the Republic of Indonesia issued Law Number 32 of 2009 on the Protection and Management of Environment (Environment Law) as the embodiment of the rights of the people of Indonesia to enjoy and utilize the environment. As time flew by, the execution of the Environment Law encountered issues due to violations toward said law, such as environment destruction in the form of land clearing by means of burning. Since the issuance of the Environment Law, violations have been carried out by several parties, including but not limited to law enforcers, business owners, and the people of Indonesia themselves. This research focuses on the prohibition toward environment destruction in the form of land clearing by means of burning as well as the reasons and the sociological factors affecting the effectiveness of the implementation of the environmental laws. This research is aimed to identify the main factors affecting the failure of the enforcement of the Environment Law as well as other environmental laws and regulations. In addressing the said issues, this research utilizes the normative legal research methodology towards secondary data consisting of environmental laws, analyzed using the qualitative data analysis methodology. In conclusion, ineffectiveness of Indonesian environment laws are due to weakness in its enforcement, ambiguity in its norms, and failure of Indonesian legal culture to adhere to its legal principles.
