Abstract

Legal protection provided by a country as a host country for investors in the business world is essential. Along with the rapid pace of economic turnover, discourse on foreign investment is increasingly in the spotlight considering the importance of investment in encouraging economic development for a country. But unfortunately, the ideal conditions are inversely proportional to the reality of the investment mechanism through the Join Venture Agreement. The problem that will be examined by the author is to focus on the incompatibility of the articles of association with the laws and regulations that have been applied in Indonesia. Moreover, another problem in the Join Venture mechanism in Indonesia is that there is regulatory differentiation with the implementation of joint ventures between foreign companies and local companies that can hamper the pace of the Indonesian economy. The role is so large related to investment for national development, it is natural that capital determination receives special attention from the government, especially presenting juridical efforts that can overcome investment problems in a country.

Abstract

Law No. 16/2011 on Legal Aid needs to be reconstructed because there are inequalities related to the provision of legal aid to persons with disabilities. The Legal Aid Law states that all provisions for the provision of legal aid are subject to the Legal Aid Law which is substantively unfriendly to persons with disabilities as individuals who need special treatment based on equal rights. This research is a normative legal research using a statutory approach, theoretical approach and analytical approach. The analysis is conducted by analysing Law No.16/2011 on Legal Aid for persons with disabilities and Gustav Radbruch concept of legal objectives. By elaborating the thought of Gustav Radbruch legal objectives, there are two discussion formulations. First, how Gustav Radbruch legal objectives view the Legal Aid Law for persons with disabilities. Second, the legal reconstruction of affirmative action for legal aid for persons with disabilities from the perspective of Gustav Radbruch legal objectives. The results of the discussion show that the Legal Aid Law does not provide justice value, benefit value and certainty value for persons with disabilities, so it is necessary to reconstruct the law of affirmative action for persons with disabilities in the Legal Aid Law in order to guarantee the fulfilment of the right to legal aid for persons with disabilities.

Abstract

Regarding the reaction of the community which shows that the case did not go through the criminal law mechanism and seems incomplete. The field of law faces new obstacles due to the rise of digital space in contemporary society. almost every activity, including in physical space. Because society has moved from the physical space to the digital space, the legal structures governing the order of social life are now present in both physical and digital spaces. With the inclusion of new platforms and professions, Covid 19 2020 is also supporting a wider campaign for tech algorithms. Regulations are needed to ensure that our digital space is beneficial for the benefit of society, and can guarantee justice for seekers, fulfilling a sense of justice in society. The ITE Law was the initial solution for the birth of this technological algorithm.

Abstract

Implementation of law number 2 of 2008 concerning political parties regarding political education for first-time voters in the 2024. General election the importance of political education for first-time voters in the 2024 general election is to become intelligent voters and understand the political dynamics that are occurring. This research aims to find out how political education is implemented for novice voters. How is the participation of novice voters in carrying out the 2024. General election. This research uses normative legal methods. Data collection techniques use literature study. Data was tested by source triangulation. Data analysis techniques go through the stages of data collection, data reduction, data presentation, and drawing conclusions.

Abstract

 This article discusses the discretionary authority of the President in the appointment and dismissal of ministers within Indonesia's presidential system of government. In this system, the President holds prerogative rights guaranteed by the Constitution, as stated in Article 17 paragraph (2) of the 1945 Constitution of the Republic of Indonesia. Although the President has considerable freedom, the use of such discretion is not absolute and must adhere to the principles of the rule of law, democracy, and good governance. Using a normative approach through library research, this article analyzes the constitutional foundation, limitations, and forms of accountability of presidential discretion in appointing ministers. It also evaluates President Prabowo Subianto’s cabinet reshuffle practices in response to political dynamics and public demands. The analysis shows that while ministerial appointments fall under the President's prerogative rights, their implementation must consider aspects of competence, integrity, and public accountability. Discretion should serve as a tool to enhance the effectiveness of governance, not as a means of exercising unchecked power. Therefore, transparency, professionalism, and accountability are fundamental principles in the exercise of executive discretion in Indonesia.

Abstract

The Indonesia, as an archipelagic nation, faces complex social, cultural, and economic challenges within the maritime space, which demand inclusive, responsive, and socially just legal formulations. This article examines the relevance of maritime legal norms to the social structure of coastal communities through a sociological perspective. The primary objective of this research is to analyze how a sociological approach to law can be used as a method for formulating maritime legal policies that are contextual and adaptive to the dynamics of coastal communities. This sociological approach demonstrates that good law is not only formally valid but also socially legitimate because it reflects local values, customary wisdom, and the just distribution of marine resources. The study's findings demonstrate that maritime legal reform must involve community participation, accommodate legal pluralism, and be based on the needs and social structure of coastal communities. By integrating formal norms and social practices, national maritime law can become an instrument for just, democratic, and sustainable social engineering.

Abstract

This study examines the implications of constitutional flexibility on governance using a comparative law method with a normative-historical approach. The focus is on comparing rigid and flexible constitutions in Civil Law and Common Law systems, along with case studies of amendments to Indonesia’s 1945 Constitution and constitutional reforms in the United Kingdom. Findings indicate that rigid constitutions provide political stability and legal certainty but adapt slowly to socio-political changes, whereas flexible constitutions allow rapid adaptation, though they may pose potential legal instability if not properly controlled. The study highlights the importance of balancing stability and flexibility through selective reforms, checks and balances, and public participation. These findings offer recommendations for lawmakers and policymakers to adjust amendment mechanisms to maintain equilibrium between stability and adaptability

Abstract

Regulatory reforms in Indonesia including the Environmental Protection and Management Law, the risk-based licensing regime, and Government Regulation 22/2021create both opportunities and challenges for achieving sustainable development. This article analyzes the effectiveness of environmental law and maps its realization from upstream instruments (Strategic Environmental Assessment/SEA and Environmental Impact Assessment/EIA) to downstream mechanisms (monitoring and multi-track enforcement). The study employs a normative legal method with statutory, conceptual, and case approaches, complemented by a policy-evaluation lens that links process indicators (EIA quality, public participation, oversight, administrative sanctions) to outcome indicators (ambient quality, land-cover change, pollution events). Findings indicate that: (i) post-approval oversight and progressive administrative sanctions strengthen compliance; (ii) high-quality EIA and meaningful participation enhance decision legitimacy and reduce dispute costs; (iii) information transparency reinforces accountability and scientific proof; (iv) civil and criminal tracks remain necessary for severe violations, while the polluter-pays principle and strict liability are effective if supported by robust damage-valuation guidance; (v) SEA functions as an upstream policy guardrail; and (vi) anti-SLAPP and citizen-lawsuit avenues broaden access to justice. The article’s novelty lies in an integrated evaluation framework that connects participation, transparency, and enforcement to measurable biophysical outcomes. Policy implications emphasize risk-based compliance assurance, strengthened environmental forensic laboratories, the use of remote sensing, independent audits, and routine public performance reporting across jurisdictions to drive continuous improvement

Abstract

This research examines the implementation of the legislative process in the House of Representatives (DPR), which constitutes one of the primary functions within Indonesia's constitutional system. However, the DPR's performance in law-making is frequently questioned due to various obstacles that affect the effectiveness and quality of the legislative products produced. This article aims to analyze the obstacles faced by the DPR in the law-making process and offers practical solutions to address them. The paper employs a normative juridical analytical descriptive approach. Research findings indicate that political, technical, and social obstacles remain the primary factors that slow down and diminish the quality of legislation. The article also proposes implementable solutions to enhance the effectiveness of the legislative process, including improving the quality of academic drafts, strengthening political coordination, and increasing public participation.

Abstract

Abstract; The weakness and strength of political literacy greatly influence the process and outcomes of elections. Therefore, enhancing political literacy is an obligation that needs to be improved through political education. Higher education institutions have a responsibility in enhancing political literacy to achieve dignified elections. The findings of this research indicate that higher education institutions play a central role in improving political literacy and building reputable elections, despite facing several challenges such as limited curriculum, limited resources, gender imbalances, technological challenges, and challenges related to politics and freedom of expression. Keywords : Political Literacy, Education, Elections Abstrak; Lemah dan kuatnya literasi politik sangat mempengaruhi proses dan produk pemilu. Maka, peningkatan literasi politik merupakan suatu kewajiban yang harus ditingkatkan melalui Pendidikan politik. Pendidikan tinggi merupakan salah satu yang bertanggungjawab dalam meningkatkan literasi politik untuk mencapai derajat pemilu yang bermartabat. Hasil penelitian ini menunjukkan bahwa  Lembaga pendidikan tinggi memegang peran sentral dalam meningkatkan literasi politik dan membangun pemilihan umum yang bermartabat dengan beberapa tantangan yang dihadapi meliputi keterbatasan dalam kurikulum, sumber daya yang terbatas, ketidakseimbangan gender, tantangan teknologi, serta tantangan politik dan kebebasan berpendapat. Kata Kunci: Literasi Politik, Pendidikan, Pemilu
