Abstract

The principle of equality before the law is one of the main pillars in the state of law. However, its implementation is often not fully felt by all parties, especially women in the political realm. This article discusses how legal equality for women is applied in the political world, the challenges faced, and steps that can be taken to address gender-based discrimination. The case study focuses on women's representation in the Indonesian parliament and the systemic barriers affecting their participation. This analysis was carried out using normative and empirical approaches, and supported by secondary data. The results of the study show that cultural, social, and policy constraints are still the main obstacles in achieving gender equality in politics.

Abstract

The implementation of Law Number 23 of 2014 concerning Regional Government has brought about fundamental changes in the structure of authority between the central government, provinces, and districts/cities. This study examines the dynamics of governance in West Java Province, with a focus on challenges, institutional responses, and intergovernmental synergy strategies. The results of the study indicate that West Java Province faces various problems, such as institutional unpreparedness, weak cross-government coordination, fiscal limitations, and fragmentation of information systems. Meanwhile, institutional responses indicate efforts to adjust structures and innovate public services, but have not been fully integrated with districts/cities. As a novelty, this study offers a strategic policy framework based on equitable asymmetric decentralization, including the formulation of regional capacity indicators, integration of planning information systems, and strengthening cross-regional collaboration. This research is expected to be a theoretical and practical contribution in formulating a model of regional governance that is adaptive and responsive to the local context.

Abstract

This study examines two critical dimensions of Indonesia’s national legal reform: the urgency of overhauling the National Legislation Program (Prolegnas) following executive interventions during President Joko Widodo’s administration, and the implications of such interventions on judicial morality. Employing a qualitative comparative methodology, the research integrates document analysis of Prolegnas, draft laws, and government regulations, regulatory audits, and in-depth interviews with legislative and judicial stakeholders. Findings reveal that fragmented authority and the omnibus law approach without thorough audits generate legal uncertainty, while abrupt statutory revisions cause ethical dilemmas for judges and inconsistencies in legal interpretation. The study recommends embedding systematic regulatory audits, early involvement of the judicial council, establishing an independent ethics oversight body, and incorporating explicit judicial morality clauses in every legislative amendment. This integrated framework aims to ensure Prolegnas produces laws that are responsive, accountable, and substantively just.

Abstract

This study examines the involvement of State Civil Apparatus (ASN) in practical electoral politics and its implications for democracy from a constitutional law perspective. ASN, as part of the state bureaucracy, are required to maintain neutrality to ensure honest, fair, and democratic elections. However, the reality on the ground shows that violations of ASN neutrality persist, manifested in support for certain candidates, both directly and through social media. The research method used is a normative juridical approach by examining laws and regulations related to ASN neutrality and case studies of violations that occurred in several elections. The results show that ASN involvement in practical politics not only violates regulations but also has negative implications for electoral integrity, the principle of equal political rights, and public trust in democracy. From a constitutional law perspective, ASN neutrality is part of the realization of the principles of the rule of law and constitutional democracy. Therefore, strengthening legal instruments, optimizing oversight functions, and implementing strict sanctions are needed to uphold ASN neutrality while strengthening the quality of democracy in Indonesia.

Abstract

This study aims to examine the legal policy of the Indonesian government in determining the COVID-19 vaccination policy and the extent to which its implementation meets the principles of justice, especially in terms of equal access and an educational approach to the community. The research method used is a normative qualitative approach with an analysis of laws and regulations, official government documents, and scientific literature. Data were collected through literature studies and analyzed descriptively-analystically. The results of the study show that although the vaccination policy was designed as a form of protecting the public interest, its implementation still faces challenges in terms of inequality in vaccine distribution, lack of public education, and a legal approach that tends to be coercive. For this reason, the vaccination policy needs to be reviewed to emphasize the principles of social justice, respect for human rights, and public participation as part of a responsive and democratic legal policy.

Abstract

Penelitian ini menganalisis penguatan fungsi Badan Pemeriksa Keuangan (BPK) sebagai Supreme Audit Institution melalui tindak lanjut hasil pemeriksaan keuangan negara. Metode yang digunakan adalah yuridis normatif dengan kajian peraturan perundang-undangan, dokumen resmi BPK, dan literatur akademik. Hasil penelitian menunjukkan bahwa meskipun landasan hukum BPK kuat, mekanisme tindak lanjut rekomendasi masih formalistik dan administratif, sehingga efektivitas pengawasan keuangan negara terbatas. Hambatan muncul dari tumpang tindih kewenangan antar-lembaga, keterbatasan kapasitas teknis entitas auditee, lemahnya pengawasan DPR, dan budaya birokrasi yang lebih loyal pada kepentingan politik daripada norma hukum. Strategi penguatan BPK harus multidimensi, meliputi penguatan regulasi dengan sanksi tegas, koordinasi kelembagaan yang jelas, harmonisasi dengan standar internasional (ISSAI), serta pengawasan publik berbasis transparansi dan partisipasi masyarakat. Pendekatan ini menegaskan posisi BPK sebagai guardian of public money yang efektif dan akuntabel, mendorong tata kelola keuangan negara yang transparan, akuntabel, sesuai standar internasional, dan memperkuat prinsip checks and balances serta pemenuhan hak rakyat.

Abstract

Democracy is a system that exists in various countries with a government where supreme power lies in the hands of the people. However, in reality the implementation of democracy is difficult to implement ideally in accordance with the values contained in democracy itself, and how democracy is implemented in Islamic democracy, especially if the election systems between Turkey and Indonesia are clearly different or have similarities between the two. One thing that often happens regarding the implementation of democratic government is presidential elections, so that we can compare Islam and democracy in these two countries. This research uses normative juridical research methods obtained from library data and statutory regulations. The results of this research show that firstly, the Presidential General Election in Indonesia and Turkey are clearly stated in the Constitution, both the Constitution of the Republic of Turkey and the 1945 Constitution in Indonesia, as for the mechanism for the direct Presidential General Election System, it is regulated in article 2 of Law Number 7 2017 regarding the Presidential General Election. Meanwhile. The two similarities are related to the system for holding the Presidential General Election, namely using a direct election system and regarding the comparison of the Presidential Elections of the Republic of Indonesia and Turkey, there are many Similarities were found, such as the presidential election system in both countries using a direct election system, presidential candidates having to be nominated by a party, the party system using a multiparty system, the existence of a party threshold for nominating the president and office of President in Indonesia an Turkey which is 5 (five) years for a period and can be nominate for two more periods. Meanwhile, the difference between the general elections of the Republic of Indonesia and Turkey is that there is a minimum age limit for the president and a threshold percentage for the party.

Abstract

This article aims to describe the phenomenon of judicialization of politics in Indonesia. This phenomenon became known at the beginning of the 21st century, which was marked by the resolution of matters relating to public policy, morality, education and political controversies through judicial institutions. The emergence of the judicialization of politics can be seen in the shift in the resolution of political conflicts which were previously resolved through political institutions, namely the MPR, to judicial-based resolution. To be able to see this phenomenon, this article will discuss the brief minutes of the formation of the Constitutional Court in Indonesia. From a socio-historical perspective, the establishment of the Constitutional Court is an institution that is not only intended to fulfill judicial interests, but also expands its presence into the political realm. Apart from that, this article will also explain the decision of the Constitutional Court regarding the institutional position of the Corruption Eradication Committee and the age limit for presidential and vice-presidential candidates to show that the phenomenon of judicialization of politics is clearly present in Indonesia through the Constitutional Court Decision.

Abstract

Since the amendment to the 1945 Constitution of the Republic of Indonesia which has been running for 20 years, the role and authority of the Regional Representative Council (DPD) is very limited. Based on its basic authority as in article 22D, the DPD is equipped with the authority to propose bills, discuss bills, and carry out supervision which is used as a consideration by the DPR on products and the implementation of laws relating to regionalism. Seeing the condition and influence of the DPD which is not very significant, the discourse to strengthen or dissolve the DPD in the Indonesian constitutional system cannot fail to be an important factor that cannot be separated from amending and revising its derivative regulations. Departing from this, the proposal to strengthen the DPD could have implications for implementing the concept of "strong bicameralism" or if the DPD is abolished, namely by strengthening government at the regional level.

Abstract

The issue of corruption in Indonesia has become a very tough problem to eradicate. A culture that has been rooted from generation to generation where state financial losses are dredged up. Various programs are created in the name of people's welfare but in fact create opportunities for personal enrichment. So far, sanctions for corruptors have not found a bright spot in creating clean institutions and countries. Starting from prison sanctions, to impoverishing corruptors still gives doubts whether the purpose of punishment to provide a deterrent effect has been realized. So that then raises another option whether the sanction of returning state financial losses can bring more benefits or still not. Departing from this, this article aims to examine more deeply the element of state financial losses in corruption cases by looking at the judges' considerations in deciding corruption cases. Then by examining and trying to construct the principle of lex specialist systematic as a legal reference in determining the verdict of returning state financial losses for perpetrators of corruption.
