Abstract

Drug abuse by police officers not only raises legal issues, but also ethical issues in the police profession. In this case, criminal and ethical liability are two interrelated aspects. Criminal liability relates to legal actions that must be taken against police officers who are proven guilty of drug abuse, while ethical liability relates to violations of the police code of ethics that reflect the morals and integrity of the profession. The formulation of the problem is 1) How are the legal regulations related to drug abuse by police officers in Indonesia? 2) How are the criminal and ethical liabilities for police officers involved in drug cases? The approach method used in this legal research is to use the normative legal approach method. The results of the research are legal regulations related to criminal acts committed by members of the police, namely regulated in several regulations, Law Number 2 of 2002 concerning the Republic of Indonesia Police, Law Number 35 of 2009 concerning Narcotics, Law Number 36 of 2009 concerning Health and criminal and ethical responsibility for police members involved in narcotics cases, Criminal sanctions that can be given in the form of imprisonment and fines according to the crime committed.

Abstract

This study aims to review and analyze the normative legal aspects within the perspective of civil law in Indonesia, including legal considerations and the application of default (wanprestasi) in debt settlement agreements in the decision of the Slawi District Court Number 38/Pdt.G/2024/PN Slw. This is a normative legal research with data collection techniques using secondary data sources. The data collection method is through literature study, and the analysis is conducted using qualitative analysis. The results of this research include references to the Indonesian Criminal Procedure Code (KUHAP), the Indonesian Penal Code (KUHP), and the Indonesian Civil Code. The focus of this research is on the application of good faith in determining the decision between fraud and default. The findings indicate that in the decision Number 38/Pdt.G/2024/PN Slw, it was categorized as default (wanprestasi) because there was no bad faith in its resolution

Abstract

This abstract discusses the legal review of the validity of the transfer of rights to shares of joint property in the context of applicable laws and regulations. The transfer of shares in joint property can raise various legal issues related to the separation or division of property in a marriage. Joint property, which consists of goods acquired during marriage, has a special legal status, and any change in ownership status, including the transfer of shares, must be carried out by considering the principles of justice and balance of rights between husband and wife. In practice, the transfer of shares carried out without mutual consent or without proper legal procedures can risk causing disputes between the parties involved. Therefore, it is important to understand the legal basis governing the transfer of shares of joint property, including the rights and obligations of each party involved in the agreement. In addition, the regulation regarding the transfer of rights to shares of joint property also needs to refer to the provisions regarding the division of property in divorce or separation, where each party is entitled to obtain a fair share of the results of the joint business. A valid transfer of shares must follow the procedures established by law in order to avoid actions that are detrimental to one of the parties. Understanding the legal aspects of share transfer is very important to maintain the validity of the transaction and avoid potential legal disputes in the future.

Abstract

PT Anugerah Suryo Propertindo telah diajukan permohonan pembatalan perjanjian perdamaian oleh PT Pembangunan Daerah Kalimantan Selatan Perseroda dikarenakan telah lalai dalam melaksanakan perjanjian perdamaian (homologasi) namun majelis namun Mejelis hakim dalam Putusan Nomor 8/Pdt.Sus-Pembatalan Perdamaian/2024/ Pn.Niaga.Jkt. Pst menolak dengan alasan tidak terdapat fakta atau keadaan yang terbukti secara sederhana. Rumusan Masalah Penelitian ini adalah Bagaimana UU Kepailitan dan PKPU mengatur mengenai Perjanjian Perdamaian, Pembatalan Perjanjian Perdamaian dan Apakah penolakan permohonan pembatalan perjanjian perdamaian oleh Majelis Hakim dalam Putusan 8/Pdt.Sus-Pembatalan Perdamaian/2024/ Pn.Niaga.Jkt.Pst telah sesuai dengan UU Kepailitan dan PKPU. Penelitian ini menggunakan penelitian hukum normatif dengan data sekunder, Sifat penelitian bersifat deskriptif dan penarikan kesimpulan secara deduktif. Hasil dari Penelitian ini pertimbangan Majelis Hakim menolak permohonan pembatalan perdamaian ini dengan alasan tidak terbukti secara sederhana hal tersebut merupakan sebuah kekeliruan dikarenakan permohonan pembatalan perdamaiain yang diajukan telah terpenuhi Pasal 170 ayat (1) UU Kepailitan dan PKPU solusi kedepanya Majelis hakim lebih memperhatikan serta menunjung tinggi kepastian hukum sehingga dapat memberi jaminan kepastian hukum dan keadilan bagi semua pihak.

Abstract

This research examines the reasons for canceling registered trademarks according to Law No. 20 of 2016 concerning Trademarks and Geographical Indications, using case Number 45/Pdt.Sus-Merek/2022/PN.Niaga.Jkt.Pst. as the focus of study. The research aims to analyze the legal basis and judicial considerations behind the trademark cancellation and assess the application of Law No. 20 of 2016 in the case. A normative-juridical approach was employed by analyzing secondary data such as legislation, court decisions, and scholarly literature. The findings reveal that the cancellation is grounded in the violation of essential provisions of the law, specifically those concerning bad faith registration and similarity with pre-existing trademarks. This study underscores the significance of judicial consistency in implementing the law and recommends measures to improve trademark protection in Indonesia.

Abstract

Terrorism Financing is any action in the context of providing, collecting, giving or lending funds, either directly or indirectly, with the intention of being used and/or known to be used to carry out terrorist activities, terrorist organizations or terrorists. Finance or Funding is an important part of a terrorist attack, funds are very important in acts of terrorism because they will be used to support all actions that will be carried out to facilitate acts of terrorism, such as introducing ideology, funding the needs of terrorist members and their families, funding travel and housing, and recruitment , train new terrorists, obtain new names and documents, purchase weapons, and plan and carry out activities. The problem in this research is how are the qualifications for the criminal act of financing terrorism through charity foundations and also how is the application of criminal law and the judge's consideration of the criminal act of financing terrorism through charity foundations in Court Decision Number: 278/Pid.Sus/2022/PN Jkt.Tim. The research method used is normative juridical research using library data such as statutory regulations, court decisions, books etc. The research results show that the qualifications for criminal acts of financing terrorism through charitable foundations are contained in Article 4 of Law no. 9 of 2013 concerning Prevention and Eradication of Terrorism Financing Crimes. The application of criminal law to criminal acts of financing terrorism through charitable foundations, namely imprisonment and fines. The judge's considerations in court decision Number:278/Pid.Sus/2022/PN Jkt.Tim still does not fulfill the sense of justice because the sentence period proposed by the prosecutor and decided by the judge is still considered insufficient and not appropriate.

Abstract

The protection of children's personal data in cyberspace has become an increasingly important issue with the rapid advancement of digital technology. In Indonesia, the Child Protection Law (UUPA) aims to provide protection for children, including their personal data. However, the effectiveness of implementing this law to safeguard children’s personal data in conflicts with the law in the digital era faces various challenges. The first research question examines the effectiveness of the implementation of UUPA in protecting children's personal data, while the second question addresses focused on how to protect children personal data based on implementation of the law. The discussion reveals that the main challenges include a lack of understanding about the importance of protecting children's personal data, digital literacy disparities, weak supervision of digital platforms, and limited enforcement of cybercrimes. Moreover, cross-border legal issues and the lack of readiness of law enforcement officials in handling cybercrimes involving children exacerbate the protection of children's personal data. The recommendations include enhancing digital literacy, strengthening regulations, and fostering collaboration between the government, private sector, and society to create a safer online environment for children.

Abstract

This research is motivated by the problem of overcrowding in the State Detention Center (Rutan) or Correctional Institution (Lapas). Overcrowding itself is an event where the accumulation of a number of detainees living in the detention center exceeds the capacity, as happened in the Depok class I detention center. The overcrowded phenomenon can certainly lead to the non-fulfillment of the rights of detainees that should be guaranteed while in the detention facility or prison. This research aims to find out the causal factors and the impact of the overcrowding phenomenon in the Class I Depok Detention Center and to find out whether Expulsion by law based on Minister of Law and Human Rights Regulation No. M.HH-24.PK.01.01.01 of 2011 can be an alternative to solve the problem of overcrowding in detention centers. The research found that the legal process is considered slow in handling a case and the lack of capacity of detention centers and law enforcers, in this case the capacity of prison guards, is a factor causing overcrowding in the Depok class I detention center, which can have a negative impact on detainee supervision and prison care and also violate the rights of detainees. Regulation of the Minister of Law and Human Rights No. M.HH-24.PK.01.01.01 of 2011 concerning the Release of Detainees by Law, which explains that detainees must be released if the detention period has expired by law. By releasing prisoners who have expired their detention period, it will certainly be able to prevent overcrowding and overstaying in detention centers and prisons. The release of detainees by law in this case can be said to be effective in solving the problem of the overcrowding phenomenon in the Depok Class I Detention Center.

Abstract

The existence of Law Number 6 of 2023 concerning the Stipulation of Government Regulation in Lieu of Law Number 2 of 2022 concerning Job Creation, in Article 88A Paragraph (1) which states that the Rights of Workers/Laborers to Wages arise when an Employment Relationship occurs between the Worker/Laborer and the Employer and ends when the Employment Relationship is terminated, in the Lawsuit for Disputes over Rights to Wages filed with the Industrial Relations Court by workers Adi Priyanto and Yussak Andrian against PT Nippisun Indonesia because the Workers' Wages were not paid even though the Workers' employment relationship had not been terminated and the Panel of Judges who examined the lawsuit issued a Decision in the main case, namely Rejecting the Plaintiffs' lawsuit in its entirety, the legal considerations of which cannot be considered, because they are not legally based. so that it should be declared rejected, then the first problem is how the Payment of Wage Rights in Law Number 6 of 2023 concerning the Stipulation of Government Regulation in Lieu of Law Number 2 of 2022 concerning Job Creation and secondly, how the Legal Considerations of the Industrial Relations Court Panel in decision Number: 153/Pdt.Sus-PHI/2024/PN Bdg, concerning the Case of Payment of Wage Rights have been in accordance with applicable regulations, the research method used by the author is normative legal research, namely research on the application of law, and it was concluded that the Legal Considerations of the Industrial Relations Court were very ambiguous and wrong in applying the law.

Abstract

Bringing foreign investment into Indonesia, especially to build infrastructure for a production process such as a nickel smelter that processes soil mud (ore) into a nickel mineral material, certainly requires very large funding. Legal certainty is needed from the beginning of the investment process, namely determining the land area where the nickel smelter factory will be built. The land acquisition process is also very important, because on the land there will be activities worth hundreds of billions of rupiah to bring in materials, workmanship and preparations until checking/commissioning can be carried out and then declaring the facility ready for production. The government should protect investors with good faith in the process of procuring/purchasing land from the community. Legal protection is something that the state must provide to foreign parties who will bring large investments to Indonesia, which of course will create jobs for the Indonesian people, as well as a domino effect for economic growth along with the project, micro, small and medium economic actors will participate in the business activities of the foreign investors. The government is obliged to protect foreign investors from land mafia who always take advantage of every land sale and purchase activity for a development project so that later foreign investors will not get disturbances from the internal Indonesian community, either individuals or legal entities. Moreover, foreign capital investment is legally protected by the state as ordered by Law Number 25 year 2007 concerning Investment, which also includes legal protection for Foreign Direct Investment.
