Abstract

Democracy is a system of government that emphasizes people's participation in the decision-making process. Although often associated with the Western world, democratic values are also found in Islamic teachings through the concept of shura (deliberation), justice, and trustworthy leadership. This article compares the concept of democracy from an Islamic and Western perspective in terms of philosophical basis, sources of law, highest authority, and political goals. In Islam, the highest sovereignty lies in the hands of Allah with the Qur'an and Sunnah as sources of law, while in Western democracy, sovereignty lies in the hands of the people with laws established through majority consensus. This study aims to examine and compare the concept of democracy from an Islamic and Western perspective, and to examine the relevance of both in the context of modern government. The method used is a library research with a descriptive qualitative approach, which examines primary and secondary literature related to the principles of democracy in both perspectives. The results of the study show that although Western democracy is rooted in the values of secularism and rationality, while Islamic democracy is based on revelation and sharia, both have common ground in terms of people's participation, social justice, and accountability of leaders. However, the striking differences lie in the source of legitimacy of power and the limits of individual freedom. In conclusion, democracy in Islam and the West can complement each other if understood contextually and implemented by paying attention to local and universal values that uphold justice and the welfare of the people.

Abstract

This paper aims to examine kaidah fiqhiyyah (the principles) regarding hadhanah (child custody). The discussion covers the definition, meaning, legal basis, and application of these principles in Islamic family law concerning hadhanah issues. This article also explores certain conditions that constitute exceptions to the main principles under discussion. The research employs a normative juridical method with a literature study approach. It analyzes primary legal sources such as the Qur’an and Hadith, classical Islamic legal texts, and statutory regulations. Secondary legal sources are also utilized, including scholarly journals, legal literature, and electronic media. The findings of this study indicate that based on the examined fiqhiyyah principles, it can be concluded that from the perspective of Islamic law, child custody is prioritized to the mother and her side of the family. This is because the mother plays a dominant role in providing affection and care for the child.

Abstract

The development of information technology has driven changes in economic activities, including in the practice of buying and selling which can now be done online. Online buying and selling provides convenience for the community, but also raises concerns about its validity and permissibility in the eyes of Islam. This study aims to examine online buying and selling based on the perspective of Islamic law, with a qualitative approach through literature study. The results of the study indicate that online buying and selling can be categorized as valid and permissive as long as it meets the pillars and conditions of the contract that have been set in Islamic law, such as clarity of the object of the transaction, agreement between both parties, and does not contain elements of gharar, fraud, or usury. This study confirms that the basic principles of muamalah in Islam provide room for transaction innovation as long as it is based on the values ​​of justice and transparency. Therefore, online buying and selling is permitted as long as it does not conflict with the principles of Islamic law.

Abstract

The ‘iddah period in Islamic family law serves as an essential safeguard for lineage, the dignity of women, and post-marital social stability. Qaidah Fiqhiyyah provide a normative foundation that elucidates the wisdom and objectives underlying the establishment of ‘iddah. This study employs a qualitative method with a literature review approach. Data were collected from primary and secondary sources, including classical and contemporary fiqh literature as well as Indonesian Islamic legal regulations. Two qaidah fiqhiyyah related to the issue of ‘iddah are discussed in this study. These qaidahs have been interpreted by scholars from the four major Islamic schools of thought, reflecting diverse perspectives that ultimately converge on a shared objective: the protection of women's rights. The ‘iddah period is not merely a ritual obligation, but a legal mechanism that realizes the objectives of Islamic law (maqāṣid al-sharī‘ah), particularly in preserving lineage and providing space for reflection and reconciliation. Understanding these principles is crucial for strengthening a just and compassionate Islamic family law system in the modern era.

Abstract

This study aims to examine the role and contribution of law enforcement officers in the planning and implementation of the restorative justice system for children involved in criminal offenses. In addition, the research method employed is normative juridical and empirical legal research. Data were obtained through data collection, literature study, and field research. The research findings indicate the continued dominance of the retributive approach in the legal culture of law enforcement, despite the increasing introduction of restorative justice. The retributive (punitive) approach still prevails in the legal mindset of Indonesian authorities. Many officers tend to impose punishment as the primary means of resolving cases, without considering rehabilitation or the restoration of social relationships.The implementation of the restorative justice system in handling juvenile criminal cases in Indonesia emerged from an urgent need to replace the conventional judicial approach, which tends to be punitive and neglects the developmental aspects of children. Factors such as children's psychological immaturity, the importance of protecting children's rights, and the negative impact of detention on a child's future strongly support the necessity of a more participatory and rehabilitative approach. This system is also driven by national regulations, such as the Juvenile Criminal Justice System Law (UU SPPA), and the demands of international conventions, such as the Convention on the Rights of the Child (CRC).

Abstract

Abstract The enforcement of law against children involved in traffic accidents is a complex issue that involves legal, social, and cultural dimensions. Although normatively regulated under Law Number 11 of 2012 on the Juvenile Criminal Justice System through the application of diversion and restorative justice, practical implementation in the field faces numerous obstacles, such as low legal awareness among the public and a permissive culture toward traffic violations committed by minors. This research uses the library research method with a content analysis approach. Data were collected from various written documents, including books, academic journals, statutory regulations, and relevant articles. The study is qualitative in nature and is presented descriptively to explore the content and meaning of the analyzed documents. The findings indicate that law enforcement against child traffic offenders is carried out through a non-punitive approach that prioritizes the protection of children’s rights and encourages dialogue with victims. However, the effectiveness of this process is hindered by several factors, such as weak parental supervision, lack of professional resources, and the absence of an integrated information system among law enforcement agencies. To address these challenges, it is necessary to strengthen the implementation of diversion and restorative justice, improve public legal literacy, provide training for law enforcement officers on child-friendly approaches, and develop an integrated legal information system. A collaborative, cross-sectoral approach is key to realizing a juvenile justice system that is fair, educational, and future-oriented.   Abtrak: Penegakan hukum terhadap anak yang menjadi pelaku kecelakaan lalu lintas menjadi persoalan yang kompleks karena melibatkan aspek hukum, sosial, dan budaya. Meskipun secara normatif telah diatur dalam Undang-Undang Nomor 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak melalui pendekatan diversi dan keadilan restoratif, praktik di lapangan masih dihadapkan pada berbagai kendala, seperti rendahnya kesadaran hukum masyarakat dan budaya permisif terhadap pelanggaran lalu lintas oleh anak. Penelitian ini menggunakan metode penelitian kepustakaan (library research) dengan pendekatan analisis isi (content analysis). Data dikumpulkan dari berbagai dokumen tertulis, seperti buku, jurnal ilmiah, peraturan perundang-undangan, serta artikel terkait. Penelitian bersifat kualitatif dan disajikan secara deskriptif untuk mengkaji isi serta makna dari dokumen yang dianalisis. Hasil penelitian menunjukkan bahwa bentuk penegakan hukum terhadap anak pelaku kecelakaan lalu lintas dilakukan secara non-punitif, dengan mengedepankan perlindungan hak anak dan musyawarah dengan korban. Namun demikian, terdapat berbagai kendala yang menghambat efektivitas penegakan hukum, di antaranya lemahnya peran keluarga, keterbatasan tenaga profesional, serta belum terintegrasinya sistem informasi antar lembaga hukum. Untuk mengatasi permasalahan tersebut, diperlukan penguatan implementasi diversi dan restorative justice, peningkatan literasi hukum masyarakat, pelatihan aparat penegak hukum dalam pendekatan ramah anak, serta pembangunan sistem informasi hukum yang terpadu. Pendekatan kolaboratif lintas sektor menjadi kunci dalam mewujudkan sistem peradilan anak yang adil, edukatif, dan berorientasi pada masa depan anak.

Abstract

Abstract The widespread circulation of cosmetics containing harmful substances has raised serious concerns about public health. The desire to appear attractive is often exploited by irresponsible business actors who market products without distribution permits and do not meet safety standards. This study aims to examine the role of the National Agency of Drug and Food Control (BBPOM) in supervising the circulation of hazardous cosmetics, identify the obstacles faced, and analyze the enforcement procedures implemented. The research employs an empirical juridical method with a descriptive qualitative approach. The study was conducted at BBPOM in Medan, and data were collected through interviews with BBPOM officials, cosmetic business actors, and consumers, supported by documentation and literature review. The findings indicate that BBPOM plays a crucial role in cosmetic supervision through intensified monitoring activities, laboratory testing, and public education. However, the effectiveness of supervision is hindered by limited human resources, low consumer awareness, and the rampant distribution of illegal products through online platforms. In terms of enforcement, BBPOM carries out confiscation, destruction of evidence, and submits cases to law enforcement authorities when criminal elements are found. Thus, BBPOM’s oversight functions not only administratively but also upholds moral values in line with the Islamic principle of halalan thayyiban. Strengthening cross-sectoral coordination, increasing public awareness, and enforcing stricter legal actions are essential steps to curb the distribution of hazardous cosmetics.   Abtrak: Maraknya peredaran kosmetik yang mengandung bahan berbahaya menimbulkan kekhawatiran serius terhadap kesehatan masyarakat. Keinginan untuk tampil menarik sering dimanfaatkan oleh pelaku usaha yang tidak bertanggung jawab dengan memasarkan produk tanpa izin edar dan tidak sesuai standar keamanan. Penelitian ini bertujuan untuk mengetahui peranan Balai Besar Pengawas Obat dan Makanan (BBPOM) dalam pengawasan terhadap peredaran kosmetik berbahaya, mengidentifikasi hambatan yang dihadapi, serta menganalisis proses penindakan yang dilakukan. Metode yang digunakan adalah yuridis empiris dengan pendekatan kualitatif deskriptif. Lokasi penelitian berada di BBPOM Medan, dan data diperoleh melalui wawancara dengan petugas BBPOM, pelaku usaha, serta masyarakat, didukung dengan dokumentasi dan studi pustaka. Hasil penelitian menunjukkan bahwa BBPOM memiliki peran penting dalam pengawasan kosmetik melalui kegiatan intensifikasi pengawasan, uji laboratorium, serta penyuluhan kepada masyarakat. Meski demikian, efektivitas pengawasan masih terkendala oleh terbatasnya sumber daya manusia, rendahnya kesadaran konsumen, serta peredaran produk ilegal melalui jalur online. Dalam hal penindakan, BBPOM melakukan penyitaan, pemusnahan, dan pelimpahan perkara kepada aparat penegak hukum apabila ditemukan unsur pidana. Dengan demikian, pengawasan BBPOM tidak hanya berfungsi secara administratif, tetapi juga memiliki nilai moral sesuai prinsip halalan thayyiban dalam Islam. Diperlukan sinergi lintas sektor, peningkatan edukasi, dan penegakan hukum yang lebih tegas untuk menekan peredaran kosmetik berbahaya.

Abstract

The phenomenon of motorcycle gangs has become a growing social concern, particularly in urban areas such as the city of Medan. These gangs are often involved in various criminal acts, including assault, vandalism of public facilities, and illegal street racing, all of which disturb public order. This study aims to examine the application of criminal sanctions against motorcycle gang members who cause public unrest. The research employs a normative juridical approach by analyzing relevant laws and regulations, complemented by empirical research through interviews with police officers, community members, and victims of motorcycle gang actions. The collected data is analyzed using qualitative analysis techniques. The findings reveal that the police play a crucial role in addressing motorcycle gang activities through preventive measures such as routine patrols and community outreach programs, as well as enforcing the law against perpetrators involved in criminal acts. The common crimes committed by motorcycle gangs include assault, murder, theft, property damage, and traffic violations. The legal sanctions imposed on perpetrators are in accordance with the Indonesian Penal Code (KUHP) and the Law on Traffic and Road Transportation, consisting of imprisonment, fines, and administrative penalties. The conclusion of this study is that law enforcement efforts against motorcycle gangs are in line with existing regulations. However, challenges remain, particularly in terms of evidence collection and handling perpetrators, many of whom are underage. Therefore, greater community involvement and collaboration between law enforcement agencies, the government, and educational institutions are recommended to comprehensively address the issue of motorcycle gangs.

Abstract

This study aims to analyze the effectiveness of the implementation of Government Regulation of the Republic of Indonesia Number 2 of 2003 on the Disciplinary Regulations of Police Officers in the enforcement of the Indonesian National Police Professional Code of Ethics (KEPP) within the Brimob Unit of the North Sumatra Regional Police. Employing a qualitative approach with normative-empirical design, data were collected through interviews, observations, and document analysis. The findings demonstrate the regulation’s effective enforcement, indicated by a yearly decrease in disciplinary violations. Nonetheless, implementation is challenged by the limited number of accredited personnel and the procedural requirement that disciplinary hearings be conducted at the provincial police headquarters. These findings highlight the necessity for capacity-building and structural reforms within the police institution to ensure just and efficient discipline enforcement

Abstract

This research discusses the criminal act of village fund corruption committed by village officials, using the case study of Decision Number 59/Pid.Sus-TPK/2019/PN Mdn. The focus of the study is to analyze the legal regulations related to village fund corruption, the application of the elements of corruption in the case, as well as the legal considerations of the judge in rendering the verdict. This study employs a normative juridical method through statutory and literature approaches, supplemented by field interviews. The findings indicate that the misuse of village funds often occurs due to weak supervision, limited legal understanding, and low integrity of village officials. The court's ruling refers to Articles 2 and 3 of the Anti-Corruption Law (UU Tipikor), considering elements such as illegality, abuse of authority, and state financial losses. In addition to juridical aspects, the judge also considered the socioeconomic background of the defendant. This research underscores the importance of reforming the village financial management system to ensure greater transparency and accountability, strengthening the legal capacity of village officials, and enhancing community participation in overseeing village fund utilization. Moreover, strong commitment and synergy among law enforcement agencies such as the Corruption Eradication Commission (KPK), the Prosecutor’s Office, and the Audit Board of Indonesia (BPK) are essential to ensure the effectiveness and sustainability of anti-corruption efforts at the village level. This case serves as a significant example of how legal approaches can be strategic instruments in upholding justice and protecting citizens' rights to corruption-free development.
