Abstract

This research is about the Position Position of Marriage Guardian according to Shamsi Ali (A Comparative Study between the Ḥanafi and Syāfi‘I school) This research is a literature study using (a) munakahat fiqh approach (b) historical approach (c) anthropological approach (d) normative theological approach (e) philosophical approach. The results of this study indicate that the position of the guardian of marriage according to the Ḥanafi school is not a pillar of marriage, Ḥanafi school allows the bride to pronounce her own consent, on condition that the bride must be mature, intelligent and in agreement with her future husband. The existence of a guardian in marriage according to the Ḥanafi school is not obligatory, but only perfect. The Syafi'i school considers the batil marriage contract whose ijab statement is pronounced by a woman, either a girl or a widow, sekufu or not, directly for herself or as a representative for others. Shamsi Ali considers marriage legal if the bride pronounces her own consent, the guardian only needs to give permission, Shamsi Ali reasons that, it will be much better and deeper in meaning if the bride directly recites her own consent because of the direct involvement of the bride and groom. Shamsi Ali also emphasized that, indeed, there is no verse that explicitly indicates that a guardian must pronounce consent for marriage.

Abstract

ABSTRACT Muh Alghifari, Nurul Safitri, Linda Oktaviana, and Kurniati TITLE " UNDERSTANDING USHULIYAH RULES: AL-AM, AL-KHAS, AL-AMRU AND AN-NAHYU AS A METHODOLOGY FOR DETERMINING ISLAMIC LAW”. There are at least three problems that will arise if the establishment of the Islamic law ignores the Ushuli theory; the ambiguity in the use of Ushuli theory, the misunderstanding of the Nash in the Qur'an and Hadith, and the broad interpretation because it does not focus on one or more of the Uushuri theories. The purpose of the study is to know the approach of the Ushuliyah al-am, al-khas, al-amru and al-nahyu as methodologies, procedures, and problems in the establishment of Islamic law. This research is a qualitative library research with a Ushul Fiqh approach. It is the same in the Qur'an as in the Quran. The procedure for the establishment of Islamic law is not much different from some of the views of scholars conducted, in general, namely by searching for the provisions of the law in Al-Qu’an and Hadith and analogous to the Islamic Shariah. The problem is that it lies at the core of the beginning of the law, on the different understanding and meaning that is presented or expressed by the scholars, the solution to overcome this problem by following the agreement of the scholar. Thus, in the understanding of the teachings of the Ushuri: Al-Am, Al-Khas, al-Amru and An-Nahyu, which is a small part of the studies of Ushuli, open a great opportunity for further research to discuss more fully about the teaching of Ussuri than Al-Amm, Al - Khas, Amru and Al – Nahyu. ABSTRAK Muh Alghifari, Nurul Safitri, Linda Oktaviana, and Kurniati TITLE "MEMAHAMI KAIDAH USHULIYAH : AL-AM, AL-KHAS, AL-AMRU DAN AN-NAHYU SEBAGAI METODOLOGI PENETAPAN HUKUM ISLAM”.Setidaknya ada tiga permasalahan yang akan timbul jika penetapan hukum Islam mengabaikan kaidah ushuliyah; ketidakjelasan dalam penggunaan kaidah ushuliyah, kesalahan dalam memahami nash dalam Al-Qur’an dan Hadis, dan interpretasi yang luas karena tidak terfokus pada salah satu atau beberapa kaidah ushuliyah. Ini menggambarkan bahwa kedudukan kaidah ushuliyah: al-am, al-khas, al-amru dan an-nahyu begitu sangat penting sebagai metodologi penetapan hukum Islam. Tujuan dari penelitian untuk mengetahui pendekatan ushuliyah al-am, al-khas, al-amru dan an-nahyu sebagai metodologi, prosedur, dan problematikanya dalam penetapan hukum Islam. Penelitian ini merupakan penelitian kualitatif berupa kepustakaan (library research) dengan jenis pendekatan Ushul Fiqh. Al-Am dan Al-Khas berbicara mengenai konteks yang sama mengenai mutlaq tetapi mutlaq yang dijelaskan pada Al-Am itu sama dengan muqayyad pada Al-Khas. Dalam Al-Amru dan An-Nahyu ini adalah sesuatu yang datang dari derajatnya tinggi kepada yang rendah, tetapi perbedaannya adalah perintah dan larangan. Prosedur penetapan hukum Islam tidak jauh berbeda dengan beberapa pandapat ulama yang dilakukan, secara umum yaitu dengan mencari ketentuan hukum dalam Al-Qur’an dan Hadis dan menganalogikan yang sesuai dengan syariat Islam. Problematikanya yaitu terletak pada inti awal kaidah, pada pengertian dan makna yang berbeda yang disampaikan atau diungkapkan para ulama, solusi untuk mengatasi problematika ini dengan mengikuti kesepakatan jumhur ulama. Maka dalam memahami kaidah ushuliyah: Al-Am, Al-Khas, Al-Amru dan An-Nahyu yang merupakan sebagian kecil dari kaidah ushuliyah dalam penelitian ini, terbuka peluang besar untuk penelitian selanjutnya membahas lebih lengkap mengenai kaidah ushuliyah selain dari pada Al-Am, Al-Khas, Al-Amru dan An-Nahyu.

Abstract

The number of application on marriage legalization in the last two years in the Religious Watampone Class I.B has been quite high. This is due to the high demands of people to legalize their marriage for certain reasons, such as divorce proceedings for an undocumented marriage, administrative requirements to get children’s birth certificate, TASPEN (retirement funds) administration, passport registration, getting veteran widow's pension, and publication ofmarriage certificate due to underhand marriage.Regarding the marriage legalization cases in the Religious Court Class I.B of Watampone, if the formal requirements have been met, then the religious court by the judges will make a verdict or decision of which written "the applicationis approved". Meanwhile, if the formal requirements are not met, then the judge will make a verdict or decision declaring that "the application is overruled". Judge in deciding a case will look and pay attention on posita (case, the actual fact) and should be in accordance with existing procedures, among others, present witnesses at the hearing and show that there is evidence for consideration. The judge, of course, will put forward maqasid syari’ah (the objectives of sharia),so that the impact will be on the benefit of generations, to keep and maintain the honor that will be seen in the decision or verdict of the judge who accepted and granted other. Therefore, marriage legalization in principle is one of the legal protection and legal certainty, as referred to in Article 7 KHI, toward a marriage that cannot be proven with a marriage certificate as an authentic document in accordance with the mandate of Marriage Act, which requires that every marriage shall be recorded by state institutions.

Abstract

AbstractThis study aims to (1) determine the effectiveness of criminal fines in the application of Law No. 22 of 2009 concerning Traffic and Road Transportation at North Luwu Police Station. (2) To determine the factors affecting criminal fines in the application of Law No. 22 of 2009 concerning Road Traffic and Transportation.This study used empirical juridical descriptive method. Collecting data using ordinary primary data, namely data obtained directly in the field such as through observations and interviews sourced from respondents, secondary data obtained and analyzed qualitatively which is then presented in a discriminatory manner.The results of the study showed that: law enforcement is less effective Criminal Fines in the Application of Law No.22 of 2009 concerning Traffic and Road Transportation. The factors that affect criminal fines in the application of Law No. 22 of 2009 concerning Road Traffic and Transportation are legal structure, legal culture, legal substance (legal rules) and other factors that affect the enforcement of criminal law fines including external factors, namely factors, officer factors, facility factors, and community factors.Research recommendations: There is a need for socialization and campaigns to the community related to Law No. 22 of 2009 on Traffic and Transportation and all elements of society, in order to comply with traffic rules, it is necessary to involve the community in counseling activities, there is a need for a review of the provisions of Criminal Sanctions to be in accordance with the capabilities of the community and to minimize the practice of bribery in order to replace or avoid fines in Law Number 22 of 2009; In order for Law Number 22 of 2009 concerning Road Traffic and Transportation to be implemented properly, it is necessary to improve adequate traffic facilities and infrastructure, especially in the North Luwu Police Area.Keywords : Traffic, Application of Criminal FinesAbstrakPenelitian ini bertujuan untuk (1) untuk mengetahui efektifitas pidana denda dalam penerapan Undang-Undang No. 22 Tahun 2009 tentang Lalu Lintas dan Angkutan Jalan di Polres Luwu Utara. (2) Untuk mengetahui faktor-faktor yang mempengaruhi pidana denda dalam penerapan Undang-Undang No. 22 Tahun 2009 tentang Lalu Lintas dan Angkutan Jalan.Penelitian ini menggunakan metode deskriptif yuridis empiris. Mengumpulkan data menggunakan data Primer biasa yaitu data yang diperoleh secara langsung dilapangan seperti melalui hasil pengamatan dan wawancara yang bersumber dari responden, data sekunder di peroleh dan dianalisis kualitatif yang selanjutnya disajikan secara diskritif.Hasil penelitian menunjutkan bahwa: penegakan hukum kurang efektif Pidana Denda dalam Penerapan Undang-undang No.22 Tahun 2009 tentang Lalu Lintas dan Angkutan Jalan. Adapun Faktor-faktor yang mempengaruhi pidana denda dalam penerapan Undang-undang No. 22 Tahun 2009 tentang Lalu Lintas dan Angkutan Jalan adalah struktur hukum, budaya hukum, substansi hukum (kaidah hukum) dan faktor lain yang mempengaruhi penegakan hukum pidana denda antara lain faktor eksternal yaitu faktor, faktor petugas, faktor fasilitas, dan faktor masyarakat.Rekomendasi penelitian: Diperlukan adanya sosialisasi dan kampanye kepada masyarakat terkait dengan Undang-Undang No. 22 Tahun 2009 Lalu Lintas dan Angkutan dan semua elemen masyarakat, agar mematuhi aturan lalu lintas, perlu melibatkan masyarakat  dalam kegiatan penyuluhan, perluadanya peninjauan kembali terhadap ketentuan Sanksi Pidana agar sesuai dengan kemampuan masyarakat serta untuk meminimalisir praktek suap dalam rangka menganti atau menghindari sanksi denda dalam Undang-Undang Nomor 22 Tahun 2009; Agar Undang-Undang Nomor 22 Tahun 2009 tentang Lalu Lintas dan Angkutan Jalan dapat dilaksanakan dengan baik maka diperlukan adanya perbaikan sarana dan prasarana lalu lintas yang memadaik hususnya di Wilayah Polres Luwu Utara.Kata kunci : Lalu Lintas, Penerapan Pidana Denda

Abstract

This study discusses the concept of the Indonesian state as stated in Article 18 of the 1945 Constitution of the Republic of Indonesia concerning the implementation of regional autonomy. the interests of the local community. One area that has the potential to implement special autonomy in Indonesia is Papua Province for the sake of accelerating the realization of justice and social welfare. Social welfare can be achieved by means of rehabilitation (recovery and capacity building), social security (guaranteeing the fulfillment of basic needs), empowerment (empowering the community to meet their needs independently with existing resources and potential), social protection (prevention of social vulnerability so that their needs can be fulfilled). basic requirements are met), and social assistance to maintain a normal life.

Abstract

AbstractThis research analyzes the construction of gender in Islamic law, particularly in relation to the narrative of Eve's creation from Adam's rib. This narrative is often the object of criticism from a feminist perspective, where the traditional view that places women as appendages of men is considered the basis of gender inequality in Muslim societies.The purpose of this study is to explore the views of Islamic scholars and feminists regarding the narrative of Eve's creation and its impact on the role of women in society, in the hope of contributing to building an Islamic theology that is more just and inclusive of gender issues.This study uses a literature review method to analyze various views and interpretations related to the narrative. Data were collected from relevant literature, both from the perspectives of traditional scholars and Muslim feminists.The results of the analysis show that although normative Islam supports gender equality, patriarchal interpretations of sacred texts still dominate social practices. However, inclusive interpretations proposed by Muslim feminists offer an approach that emphasizes equality and respect for women's rights. This research encourages dialogue between Muslim feminists and Islamic scholars to achieve a better understanding of the position of women in Islamic law. AbstrakPenelitian ini menganalisis konstruksi gender dalam hukum Islam, khususnya terkait narasi penciptaan Hawa dari tulang rusuk Adam. Narasi ini sering kali menjadi objek kritik dari perspektif feminis, di mana pandangan tradisional yang menempatkan perempuan sebagai pelengkap laki-laki dianggap sebagai dasar ketidaksetaraan gender dalam masyarakat Muslim.Tujuan dari penelitian ini adalah untuk mengeksplorasi pandangan para ulama dan feminis Islam mengenai narasi penciptaan Hawa serta dampaknya terhadap peran perempuan dalam masyarakat, dengan harapan dapat memberikan kontribusi dalam membangun teologi Islam yang lebih adil dan inklusif terhadap isu-isu gender.Penelitian ini menggunakan metode telaah pustaka untuk menganalisis berbagai pandangan dan interpretasi terkait narasi tersebut. Data dikumpulkan dari literatur yang relevan, baik dari perspektif ulama tradisional maupun feminis Muslim.Hasil analisis menunjukkan bahwa meskipun Islam normatif mendukung kesetaraan gender, interpretasi patriarkal terhadap teks-teks suci masih mendominasi praktik sosial. Namun, penafsiran inklusif yang diusulkan oleh feminis Muslim menawarkan pendekatan yang menekankan kesetaraan dan penghargaan terhadap hak-hak perempuan. Penelitian ini mendorong dialog antara feminis Muslim dan para pakar Islam untuk mencapai pemahaman yang lebih baik tentang posisi perempuan dalam hukum Islam.

Abstract

Abstrak: Penelitian ini tentang Wasiat Wajibah Terhadap Anak Angkat (Tinjauan Filsafat Hukum Islam Pasal 209 Kompilasi Hukum Islam), pokok permasalahan yang dibahas dalam tesis ini yaitu bagaimana status hukum anak angkat dalam Kompilasi Hukum Islam (KHI) dan bagaimana status hukum pemberian wasiat wajibah kepada anak angkat dalam pasal 209 Kompilasi Hukum Islam (KHI). Masalah ini diuraikan dengan pendekatan filsafat hukum Islam, dan pendekatan yuridis normatif, dibahas dengan metode deskriptif analitik.Status hukum anak angkat dalam Kompilasi Hukum Islam yaitu, status dalam perkawinan, anak angkat tidak termasuk kepada kelompok yang diharamkan saling kawin antara dia dengan orang tua angkatnya. Ia tetap berada diluar lingkungan kekerabatan orang tua angkatnya, bukan menjadi mahram bagi mereka. Selanjutnya, status kewarisan anak angkat adalah ia tidak termasuk ke dalam kategori seseorang yang berhak menerima warisan. Hal ini berarti, antara anak angkat dengan orang tua angkatnya tidak ada hubungan saling mewarisi dengan orang tua angkatnya, namun dalam Kompilasi Hukum Islam pada pasal 209 membuka peluang baginya menerima wasiat ataupun hibah dari orang tua angkatnya.Status hukum pemberian wasiat wajibah  kepada anak angkat dalam pasal 209 Kompilasi Hukum Islam (KHI) yaitu Penerima wasiat wajibah yaitu anak yang diangkat sebaiknya dari kalangan karib kerabat, jika tidak ada maka beralih kepada anak dari kalangan fakir miskin, yatim piatu, dan anak-anak yang berada dalam golongan ekonomi lemah, atau anak temuan (al-laqit). Pemberi wasiat wajibah adalah orang yang memiliki harta yang banyak sehingga memungkinkan tidak mengurangi perolehan harta peninggalan untuk pembagian warisan. Abstrack: The Research is Wajibah Wills to Adopted Child (Review of Islamic Philosophy Article 209 Compilation of Islamic Law), the subject matter discussed in this thesis is how the legal status of adopted child in The Compilation of Islamic Law (KHI) and how the legal status of wajibah wills to adopted children in article 209 of Islamic Law Compilation (KHI). This issue is outlined by the approach of Islamic legal philosophy, and the normative juridical approach, discussed by analytical descriptive method.The legal status of the adopted child in The Compilation of Islamic Law are the status of marriage, the adopted child does not belong to the group who are forbidden to get marriage with adoptive parents, they are not in relationship with their adoptive parents, and they are not mahram from them. Furtheremore, inheritance status of the adopted child is that it does not fall within the category of a person entitled to inheritance. This means that between adopted child and his adoptive parents there is no relationship of inheriting with their adoptive parents, but in The Compilation of Islamic Law in article 209 opens the opportunity for him to receive a will or grant from his adoptive parents.The legal status of the provision of wills to the adopted child in article 209 of The Compilation of Islamic Law, the recipient of the wills is the child who should be raptured from among the close relatives, if no one then turns to the children of the poor, orphans, and children who are in weak economy class, or the child’s findings ((al-laqit). The holder of a will is a person who has a lot of property so as to allow not to reduce the acquisition of heritage treasures for the division of inheritance.

Abstract

AbstractThis study examines the study of zakat and waqf legal legislation in Indonesia. This research is purely library research. Data obtained from available literature and documentation, whether in the form of laws or available books, were then analyzed using a historical approach and a statutory approach. Based on the results of the study, it can be concluded that the implementation of zakat and endowment law in Indonesia is seen from its history, starting from the era of independence to the reformation era. The birth of different legal regulations is influenced by the underlying conditions, such as the political motives of the ruling government, economy and religion. The legal position of zakat as a form of increasing the effectiveness of realizing community welfare and poverty alleviation. If so, zakat law legislation is considered necessary, so that people's awareness of zakat will be high and zakat can be used as an alternative to realizing community equality. The position of waqf law as a manifestation of the formality of the traditions of society in Indonesia, especially those who are Muslim, so that they can meet the needs of the times is the duty of the state as a regulator, so that in the form of waqf implementation it can function more as an increase in the socio-economic welfare of the people. Several new provisions on zakat law in Indonesia are different from what is taught in fiqh. Likewise with the new provisions of the law. waqf in Indonesia which is different from what is taught in fiqh, several new provisions in laws and regulations include expanding the parties who can become waqif and nadzir, expanding the types of waqf assets that can be donated, the waqf period does not have to be forever, changes status of waqf objects with clear terms and procedures, as well as detailed management and development of waqf assets. Abstrak:Studi ini menelaah studi legislasi hukum zakat dan perwakafan di Indonesia. Penelitian ini murni penelitian kepustakaan. Data yang diperoleh dari literatur dan dokumentasi yang tersedia baik itu berupa undang-undang ataupun buku yang tersedia kemudian dianalisis dengan menggunakan pendekatan historis dan pendekatan yuridis-normatif. Berdasarkan hasil telaahan dapat disimpulkan bahwa Pemberlakuan hukum zakat dan perwakafan di Indonesia di lihat dari sejarahnya di mulai dari era kemerdekaan sampai era reformasi. Lahirnya regulasi hukum yang berbeda-beda dipengaruhi oleh kondisi-kondisi yang melatabelakanginya, seperti motif politik pemerintah yang berkuasa, ekonomi serta keagamaan. Kedudukan hukum zakat sebagai wujud meningkatkan efektivitas mewujudkan kesejatraan masyarakat dan penanggulangan kemiskinan. Jika demikian legislasi hukum zakat dianggap perlu, sehingga kesedaran masyarakat dalam berzakat akan tinggi dan zakat dapat digunakan sebagai alternatif mewujudkan kesejataraan masyarakat. Kedudukan hukum perwakafan sebagai wujud formalitas tradisi masyarakat di Indonesia khususnya yang beragama Islam agar dapat memenuhi kebutuhan zaman merupakan tugas negara sebagai regulator, sehingga dalam wujud pelaksanaan wakaf dapat lebih difungsikan sebagai peningkatan kesejatraan sosial ekonomi umat. Begitu juga dengan ketentuan baru hukum. perwakafan di Indonesia yang berbeda dengan dengan apa yang diajarkan dalam fikih, beberapa ketentuan baru dalam peraturan perundang-undangan meliputi perluasan pihak-pihak yang bisa menjadi wakif dan nadzir, perluasan jenis harta benda wakaf yang bisa diwakafkan, jangka waktu wakaf tidak harus selamanya, perubahan status benda wakaf dengan syarat dan prosedur yang jelas, serta pengelolaan dan pengembangan harta benda wakaf yang diatur terperinci.

Abstract

Based on the results, it is found that the philosophy of tasyri 'polygamy in Islam requires the dimension of ontology, epistemology, and axiology to synergize between the historical texts and the historical context so that polygamy becomes a Shari'a that brings benefit to mankind either by do it or by leave it behind. The application of Islamic Law Philosophy to polygamy rules according to Government Regulation number 10 Year 1983 jo Government Regulation number 45 Year 1990 Chapter 4 2nd paragraph on the prohibition of Civil Servants of women to become second/third/fourth wives indicates that shows a law enforcement that in the dimensions of ontology, epistemology and axiology of Islamic law supports its enforcement along with the mission of justice and the benefit of mankind brought by the teachings of Islam itself. mplication of this research is the Philosophy of Islamic Law which is a legal philosophy consisting of three frameworks namely ontology, epistemology, and axiology has provided a comprehensive philosophical and juridical picture of tasyri 'polygamy in Islam and the application of Government Regulation number 10 Year 1983 jo Government Regulation number 45 Year 1990 Chapter 4 2nd paragraph on the prohibition of Civil Servant women become second/third/fourth wife.

Abstract

This research led to the application of the law of Islamic marriage in rural communities. The purpose of this research is to know the application of Islamic marriage legal on rural communities in the Mare, the effectiveness of the role of extension officers in the implementation of Islamic law in the Islamic marriage Mare and barriers in the application of the law Islamic marriage in rural communities in district Mare Bone Regency. The role of religion in the legal application of extension officers marriage Islam in Mare Bone Regency have not fully maximized. The countryside has not been entirely untouched by the public. The form of the application made by extension officers have not completely evenly in the Mare and the methods used in extension is not effective. In addition, the guidance material is delivered poorly understood by the public, so that the impact on the lack of implementation of relevant Islamic marriage law with the provisions of legislation in force in Indonesia. Constraints in the implementation of the Islamic law of marriage in society is a condition of the Mare was lacking presence and outreach programs respond to the low level of education of rural people in district Mare Bone Regency.
