Abstract

The advancement of marine biotechnology in the 21st century has transformed deep-sea microorganisms into highly valuable objects of exploitation, particularly due to their potential in the pharmaceutical industry, industrial enzymes, and biofuels. However, behind this promising prospect, the existing international law of the sea regime—primarily UNCLOS 1982—has not been able to adequately regulate the utilization of marine genetic resources (MGR), especially in areas beyond national jurisdiction (ABNJ). This study aims to analyze two main issues: first, the normative gaps and ambiguities within UNCLOS regarding deep-sea MGR; and second, the extent to which the 2023 BBNJ Agreement is capable of addressing these legal challenges. The method employed is normative legal research through a juridical-normative approach, drawing on international regulations, legal doctrines, and relevant scientific literature. The analysis reveals that the regulatory vacuum in UNCLOS has created significant disparities in access between developed and developing countries, opened opportunities for biopiracy, and threatened the sustainability of highly vulnerable deep-sea ecosystems. The 2023 BBNJ Agreement represents an important step forward, yet several issues remain unresolved, including the regulation of Digital Sequence Information (DSI) and concrete implementation mechanisms. This study also formulates policy recommendations for Indonesia as an archipelagic state with substantial strategic interests in the international governance of deep-sea MGR.

Abstract

Inheritance is the transfer of assets from a deceased person to their heirs, and their use to improve the welfare of surviving family members and improve their lives. This means that all rights and responsibilities of the deceased are fully transferred to the heirs or other individuals entitled to the transfer. This document is a crucial type of population administration document, as without it, other population administration processes can be hampered. Presidential Regulation Number 25 of 2008 concerning Requirements and Procedures for Registering Residents and Civil Registration, in Article 1 paragraph (10) explains that "Population events refer to every event experienced by citizens that needs to be reported because it can affect the issuance of a resident identity card, or other population documents. The formulation of the problem raised in this study is: (1) how urgent is the death certificate according to Indonesian civil law in the inheritance process?; (2) what is the impact that arises when there is a delay in issuing a death certificate in the inheritance process? The purpose of this study is to find out and understand the urgency of a death certificate according to Indonesian civil law in the inheritance process and to find out the impact of the delay in issuing a death certificate on the inheritance process. This study uses a normative juridical method by examining laws and regulations and a case approach with data collection techniques through literature studies of laws and regulations, legal literature. The conclusion is that recording death in the form of a death certificate to fulfill legal certainty. Legal certainty has a big influence on a law that If legal certainty is met, the law is considered to be in effect.

Abstract

This research comprehensively examines the legal protection afforded to crime victims within the framework of victimology in Indonesia. For decades, the Indonesian criminal justice system has tended to prioritize perpetrators over victims, leaving the latter's interests inadequately addressed. Employing a normative juridical approach supplemented by conceptual analysis, this study identifies that while Indonesia's legal framework for victim protection particularly Law No. 13 of 2006 as amended by Law No. 31 of 2014 on the Protection of Witnesses and Victims has made considerable progress, significant systemic gaps persist. Applying a critical victimology lens, this study finds that the implementation of victim rights such as restitution, compensation, and rehabilitative assistance remains suboptimal due to weak enforcement mechanisms, limited institutional capacity of LPSK (Witness and Victim Protection Agency), and insufficient victim access to legal information. This research concludes that reforming the victim protection system requires a more holistic approach not merely normative but also structural and cultural to ensure that victims can substantively enjoy their legally guaranteed rights.

Abstract

Tingginya tingkat tidak jujur dikalangan mahasiswa, seperti tindakan menyontek, plagiarisme, dan titip absen, tidak lepas dari faktor keserakahan dan adanya peluang untuk berbuat demikian. Sayangnya, hal ini telah berkembang menjadi budaya yang mulai diterima sebagai hal yang normal, padahal sikap ini dapat menjadi langkah awal tindakan korupsi. Penelitian ini bertujuan untuk menganalisis seberapa efektif pendidikan anti-korupsi dalam mencegah prilaku curang di lingkungan perguruan tinggi. Metode yang digunakan pada penelitian ini adalah pendekatan kuantitatif dengan library research. Analisis dilakukan dengan mejuruk berbagai sumber ilmiah, termasuk buku, journal, dan media kredible lainnya. Hasil penelitian menunjukkan bahwa pendidikan anti korupsi memiliki peran yang signifikan dalam dalam pembentukan karakter jujur pada mahasiswa sebagai langkah pencegahan perilaku korupsi. Namun efektivitasnya masih sangat bergantung pada individu mahasiswa, apakah penerapannya bersifat teori semata, atau dapat menjadi budaya dalam kehidupan sehari-hari.

Abstract

Violations of the code of ethics by judges in handling cases constitute a serious problem in the Indonesian judicial system, potentially undermining the integrity of the judiciary. Judges, as key actors in the law enforcement process, are required to uphold the principles of independence, impartiality, and professionalism in every decision they make. However, in practice, various violations persist, such as conflicts of interest, bribery, and abuse of authority. This study aims to analyze the forms of violations of the code of ethics by judges, the factors causing them, and their impact on public trust in the judiciary. The method used is a normative juridical approach by examining laws and regulations, the code of ethics for judges, and relevant case studies. The results indicate that weak oversight, low individual integrity, and external intervention are the main factors contributing to these violations. The resulting impact not only undermines public trust but also undermines the legitimacy of law and justice in society. Therefore, strengthening the oversight system, enforcing strict sanctions, and increasing awareness of professional ethics are necessary to maintain the dignity of the judiciary.

Abstract

Issues regarding the distribution of inheritance based on private wills still frequently cause tension in society. This occurs because wills are not made through authorized officials, so their legal validity is often questioned, especially during the evidentiary process in court. This study aims to determine the validity of private wills in the distribution of inheritance and analyze the judge's considerations in providing legal certainty in Decision Number 425/Pdt.G/2021/PN Jkt.Pst. This research uses a normative legal method with a statutory regulatory approach and a case study approach.The results indicate that private wills can still be used as a basis for the distribution of inheritance if they meet applicable legal requirements and do not conflict with inheritance provisions. However, their evidentiary strength is not as convincing as authentic wills, potentially leading to disagreements among other heirs. In Decision Number 425/Pdt.G/2021/PN Jkt.Pst, the judge assessed the consistency between the contents of the will, supporting evidence, and the testator's wishes before deciding the case. The judge's considerations are crucial in creating legal certainty and protecting the rights of disputing parties. Therefore, legal certainty regarding the distribution of inheritance based on a private will is greatly influenced by the strength of the evidence and the judge's assessment during the trial.

Abstract

Tunggu tubang is a customary inheritance system that continues to exist within the Semende community of South Sumatra. This system appoints the eldest daughter as the custodian and manager of family ancestral property, including houses and agricultural land, for the collective benefit of the extended family. This research aims to analyze the position of tunggu tubang as a customary law inheritance mechanism and to examine its role in maintaining family sustainability and social order within the indigenous community. The study employs normative legal research with a juridical-normative approach using literature review and qualitative descriptive analysis. The findings indicate that tunggu tubang does not grant absolute ownership to women but assigns them the responsibility to manage ancestral property based on communal values, social responsibility, and sustainability principles. The system contributes to food security and food sovereignty through the intergenerational management of agricultural land. From a gender perspective, tunggu tubang reflects recognition of women’s strategic roles, although it also entails significant social responsibilities. Furthermore, this practice can coexist with Islamic law and national law as long as it does not contradict fundamental legal principles. Therefore, tunggu tubang represents a form of harmonization between customary law, religious law, and national law within the Semende community.

Abstract

This study aims to analyze the administrative validity of the environmental approval for the Teluk Sepang Steam Power Plant (PLTU) project following the enactment of Law Number 11 of 2020 concerning Job Creation and to examine the application of the principles of authority, procedure, substance, and the General Principles of Good Governance (AUPB) in its issuance. This study also discusses legal protection for affected communities in environmental approval disputes at the State Administrative Court (PTUN). The research uses a normative legal research method with statutory, case, and conceptual approaches. Legal materials consist of primary, secondary, and tertiary legal sources obtained through library research and analyzed descriptively and qualitatively. The results show that the transition from environmental permits to environmental approvals under the Job Creation Law and the risk-based licensing system has changed the mechanism of environmental administrative supervision. In the Teluk Sepang PLTU case, the environmental approval was formally issued by authorized officials and in accordance with administrative procedures; however, substantively there are still weaknesses regarding environmental protection, public participation, transparency, and the application of the precautionary principle. Therefore, stronger administrative supervision and public participation are needed to achieve a balance between economic development and ecological justice.

Abstract

International treaties are one of the primary sources of international law that serve as the basis for relations and cooperation among states. The existence of the 1969 Vienna Convention on the Law of Treaties provides a legal framework governing the formation, implementation, and termination of international treaties. In its implementation, every state is obliged to comply with the principle of pacta sunt servanda, which emphasizes that every agreement that has been validly concluded must be carried out in good faith. However, in the practice of international relations, violations of treaty obligations are still frequently found, including unilateral interpretations, delays in fulfilling obligations, and unilateral termination of treaties. This study aims to analyze the binding force of international treaties based on the 1969 Vienna Convention and to examine the legal consequences arising from violations of international treaties. This research employs a normative legal research method using statutory and conceptual approaches. The data used are secondary data obtained through library research on the 1969 Vienna Convention, books, journals, and other international law literature. The data analysis technique uses descriptive qualitative analysis to explain the relationship between the principle of pacta sunt servanda, state obligations, and the legal consequences of treaty violations. The results of this study indicate that the binding force of international treaties arises from the consent of states to be bound by a treaty through ratification, acceptance, approval, or accession as regulated in the 1969 Vienna Convention. In addition, violations of international treaties may result in legal consequences such as suspension, termination, or withdrawal from treaties in accordance with the provisions of the 1969 Vienna Convention. The implications of this study highlight the importance of strengthening state commitment in consistently implementing international obligations in order to maintain legal certainty, stability in international relations, and mutual trust among states

Abstract

This article discusses the urgency of developing notary integrity as a preventive effort against abuse of authority in notary practice in Indonesia. Notaries as public officials have a strategic role in ensuring certainty and legal protection through authentic deeds, so that integrity is the main foundation in the implementation of their positions. The results of the discussion showed that there were various patterns of abuse of authority, including procedural irregularities, manipulation of the substance of the deed, conflicts of interest, and collusion that had an impact on legal losses for the parties. These irregularities have administrative, civil, criminal, and ethical consequences. To overcome this, a comprehensive strategy is needed through strengthening professional ethics, increasing supervision, transparency, and building a legal culture with integrity. Thus, notary integrity is the key to maintaining professionalism, accountability, and public trust in notary institutions.
