TADHKIRAH: Jurnal Terapan Hukum Islam dan Kajian Filsafat Syariah, Jurnal ini ditujukan untuk publikasi artikel ilmiah yang diterbitkan oleh STIKes Ibnu Sina Ajibarang. Jurnal ini menggabungkan terapan hukum Islam dengan kajian filsafat syariah. Melalui artikel-artikelnya, jurnal membahas aplikasi praktis hukum Islam dalam kehidupan sehari-hari serta aspek teoritis dan filosofisnya. Isu-isu yang dibahas mencakup terapan hukum islam dan kajian filsafat syariah. Dengan pendekatan multidisiplin, jurnal ini relevan bagi praktisi hukum Islam, akademisi, dan pembuat kebijakan yang tertarik dalam memahami implikasi hukum dan filsafat syariah dalam konteks kontemporer. Jurnal ini terbit 1 tahun 4 kali (Maret, Juni, September, dan Desember).

Abstract

This study examines the comparative fatwas of Muhammadiyah and Nahdlatul Ulama (NU) regarding the Islamic legal ruling on smoking in the Indonesian context. The research employs a qualitative method through a literature-based analysis of official documents, academic journals, and decisions from Bahtsul Masā’il and the Majelis Tarjih dan Tajdid. The findings indicate that Muhammadiyah declares smoking as prohibited (ḥarām) because it contradicts the objectives of Islamic law (maqāṣid al-syarī‘ah), particularly in preserving life (ḥifẓ al-nafs) and wealth (ḥifẓ al-māl). Conversely, NU categorizes smoking as reprehensible (makrūh) on the basis that no definitive textual evidence explicitly forbids it, while also considering socio-economic factors within society. Muhammadiyah adopts a normative-preventive approach, whereas NU emphasizes a cultural-educational one. The difference between the two fatwas reflects not a contradiction but a constructive ikhtilāf, enriching the diversity of Islamic jurisprudence in Indonesia.

Abstract

Penelitian ini bertujuan untuk mengkaji peran simbol keagamaan dalam merefleksikan maupun menutupi kesenjangan kelas sosial di masyarakat perkotaan, dengan menggunakan perspektif teori Karl Marx mengenai agama sebagai ideologi dan alat legitimasi kekuasaan. Metode yang digunakan adalah penelitian kualitatif dengan pendekatan studi kasus, melalui wawancara semi-struktural terhadap warga kota dari kelas sosial menengah ke atas dan kelas menengah ke bawah, serta tokoh agama setempat. Data dianalisis dengan teknik analisis tematik untuk melihat pola relasi antara simbol agama, posisi kelas, dan akses terhadap kekuasaan sosial-ekonomi. Hasil penelitian menunjukkan bahwa simbol agama kerap digunakan oleh kelas atas sebagai sarana pembentukan citra, legitimasi status, dan penguatan struktur sosial, sedangkan bagi kelas bawah agama berfungsi sebagai sumber harapan dan solidaritas sosial, namun tidak selalu membuka akses terhadap mobilitas ekonomi. Secara umum, agama dapat berfungsi ganda: menjadi media pemersatu sosial sekaligus cermin ketimpangan kelas yang tersembunyi dalam praktik keagamaan sehari-hari. Penelitian ini menegaskan pentingnya membaca agama tidak hanya secara teologis, tetapi juga sebagai fenomena sosial yang berkaitan dengan produksi makna, kekuasaan, dan distribusi sumber daya.

Abstract

Pendidikan humanistik menekankan pengembangan potensi manusia secara utuh dan menempatkan peserta didik sebagai subjek pembelajaran. Dalam konteks pendidikan Islam, nilai-nilai tersebut memiliki landasan normatif dalam Al-Qur’an, salah satunya QS. An-Nahl (16):125. Penelitian ini bertujuan untuk mengkaji konsep dan nilai-nilai pendidikan humanistik yang terkandung dalam QS. An-Nahl (16):125 ditinjau melalui pendekatan tafsir tarbawi, serta menganalisis implikasinya terhadap pengembangan konsep pendidikan humanistik. Penelitian ini menggunakan metode kepustakaan (library research) dengan sumber data utama berupa Al-Qur’an dan kitab-kitab tafsir, serta literatur tarbiyah dan jurnal ilmiah relevan. Analisis data dilakukan dengan model maqāṣid-interpretatif untuk mengungkap tujuan dan nilai pendidikan dalam ayat yang dikaji. Hasil penelitian menunjukkan bahwa QS. An-Nahl (16):125 memuat tiga prinsip utama, yaitu bil ḥikmah, mau‘izhah ḥasanah, dan mujādalah bi-allatī hiya aḥsan, yang mencerminkan nilai rasionalitas, empati, dan dialog edukatif. Temuan ini menegaskan bahwa pendidikan humanistik memiliki dasar konseptual yang kuat dalam Al-Qur’an dan relevan untuk pengembangan pendidikan Islam yang humanis dan dialogis.

Abstract

Incest is a form of sexual violence that not only violates social and religious norms but also causes serious physical and mental health impacts on victims. In the context of Islamic law, incest is considered a heinous act that violates sharia and may be subject to hudud or ta'zir punishment. Meanwhile, in public health, incest is viewed as an issue that poses long-term risks, such as genetic disorders, psychological trauma, and socio-economic consequences. This study aims to examine prevention strategies for incest through a holistic approach combining Islamic legal principles and public health perspectives. The method used is qualitative research with a normative literature review and descriptive-analytical approach. The findings indicate that incest prevention can be achieved through strengthening religious values within families, sharia-based sexual education, and improving mental health services and case reporting systems in the community. The implications of this study highlight the importance of synergy between religious institutions, healthcare professionals, and public policy in establishing effective and sustainable incest prevention systems.

Abstract

Solid waste management in Makassar City constitutes a strategic issue that extends beyond technical and administrative concerns to encompass legal, ethical, and socioreligious dimensions. Although the local government has established regulatory frameworks and policy instruments for waste management, empirical conditions reveal a persistent gap between legal norms and their implementation, as reflected in high waste generation rates, weak source segregation, limited public participation, and increasing pressure on landfill capacity. This study aims to analyze the effectiveness of waste management in Makassar City from the perspective of Islamic law and to examine the potential integration of Sharia principles in strengthening sustainable environmental governance. The research employs a qualitative approach with a descriptive-analytical design based on policy analysis, literature review, and theoretical synthesis of Islamic legal doctrines, particularly maqāṣid al-sharīʿah and fiqh al-bī’ah. The findings indicate that, despite the existence of adequate local legal instruments, waste management practices remain ineffective due to insufficient internalization of ethical values, weak law enforcement, and limited behavioral change within society. From the perspective of Islamic law, these conditions demonstrate the incomplete realization of the principles of amanah (trust and responsibility), maslahah (public interest), and the prevention of harm (lā ḍarar wa lā ḍirār) in both governmental practice and public conduct, thereby undermining the objectives of protecting human life and the environment. The implications of this research highlight the importance of synergizing positive law and Islamic legal principles to promote environmentally sustainable governance oriented toward long-term public welfare.

Abstract

The book Uqūd al-Lujjayn fī Bayān Ḥuqūq az-Zaujayn by Sheikh Nawawi al-Bantani is one of the classical texts that is very popular among Islamic boarding schools and the Muslim community of the archipelago. However, in contemporary discourse, this book is often the target of criticism from Muslim feminists who accuse it of being full of gender bias and patriarchal. This criticism arises because of discussions about the wife's obligation to obey her husband, the prohibition of leaving the house without permission, and the husband's permissibility to reprimand his wife who is considered nusyūz. This paper attempts to conduct a philological and hermeneutic analysis of the text Uqūd al-Lujjayn by reviewing the historical, methodological, and fiqh reference sources of Sheikh Nawawi al-Bantani. This study found that the patriarchal character in the book is pseudo (pseudo), not ideological. Sheikh Nawawi actually wrote this book within the tradition of Islamic jurisprudence (fiqh akhlaqiyyah), not as a legitimation of male power over women. Through a philological approach, it was found that the text's structure and selection of hadith in this book aimed to educate household morals, not to reinforce the patriarchal system. Therefore, accusations of gender bias against Sheikh Nawawi require methodological reexamination to avoid falling into ahistorical ideological readings.
