Abstract

Inheritance disputes in polygamous families often present complex issues regarding the commingling of assets (vermenging) which are not rigidly accommodated by Article 94 of the Compilation of Islamic Law (KHI). This study aims to analyze the legal reasoning of Supreme Court Justices in determining the status of joint property (gono-gini) and inheritance estate (tirkah) in cases where physical assets are administratively controlled by a single wife. This research employs a qualitative method with a normative- juridical approach and a case study of the Judicial Review Decision Number 107 PK/Ag/2016. The findings indicate that the Supreme Court applied a progressive legal paradigm by introducing the concept of Collective Joint Property. The judges ruled that assets registered under the name of the third wife constitute joint property belonging to the marital union of the husband and all three wives collectively. Legally, the asset was separated (tashfiyah) into two equal parts: one half as the deceased's inheritance estate, and the other half distributed equally among the three wives as their joint property rights, regardless of marriage duration or certificate holdership. Furthermore, this study found that the judge's ex officio action to annul the Freehold Title Certificate (SHM) even though not explicitly requested in the lawsuit's petitum was not a violation of the ultra petitum partium principle, but rather an absolute juridical consequence to ensure legal certainty and the executability of the verdict. This study concludes that in polygamous inheritance disputes, judges tend to prioritize distributive justice and material truth over procedural formalities and administrative evidence.

Abstract

The phenomenon of students deviating from the primary goal of studying religious texts to engage in other activities has become an interesting social issue to examine, especially in the context of pesantren education. This study aims to analyze the sociological factors underlying such behavior and the efforts to address it. The research uses a qualitative approach with a case study method in one of the pesantren. Data were collected through interviews, observations, and documentation. The results show that peer influence, routine fatigue, and lack of social control are the dominant causes. As stated by one of the pesantren caretakers, who also serves as the head of security, there is a need for a persuasive approach and exemplary behavior from the administrators to redirect students back to their primary objectives. This study recommends the importance of group-based counseling guidance and instilling discipline values through role modeling.

Abstract

As Indonesian citizens, the implementation of marriage has been regulated in Law Number 1 of 1974 concerning Marriage and the Compilation of Islamic Law. Legally, a marriage is declared valid if it is carried out according to religious provisions and is officially registered at the Office of Religious Affairs. However, in practice in society, there are still marriages only carried out based on religious provisions without being officially registered with government institutions, known as “nikah siri”. The research aims to determine the legal certainty of nikah siri. This research uses a normative approach through literature study to examine the position of nikah siri from the perspective of Islamic law and national law. The results show that nikah siri is a valid marriage practice from a religious perspective because it meets the requirements and pillars of Islamic law. However, in the context of positive Indonesian law, this marriage type is not legally recognized because it is not officially registered by the state. This lack of registration gives rise to various legal issues, particularly in terms of protecting the rights of women and children born from these marriages. They are at risk of not receiving legal rights such as birth certificates, inheritance rights, rights to support, and other protections. Although Islamic law does not require registration as part of the validity of a marriage, social and legal developments in Indonesia demand valid administrative evidence as a basis for legal protection. Therefore, marriage registration is not merely a formality, but a crucial step in realizing justice, legal certainty, and the common good in household and community life.

Abstract

The deep learning approach integrating mindful, meaningful, and joyful learning was implemented to address low creativity and independence among grade VIII students in Islamic Religious Education (PAI) at SMP Negeri 4 Kota Sukabumi. This qualitative case study examined: (1) deep learning implementation through four phases (preparation, exploration, application, reflection); (2) creativity enhancement via innovative projects like Islamic values posters and animated videos; and (3) supporting-inhibiting factors. Data were collected through observation, teacher-student interviews, and RPP document analysis aligned with the Merdeka Curriculum. Findings reveal deep learning effectively boosts creativity through akidah akhlak concept exploration and independence through personal reflection journals, supported by teacher commitment but hindered by limited digital facilities. The study provides a replicable deep learning-based PAI model for developing Pancasila student profiles.

Abstract

The social environment is a crucial factor influencing family education through the formation of children's values, behaviors, character, and learning achievement. This study aims to analyze the positive and negative impacts of the social environment on family education, examine its role in shaping family educational practices, explore the effects of technological advancements and social media on children's character development, and identify family strategies for optimizing the social environment to support children's education. This research employed a mixed-method approach combining library research and field research. Data were collected through a literature review of books, journal articles, previous research, interviews, and other scholarly works relevant to the research topic. The findings indicate that the social environment has an ambivalent influence, as it can both strengthen and weaken family education. The development of information technology, increasing individualism, and the growing flow of cross-cultural information have transformed the social environment from being local and homogeneous into one that is global, digital, and pluralistic. Effective family strategies for optimizing the role of the social environment include maintaining harmonious communication, providing moral role models, supervising social interactions, collaborating with communities and educational institutions, and utilizing technology wisely. Religious and cultural values serve as the fundamental foundation for creating a supportive social environment capable of fostering a generation that is morally upright, intellectually competent, and adaptable to social change.

Abstract

This study is motivated by the weakening of character formation among students, indicated by declining moral values, discipline, and responsibility in educational environments. The study aims to analyze the concept of At-Ta’wid (habituation) in shaping students' personality based on Ibn Miskawaih’s perspective and its relevance in modern education. This study’s novelty lies in integrating Ibn Miskawaih’s classical framework with modern learning theories to build a comprehensive habituation model. This research uses a qualitative library research method. Primary data include Ibn Miskawaih’s works, supplemented by relevant  journals and books. Data were collected through documentation and analyzed using content analysis. The findings show that At-Ta’wid is an effective method for character formation through continuous and consistent habituation. Repeated positive behaviors gradually form stable character traits in students. The success of habituation is influenced by teachers' role modeling and a supportive environment. The study concludes that At-Ta’wid remains highly relevant in modern education as a strategy for developing students' personality and moral character.

Abstract

This study analyzes the implementation of inclusive education services, which continue to face various challenges, including limited teacher competence, inadequate supporting facilities, adaptive curriculum constraints, and difficulties in meeting the learning needs of students with special needs. The purpose of this study is to examine the implementation of educational services for students with special needs at SP3I Primary School, SDN 093 Tunas Harapan Cijerah. This research employed a qualitative approach using a case study method. Data collection techniques included semi-structured interviews with teachers, observations, and document analysis, such as Individual Learning Implementation Plans and the Individual Adaptive Curriculum for Students. The findings reveal that SDN 093 has implemented the SP3I model continuously since 2005 through the establishment of the SP3I Team and Special Assistant Teachers, curriculum adjustments using individualized lesson plans that simplify learning materials with illustrations, as well as social-emotional development programs involving daily life skills and religious activities. These efforts have contributed to the development of an empathetic culture among students. Nevertheless, the main challenges include limited disability-friendly infrastructure, insufficient learning aids for students with physical and visual impairments, and increased teacher workload due to minimal support from the another stakeholders. This study highlights the importance of internal school support in ensuring the sustainability of inclusive education. Furthermore, it provides an overview of the implementation of inclusive education at the elementary school level, particularly under conditions of limited resources, and is expected to serve as a reference for schools and policymakers in strengthening support for inclusive education services.

Abstract

This article examines the mapping and reconceptualization of Human Resource Development (HRD) within educational institutions through a Systematic Literature Review (SLR) combined with bibliometric analysis. The study is grounded in the need to contextualize HRD in the education sector, as most HRD literature remains dominated by corporate perspectives. The research focuses on the concepts, components, practices, and leadership roles involved in educational human resource development. The SLR process followed the PRISMA protocol, including identification, screening, eligibility assessment, and inclusion, with data drawn from Scopus, Crossref, and Google Scholar. Thematic analysis was applied to synthesize conceptual findings, while bibliometric analysis using VOSviewer mapped the intellectual structure and dominant clusters within the HRD discourse. The results indicate that HRD in educational settings is strategic and long-term in orientation, encompassing human capital planning, talent development, performance management, reward systems, HR digitalization through HRIS, and organizational development. Bibliometric findings also highlight the central role of human capital and leadership as key drivers of HRD effectiveness. The main conclusion emphasizes the need to reconceptualize HRD not merely as an effort to enhance individual competencies but as an institutional transformation tool that strengthens organizational capacity and fosters a sustainable learning culture. Thus, HRD emerges as an essential institutional strategy for ensuring the long-term quality and sustainability of educational institutions.

Abstract

The rapid development of digital technology has transformed the way information is produced, distributed, and consumed by society. While digital media facilitates access to information, it also contributes to the widespread dissemination of hoaxes, misinformation, and disinformation that may threaten social stability and public trust. In this context, the Islamic principle of tabayyun (information verification) becomes increasingly relevant as an ethical framework for evaluating information before accepting or disseminating it. This study aims to analyze the hadiths concerning information verification and examine their relevance from the perspective of maqāṣid al-sharī‘ah in responding to the challenges of the digital era. This research employs a qualitative approach using library research. The primary data consist of hadiths related to information verification, communication ethics, and caution in conveying information, while secondary data are derived from books, scientific articles, and studies on digital communication and maqāṣid al-sharī‘ah. Data were analyzed using content analysis with a normative-contextual approach. The findings reveal that the hadiths on information verification emphasize the values of honesty, caution, responsibility, and critical evaluation of information. From the perspective of maqāṣid al-sharī‘ah, tabayyun contributes to the protection of religion (ḥifẓ al-dīn), intellect (ḥifẓ al-‘aql), life (ḥifẓ al-nafs), and wealth (ḥifẓ al-māl) from the harmful effects of misinformation and digital disinformation. Therefore, tabayyun can be understood not only as an ethical principle of communication but also as an instrument for realizing public welfare and preventing social harm in the contemporary digital environment.

Abstract

This study aims to describe the concept of teacher wellbeing from the perspective of educational human resource management, analyze the role of human resource management in improving teacher wellbeing, and identify human resource management factors that influence teacher wellbeing in educational institutions. This study employed a qualitative approach using library research methods. Data were collected through documentation techniques from reputable international journals, indexed national journals, academic books, and other scientific sources relevant to teacher wellbeing and educational human resource management. Data analysis was conducted using content analysis through the stages of data reduction, classification, interpretation, and conclusion drawing. The findings indicate that teacher wellbeing is influenced by several human resource management factors, including school leadership, organizational support, professional development, school work culture, and workload management. Supportive human resource management practices were found to enhance teachers’ work motivation, professional engagement, job satisfaction, and instructional quality. Conversely, human resource management practices that neglect teacher wellbeing may increase work stress and burnout among teachers. This study concludes that teacher wellbeing is an integral part of educational human resource management strategies in improving learning quality and educational outcomes sustainably.
