Abstract

People's living and financial needs are increasing, causing people to have to try hard to meet these needs in various ways. The development of the banking sector in Indonesia is here to offer changes and benefits to society, especially regarding financial needs which are essentially always related to social life. One of the financial facilities that attracts public interest and is considered to make transactions easier, increase assets or develop a business is credit services. Credit is a loan originating from a bank to its customers with a return of principal and interest within a specified time period. However, in reality, this facility is actually vulnerable to the emergence of other problems such as bad credit which occurs between the creditor, in this case the bank, and the customer or in this case the debtor. Bad credit is a problem that is quite important to deal with because it not only affects the economic system as a whole. There are many factors that cause this dispute, both from creditors and debtors, so the aim of this research is to carry out an in-depth legal analysis regarding existing regulations regarding the problem of bad credit in the banking sector and the role of related institutions in resolving this problem and providing definite legal protection.

Abstract

Berdasarkan data Badan Pusat Statistik, pekerja perempuan di Indonesia mencakup sekitar 36,32 persen dari total angkatan kerja nasional. Namun demikian, peningkatan partisipasi ini belum sepenuhnya diiringi dengan jaminan perlindungan hukum yang memadai. Perempuan masih kerap menghadapi berbagai hambatan struktural dan kultural, seperti diskriminasi berbasis gender, pelecehan seksual di tempat kerja, beban ganda, serta akses terbatas terhadap posisi kepemimpinan. perlindungan hukum bagi pekerja perempuan di Indonesia telah diatur dalam Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan, yang selanjutnya diperbarui melalui Undang-Undang Nomor 6 Tahun 2023. Namun terdapat tantangan dalam implementasinya, Banyak pekerja perempuan masih mengalami kesulitan dalam mengakses hak cuti hamil, menghadapi diskriminasi berbasis gender, serta bekerja dalam lingkungan yang tidak ramah atau bahkan tidak aman. Menteri Pemberdayaan Perempuan dan Perlindungan Anak memberikan jawaban atas tantangan implementasi dalam perlindungan dan pemenuhan hak-hak pekerja atau buruh perempuan dengan menerbitkan Peraturan Menteri (PERMEN) Nomor 1 Tahun 2020 tentang penyediaan Rumah Perlindungan Pekerja Perempuan di tempat kerja.

Abstract

Irregular Indonesian migrant workers are a vulnerable group frequently subjected to human trafficking due to their undocumented and unlawful departure processes. Their absence from the official labor placement system leaves them outside the scope of state protection and exposes them to various forms of exploitation. This study aims to analyze the legal framework and implementation of protection for irregular Indonesian migrant workers as victims of human trafficking, as well as to identify the key obstacles hindering the effectiveness of such protection. Employing a normative juridical method, this research uses statutory and case-based approaches. The findings indicate that while Indonesia has established a relatively comprehensive legal framework through Law No. 18 of 2017 and Law No. 21 of 2007, its implementation remains suboptimal, particularly in reaching undocumented victims. Substantive, institutional, and socio-cultural barriers continue to undermine equitable protection efforts. Therefore, a holistic approach grounded in non-discrimination and victimology principles, along with strengthened cross-sectoral coordination, is essential to ensure the realization of victims’ rights in a meaningful and sustainable manner.

Abstract

Industrial relations disputes, particularly those related to termination of employment, are a significant issue in the labor sector that require fair and just legal resolution. One of the dispute resolution methods regulated under Law Number 2 of 2004 concerning the Settlement of Industrial Relations Disputes is mediation. The results of the mediation process are formalized in a joint agreement which can be registered at the Industrial Relations Court to obtain executorial legal force. However, in practice, violations of the contents of the joint agreement are still frequently found, even after the agreement has been ratified by the court. The joint agreement resulting from mediation and registered at the Industrial Relations Court (PHI) has binding legal force and can be executed like a court ruling. Nevertheless, violations of its implementation are still encountered, especially in cases of employment termination. This article analyzes the legal consequences of non-compliance with the joint agreement as well as the available execution mechanisms. The study results show that disregarding a valid and registered joint agreement may incur legal sanctions and affect the overall effectiveness of the industrial relations dispute resolution system. Strict law enforcement, institutional strengthening, and increased legal literacy are required as strategic steps to enhance legal protection for workers.

Abstract

The purpose of this study is to determine the role of the prosecutor against recidivist child offenders in Decision Number 23/Pid.Sus-Anak/2024/PN Smg. The research method uses an empirical and sociological juridical approach that examines the effectiveness of the application of law through analysis of regulations, social values, and the practice of handling children's cases. The results of the study explain that the role of prosecutors in the juvenile criminal justice system against recidivist child offenders in the Semarang District Attorney's Office is very important and takes place thoroughly from the investigation stage to prosecution. Prosecutors not only carry out the prosecution function, but also actively examine the completeness of case files, evaluate the results of the litmas from Bapas, and consider psychological, social factors, and the potential for child recidivism. Prosecution is carried out proportionally with a restorative and rehabilitative justice approach, paying attention to the principle of the best interest of the child, and applying disparity in charges between recidivist and non-recidivist child offenders. Obstacles in the form of time constraints and lack of family support are challenges, but case resolution is still pursued quickly, fairly, and in favor of the protection and social recovery of children. These findings indicate the urgency of improving the handling of recidivist child offenders, which requires a more comprehensive and adaptive update of the SPPA Law, as well as the issuance of prosecutor regulations as official guidelines based on restorative justice and the principle of the best interests of the child.

Abstract

Price fluctuations and the scarcity of cooking oil in Indonesia prompted the government to launch Minyakita as a subsidy product with the Highest Retail Price (HET) setting. However, the implementation of Minyakita distribution in Semarang City still raises various problems, especially related to mismatches in doses and violations of the HET. This research aims to examine legal provisions, the implementation of supervision, and the form of legal protection for consumers for these violations. This study uses an empirical juridical approach with a qualitative type. The results of the study showed that there was a practice of filling the dosage that did not match the packaging label and the selling price was above the HET (Rp15,700 per liter) which was Rp16,000-Rp17,000 per liter, which was clearly detrimental to consumers. On the other hand, supervision by the Trade Office and the Legal Metrology Unit has not run optimally due to limited resources and low public awareness in using the complaint mechanism. In conclusion, although there is a strong legal basis such as Law No. 8 of 1999, BPOM Regulation No. 31 of 2018, and Permendag No. 18 of 2024, the implementation of consumer protection is still weak at the regional level. Therefore, it is recommended to strengthen decentralized supervision, increase consumer education, and apply strict sanctions to violating business actors, in order to realize a fair, transparent, and community-friendly cooking oil distribution system.

Abstract

This study addresses the legal uncertainty surrounding the term limits of legislative members in Indonesia, encompassing the House of Representatives (DPR), Regional Representative Council (DPD), and Regional People's Representative Councils (DPRD). The core problem lies in existing laws, such as Law No. 17 of 2014 on MD3 and Law No. 8 of 2012 on Elections, which specify a five-year term but lack explicit limitations on re-election periods. This regulatory vacuum enables incumbents to hold office indefinitely, leading to significant implications for democratic quality. The research aims to analyze the legal and socio-political consequences of this unlimited tenure, including the stagnation of democratic circulation, the proliferation of political dynasties, increased risks of corruption, and declining public trust. It employs a normative-legal methodology, scrutinizing primary legal materials, academic journals, and survey data to evaluate the existing framework. Findings reveal that the absence of term limits undermines equal political opportunities, fosters political dynasties, and correlates with a high incidence of corruption cases among legislative members. Comparative analysis with other countries, such as Venezuela and the Philippines which impose strict term limits, highlights the necessity for reform. The study concludes that amending the 1945 Constitution and revising the MD3 Law and Election Law to include clear term limitations is crucial. These legislative reconstructions are essential to foster leadership regeneration, enhance accountability, and ensure a healthy, responsive constitutional democracy in Indonesia.

Abstract

Forced marriage, particularly involving underage victims of sexual violence, remains a pressing issue in Indonesia’s legal and human rights landscape. Despite the enactment of Law No. 12 of 2022 on Sexual Violence Crimes, which criminalizes forced and child marriage—including those justified by cultural traditions—challenges persist in enforcement and victim protection. This study examines the legal safeguards available to child rape victims forced into marriage with their perpetrators, evaluates the effectiveness of Indonesia’s legal system in addressing sexual violence, and explores necessary legal reforms to enhance justice for survivors. By applying a normative descriptive approach, this research identifies gaps in policy, law enforcement, and institutional support, emphasizing the need for stronger victim protection mechanisms, law enforcement consistency, and multi-sector collaboration to ensure comprehensive recovery and justice

Abstract

This study aims to examine the legal validity of the Deed of Sale and Purchase (AJB) of land in transactions where the buyer has not fully settled the payment. This phenomenon frequently occurs in land practices in Indonesia and raises legal concerns regarding the legal strength of AJB as an authentic deed made by a Land Deed Official (PPAT), especially in the case of breach of contract. The research focuses on two main aspects: the validity of AJB in incomplete payment transactions under agrarian law and PPAT regulations, and the legal mechanism for its cancellation and protection for aggrieved parties. A normative legal approach is used by analyzing statutory regulations, legal principles, and relevant court decisions. The findings show that while AJB remains formally valid if procedural requirements are fulfilled, it may be materially flawed when the payment condition as a substantive requirement is unmet. Cancellation of AJB may be pursued through a civil lawsuit for breach of contract, with the burden of proof placed on the seller. This study recommends strengthening regulations on payment verification by PPAT and incorporating breach of contract clauses in preliminary agreements to enhance legal protection and certainty in land sale transactions.

Abstract

Crypto asset atau cryptocurrency merupakan entitas baru pada sistem keuangan dan aset digital. Keberadaan crypto asset di Indonesia diakui sebagai komoditas berjangka dan aset digital serta keuangan digital. Keterbatasan pengaturan crypto asset sebagai jaminan, memahami pengguna atau pemilik nya telah meningkat, maka diperlukan adanya pembaharuan pengaturan yang dapat mengakomodasi crypto asset sebagai objek jaminan di Indonesia. Hal ini akan mempermudah pemilik atau pengguna crypto asset untuk memperoleh dana segar tanpa harus menjual aset digitalnya. Hukum jaminan dalam KUHPerdata belum mengakomodasi terkait permasalahan ini. Penelitian ini bertujuan untuk mengumpulkan dan menganalisis apakah hukum positif di Indonesia telah mengatur crypto asset sebagai objek jaminan dan bagaimana urgensi pengaturan crypto asset sebagai objek jaminan di Indonesia. Penelitian ini menggunakan pendekatan kualitatif dan jenis penelitian yuridis normatif. Sumber data pada penelitian ini menggunakan data sekunder yang berasal dari bahan hukum primer, sekunder, dan tersier. Bahan hukum tersebut dianalisis berdasarkan perspektif kualitatif dan diuji validitas datanya menggunakan triangulasi data dan triangulasi metode. Hasil penelitian dan pembahasan menunjukan bahwa: (1) hukum positif di Indonesia belum mengakomodasi terkait crypto asset sebagai jaminan, namun diakui sebagai komoditas dan aset digital serta termasuk keuangan digital. (2) Urgensi pengaturannya yaitu adanya pengakuan hukum terhadap crypto asset sebagai aset yang dapat dijaminkan, mekanisme pendaftaran dan pengawasan, penentuan nilai crypto asset sebagai jaminan, sistem penilaian dan pemantauan nilai jaminan secara otomatis, integrasi dengan sistem keuangan digital, perbankan, dan platform fintech, penyelesaian sengketa dan perlindungan hukum bagi para pihak, serta proses eksekusi jaminan yang efisien dan transparan sesuai dengan ketentuan hukum jaminan.
