Res Publica: Jurnal Hukum Kebijakan Publik is a peer-reviewed journal published by Constitutional Law Department, Faculty of Law, Universitas Sebelas Maret three times a year in April, August, and December. This Journal aims primarily to facilitate scholarly and professional discussions over current developments on legal issues in Indonesia as well as to publish innovative legal researches concerning constitutional law and democracy. It provides immediate open access to its content on the principle that making research freely available to public support a greater global exchange of knowledge. Published exclusively in English and / or Bahasa Indonesia (will be considered), the Review seeks to expand the boundaries of Indonesian legal discourses to access English-speaking contributors and readers all over the world. The scope of the articles published in this journal deal with a broad range of topics in the fields of constitutional law and democracy. Abstract

ABSTRAKArtikel ini mengkaji dan menganalisis implementasi dari presidential threshold yang secara nyata merupakan suatu praktik tidak lazim dan bahkan cenderung bertentangan dengan sistem presidensiil di Indonesia. Artikel ini akan mengangkat dua permasalahan utama yaitu pertama, penyebab presidential threshold  tidak cocok diterapkan dalam sistem presidensiil di Indonesia. Kedua, mengkaji praktik presidential threshold di negara lain. Penelitian ini merupakan penelitian normatif dengan pendekatan perundang-undangan, pendekatan konseptual, dan pendekatan perbandingan. Hasil penelitian menunjukkan bahwa pertama, penyebab ketidakcocokan penerapan presidential threshold di Indonesia adalah perpaduan antara sistem presidensiil dan sistem multipartai serta sukarnya untuk membentuk koalisi yang bersifat permanen. Kedua, negara-negara yang menerapkan sistem presidensiil seperti Brazil, Ekuador, Argentina tidak mengenal adanya ambang batas pencalonan Presiden. Setiap partai politik bahkan calon independen diberikan kesempatan yang sama untuk mencalonkan Presiden.Kata Kunci : Presidential threshold, Anomali, Sistem Presidensiil.ABSTRACTThis article analyzes the implementation of presidential threshold as unproper practice in presidential system in Indonesia. This article raises two main problems, first, This is a normative research with legal, conceptual, and comparative approach. The study discovers that first, he unproper of presidential threshold in presidential system is influenced by two reasons, a blend of a multiparty system with presidential system and the difficulties on forming a permanen coalition of political parties. Second, in other presidential countries such as Brazil, Ekuador, Argentina, there is no place for presidential threshold. Each political parties and even independent given same rights to propose their President’s candidate.Keywords : Presidential Threshold, Anomaly, Presidential System.

Abstract

Penulisan hukum ini bertujuan untuk mengetahui Pelaksanaan UndangUndang Nomor 6 Tahun 2014 Tentang Desa terkait dengan Pemilihan Kepala Desa di Desa Sumberejo Kecamatan Wuryantoro Kabupaten Wonogiri.Jenis penelitian yang digunakan dalam penelitian ini adalah penelitian hukum empiris yaitu diawali dari data sekunder yaitu buku-buku, literatur, dan dokumen terkait serta peraturan perundang-undangan yang terkait dengan pemilihan kepala desa, yang kemudian dilanjutkan dengan penelitian terhadap data primer dari lapangan atau terhadap masyarakat yaitu dengan wawancara kepada beberapa narasumber yang berkaitan. Sifat penelitian dalam penulisan hukum ini adalah penelitian deskriptif yaitu penelitian yang mempelajari masalah yang timbul di masyarakat serta situasi tertentu. Teknik pengumpulan data yang digunakan adalah dengan wawancara dan studi kepustakaan. Teknik analisis data menggunakan teknik analisis kualitatif yaitu menggunakan, mengelompokkan, dan menyeleksi data yang diperoleh dari penelitian lapangan yang kemudian dihubungkan dengan teori-teori,asas-asas, dan kaidah-kaidah hukum yang diperoleh dari studi kepustakaan. Berdasarkan hasil penelitian yang dilakukan oleh penulis, bahwa: 1) pelaksanaan pemilihan Kepala Desa di Desa Sumberejo dimulai dari tahapan Persiapan, Pencalonan, Pemungutan Suara, dan Penetapan dapat penulis simpulkan bahwa telah sesuai dengan prosedur peraturan perundangundangan.2)Adapun hambatan yang terjadi saat pemilihan Kepala Desa di Desa Sumberejo yaitu Pertama,kurangnya lokasi Tempat Pemungutan Suara.Kedua, kurangnya kejelasan oleh BPD dan pengawas dari kecamatan saat menjadi pengawas pemilihan Kepala Desa

Abstract

This article aims to analyze the implementation on function of Village Consultative Body (BPD) in village development in Prambatan Kidul village, Kaliwungu District, Kudus Regency. This research is an empirical legal research or non-doctrinal research with qualitative approach. The type of data used is primary data in form of field data  and secondary data which includes primary legal materials, secondary legal materials and tertiary legal materials. Data collection technique in this research are interviews and literature study. This study uses descriptive qualitative data analysis techniques. The results of this study indicate that the BPD Prambatan Kidul has not been able to function optimally. BPD Prambatan Kidul which has the three main function which are legislative, aspiration and supervision is still lack in collecting the aspirations. Whereas the realization of legislative and supervition has been carried out quite well. In addition, the ability of BPD members to handle aspirations is still not visible. There are inhibiting factors such as the quality of human resources, the facility factor and the Covid-19 virus factor that have a major influence on village development.

Abstract

This study aims to examine the Application of Treshold Parliamentary in the Establishment  of  Stable  Presidential  Governments  according  to  the 1945 Constitution of the Republic of Indonesia. This research is normative legal research, the types and sources of data used are secondary data consisting of primary legal materials and secondary legal materials related to the discussion. The nature of the research used is descriptive research using the Law approach, case approach, historical approach, comparative approach, and conceptual approach. The legal material analysis technique used is deduction with the syllogism method, meaning that the analysis of legal material prioritizes thinking logically so that it finds the cause and effect that will occur. The results of the study show how the influence of the implementation of the parliamentary threshold in the Indonesian electoral system towards the establishment of a stable presidential government adopted by Indonesia in accordance the 1945 Constitution of the Republic of Indonesia.

Abstract

Dalam jurnal ini meneliti dan mengkaji pembentukan pereraturan daerah DPRD Polewali Mandar khususnya mengenai pembentukan peraturan daerah Polewali Mandar mengingat beberapa tahun terakhir ini, masih banyak peraturan daerah yang bermasalah bahkan bertentangan dengan peraturan yang lebih tinggi di Indonesia. Hasil penelitian ini menunjukkan bahwa pembentukan peraturan daerah yang dilaksanakan DPRD Polewali Mandar sudah cukup baik. Pertama, DPRD Polewali Mandar sudah menggunakan beberapa dasar hukum mengenai pembentukan peraturan daerah yang berlaku saat ini sehingga mendapatkan kepastian hukum dan tidak bertentangan dengan peraturan yang lebih tinggi khususnya Undang-Undang Nomor 15 Tahun 2019 tentang Perubahan Atas Undang-Undang Nomor 12 Tahun 2011 tentang Pembentukan Peraturan Perundang-Undangan baik secara formil maupun material. Dari aspek materiil telah mencerminkan materi baik yang mencakup isi, bentuk maupun susunan yang disertai penjelasan atau naskah akademik. Adapun dari aspek formil telah dilakukan pembahasan melalui dua tingkat pembicaraan dan disetujui secara musyawarah mufakat oleh seluruh komisi dan fraksi DPRD serta pemda Polewali Mandar melalui rapat paripurna. Kedua, DPRD Polewali Mandar dalam pembentukan peraturan daerah telah menetapkan program legislasi daerah yang dikoordinasikan melalui Badan Pembentukan Peraturan Daerah dan Bagian Hukum Sekretariat Daerah. Sebanyak 16 raperda telah ditetapkan dengan perincian 4 raperda kelanjutan pembahasan dari tahun 2020, 7 raperda usul inisiatif dari pemda Polewali Mandar, dan 5 usul inisiatif dari DPRD Polewali Mandar.

Abstract

This study aims to find out how the implementation of Act Number 23 of 2014 on The Local Government againts the recess period process for the DPRD members of Sukoharjo Regency in capturing public aspiration to actualize the principle of popular sovereignty and how regulations order the recess period of parliament members.This study took a sample from five parliament members of five political parties in the DPRD of Sukoharjo Regency.The kind of research used in this research is a normative-empirical and descriptive legal research.The type of used data is primary data and secondary data. The source of primary data is direct interview with related parties of the research. The sources of secondary data are literature, regulations, journals, articles and materials from the internet and other related sources.Technique of  data collection that be used are field studies which directed to the object of research and literature study to obtain theoretical basis related to the research.Based the result of the research and discussion, concluded that the regulation regarding the recess period of DPRD members in Indonesia have regulated in various acts and regulations such as Act Number 27 of 2009 on Majelis Permusyawaratan Rakyat, Dewan Perwakilan Rakyat, dan Dewan Perwakilan Daerah, Act Number 23 of 2014 on Local Government, and Government Regulation Number 16 of 2010 on the Procedures of the Dewan Perwakilan Rakyat Daerah.Each DPRD members of Sukoharjo Regency have commited the mandate of recess according to Article 108 Section (i) and Article 161 Section (i) Act Number 23 of 2014 on Local Government. According to Article 108 Section (i) and Article 161 Section (i) Act Number 23 of 2014 on Local Government, DPRD members of Sukoharjo Regency have been doing periodic visit or recess to visit their constituents in their electoral region.

Abstract

ABSTRACTThis research aims to identify and examines issues related to the law interpretation used in the Constitutional Court Verdict Number 55/PUU-XVII/2019 and to analyze the extent to which this verdict has fulfilled the principles of democratic general election in order to formulate an ideal construction model of concurrent election to manifest a democratic election. The type of research in this article is normative or doctrinal and is a descriptive analytical legal research. The result shows that in the Constitutional Court Verdict Number 55/PUU-XVII/2019, the Constitutional Judge in interpreting uses historical and functional interpretation on which is the basis for expanding the meaning of concurrent election into 6 (six) variants of concurrent election design. Thereafter, in the Constitutional Court Decision Number 55/PUUXVII/2019, there are several variants of concurrent election designs that do not yet fulfill the elements and principles of democratic election management. Based on various studies and considerations, it is necessary to reconstruct the concurrent election model through the division of national concurrent election and local concurrent election.Keywords :  constitutional court verdict number 55/PUU-XVII/2019; concurrent election; interpretation; democratic election.

Abstract

No one has the authority to revoke the right to total immunity. Although the right to qualified immunity is relative, it can still be denied if it is used "intentionally" to belittle or degrade another person's honor and dignity. This research discusses the implementation of the rights possessed by members of the People's Representative Council (DPR), namely the immunity rights regulated in Law Number 20 of 2014 concerning the People's Consultative Assembly, the People's Representative Council, the Regional Representative Council, and the Regional Representative Council. In this research, the type of legal research that the author uses is normative legal research. The technique for collecting legal materials is carried out by studying literature which then uses the deductive method as an analysis technique. This research produces the author's views regarding the implementation of the right to DPR immunity which is reviewed based on Law Number 17 of 2014 concerning the MPR, DPR, DPD and DPRD..

In addition, it also examines the obstacles faced by the Karanganyar Regency Government in implementing good market empowerment. The main objective of the role of the Karanganyar Regency Government is as a facilitator in the participatory market empowerment process.This legal research uses descriptive empirical juridical research, the source of legal material consists of primary legal material and secondary legal material. The legal material collection technique used is related literature studies from print and internet media and field techniques that use interview methods.Based on the research and discussion, it can be concluded that the role of the Karanganyar Regency Government in Empowerment Implementation that can compete in the current competition era in Karanganyar Regency is carried out as a facilitator of empowerment planning review in Karanganyar Regency and managing the budget that has been planned by the Karanganyar Regency Government. planning stage, implementation stage, monitoring and evaluation stage. The obstacles faced are First, lack of budget or funds. Second relocation of traders. Third, there are third parties who are not satisfied with the arrangement of the market. Fourth, the lack of competitiveness of the People’s Market is compared to the Modern Market. Fifth, the draft regional regulation has not yet been passed. Sixth lack of human resources who master and understand about the people’s market. The seventh is a bad stigma about the People’s Market.

Abstract

This research aims to find out how was the management of Village Fund at Triharjo village in Sleman sub-district of Sleman District. Based on Government Regulation No 60 of 2014 juncto Government Regulation No. 22 of 2015 about Village Fund sourced from State Budget and Expenditure as well as analyze the obstacles that arise in the management of the Fund.The author of this research choose the empirical legal research with descriptive character using qualitative approach, research method that generates descriptive analytical data that is stated by the respondents according to their writing or orally also real behavior, that is researched and studied as a whole. This research uses the secondary and primary sources. While the sources collection technique carried out troughinterview and observation.Considering the result of research and discussion, it could be stated that the management of Village Fund at Triharjo village in Sleman sub-district of Sleman District were appropriate with the applicable law, but it still have obstacles that occurred because of the late report from the country side which got the stimulants fund of Village Fund at Triharjo village. The late report occurred because of the country side people still unfamiliar with the existence of Village Fund. So that, a socialization concerning on technical management of the Village Fund is needed. This socialization purpose is to adjust the implementation of the applicable Law concerning on Village Fund Management.
