Abstract

Loan activities or debts and receivables are common in Indonesian people in the scope of daily life. This research is intended to delve into the criminal law related to lending activities by focusing on regulations and phenomena that often occur along with the impact on users. This research uses data collection methods from various relevant sources or literature studies. The findings of this study prove that regulations and user rights are often ignored in credit lending activities and online loans (pinjol) or illegal loan funds. In this study, it is to voice more affirmations of civil law and criminal law against aggrieved users. The results of the study examined the factors, characteristics and impacts from various sides on illegal online loan users and on the perpetrators of these illegal online loans. This research yielded results regarding the low level of public literacy in social media which drags users to participate in online lending activities and activities with an attractive appearance and a fast process without further identifying the risks in the future

Abstract

This study aims to compare the concept of inheritance in three different legal systems: Islamic law, Anglo-Saxon law, and Continental European law. The main objective of this study is to analyze the differences, similarities, and social and legal implications of these different inheritance systems. The methodology of this research involves a literature review and analysis of relevant laws and regulations regarding inheritance law in the three legal systems studied. Data is collected from reliable primary and secondary sources, including Islamic legal texts, relevant laws and court decisions in Anglo-Saxon law, as well as legal regulations and precedents in Continental European law. The findings of this study reveal that Islamic law regulates inheritance based on Sharia principles, which divide inheritance proportionally according to family relations and religious provisions. Anglo-Saxon law adheres to the principle of intestate succession, whereby property is distributed to heirs based on lineage and special rules in law. On the other hand, the Continental European legal system bases the distribution of inheritance on the concept of a broader lineage, encompassing more distant relatives as heirs. The social implications of these findings highlight differences in the way societies manage inheritance and inheritance rights, which can affect justice and harmony in the family. From a legal perspective, the implication is the comprehensive variation in the protection of inheritance rights and the legal process that applies in each legal system.

Abstract

This study examines the comparison of the divorce legal system in three main legal traditions, namely Islamic Law, Continental European Law (civil law), and Anglo-Saxon Law (common law). Divorce as a legal event not only has implications for the breakdown of civil relations between spouses, but also has significant social, psychological, and economic consequences. Each legal system offers a different normative, procedural, and philosophical approach to regulating divorce, both in terms of terms, implementation mechanisms, and protection for vulnerable groups such as women and children. This study uses a comparative legal approach by utilizing Kelsen's theory of legal norms, Pound's theory of the social function of law, and Rawls and Dworkin's concepts of substantive and procedural justice. This analysis aims to describe the differences and similarities in divorce legal approaches in the three systems, as well as evaluate the effectiveness of each system in realizing justice and protection of rights in the context of divorce. This research also emphasizes the importance of harmonizing the principles of justice in divorce regulation in the era of globalization.

Abstract

In the business world, disputes between the parties involved are often unavoidable. Business disputes can arise due to various factors, such as differences in contract interpretation, unfair business competition, breach of agreement, or actions that are detrimental to one of the parties. Resolving business disputes is an important aspect in maintaining economic stability and business continuity, especially in the context of company law which regulates the rights and obligations of business actors, including the protection of investors. The research method used in this research is descriptive analysis, because it is based on the provisions governing business dispute resolution and its implications for investor protection in company law. The conclusion of this research is that resolving business disputes in the context of company law has a significant impact on investor protection. An effective resolution process, whether through litigation or alternative channels such as arbitration or mediation, can provide a sense of security for investors because they know there is a legal mechanism that can ensure their rights are protected in the event of a dispute. . Therefore, it is important to ensure that there are regulations that support fast and efficient dispute resolution as well as competent resolution institutions to protect investors' interests, both at the national and international levels.

Abstract

The rising trend of divorce has brought significant attention to the protection of women’s rights after marital dissolution. This study explores and compares how Islamic Law, Anglo-Saxon Law, and Continental European Law regulate post-divorce rights such as maintenance during ‘iddah, mut’ah compensation, joint property division, and child custody. Employing a normative-juridical and comparative approach through library research, the study examines primary and secondary legal sources. The findings reveal that Islamic Law emphasizes spiritual and social justice grounded in maqāṣid al-sharī’ah; the Anglo-Saxon system relies on judicial discretion to adapt to individual circumstances; while the Continental European system focuses on legal certainty through codified statutes. Each system presents unique strengths and challenges in ensuring protection for divorced women, particularly in addressing patriarchal practices, legal access disparities, and emotional needs. The study advocates for an interdisciplinary and integrative approach that synthesizes the strengths of all three systems to foster a more equitable, gender-sensitive, and contextually relevant legal framework for post-divorce women’s rights.

Abstract

Tax crimes accompanied by money laundering are important issues affecting the Indonesian economy. This illegal practice not only costs the country in the form of lost tax revenues, but also disrupts the legitimate financial system and has the potential to damage the integrity of the economy. This article aims to examine forms of tax crimes related to money laundering in Indonesia and assess the effectiveness of law enforcement against these crimes. Using normative legal research methods, this article explores various existing legal regulations and policies, including the Income Tax Law, Money Laundering Law, and other related regulations. The research results show that although Indonesia has a strong legal framework to tackle tax crimes and money laundering, the effectiveness of law enforcement is still hampered by various challenges, such as limited resources, weak institutional coordination, and gaps in the tax system. Therefore, increasing the capacity of law enforcement agencies, the use of advanced technology in detecting suspicious transactions, and increasing international cooperation are very necessary to strengthen law enforcement.

Abstract

Malaysia adalah sebuah negara federasi yang terdiri dari 13 negara bagian dan 3 wilayah persekutuan di Asia tenggara dengan luas 329.847 km persegi dan Ibukotanya adalah Kuala Lumpur, sedangkan Putrajaya menjadi pusat pemerintahan persekutuan. Jumlah penduduk negara ini melebihi 27 juta jiwa. Negara ini dipisahkan ke dalam dua kawasan Malaysia Barat dan Malaysia Timur oleh Kepulauan Natuna, wilayah Indonesia di Laut Cina Selatan. Malaysia berbatasan dengan Thailand, Indonesia, Singapura, Brunei, dan Filipina. Negara ini terletak di dekat khatulistiwa dan beriklim tropika. Kepala Negara Malysia adalah yang di-Pertuan Agong (raja) dan pemerintahannya dikepalai oleh seorang Perdana Menteri.

Abstract

This study aims to analyze the integration of the essence of syura values in the concept of Pancasila Democracy through a constitutional analysis approach to Article 1 Paragraph (2) and Article 2 of the 1945 Constitution. The method used is normative legal research with a qualitative and comparative approach, examining primary legal materials such as the text of the constitution and QS. Ali ‘Imran 3:159, as well as secondary materials such as journals and tafsir books. The results of the study show that there is a significant philosophical meeting point between syura and Pancasila Democracy, particularly in the rejection of authoritarianism, the emphasis on deliberation to reach consensus as the heart of decision-making, and the recognition of a transcendent value framework that limits human sovereignty. Constitutional analysis reveals that the phrase “implemented in accordance with the Constitution” and the naming of the People's Consultative Assembly can be interpreted as the institutionalization of shura values such as justice, public interest, and moral accountability. Thus, the integration of shura values enriches the meaning of people's sovereignty and restores substantive democracy without changing the foundations of the state. This study recommends strengthening the ethics of deliberation in constitutional practice to realize more dignified and just public deliberation.

Abstract

This study aims to analyze the Regional Regulation of Banjar Regency Number 6 of 2013 concerning the Control of Environmental Damage Caused by Forest and/or Land Burning, focusing on the conflict between the interests of local farmers and the prevailing environmental law provisions. Normatively, this regulation was established to prevent environmental degradation caused by land burning activities, particularly in peatland areas. In practice, however, farmers in Gambut District continue to burn land as a traditional method of cultivation and pest control for local paddy (banih habang), due to the absence of effective non-burning agricultural technologies provided by the government. This research employs a normative juridical method with a statutory and conceptual approach, using literature study techniques through analysis of laws, legal doctrines, and related documents. The results indicate that normatively, this regulation aligns with the environmental law principles stipulated in Law Number 32 of 2009 on Environmental Protection and Management, namely the principles of state responsibility, precaution, sustainability, and participation. However, substantively, its implementation has not been effective, as it has not been responsive to the socio-economic conditions of the farming community. The study concludes that the effectiveness of Regional Regulation No. 6 of 2013 depends not only on its normative content and sanctions, but also on the government’s ability to provide fair and practical alternatives for farmers, such as non-burning technology, environmental law education, and participatory policies that promote community legal awareness.

Abstract

This study analyzes the juridical implications of the protracted practice of appointing Acting Officers (Plt) and Daily Executors (Plh) in government administration in Indonesia. Normatively, Acting and Acting Employees are temporary solutions based on the Mandate (Article 14 of Law No. 30/2014) to ensure the continuity of public services. However, the practice of appointment that exceeds the ideal time limit (maximum 6 months based on SE BKN No. 1/SE/I/2021) raises legality issues. Juridical analysis shows that the prolonged extension of the Plt/Plh harms the Principle of Legal Certainty and the Principle of Professionalism in the General Principles of Good Government (AUPB). The implication is that State Administrative Decrees (KTUN) issued outside the scope of the mandate, especially in the personnel aspect, are classified as Ultra Vires and have the potential to be null and void at the State Administrative Court (PTUN). Therefore, it is necessary to affirm administrative sanctions and strengthen the merit system supervision mechanism by the authorized institution (KemenPAN-RB/BKN or the Independent Supervisory Institution in place of KASN) to ensure that the filling of definitive positions runs on time, as well as ensuring the legitimacy of the issued KTUN.
