Abstract

Anime and manga have been objects to digital copyright infringement by its fans around the globe for years. Fansubbing and scanlation activities creates a huge economic loss for Japan every year. In an effort to protect the intellectual property rights of anime and manga, Japan’s Ministry of Economy, Trade, and Industry in collaboration with anime and manga publishers are starting the Manga Anime Guardian Project. The purpose of this research is to explain how the project used to protect the intellectual property rights of anime and manga. Using liberalism view of the property right and the concept of public policy, this study argues that it is Japan’s responsibility to protect anime and manga as it’s people economy product, and cooperation between goverment and publishers is essential to implement policy strategies. The results of this study indicate that cooperative efforts of intellectual property right protection is done by persuasive approach to the fans and begin to bans sites that listed as illegal sites sharing intellectual property products protected under Berne Convention of Intellectual Property Rights.

Abstract

The notorious Viktor Bout, the most influenced person in the illegal arms smuggling hashuge reputation in supplying illegal arms to the conflicted countries. With his offshorecompanies and his wide-scale network in arms business he supplied small arms and lightweapon (SA/LW) freely without any suspicion of violated the arms embargoes. Liberiaand Angola were countries which clearly cooperated with Viktor Bout to illegally sellarms with the high intensity. Using the method of library research, arms traffickingconcept, and refer to the previous research also with the comparison method in the patternused by Bout in both countries, this research concludes that there is opposite pattern inarms smuggling between Liberia and Angola by Bout. In his operation in Liberia, Boutused the pattern of government assisted-trade which he used to cooperate with localgovernment to illegally break arms embargo and smuggle arms. In Angola, he used thepattern of company brokered-trade which allowed him to utilize his companies andcooperation network to help him smuggled arms to both government and rebel group inAngola.

Abstract

Ketidakmampuan Indonesia untuk memberikan pelayanan navigasi penerbangan yangmemadai sesuai Pasal 28 Konvensi Chicago 1944 merupakan alasan utama penguasaanruang udara Kepulauan Riau oleh FIR Singapura sejak tahun 1946. Upayapengambilalihan yang dilakukan oleh Indonesia dengan membenahi pelayanan navigasipenerbangannya berdampak pada peningkatan kualitas pelayanan tersebut yang signifikanmenjadi di atas rata-rata global pada penilaian dari ICAO tahun 2017. Tetapi, ruang udaraKepulauan Riau sampai tahun 2018 ini masih dikuasai FIR Singapura. Padahal,penguasaan ruang udara tersebut oleh FIR Singapura berdampak pada kedaulatanIndonesia yang berujung pada kerugian material. Melihat fenomena tersebut, identitasperan dan norma internasional menjadi elemen yang sangat berpengaruh. KepatuhanIndonesia dan Singapura terhadap norma internasional yang berkaitan denganpermasalahan ruang udara ini, yakni ICAO, serta identitas peran kedua negara di ruanglingkup ICAO itu sendiri mempengaruhi sikap kedua negara dalam memandangpermasalahan ruang udara tersebut. Identitas peran dan norma di ruang lingkup ICAOmenimbulkan persamaan perspektif yang berujung pada kepentingan bersama sehinggamenjadi penyebab Singapura masih menguasai ruang udara Kepulauan Riau.Kata Kunci: FIR, ruang udara, ICAO, identitas peran

Abstract

Immigrant become an important issue because some state used it for atool to fight for their interest. Tanjungpinang UNHCR discriminativepolicy for the sake of the interest of the donor state resulted a loss inUNHCR independency in giving a humanitarian aid. This researchobjective is to know United States through UNHCR within RefugeeStatus Determination giving in Rumah Detensi Imigrasi PusatTanjungpinang. In knowing that interest, used a theory called realismtheory. The type of this research is mixed methods that analyzed theTanjungpinang UNHCR discriminative policy that favor theAfghanistan nationality immigrant in Rumah Detensi Imigrasi PusatTanjungpinang. The discriminative policy that occur is to favor anAfghanistan nationality immigrants in term of giving the refugeestatus determination. The obtained result by this research shows thatUNHCR discriminative policy are not to bring United States interestto reform their image, but more to fight for their other interest.

Abstract

The problem of death penalty that befell Indonesian migrant workers in Saudi Arabia reached dozens of migrant workers starting from 2014-2018. Indonesian government in this case has made efforts to releasing the migrant workers which have been entangled by this death penalty and these efforts are a form of diplomatic relations, diplomatic protection, and the embodiment of official diplomacy in the first track diplomacy. Therefore, this research intends to describe Indonesia’s diplomatic efforts in the process of releasing death penalty’s convicted migrant workers in Saudi Arabia, and to describe the Indonesian government’s inhibition in guarding cases that ensnare the migrant workers due to Indonesia’s lower bargaining position than Saudi Arabia. This research uses two concepts, first concept is diplomacy, that can explain the efforts of Indonesian government diplomacy, formal diplomacy or the informal diplomacy. Second concept is bargaining position which can explain the obstruction of the Indonesian government because of its bargaining position in overseeing the cases. The results of this research are Indonesia's bargaining position is lower and weaker compared to Saudi Arabia because of several factors such as poor governance of the protection of Indonesian migrant workers, Indonesia’s dependency on Saudi Arabia, Indonesia’s economic problems, and owning death penalty system in Indonesia.

Abstract

Nigeria is an African country notorious for human trafficking across its borders.Trafficking in Nigeria is one of the biggest crimes after economic fraud and drugtrafficking. Victims of human trafficking in Nigeria are mostly children; this is becausetheir families have to deal with a number of economic constraints, for instance low wages,which make them more vulnerable to being trafficked. To overcome the problem, theUNICEF has been mandated by the UN to assist Nigeria in applying the internationalchild rights convention to combat the problem of child trafficking in there. In 2003,UNICEF and the Government of Nigeria agreed on the Child Rights Act, which is used asthe basis for addressing the problem of child trafficking. As a descriptive study, thisresearch aims to describe the phenomenon of child trafficking in Nigeria and gives anoverview of cooperation by the government of Nigeria with UNICEF in order to handlethat problem. This study would like to observe the Nigerian government's cooperation withUNICEF in addressing child trafficking in Nigeria. The cooperation between theGovernment of Nigeria with UNICEF related to child trafficking generates the ChildRights Act (CRA), which becomes the foundation of the rights of the child, as well as theprotection of the children.

Abstract

Annexation of Crimea by the Russian Federation through the Crimean declaration of independence from Ukraine and the Crimean referendum, as well as the treaty signed by the Russian government in March 2014 have made Crimea as de facto join with 21 other republics within Russian territory. However, most of the international community considers that the Crimean referendum is illegal and violates the international law. Because Russia is considered violating Ukraine territorial integrity through the presence of Russian military which is considered to affect the legality of the referendum. This study aims to analyze Russian identity influences Russian foreign policy in the annexation of Crimea. The identity in this case is the Russian national identity which is ‘personal identity’ in constructivism perspective constructed from Russian domestic concepts or ideas rooted in Russian ethnic, demographic, historical, and spiritual backgrounds that are closely related to Crimea, as well as Russian national identity is on the rise under Vladimir Putin. It will also explain the history, status, and progress of the annexation of Crimea, as well as international sanctions against Russia and the Crimea until 2017.

Abstract

The issue of terrorism is increasingly become world's attention post 11September 2001. One of the handling of the crime of terrorism is through thesoft approach conducted with de-radicalization program. Indonesia's deradicalizationprogram conducted by BNPT obtained objections fromTransnational Islamic Organizations in Indonesia. This research aims to findout the factors that influence the Transnational Islamic Organization’sresistance towards de-radicalization program of BNPT viewed from socialmovements perspective. The research method is qualitative and the type ofresearch is explanatory that explain the cause of rejections from TransnationalIslamic Organizations towards the de-radicalization program BNPT. Thisresearch uses globalization theory by Holton and social movements theory byMcCarthy and Zald. The results of this research indicate that the rejection’sresponse to the de-radicalization BNPT is a form of backlash conscious byTransnational Islamic Organizations to oppose Western thought. Viewed fromthe perspective of social movements, framing, and resource mobilizationstrategies seen in the rejection’s movements of the Transnational IslamicOrganization. In addition the political opportunity structure in the reformationera makes the system and political structure existed became more open. It hasprovided an opportunity for Transnational Islamic Organization to conduct itsmovement in criticizing the government.

Abstract

ASEAN as a regionalism has its own region problematic, that is Rohingya asylum seekers which commenced from the domestic conflict of Myanmar yet subsequently spread into a regional issue. ASEAN Way evokes a dilemma due to the non-interference principle that restricts such efforts and behaviors of the institution in handling the issue of Rohingya asylum seekers. The purpose to determine ASEAN efforts, with its ASEAN Way, to overcome the dilemma which has emerged in handling the issue of Rohingya asylum seekers yet inflict to regional destabilization. Written in Constructivist Paradigm and Logic of Appropriateness Concept, ASEAN Way dilemma uses consensus as a peaceful settlement of dispute at a time of universal human rights deployed globally in handling the issue of the Rohingya asylum seekers. The result of this research indicates there is a normative alteration in ASEAN Way in accordance with the standard of appropriate behaviors in global and social context of the universal human rights.

Abstract

Money laundering through the football sector according to the FATF report can be present through several channels, one of which is betting activities that in practice has a close connection with match-fixing. The linkages between the two is carrying a complex and broad dimension. This is not separated from the role of Singaporean criminal organizations that involved in many cases throughout the world. In responding to this, Singapore took two crucial policies as a handling effort after previously not recognizing that its country was the base of the perpetrators of betting activities and match-fixing. This research aims to describe and analyze the influence of the FATF Recommendation which is understood as the AML / CFT regime towards Singapore in handling related cases. The conceptual framework used is the concept of an international regime from Krasner (1983) and Barkin (2006) by using a rationalist approach that has a focus of discussion on the regulative effects of a regime in influencing a country's attitude or behavior. This study shows that changes in attitude through a policy adopted by Singapore in handling betting activities and match-fixing as an influence of the process of "accepting" and "complying" with FATF recommendations.
