Abstract

The policy of regulating carbon trading as an effort to mitigate climate change in the forestry sector in NTB still faces legal and normative obstacles in its implementation. The objectives of this study are to review the legal framework concerning carbon trading as a climate change mitigation instrument in the forestry sector and to identify the juridical and normative constraints encountered in implementing the carbon trading policy in the NTB forestry sector. This study employs a normative legal research method which examines law as norms, rules, and doctrines, aiming to answer the legal problems investigated. The approaches utilized are the Statute Approach and the Conceptual Approach. Secondary data was used, consisting of primary legal materials (legislation), secondary (scholarly opinions), and tertiary (legal dictionaries). The analysis was conducted qualitatively using an inductive-deductive reasoning pattern to draw significant conclusions. The findings indicate that forest-based carbon trading emerges as a potential innovative financing opportunity to support the sustainability of Social Forestry programs, addressing the lack of financial support that has long been a challenge. Carbon trading regulation must be viewed as part of an environmental governance mechanism that demands certainty, transparency, and fairness among actors. Therefore, the implementation of this policy must ensure community participation and the integration of regulations to prevent legal disharmony at the local implementation level.

Abstract

This study aims to explore fishermen's perceptions of destructive fishing practices in the coastal area of Sape, Bima Regency. The method used was a descriptive approach using a five-point Likert scale questionnaire. Data were analyzed using a manual thematic technique based on NVivo principles, which grouped statements into five categories: ecological impacts, socio-economic impacts, legal knowledge, attitudes toward the environment, and perceptions of the government's role. The analysis results indicate that fishermen have a high awareness of the ecological and socio-economic impacts of destructive fishing. They also demonstrated a positive attitude toward environmental conservation and law enforcement, although perceptions of government assertiveness remained low. These findings provide important insights for formulating policies for community-based fisheries resource management

Abstract

The persistence of early marriage within educational settings often results in school dropout. This study aims to (1) optimize the role of MTs and MA Darul Qur’an in Bengkel Village in supporting educational continuity for underage married students, and (2) identify the challenges encountered. Using a qualitative field study approach, the research explores the implementation of relevant educational policies and practices. MTs and MA Darul Qur’an address early marriage through two main strategies: offering Equivalency Education Programs (Packages B and C) and implementing inclusive policies that allow underage married students to continue formal education. These initiatives reflect the constitutional mandate of the 1945 Constitution, which guarantees every citizen’s right to education. The policy implementation has yielded positive results, as shown by the graduation of two underage married students. Nevertheless, challenges remain, including limited support from parents or spouses, low student motivation, lack of socialization and collaboration, insufficient regulatory guidelines, and limited community awareness. Moreover, the madrasa has yet to establish a comprehensive strategy to address these issues

Abstract

Altura Housing is located on Jalan Raya Mambalan, Gunug Sari District, West Lombok Regency, with coordinates -8°55'02.36‘S and 116°130'29’E. Benchmark point + 38. The housing area is a potential rice field area. The topography of the housing area is terraced with sandy loam and clay soil types. The analysis aims to determine the flood height in the housing drainage channels according to the flow direction and the Altura Housing Site Plant. The Altura Housing Complex does not yet have a safe point against flooding, whether caused by very high rainfall intensity or flooding originating from the Rainfall Catchment Area (ADT). Therefore, an analysis of the Housing Complex flood level with a 2-year return period using the Sherman Method is required. The results of the analysis of the two-year return period flood discharge using the Sherman method obtained a Q2Th of 0.878 m3/sec with a maximum rainfall intensity of 175.521 mm/hour and a drying duration of 10 minutes. And the channel construction material was designed using Yudith K225 concrete. The analysis results obtained a primary Yudith base width (B) of 1 metre, a secondary B of 0.8 metres and a tertiary B of 0.5 metres, an average slope of 0.002, a water velocity of 0.777 m/sec, and a water level in the primary channel of 0.4 m. The flood level or flood water elevation (EMAB) of the primary channel is +35.80, the secondary channel is +36.10, and the tertiary channel is +36.60. Therefore, it can be recommended that the Altura Housing Complex is safe from flooding

Abstract

Informed consent is a fundamental legal and ethical principle in medical practice that affirms the patient’s autonomy to make decisions based on complete and transparent information. The rapid digital transformation of health services in Mataram City—such as online registration systems, telemedicine consultations, and the implementation of digital signatures—has reshaped the legal framework of informed consent in Indonesia. This study aims to analyze the legal validity and implications of digital informed consent under Indonesian health law, as well as to identify mechanisms of patient protection in the digital era. Using a normative juridical method with statutory and conceptual approaches, this research examines relevant legislation, including the Medical Practice Law, the ITE Law, and the Personal Data Protection Law. The findings indicate that digital informed consent is legally valid as long as it fulfills the essential elements of a lawful agreement under Article 1320 of the Indonesian Civil Code and complies with Article 11 of the ITE Law regarding electronic signatures. However, regulatory gaps remain concerning technical procedures, authentication standards, and data protection mechanisms. Therefore, comprehensive regulations are urgently required to ensure legal certainty, medical accountability, and the protection of patient rights in Indonesia’s evolving digital health ecosystem.

Abstract

This article examines the implementation of village development and community empowerment in Mujur Village, Praya Timur Sub district, Central Lombok, through the lens of Law No. 3 of 2024 on Villages (amending Law No. 6 of 2014). It addresses two questions: (1) how village development and community empowerment are practiced in Mujur visàvis the Village Law and its implementing regulations; and (2) what the main obstacles are and how to address them. A socio legal (normative empirical) qualitative approach is used, combining legal analysis (Village Law, Ministerial Regulation No. 21/2020 and its amendment) with document review and contextual description (demography, village governance structure, and local economy) based on the village profile. Findings indicate that the statutory goals (well being, quality of life, and poverty reduction) require a participatory plan do check cycle via RPJM Desa, RKP Desa, and APBDes. Community empowerment should be inclusive, data informed, culturally sensitive, and involve village actors (village government, BPD, community institutions, BUMDes, and village facilitators) with facilitative, educational, representative, and technical competencies. Key obstacles in Mujur include human resource capacity, data quality, coordination, program continuity, and socio cultural challenges. We propose a 12‑month roadmap and a 5C+G framework (Capacity, Collaboration, Compliance, Communication, Continuity + Governance) to strengthen village level development and empowerment governance.
