Abstract

The authenticity of God’s revelation is important to study because it might raise doubts among Muslim scholars when it is used for interpretation. The purpose of this study is to examine the authenticity of the revelation using Hasan Hanafi's thoughts as an Islamic thinker who has serious attention to the topic. This study uses a qualitative method and employs literature study. The approach is dialectic and historical. The results of the study show that Hasan Hanafi, in determining the authenticity of the revelation, carried out historical criticism that is free from theological, philosophical, mystical, and spiritual aspects. Hasan Hanafi put forward four instruments to authenticate. First, the text must be in verbatim. Second, the words of the revelation received by the Messenger must be written down at the time of recitation. Third, the transfer is through writing. Fourth, the process of transfer from oral medium to the written one must follow the rigid rules of transfer. He confirms that Qur'an qualifies as an authentic holy book when it is authenticated with historical criticism.

Abstract

The increasing, often controversial, roles of the Indonesian Ulama Council or Majlis Ulama Indonesia (MUI) in society have attracted scholars to study the institution, including its fatwas and their arguments. This study examines how legal maxims (qawa'd fiqhiyyah) had been used to construct the arguments of MUI's fatwas. This study also identifies the legal maxims used, observes their frequencies, and determines the patterns of their application. Legal maxims are important since they show principles and logic to discover legal norms. Some 118 fatwas on ritual, Shariaheconomic, and socio-cultural issues are examined. This study found that 25 legal maxims had been used by the MUI's fatwas, with five being most frequently referred to. On average, each fatwa referred to 1.23 legal maxims. Fatwas on economic issues used most legal maxims with an average of 2.14, while those on socio-cultural and ritual issues used only 0.66 and 0.47 legal maxims on average, respectively. Fatwas on economic issues seemed to be the most dynamic ones.

Abstract

In the last two decades, the theme of intuition has increasingly attracted the attention of academics, including psychologists. The increasing interest of psychologists in intuition is because the process of judgment and decision-making within individuals often occurs outside of their conscious thinking. This happens when individuals face uncertain situations, time pressure, and complex, ambiguous, and even strange problems. Intuition is the capacity of the human soul to know or understand a matter automatically, effortless, and affectively without rational processes. Intuition in psychological studies is based on experiences and knowledge accumulated from the past and stored in memory. In contrast to the Islamic perspective, intuition (divine) is based on the experience of spiritual disclosure coming from divine gifts. This study uses a psychological approach with descriptive comparative analysis techniques to discuss intuition, its mechanisms and development, originating from two perspectives: Islam and contemporary psychology. This study constructs five types of intuition where spiritual intuition occupies the highest position, followed by moral, creative, expertise, and social intuition.

Abstract

The main purpose of this article is to denote the historical fact that Piagam Jakarta does not only instruct the state to apply the Sharia for the Muslim population but it also softens the binding force of the Sharia by obligating the state to harmonize the requirements of Sharia with the comprehensive understanding of Pancasila in its entirety. The research finding: the historical fact indicates that the consent of the representatives of the Muslim group in Panitia Persiapan Kemerdekaan Indonesia (PPKI) as well as in Badan Penyelidik Usaha Persiapan Kemerdekaan Indonesia (BPUPKI) is to the abandonment of the Islamic Clause (klausula tentang Islam). They called for the deletion of any reference to Islam. Hence, for this research, it can be concluded that the Islamic Clause does not present a counter-draft but forms a preliminary stage of Pancasila and its first sila. This conclusion is also strengthened by linguistic rules referring to the word “Ketuhanan” abstaining from making any statement about the attitude of people towards God. Therefore, replacement of the Islamic Clause with the term “Ketuhanan Yang Maha Esa” has removed any boundary which would have been established by any religious doctrines against the inclusion of citizens with equal rights and has opened the way for Indonesia to implement the universal human rights to their full extend. The research is done through socio-legal approach. It sees historical data from socio-legal perspectives.

Abstract

This research aims to explain the concept of religious tolerance of Mun'im Sirry from the reconstruction and reinterpretation of Sura al-Kafirun. This is library research using qualitative method and descriptive-explanatory research design. The analysis employed in this research is Critical Discourse Analysis by Teun A. Van Dijk. The authors use Critical Discourse Analysis to reveal the various strategic interests behind the writing of Sirry‘s commentary and the struggles of social and understanding of groups. The result of this research explains that the concept of religious tolerance offered by Sirry does not only stop in sociological framework, but, more than that, it also extends tolerance in a theological framework. In Sirry's perspective, Muslims need not only to respect, appreciate, acknowledge differences in belief with followers of other religions and live in harmony (sociological field), they also need to acknowledge the recognition of the possible salvation of other religious followers in the hereafter (theological field). Furthermore, the discourse cannot be separated from the power of the West as the controller of science and the ideologies that influence the discourse are rationalism, empiricism, or neo-mu‘tazilism.

Abstract

Recently, the issue of sexuality in Islamic bioethics has often led to discrimination on gender issues, especially against women. The model for reading religious texts influenced by patriarchal culture and the massive development of health technology are allegedly the two reasons for this problem. This article examines sexuality in the discourse of Islamic bioethics developed by Ingrid Mattson. This article is included in qualitative research with the type of literature study. The discourse on sexuality in Islamic bioethics developed by Ingrid Mattson is a material object in this research. At the same time, the formal object of this research is discourse theory. The three points described in this study include; what is the form of discourse reading religious texts about sexuality in Islamic bioethics from the perspective of Ingrid Mattson, what are the background factors, and what are the implications. As a result, Ingrid Mattson's reading of religious texts must present the historicity of each verse and consider a gender balance. The factor that causes this discourse to exist is discrimination, verses that defend women in sexuality. This discourse's implications can unravel the discrimination problem that often befalls women and children.

Abstract

The life of Javanese society in general is heavily influenced by the culture and the values of pesantren. For some Javanese who fall into the category of santri, their education cannot be separated from the world of pesantren. This also happens in Mlangi community, where they are also part of santri who study at pesantren. But as the time progresses and the time changes, the people of Mlangi also began to pursue formal education in their lives. This research uses the concept of dynamics and of modernization with historical research methods. The theory used is of evolution by Herbert Spencer. Spencer said that the evolution occurring in a society is based on the types of society in question. The typology of society developed by Spencer is a simple society and a pluralistic society. The historical research method consists of heuristics, verification, interpretation, and historiography. The study found that Mlangi community initially feel that religious education alone is sufficient. After modernization, they feel that formal education is also important in addition to the religious education obtained at pesantren. This is due to their evolving mindset due to modernization. In 2001, many parents started sending their children to several pesantren in Mlangi. In addition to studying at pesantren, they also want to study in formal schools because of the demands of an increasingly modern era. They want balance between the world and the hereafter.

Abstract

Political expression of religion can be dangerous for good governance system. And this has really happened in Indonesian history, both during the Dutch occupation and when Indonesia became independent. Religion has become a political vehicle in various forms of political parties and non-parties. Religion also caused military wars which resulted in heavy casualties. The research questions are: What are the factors that turn religion against the government? How did Hurgronje resolve the religious versus government conflict? The approach is carried out with the Sociology of Religion. This paper uses the IMRAD style. Materials obtained through documents and internet news media. The method used is qualitative. The Results: religion as a political doctrine will lead to conflict religion and government and through three groupings of the role of religion in the right portion, ala Hurgronje, will enable the government to reduce conflict

Abstract

This article aims to reveal the rareness of historical writing that elevated the female figure as the main character. This gives rise to the assumptions that women are not much involved in history. The method used in this article is the historical research method. This Article finds that there are several possible factors that have made the writing of women's development history neglected and relatively slow compared to other social histories. First, the erroneous paradigm of women's history. Many opinions assume that everything related to women's problems is domestic issues and private. While anything related to science is identical to the world of men. Second, the wrong perspective about women's world is very influential on other factors. Among them are methodological and source issues; women are considered to be dealing with private issues only, while most of the documents/data deal with public issues, which are dominated by men's world. Therefore, it is possible that women are often overlooked and neglected from the record

Abstract

The phenomenon of the emergence of the international terrorist group ISIS has succeeded in recruiting members from various countries in the world. This serious threat to national security is closely related to the issue of a person's citizenship status, either as a member or as a mere sympathizer. Several countries responded to the entry of their nationals into this international terrorist group with proposals to revoke their citizenship. On the one hand, international terrorism is a serious threat to state sovereignty, on the other hand the problem of denationalizing a former member or affiliated with ISIS is not an easy thing. Citizenship status is a human right that is protected, both in legal instruments in Indonesia and in international legal instruments. Citizenship law in Indonesia regulates in such a way regarding loss of citizenship. From an international perspective, international legal instruments strictly prevent member states from carrying out such denationalization efforts.
