Abstract

Indonesia’s Omnibus Law on Job Creation (Law No. 6/2023) sparks debate over labor rights, balancing economic growth and social justice. This study analyzes the law through John Rawls’ and Madjid Khadduri’s justice theories using normative-philosophical methods. Examination of legislative texts and policy documents reveals normative conflicts: severance pay cuts, flexible contracts, and unionization limits violate Rawls’ difference principle, disproportionately harming vulnerable workers. Khadduri’s Islamic justice framework further identifies breaches of maqāṣid al-sharīʿah, particularly eroding worker dignity (ḥifẓ al-ʿird) and collective welfare (maṣlaḥah). The study advocates labor policies integrating universal ethics—merging market efficiency with moral obligations—to protect workers. By synthesizing Rawlsian liberalism and Islamic ethics, it proposes a cross-cultural justice model for pluralistic societies. Findings emphasize reconciling legal reforms with transcendental values, ensuring labor protections align with both human rights and religious norms. This framework addresses Indonesia’s policy tensions while offering a template for equitable labor governance in culturally diverse contexts.

Abstract

This study examines the normalization of prewedding photography among urban Indonesian Muslims as visual culture serving aesthetic documentation, social status display, and love expression, while negotiating tensions with Islamic norms (khalwat, ikhtilath, tabarruj) derived from hadiths. Using maqāṣid al-syarī'ah and qualitative textual-cultural analysis, the research reframes prewedding practices not merely as Shari'ah violations but as spaces for reconciling religious authority and societal realities. Findings reveal adaptations like modest attire, non-physical poses, and sessions post-akad (marriage contract), reflecting “cultural ijtihad” to ethically reinterpret hadiths within digital visual culture. The study repositions hadiths as flexible ethical tools guiding Muslims to preserve honor (ḥifẓ al-’irdh) and marital spirituality (ḥifẓ al-dīn), transforming prewedding into expressions of Islamic values. It concludes that maqāṣidī-driven reinterpretation fosters harmony between popular culture and religious norms, advancing social hadith hermeneutics and Islamic visual ethics to address modernity’s challenges. This approach enables Muslims to navigate evolving traditions while upholding theological commitments through contextual adaptability.

Abstract

During the Sultanate era, Banten emerged as a global spice emporium, attracting international traders through its pepper-dominated 16th-century economy. Though its prominence in the spice trade has waned, historical traces persist through preserved heritage and enduring culinary traditions rooted in spice culture. This study employs qualitative methods and a cultural-historical approach within the Islam Nusantara framework to analyze women’s pivotal role in sustaining Banten’s spice-based culinary practices. As guardians of traditional recipes, healers, and perfumers, women preserve spiritual and health values tied to spices. Findings reveal their multifaceted contributions—from agricultural cultivation and post-harvest processing to local commerce—while embedding spices into religious rituals, spiritual healing, and cultural traditions. These activities enrich the symbolic significance of spices and reinforce community identity. Women’s strategic participation not only sustains the archipelago’s spice civilization but also bolsters the local economy, demonstrating how cultural stewardship aligns with Islamic principles of community welfare. This research underscores the intersection of gender, cultural preservation, and economic resilience in maintaining Indonesia’s spice heritage.

Abstract

This study explores Sendratari Kadita as a synthesis of Javanese heritage and Islamic spirituality, reimagining Princess Kadita’s story to promote female agency while integrating Islamic ethics and moral education like patience (ṣabr), retreat (ʿuzlah), and self-purification (tazkiyat al-nafs). Through ethnographic fieldwork—participatory performance observation, interviews with Sanggar Sri Manik’s founder, and textual analysis—the research demonstrates how Islamic norms are embedded via green attire (symbolizing purity), sacred accessories, and minimized mysticism. Sendratari Kadita functions as both cultural preservation and moral pedagogy, merging tradition with communal spirituality. It exemplifies Islam’s adaptability in harmonizing local customs without compromising orthodoxy, offering an inclusive model for cultural sustainability in Indonesia’s pluralistic society. The performance’s aesthetic-religious negotiation fosters coexistence amid diversity, positioning it as a replicable framework for heritage-faith integration. By reframing cultural performance as ethical instruction and interfaith dialogue, this study highlights art’s transformative potential in multicultural contexts, balancing identity preservation with progressive spiritual values.

Abstract

Indonesia’s halal certification self-declaration system faces criticism for oversight and accountability gaps. This study evaluates its compliance with transparency principles under national law and Islamic jurisprudence (fatwa), employing a mixed-methods analysis of legislative texts, case studies, and interviews. Contrasting law in books and law in action, findings reveal systemic gaps between regulatory ideals and implementation. Procedural misconduct—including data falsification and lax verification by Halal Product Process (PPH) officers—undermines accountability, exposing flaws in coordination and audit mechanisms. The self-declaration model inadequately safeguards halal integrity, requiring reforms: real-time monitoring, standardized verification protocols, and collaborative governance between Indonesia’s National Ulama Council (MUI) and state agencies. Such measures are vital to aligning Indonesia’s halal assurance with global Islamic economy benchmarks while safeguarding consumer trust and principles. The study underscores bridging normative-practical divides through adaptive governance, ensuring coherence and compliance in Indonesia’s evolving halal ecosystem.

Abstract

Indonesia’s Islamic fintech leadership necessitates aligning digital finance with Sharia governance and compliance. This study evaluates doctrinal conformity in Indonesia’s Sharia fintech ecosystem, focusing on spiritual-financial obligations (zakat, infaq, sadaqah) and commercial transactions. Through qualitative analysis of MUI fatwas, laws, and operational frameworks, systemic gaps are identified between maqāṣid al-sharīʿah (Islamic legal objectives) and current practices. Three critical deficiencies emerge: (1) ambiguous aqd (contract) standardization for P2P lending, (2) inadequate consumer data safeguards under OJK oversight, and (3) fragmented coordination between DSN-MUI and fintech operators. The research proposes a value-driven regulatory model integrating Islamic legal philosophy—prioritizing justice (‘adl), welfare (maṣlaḥah), and ethical risk-sharing—into governance structures. Such reforms could position Indonesia as a global benchmark for harmonizing faith-based economic principles with fintech innovation, ensuring legal certainty and advancing financial inclusion. By bridging jurisprudential expectations with technological advancement, this paradigm fosters sustainable Sharia compliance while strengthening inclusive digital finance ecosystems.

Abstract

This qualitative case study investigates community-based educational initiatives fostering interfaith tolerance in Temanggungan Village, Bogor, Indonesia. Confronting rising intolerance and social fragmentation, the research demonstrates how participatory, context-sensitive strategies enhance multicultural awareness from childhood. Utilizing in-depth interviews, participatory observation, and documentation analysis of socio-religious activities, findings reveal that tolerance education emerges through three key mechanisms: non-formal learning frameworks, community leadership engagement, and collaborative platforms such as interfaith service projects and cultural exchange programs. Youth participation in these initiatives significantly strengthens social cohesion and intercultural understanding. The study positions this grassroots model as a viable alternative to formal education systems that inadequately incorporate multicultural principles. Policy recommendations emphasize integrating community-based approaches into national religious moderation strategies and character education curricula to address systemic gaps in value-based education. These insights contribute to global discourse on sustainable interfaith relations through localized pedagogical practices.

Abstract

Law No. 38/1999 established Indonesia’s first legal framework for zakat management, institutionalizing the National Zakat Agency (BAZNAS) and civil society-led Amil Zakat Institutions (LAZ). Revised through Law No. 23/2011 to enhance oversight and systemic integration, the amendment triggered debates over four critical issues: (1) potential criminalization of LAZ/BAZ (Articles 38-41); (2) centralization of authority under BAZNAS; (3) operational restrictions on LAZ/BAZ (Article 20); and (4) legal ambiguities and perceived inequities. This study examines state regulatory roles in zakat governance through Constitutional Court Case 97/PUU-XXII/2024, which challenges BAZNAS’s exclusive authority. Using normative juridical methods, the paper analyzes statutory frameworks and LAZ’s legal arguments against Law 23/2011. Findings reveal tensions between centralized state control and civil society autonomy, underscoring unresolved legal ambiguities in Indonesia’s zakat ecosystem. The research contributes to discourse on balancing regulatory efficiency with participatory governance in Islamic social finance systems.

Abstract

This study critically evaluates Majid Daneshgar’s central thesis in Studying the Qurʾan in the Muslim Academy, which posits that Qurʾānic and tafsīr scholarship within Islamic universities predominantly manifests as normative-apologetic discourse rather than rigorous academic inquiry. Through a case study analysis of 2019-2023 graduate theses and dissertations from Syarif Hidayatullah State Islamic University (UIN) Jakarta, the research applies the methodological framework developed by Andrew Rippin, Aaron W. Hughes, and Daneshgar to distinguish between academic, normative, and apologetic studies. Findings reveal that the majority – though not entirety – of examined works demonstrate a predominantly apologetic orientation in their engagement with Qurʾanic texts and exegetical traditions. This systematic investigation contributes empirical evidence to ongoing scholarly debates about epistemological paradigms in contemporary Islamic higher education.

Abstract

This study wants to provide insight into the importance of thinking Seyyed Hossein Nasr in the Islamic world. The rise of various thoughts that deviate from the teachings of Islam made Seyyed Hossein Nasr moved to make breakthroughs in reforms that denied in the Islamic world. One response that challenges the thought of Seyyed Hossein Nasr is the flow of Western development that overrides the spiritual aspect. Seyyed Hossein Nasr is due to the opposition to the Islamic religion which is felt to be very struggling with Islamic civilization going forward. The main weapon of Seyyed Hossein Nasr to counter this Western discussion is the use of the philosophy of perennialism or what is often referred to as Pernenis Religion.
