Abstract

AbstractArkoun finds even secularist and reformist Muslims who are still prisoners, in their discourse of the problematic thrown up by the Modernity of the Classical Age (1800-1950), imposed by the so-called revolutionary civilized Europe until at least 1950. In order to transcend this impasse, Muslims must undertake a radical double critique: western Modernity and the Islamic heritage, with the aim of transcending both, instead of just trying to come to terms with the European modernity while still prisoner to a heritage that is uncritically re appropriated. This article shows that Arkoun interpret the modernity that is based on philosophical, more than just a historical or sociological sense. Arkoun distinguish between "material" modernity and "intellectual" or "cultural" modernity. The first means that the various advances that occurred in the outer frame of the human form, while the latter includes the methods, analytical tools, and intellectual attitude that gives the ability to understand reality. There are some important notes about the criticism of Islamic rationality, particularly relating to religion and truth values of Islam, and the construction of Islamic reasoning and modern rationality. That the reasoning required in meaning a comprehensive understanding of aspects of the historical, socio-cultural, socio-political, and religious. Abstract

The majority of Islamic community in this world had hold on the fatwa (advice on relegious matters) of their Ulama Madzhab on their relegious matters. But also they profess to others i.e, Dzahiri and Syi’ite sects. Beside that there was also some scholars of relegion who took apart  from that Madzhab at all, they didn’t  follow any other advice on their relegious matters teachers, but they hold on they selfes opinion. Of course, it caused to uncertainty mind or confused  to Islamic Community, who had along time ago hold on to the fatwa of their Scholar opinion. Abstract

AbstractThis paper aims to determine the implementation of Law No. 23 of 2011 on the Management of Zakat by Bazda (Badan Amil Zakat Local) Metro City and its influence on society. And aims to determine the contributing factors; inhibiting the movement of charity in the city Metro. This paper is descriptive qualitative data collection using the techniques of observation, in-depth interviews (depth interview) with the life history of various actors in the community. This paper also uses participatory action research in order to obtain accurate data relating to zakat and performed well Focus Group discussion. Data analysis techniques using qualitative analysis and induction yaang analysis was used to analyze the legal system of zakat and social reality in the public notice on the implementation of zakat. Based on the results of the research, that the issuance of Law No. 23 of 2011 on the Management of Zakat affect the fulfillment of zakat in Metro City are becoming more organized and in accordance with the purpose of compulsory zakat. As a key enabler of charity movement activities in Metro City is the positive response of the Mayor with the additional rules to respond to the performance of Act No. 23 of 2011 on the Management of Zakat. Source zakat collected Metro City has been perceived by society such as; house renovation, scholarships, provision of means of places of worship. Inhibiting factor is understanding people in just the tithe, so zakat mal still less become a major breakthrough. Then further inhibiting factor is the lack of motivation of people to channel funds through the zakat BAZNAS Metro City. Keywords : Zakat, zakat management, empowerment of People. AbstrakTulisan ini bertujuan untuk mengetahui implementasi Undang-undang No. 23 Tahun 2011 tentang Pengelolaan Zakat oleh BAZDA (Badan Amil Zakat Daerah) Kota Metro dan pengaruhnya terhadap masyarakat. Serta bertujuan untuk mengetahui faktor pendukung; penghambat gerakan zakat di kota Metro. Tulisan ini bersifat deskriptif kualitatif dengan menggunakan teknik pengumpulan data observasi, wawancara mendalam (indepth interview) dengan life history berbagai aktor yang ada dalam komunitas masyarakat. Tulisan ini juga menggunakan partisipatori action research guna memperoleh data yang akurat berhubungan dengan zakat serta dilakukan juga Focus Group discussion. Teknik analisa data menggunakan analisis kualitatif dan analisis induksi yaang digunakan untuk menganalisis sistem hukum zakat  dan melihat realitas sosial di masyarakat tentang pelaksanaan zakat. Berdasarkan hasil penelitian, bahwa dikeluarkannya Undang-undang No. 23 Tahun 2011 tentang Pengelolaan Zakat berpengaruh kepada penunaian zakat di Kota Metro menjadi lebih terorganisir dan sesuai dengan tujuan diwajibkannya zakat. Sebagai faktor pendukung utama kegiatan gerakan zakat di Kota Metro yaitu adanya respons positif dari Walikota dengan adanya peraturan tambahan untuk merespon kinerja Undang-undang No. 23 Tahun 2011 tentang Pengelolaan Zakat. Sumber zakat Kota Metro yang terkumpul sudah dirasakan manfaatnya oleh masyarakat seperti; bedah rumah, beasiswa, pemberian sarana tempat ibadah. Faktor penghambatnya yaitu pemahaman masyarakat Kota hanya pada zakat fitrah, sehingga zakat mal masih kurang menjadi terobosan utama. Kemudian faktor selanjutnya yang menjadi penghambat yaitu masih kurangnya motivasi masyarakat untuk menyalurkan dana zakat melalui BAZNAS Kota Metro. Kata Kunci : Zakat, pengelolaan zakat, pemberdayaan umat.

Abstract

AbstrakUpaya penanggulangan tindak pidana narkoba yang dijalankan selama ini belum mampu mewujudkan tujuan dari sistem peradilan pidana baik jangka pendek yaitu resosialisasi pelaku tindak pidana, jangka menengah berupa  pencegahan kejahatan dan jangka panjang yakni mewujudkan kesejahteraan sosial. Tidak terwujudnya tujuan sistem peradilan pidana tersebut antara lain disebabkan dari kinerja aparat penegak hukum yang masing-masing berpikir dan berjalan dengan konsepnya sendiri-sendiri (department oriented), tidak satu visi dan misi atau dengan kata lain tidak dilakukan secara integral. Oleh karenanya kedepan perlu adanya upaya penanggulangan tindak pidana narkoba yang dilakukan secara integral, yaitu adanya kesatuan konsep dan tujuan baik antar sub sistem dalam sistem peradilan pidana yang terdiri dari polisi, jaksa, hakim dan petugas lapas maupun antara sub sistem tersebut dengan lembaga yang terkait antara lain BNN, BNP, Diknas, Depag, Depsos, Depkes sebagai  sub sistem sosial, serta peran serta masyarakat yaitu (P4GN) dalam rangka penanggulangan narkoba baik upaya preventif maupun refresip untuk mencapai  tujuan sistem peradilan pidana yaitu mewujudkan kesejahteraan sosial, Untuk membangun penanggulangan yang integral tersebut diperlukan menyatukan visi dan misi (konsepsi) antar penegak hukum, adanya koordinasi (menjalin hubungan interaksi dan interdevensi serta interkoneksi) antar lembaga penegak hukum, mewujudkan kesejahteraan sosial, menjalin hubungan kerjasama dengan instansi di luar sistem peradilan pidana, baik dalam upaya preventif maupun rehabilitasi, meningkatkan peran serta masyarakat melalui pelaksanaan program P4GN (Upaya Pencegahan, Pemberantasan, Penyalahgunaan dan Peredaran Gelap Narkoba). Kata kunci : Pidana Narkoba, Integral, Peradilan Pidana AbstractEfforts to combat crime, drug running as long as it hasnt been able to realize the goals of the criminal justice system both short-term resocialization perpetrators of crime, crime prevention in the form of medium-term and long-term that embody the social welfare.Not accomplishing the purposes of the criminal justice system, among others resulting from the performance of law enforcement officers who each thought and runs with its own concept (department oriented), no ones vision and mission, or in other words not done in the integral. Hence fore need for efforts for tackling drug crime perpetrated by an integral, namely the unity of concept and good cause between sub system in the criminal justice system which is composed of police, prosecutors, judges and officers of sub system and prison with related agencies, among others, BNN, the BNP, from Education Beureu, Sport Ministry, the Department of health, as sub social systems, as well as the role of the community as well as the (P4GN) in order to combat drug preventive efforts and good refresip to achieve the purpose of the criminal justice system realization of social welfare, to build the integral relief needed unifying vision and mission (conception) between law enforcement, lack of coordination (interdevensi interactions and relationship as well as interconnections) between law enforcement agencies, social welfare, manifesting in a relationship of cooperation with agencies outside of the criminal justice system, both in the preventive and rehabilitation efforts, increase community participation through the implementation of the program P4GN (prevention, Eradication Efforts, Abuse and Illicit Drugs). Keywords : Drug Criminal, criminal justice, Integral

Abstract

Al-Qur’an is the media for interaction between God and His creatures. As the interaction media, it uses various kinds of sentence. The sentences are categorized into two forms : tholabi and ghairu tholabi. The tholabi sentences are not always in the form of imperative sentences; there are other forms. In other words, the meaning of a verse is not always linear with its formal form. Abstract

AbstrakPengacara adalah salah satu lembaga penting dalam penegakan hukum , sehingga dalam menjalankan fungsinya harus independen. Di Indonesia diposisikan di bawah kekuasaan eksekutif. Posisi yang dianggap rentan terhadap intervensi kekuasaan eksekutif dalam melaksanakan fungsi penegakan hukum. Untuk menjamin independensinya, pengacara harus dimasukkan dalam kekuasaan kehakiman. Selain itu, harus diberikan legitimasi oleh eksplisit dinyatakan dalam konstitusi untuk menjamin kemerdekaan kedua institusional dan fungsional. Sistem peradilan pidana sebagai sistem penegakan hukum, tidak berjalan secara optimal bahkan menjadi alat penguasa karena kedudukannya yang tersubordinasi oleh kekuasaan eksekutif. Sub-sistem pengadilan secara struktural dan fungsional berada di bawah kekuasaan eksekutif, sehingga perannya sebagai penegak hukum terlihat melayani kepentingan penguasa. Sub-sistem dalam sistem peradilan pidana (sub-sistem penyidikan, penuntutan dan pelaksana pidana) secara fungsional dan kelembagaan belum menujukkan adanya independensi karena secara struktural berada dibawah kekuasaan eksekutif. Sedangkan kekuasaan mengadili (pengadilan) sudah ditempatkan sebagai kekuasaan yang independen lepas dari kekuasaan eksekutif, baik secara organisasi kelembagaan, anggaran, kepegawaian dan sistem kerier dibawah satu atap (one roof system) dibawah Mahkamah Agung. Ketidakmandirian disebabkan kelembagaan yang tidak independen, kerancuan atau tumpang tindih substansi hukum dan faktor budaya hukum pelaksana sub-sistem peradilan pidana yang cenderung arogan, ego sentris, komersial dan melayani kepentingan-kepentingan pragmatis diluar tujuan penegakan hukum. Kata kunci : Pengacara, kemandirian, penegakan hukum, eksekutif AbstractLawyer is one of the important institutions in law enforcement, so that in carrying out its functions it should be independent. In Indonesia it is positioned under the executive power where it is considered as vulnerable toward the intervention of executive power in carrying out law enforcement functions. To ensure its independence, the lawyer must be participated in the judicial power. Furthermore, it should be given legitimacy by explicitly stated in the Constitution to ensure the independence of both institutional and functional . The sistem of criminal justice which is applied as the law enforcement system doesn’t not run optimally even become a ruler tool due to its position is subordinated by the executive power. The court Sub-system is structurally and functionally under the authority of the executive, so that its role as law enforcement authorities seems as only serve the interest of ruler. The Sub-systems within the criminal justice system (sub-system investigation, prosecution, and criminal executor) is functionally and institutionally not showed any independence because it is structurally  under the executive control. While prosecuting authority (court) has been placed as an independent authority from the executive dominance, either institutional organization, budgets, personnel or kerier systems under one roof (one-roof system) under the Supreme Court. The dependence  dominance which is caused as by the dependent institutions, confusion or overlapping law substance and law cultural factors of sub-system of criminal justice executor that tends to be arrogant, ego centric, commercial and serve pragmatic interests beyond the law enforcement purposes.Keywords: Lawyer, independence, law enforcement, executive

Abstract

Abstrak Dalam Islam pada prinsipnya tidak ada penyatuan harta dalam keluarga, antara suami isteri masing-masing mempunyai hak memiliki, mengelola dan menggunakan harta miliknya secara bebas dan mandiri. Saat terjadi perselisihan, maka menjadi penting untuk mengetahui bagaimana penyelesaian sengketa hak kepemilikan dalam keluarga menurut para ulama dan pemikiran siapa yang lebih tepat dalam kontek kekinian dan ke Indonesiaan.Melalui pendekatan kualilatif data hasil kajian kitab-kitab fiqih dideskripsikan dan dianalisis dengan memperhatikan situasi dan kondisi sosial keagamaan pada saat dan di mana pemikiran tersebut dilahirkan. Data yang akan dihimpun berupa konsep atau pemikiran para ulama berkaitan dengan penyelesaian sengketa harta dalam keluarga. sumber datanya adalah dokumentasi dari karya-karya fuqaha yang dideskripsikan secara kritis. Hasil penelitian dari beragam pemikiran mengenai penyelesaian sengketa hak kepemilikan antara suami isteri, pemikiran Syâfi’î lebih rasional dan realistis sejalan dengan hak-hak perempuan yang sama dengan hakhak laki-laki, termasuk hak kepemilikan, terutama dalam kontek kekinian dan ke Indonesiaan, di mana laki-laki dan perempuan sama-sama bekerja dalam berbagai profesi sehingga sangat memungkin laki-laki memiliki barang-barang yang biasanya dimiliki oleh perempuan dan sama dengan perempuan yang profesinya sebagai pengusaha, politisi, pengacara bisa memiliki barang-barang yang biasanya dimiliki oleh laki-laki. In the event of a dispute, then it becomes important to know how dispute resolution rights ownership in the family according to the scholars and thought who is more appropriate in the context of the present and to the Indonesiaan. Through kualilatif approach to the results of the study data books of Fiqh is described and analyzed by observing the situation and religious social conditions at the time and where the idea was born. Abstract

AbstrakIsu korupsi setelah satu dekade reformasi ternyata belum membawa Indonesia pada titik zona bebas korupsi. Keberadaan lembaga seperti KPK pernah dianggap sebagai ujung tombak untuk membersihkan republik ini dari virus korupsi. Namun pada akhirnya menemui anti klimaks lantaran tak adanya tanda-tanda pelaku korupsi menjadi jera dan tidak mendatangkan efek jera. KPK dihadapkan pada situasi sulit ditandai dengan upaya pelemahan wewenangnya sementara hukuman mati untuk koruptor bagi sebagian pihak belum dianggap urgen. Undang Undang KPK secara eksplisit sebetulnya membuka ruang untuk hukuman mati bagi koruptor namun tampaknya masih belum menemukan momentum.Tindak pidana korupsi adalah masalah yang perlu dihadapi dengan serius dan merupakanpersoalan hukum di setiap negara di dunia, termasuk Indonesia. Penyakit korupsi semakinhari semakin merajalela. Keseriusan pemerintah dalam menanggulangi tindak pidana korupsiyaitu dengan dibentuknya Undang-undang Nomor 31 tahun 1999 sebagaimana telah diubahdengan Undang-undang Nomor 20 tahun 2001 mengenai Pemberantasan Tindak PidanaKorupsi. Keywords : korupsi, hukuman mati, KPK, hukum progressif  Abstract The issue about corruption after a decade of reformation has not brought Indonesia to the point of free corruption zone. The existence of institutions such as KPK has ever cosidered as  the spearhead to rid the republic from corruption virus. However, it finally comes upon an anti climax because it doesn’t give a deterrent effect to the doers of corruption. KPK is faced on a difficult situation. It can be seen from the weakening of its authority, while the death penalty for corruptors was still considered by some parties that it is not urgent. Explicitly, the Law of KPK is actually available on the space for the death penalty for corruptors, but it seems that it still has not found the momentum yet. The criminal of  corruption is a problem that needs to be solved seriously and it becomes the problem of law in every country in the world, include Indonesia. The disease of corruption becomes more rampant day by day. The governments seriousness in finding solution about criminal of corruption is that an establishment of Law No. 31 of 1999 changed into Law No. 20 of 2001 about the Eradication of corruption. Keywords: corruption, death penalty, KPK, progressive law

Abstract

AbstractThis study discusses the concept of maslahat as the law theorem of Islam. Recently, maslahat as a study is being discussed. The facts indicates that maslahat is increasing rapidly in line with the human’s needs. The change of the society’s condition and situation from time to time brings about complexity of human’s problems. This influences and changes the human’s need structure and their maslahat which in turns it changes the law theorem. In the meantime, the nas related to this discussion is very limited, the exploration on ulama’s thoughts is badly needed, particularly those that closely connected to the discussion of maslahat. This way, it can be proven that Islamic syariat is in line and adaptable to the rapid changes of any condition and from time to time even since Al-Qur’an bestowed the human being until the end of time. This research is a library research. The exploration is conducted through analyzing descriptively. The researcher describes the thoughts of proposed by ulamas thoughts their mazhab and then compare them critically before finally composing concluding remarks. The result of this research shows that maslahat as the law theorem of Islam is accepted by all mazhab such as Hanafi, Maliki, Syafii and Hambali.. Furthermore, the use of maslahat is various based on the knowledge background. The way people see maslahat may be influenced by certain given condition and situation. Keywords: Islamic law, maslahat.
