Abstract

This article explores the reconstruction of divorce in the understanding of Muslim community in Malang. Marriage in Islam is not only a civil bond, but also as a religious attachment that contains the values of worship. However, many Muslims fail to defend their marriage. Divorce at Religious Court of Malang district is recorded as very high in East Java. The divorce rate in the region of South Malang is the highest, with labor women as the majority population. They looked at divorce as the only way out to end the marriage. Divorce begins with conflicts, disputes and quarrels which negate the hope to live in harmony again in the household. The solution is understood by most of them as a normal thing that does not need to worry. These perceptions arise because of their lack of knowledge about the meaning of marriage and the danger of divorce with all its consequences. Infact, divorce can result in consequences which disturb the emotion of women and their social and economic conditions as the single parent.

Abstract

The article seeks to analyze the transaction of vegetables through wakālah method in Krisik Village Ponorogo from Islamic legal perspective. Wakālah requires four important elements: the person who gives a trust (muwakkil), the trustee (muwakkal or wakīl), the deed (muwakkal fīh), and the transaction statements (ijāb-qabūl). The transaction of vegetables in Krisik Village is done in an unusual way. In many areas, the brokers usually buy all farmers’ crops at once and pay for the farmers in-cash. In Krisik Village, the brokers, however, first of all, sell farmers’ vegetables into markets. The brokers will pay the farmers for their vegetables afterward. It means that the brokers do not pay for the farmers in-cash. It is also found that the farmers and brokers in Krisik Village make an uncommon agreement ('aqd), in which they agree to reduce the scale. The practice seems to violate a number of Quranic verses, which ask people to enhance the scales. Such a practice of reducing scale has been a "common agreement" among the Krisik people for decades. On the one hand, the practice aims at preventing the brokers from loss, while on the other the farmers do not feel aggrieved from the reduction of the scale.

Abstract

This article examines about improving the education quality of SMA Muhammadiyah 2 Sidoarjo as the Outstanding School of Muhammadiyah. This article reveals that the quality improvement of SMA Muhammadiyah 2 Sidoarjo was conducted through: the arrangement of school program and self evaluation, the reinforcement of vision, mission and education objective, the reinforcement of leadership and teamwork, the improvement of teachers and educators competence, the improvement learners quality input, the development of curriculum and learning, the development of school culture, the development of facilities and infrastructure, the development of community service, the cooperation of education and student exchange, the mobilization of education funding resources, the develop-ment of SIM, monitoring and evaluation, and education quality system. The management quality of SMA Muhammadiyah 2 Sidoarjo was run through input-process-output formula. The process of quality containes the process of quality planning, main process, supporting process, dan quality improvement process. Factors supporting the quality improvement are: Muhammadiyah’s popular name, the doctrine of education quality improvement, the leadership of TORSIE paradigm, the school academicians’ spirit of gaining achievement, the synergy of school academicians, the appropriate facilities, and the supports of all stakeholders.

Abstract

This article discusses the institution and the aplication of human rights courts in Islamic court system based on data revealed from the books of hadīth, al-sīrah al-nabawīyah, history, Islamic law, and others. From a comparative analysis, it can be concluded that the institution of Wilāyat al-Maẓālim can be seen as human rights court in Islam due to the similarity with the jurisdiction of Indonesian human rights court. If the authority of Indonesian human rights court is limited, that of Wilāyat al-Maẓālim is much wider as to cover the duties and authorities of other state bodies like the Commission of Truth and Reconciliation, State Administration Court, and the Commission of Ombudsman. Various regulations and practices of human rights in Islamic court as played by Wilāyat al-Maẓālim can be used as positive input for building the institution of human rights court.

Abstract

This article attempts to answer two questions: how is the genesis of Islam in Central Asia and how is the dynamics of ‘ulama related to the fragmentation of qadimism and jadidism. There is no doubt that ‘ulama played important role in spreading Islam and Islamic civilization, including in Central Asia. They got involved in the process of diversification of Islamic teaching and contributed to the struggle against colonialism. However, with modernity the ‘ulama underwent fluctuative relation with each other. Diverse responses to modernity resulted in the diversity of ways of actualization in coping with social problems. The rise of jadidism that was reacted by qadimism constituted a modern phenomenon in Central Asia when the ulama attempted to respond modernity. The diversity of ways of actualization caused the relation between qadimism and jadidism problematic. On another occasion, however, the ulama could contribute to each other, especially when they shared the same interest.

Abstract

The behavior of impulsive buying becomes common today, along with the rampant variety of marketing promotions carried out by business people. Many consumers make purchases impulsively after being attracted to several factors that drive this behavior. The purchases due to unplanned decisions often occur in products and services of taḥsīnīyāt. Actually there is nothing wrong with the behavior of impulsive buying if the consumers who do it have fulfilled the ḍarūrīyāt needs and have prepared their future needs. However, it becomes a problem if impulsive buying for products and services of taḥsīnīyāt precede the primary needs that have not been fulfilled properly. This research will try to provide a brief solution on how to limit the self from rughbah and shahwat of buying, by planning income for several financial posts. Here the author offers the concept of Islamic models of saving and investment which can also be interpreted as Islamic family wealth management. It is hoped that this research can provide a meaningful contribution to human development.

Abstract

This article attempts to discuss the views of Banjarese ‘ulama and the legal method used in responding to the issue of polygamy. The Banjarese ulama interviewed are nine. This study reveals the existence of different opinions among the Banjarese ulama. There are many ulama who accept polygamy, the minority being not too rigid in terms of conditions for polygamy, while the majority emphasize rigid conditions. However, there are ulama who reject polygamy due to various considerations and recent conditions. The desire to polygamy can be tolerated, but the conditions are required. The difference of opinions between the Banjarese ulama cannot be separated from the method of Islamic law used in understanding this phenomenon. If related to uṣūl al-fiqh, most views of the Banjarese ulama with regard to polygamy can be concludedas using the method of istiḥsān and dharī‘ah.

Abstract

This paper discusses the phenomenon of urban sufism among the majelis Shalawat Muhammad under the murshid Gus Kahar in Surabaya with followers (disciples) spreading in various places especially East Java, even abroad. The theory of continuity and change is used to critically review Howell’s concept on urban sufism, and to present key concepts on sufism in its generic sense in terms of doctrine and empirical praxis. Although based in Surabaya, the doctrine and praxis of urban sufism in the Majelis Shalawat Muhammad reflects generic sufi teachings. The findings of this research reveal that the principle of continuity and change prevails in sufi tradition from time to time. This finding is different from Howell’s theory which stress on ritual dimension. The followers of Shalawat Muhammad emphasize more on education on the basis of praxis (sālik-sulūk, riyāḥah, and mujāhadah), in addition to the dimension of doctrine itself.

Abstract

This article attempts to uncover the point of encounter of human rights and sharī'ah in Indonesia which often contradict with each other in light of differences in its development base, both as a concept and, furthermore, as an instrument, which ultimately leads to the human dimension. The basis of the development in question is that human rights derived from human rationality, while sharī'ah comes from revelation. Therefore, this article seeks to explore the compatibility between the two. Human rights and sharī'ah always have a point of encounter because in principle they are both fighting for humanity. The intersection between the two is often the case--and it becomes common because the basis for the development of the law originates from different sources. Human rights comes from human rationality, while sharī'ah departs from Allah's revelation. Thus, it is only natural that various debates arise as in general a discourse of knowledge. It's just that it needs to be understood that the conflict and tension that arise, should not lead to violence. On the one hand, Muslim groups who reject the principles of human rights are undoubtedly existent. However, on the other hand, many Muslims also graciously accept human rights. Accommodative people hold the view that they have a common vision of justice, peace, equality, and tolerance. Human rights need not be viewed as contradictory to Islam, in part because many Muslim-majority countries recognize and ratify human rights instruments issued by the United Nations.

Abstract

This article answers the problem of continuity and change of salaf tradition in the educational system of Pondok Pesantren Lirboyo Kediri. Using system theory along with historical, sociological, anthropological and phenomenology-cal appraoch, this article reveals some important points. First, the salaf tradition of pesantren undergoes substantial continuity, where knowledge structure of pesantren are conserved in learning of religious sciences originated from classical books, and partial change, where changes occur in the aspect of learning method, curriculum development, and teachers from outside pesantren. Second, there are internal and external factors that drive continuity and change in salaf tradition in the educational system of Pesantren Lirboyo. The internal factor is the attitude and thought of kiai as the servant of ummah (khādim al-ummah) and the objective condition of santri. While the external factor occurs because the development of the system of public education and the development of science and technology.
