Abstract

This study aims to examine the regulation of marriage dispensation in Indonesian positive law from the perspective of Maqashid Shariah, focusing on the protection of the rights of underage children. Marriage dispensation, which allows underage marriages, raises concerns regarding its negative impacts on the physical, psychological, and social well-being of children. In the context of Maqashid Shariah, the protection of life (hifzh an-nafs), intellect (hifzh al-‘aql), and progeny (hifzh an-nasl) are primary objectives that must be prioritized in any legal policy, including the regulation of marriage dispensation. This research employs a normative juridical method with a qualitative approach to analyze existing legal provisions related to marriage dispensation. This analysis is then linked to Maqashid Shariah to assess whether the policy aligns with the principles of child protection. The findings indicate that the regulation of marriage dispensation in Indonesia, while legally permissible, often neglects child protection aspects in line with Maqashid Shariah’s objectives. This study recommends policy reforms that are more child-centered, ensuring that marriage dispensations are granted only in genuinely urgent situations and that the principles of protection within Maqashid Shariah are fully observed.

Abstract

Many criteria are often used as reasons for choosing a partner. Among them are wealth, lineage, beauty and religion. Some people have the principle of only wanting to marry a partner who has high criteria related to these criteria, so that the effect is to delay marriage or even end up living without a partner. This study aims to analyze this principle by referring to the maqashid sharia perspective. maqashid sharia is a central concept in Islam that highlights the goals or purposes of Islamic law. This research is a qualitative research. The method used in data collection is library research. The results showed that the principle of only wanting to marry a partner who has high criteria can be in harmony with maqashid sharia as long as it is applied realistically and considers sharia principles in decision making when there is a conflict between various maslahat, various mafsadat or between maslahat and mafsadat. And it would be better if it is aimed at achieving His pleasure, even though it is not a necessity. The principle will become inconsistent with maqashid sharia if it is applied without considering these matters.

Abstract

This study examines the arguments of both proponents and opponents of the Constitutional Court's Number 46/PUUVIII/2010 decision regarding the legal status and rights of children born out of wedlock, using the maqashid syari’ah framework. Employing a qualitative method with a normative-descriptive approach, the research evaluates how each perspective aligns with the Islamic objective of preserving lineage (hifdz an-nasl). The findings reveal that while proponents base their stance on hajjiyah (complementary) needs, they tend to overlook the more fundamental dharuriyyah (essential) aspects. In contrast, opponents prioritize hifdz an-nasl at the dharuriyyah level, reflecting a stronger alignment with core Islamic legal principles. Therefore, the opposing arguments are considered more beneficial (maslahah) from a maqashid syari’ah standpoint. This research contributes to the theoretical development of maqashid-based legal reasoning in assessing state legal decisions affecting family and social structures.

Abstract

The family is the smallest unit in society and is not immune to internal conflicts, including divorce. Divorce often has a serious impact on the psychological and mental condition of children, leading to issues related to child custody. The Religious Court has the authority to resolve child custody disputes through decisions that take various aspects into consideration. This study aims to analyze the factors that influence judges' considerations in formulating decisions in child custody cases. Using a descriptive qualitative approach, this research examines a number of judicial decisions and objectively describes the underlying considerations. The findings indicate that judges’ considerations are not solely based on normative provisions, but also include psychological aspects, the child's well-being, trial evidence, and expert reports. Factors influencing the judges’ decisions include: the plaintiff’s dishonesty in providing truthful statements during the trial, the absence of supporting evidence for the plaintiff’s claims, and the judges’ assessment that the child's welfare is better secured with the defendant, thus leading to the rejection of the claims. In addition, the defendant’s health condition, ability to provide care and education, as well as an environment considered conducive to the child’s development, are key factors taken into account in formulating the decision.

Abstract

Artikel ini mengkaji perspektif aktivis perempuan Aisyiyah dan Muslimat NU di Surabaya terhadap fenomena marital rape dan kritik mereka terhadap konsep tersebut dalam hukum positif Indonesia. Menggunakan pendekatan Deskriptif dengan teknik pengumpulan data melalui wawancara mendalam dan studi pustaka, penelitian ini melibatkan enam tokoh kunci dari kedua organisasi tersebut. Hasil penelitian menunjukkan bahwa aktivis kedua organisasi memiliki perspektif yang komprehensif namun berbeda dalam penekanannya. Aisyiyah menekankan kesetaraan dalam hubungan suami-istri melalui konsep mu'asyarah bil ma'ruf dan hunna libasullakum, sementara Muslimat NU menghadirkan interpretasi progresif terhadap konsep qawwamun yang memandang kepemimpinan suami sebagai tanggung jawab perlindungan. Kedua organisasi mengidentifikasi kelemahan dalam kerangka hukum positif Indonesia terkait penanganan marital rape. Kebaruan penelitian ini terletak pada analisis komparatif pendekatan kedua organisasi, eksplorasi program konkret penanganan kasus, formulasi model berbasis agama yang mengintegrasikan nilai Islam dengan HAM, dan penyusunan batasan marital rape yang kontekstual. Penelitian ini merekomendasikan reformasi hukum responsif gender, penguatan kelembagaan perlindungan korban, dan pendekatan sosio-kultural terintegrasi dalam penanganan marital rape di Indonesia.   This article examines the perspectives of women activists from Aisyiyah and Muslimat NU in Surabaya regarding the phenomenon of marital rape and their critiques of this concept within Indonesian positive law. Using a Descriptive approach with data collection techniques through in-depth interviews and literature studies, this research involved six key figures from both organizations. The findings indicate that activists from both organizations hold comprehensive yet differently emphasized perspectives. Aisyiyah emphasizes equality in marital relationships through the concepts of mu'asyarah bil ma'ruf (good companionship) and hunna libasullakum (they are garments for you), while Muslimat NU presents a progressive interpretation of the qawwamun concept, viewing husband's leadership as a protective responsibility. Both organizations identify weaknesses in Indonesia's positive legal framework regarding the handling of marital rape. The novelty of this research lies in the comparative analysis of both organizations' approaches, exploration of concrete case handling programs, formulation of religion-based models integrating Islamic values with human rights, and development of contextual boundaries for marital rape. This research recommends gender-responsive legal reforms, strengthening victim protection institutions, and integrated socio-cultural approaches in addressing marital rape in Indonesia

Abstract

This study aims to comprehensively examine the dual roles carried out by female single parents who work as teachers in the Darunnajah Islamic Boarding School, Jakarta. This phenomenon is a crucial subject in Islamic family law and educational sociology, as women in such conditions are not only responsible for meeting the economic needs of their families but also serve as the primary caregivers for their children. The research employs a qualitative approach with a case study method. Data were collected through in-depth interviews, participatory observation, and documentation. The findings reveal that single-parent teachers in pesantren face complex challenges, including psychological stress, time constraints, and limited financial resources. However, they manage to balance these dual roles relatively well, supported by institutional flexibility, effective time management strategies, and personal spirituality. The study highlights the importance of affirmative policies in Islamic educational institutions that are inclusive toward the needs of single-parent teachers. Furthermore, this article recommends stronger collaboration between state and religious educational institutions to provide social protection and proper education for children from incomplete families.

Abstract

This study examines in depth various TikTok monetization strategies from an Islamic legal perspective. It analyzes methods such as live streaming with virtual gifts, brand endorsements, affiliate marketing, and direct sales through TikTok Shop to determine whether these methods are ethically and legally permissible under Sharia. The study is qualitative with a library research approach based on primary Islamic sources (the Qur’an and Hadith) and contemporary scholarly interpretations. The analysis is guided by classical Islamic contract frameworks like ju’ālah (reward-based contract) and ijārah (service-for-hire contract), as well as the higher objectives of Islamic law (maqāsid al-sharī’ah). Findings suggest that TikTok’s monetization features have the potential to align with Islamic principles, but only with proper ethical safeguards. Income from live streaming is considered halal if the shared content is beneficial, ethical, and non-manipulative. Endorsement and sponsorship agreements can be accepted under ijārah as long as they involve halal products and honest disclosure practices. Similarly, affiliate marketing aligns with ju’ālah principles if conducted transparently and truthfully. Transactions on TikTok Shop generally meet Sharia criteria as long as they adhere to the pillars (rukun) and conditions of a valid sale (bay’), including clear pricing and the sale of lawful goods. The study emphasizes the importance of clear ethical guidelines, public education, and platform policies that uphold Islamic values while fostering digital economic innovation. It also provides theoretical and practical contributions for content creators, regulators, and academics to build a responsible and Sharia-compliant online marketplace.

Abstract

The Religious Court in Indonesia is the oldest institution among Islamic institutions, having existed since the arrival of Islam in the regions that make up the Unitary State of the Republic of Indonesia. This institution has undergone a long journey from the era of Islamic sultanates to the present day. Despite experiencing ups and downs in line with political and legal dynamics, the Religious Court continues to exist and develop. This study aims to elaborate on the historical dynamics and role of the Religious Court in Indonesia's national legal system, as well as to identify the challenges it faces in the future. The method used is qualitative descriptive with a literature review approach to collect data that is analyzed qualitatively. The results of the study indicate that the Religious Court has a long history and plays an important role in the exercise of judicial power, providing legal certainty and protection for legal issues concerning Muslims in Indonesia. The challenges ahead are to ensure legal certainty and protection, especially in cases related to Islamic economics.

Abstract

This research discusses the contextualization of Islamic law in the socio-cultural reality in Indonesia. In a diverse society, Islamic law cannot be understood textually alone, but needs to consider social and cultural dynamics. This study highlights five shades of Islam in Indonesia, namely cultural, pluralist, neo-modernist, normative, and nationalist, which shape the character of Islamic legal thought in Indonesia. The contextual approach in Islamic law allows flexibility in the face of changing times without leaving the basic principles of sharia. Based on the perspective of Wael B. Hallaq's perspective, Islamic law must be designed by considering social reality to achieve benefit. This study confirms that contextualization of Islamic law is a must in order to remain relevant and applicable in people's lives. By understanding history and social dynamics, Islamic law can continue to develop as a guideline that suits the needs of the times.

Abstract

This research is a quantitative research with an experimental approach, pre-experimental method with a one group pretest-posttest design. The research was carried out by the Makassar City Office of Religious Affairs (KUA), with the subjects being 40 prospective married couples. The sampling technique in this research is simple random sampling. Data collection techniques are carried out through observation, questionnaires and documentation. The data was then analyzed using descriptive and inferential analysis using SPSS. The results of the descriptive analysis where the average pre-test score was 48.24 and the average post-test score was 86.00 in the very good category, then the results of the inferential analysis where the normality test was 0.300, the homogeneity test was 0.633 and the t-test result was 0.000, from these results It was concluded that there was an influence of the implementation of Suscatin KUA Makassar City on the readiness of prospective married couples to build a SAMAWA family.
