Musawa : Jurnal Studi Gender dan Islam
Musãwa Journal of Gender and Islamic Studies was first published in March 2002 by PSW (Pusat Studi Wanita) Sunan Kalijaga Yogyakarta under contribution with the Royal Danish Embassy Jakarta. In 2008, published twice a year in collaboration with TAF (The Asia Foundation), namely January and July. Musãwa Journal is a study of gender and Islam especially on gender mainstreaming and child rights both in the study of texts in the Qur’an and Hadith, figures and thoughts, history and repertoire, classical and contemporary literature as well as socio-cultural studies. All concentrations are in the context of Indonesia and other countries in Southeast Asia within the framework of unified NKRI, based on Pancasila. Musãwa Journal has been published by PSW UIN Sunan Kalijaga Yogyakarta since 2002. Initiated by lecturers, gender activists and Islamic studies scholars of PTKI ( Higher Education of Islamic Religion) Musãwa has regularly published academic works and researches on gender and Islam for almost two decades. Now, the Journal extends its studies with Children and Human Rights (HAM). All studies are still in the context of gender and its mainstreaming. Through the studies hopefully, the Musawa journal can be part of the implementation of gender mainstreaming in the context of Indonesian society.

Abstract

Contemporary Indonesians witness the rise of the popularity of marriage of the minors, despite the application of the Indonesian Marriage Law no 1/1974 that forbids child marriages for decades. The enactment of the Law decades ago was meant to be a social engineering mean to erase the practice of child marriage with social compromises. Recent research in medical studies show that there is significantly high risk for young women under 18 years old who do sexual intercourse to be infected with servick cancer. Many other research on child marriage using psychological and social approaches also suggest that actors of child marriage are of high risk of suffering from social and psychological troubles. Now, what can we do with the Indonesian Marriage Law that still endorse marriage for girls under 18 years old? This paper discusses the issues from different perspectives.

Abstract

Kearifan lokal suku Baduy terletak pada pandangan mereka terhadap alam semesta, kesederhanaan dan  toleransi terhadap lingkungan disekitarnya adalah ajaran utama suku Baduy. Suku Baduy sangat menjaga  ajaran tentang menjaga alam serta melestarikan, hal tersebut yang menciptakan masyarakat Baduy hidup berdampingan dengan alam secara harmonis. Seperti yang ditayangkan oleh stasiun televisi NET. pada program feature dokumenter “Indonesia Bagus” mengenai kearifan lokal suku Baduy. Metode yang digunakan dalam penelitian ini yaitu metode studi kasus yaitu metode riset yang menggunakan berbagai sumber data yang bisa digunakan untuk meneliti, menguraikan dan menjelaskan secara komprehensif berbagai aspek individu, kelompok, suatu program, organisasi atau peristiwa secara sistematis. Kesimpulan menunjukkan bahwa suku Baduy tidak mengeksploitasi alam, mereka menggunakan seperlunya yang ada di alam dan disertai dengan pelestarian. Suku Baduy memiliki kepercayaan bahwa alam adalah salah satu titipan maha kuasa yang harus dijaga dan dilestarikan.

Abstract

Menstrual Taboo is a never ending phenomenon. We can study about it from different points of view: medical, psychological, anthropological, mythological, theological as well as ideological perspectives. Talking about the popular myth of menstrual taboo, there are "evil eyes", "huts" etc, that protect women in her monthly period. Right now, the myth of menstrual taboo has deviated into the farms of menstrual creations such as the present of cosmetology like Kohl, eye liner, shoes and fashion. Jilbab, as a code of women's dress has actually been widely practiced far before emergence of Islam. Nevertheless, when Islam come to be spread, jilbab was associated with several superstitions, one of them is menstrual taboo. In the last ten years, Jilbab for teenagers and young women has been "booming in Indonesia. Many schools from elementary to university, and governmental offices as w~U have made jilbab as part of their official uniforms.

Abstract

The issue of women’s representation in politics is important because numbers of women who occupy political posi- tions in the party, legislative and executive bodies are still low. In fact, the laws of political parties and elections have provided opportunities for women to be involved in the formal political sphere, especially in the legislature. This is why the role of political parties becomes important in carrying out the function of political recruitment and of course the selection of legislative candidates including women. This article discusses the issues faced by women candidates in the post-New Order Elections that have an impact on the low number of women’s representation in the legislation. By using qualitative method, based on literature study and interview, the study reveals that the low number of women representation in legislative institution is caused by 1) motivation of women to become legislative candidate, 2) patriarchal culture of Indonesian society, 3) limited financial capital, and 4 ) the pragmatism of political parties. This condition is a challenge for women candidates to take political positions in the post-New Order.[Isu keterwakilan perempuan dalam politik ramai diperbincangkan karena masih rendahnya jumlah perempuan yang menduduki jabatan politik baik di internal partai, lembaga legislatif maupun eksekutif. Padahal, undang-undang partai politik dan pemilu sudah memberikan peluang bagi perempuan untuk bisa masuk dalam ranah politik for- mal, khususnya lembaga legislatif. Di sinilah peran partai politik menjadi penting dalam menjalankan fungsi re- kruitmen politik dan tentu saja seleksi calon anggota legislatif termasuk perempuan. Artikel ini membahas per- soalan yang dihadapi oleh kandidat perempuan pada Pemilu pasca-Orde Baru yang berdampak terhadap rendah- nya angka keterwakilan perempuan di legislatif. Dengan menggunakan metode kualitatif berdasarkan studi litera- tur dan wawancara, diketahui bahwa rendahnya angka keterwakilan perempuan di lembaga legislatif disebabkan oleh 1) motivasi kandidat perempuan untuk menjadi caleg, 2) budaya patriarki yang masih melekat di masyarakat Indonesia, 3) keterbatasan modal finansial perempuan, dan 4) pragmatisme partai politik. Kondisi inilah yang men- jadi tantangan bagi kandidat perempuan untuk mengisi jabatan-jabatan politik di Indonesia pasca-Orde Baru.]

Abstract

Trafficking was initially associated with prostitution but, infact, it includes some other exploitations and slavery. Human trafficking keeps growing and its farm and complexity are changing from time to time_the only persistent thing is its characteristic of human exploitation. It is illegal activity and is against human rights: it is against the rights of its victims, which include women, children and worker. Trafficking is vulnerable to the emergence of violence against human beings, unwanted pregnancy, and sexually transmitted (STD) and infectious diseases. The networks of trafficking are currently well organized and, therefore, it demands a more serious and global attention to deal with the issue. Each country, including Indonesia, has to rethink about its system of law to be able to prosecute the traffickers and help the victims, both materially and immaterially. Some countries have ratified and implemented the anti-trafficking law. In Indonesia, however, the law is presently neither ratified nor implemented yet. The government of Indonesia, nonetheless, proclaimed the national action plan for the elimination of trafficking in women and children and made RUU (draft of laws) on anti, trafficking. So many women and children in Indonesia are waiting for the law that liberates them from any violence or exploitation and enables them to enjoy freedom of life. This draft, therefore, has to be immediately ratified.

Abstract

Tranformasi merupakan terjadinya perubahan dari sebuah bentuk ke bentuk yang lain, baik dilakukan oleh indvidu maupun kelompok tertentu. Terjadinya tranformasi biasanya disebabkan oleh suatu kebutuhan yang mengharuskan tranformasi tersebut harus dilakukan. Dalam kaitannya dengan tranformasi dakwah Nahdhatul Ulama dan Muhammadiyah, sejauh ini terdapat dinamika keputusan dakwah keduanya yang berhubungan dengan fatwa-fatwanya. Menggunakan pendekatan studi pustaka yang fokus pada hasil kajian fatwa yang dihasilkan oleh kedua organisasi, penelitian ini menemukan bahwa dari hasil perkembangan dakwah keduanya, terdapat   proses transformasi fatwa, terutama pada masalah fatwa-fatwa hukum yang berkaitan dengan sikap kedua organisasi terhadap perempuan. Kedua organisasi  massa ini mengalami tranformasi fatwa dari sikapnya yang cenderung subordinatif berkembang menuju keputusan-keputusan hukumnya yang bersifat emansipatif, yang mendukung peran dan hak-hak perempuan di ranah publik.[Transformation is a change from one form to another by both individuals and certain groups. The transformation is usually caused by a need that requires the transformation to be done. In relation to the dakwah transformation of  Nahdhatul Ulama and Muhammadiyah, so far there are dynamics of organization decision related to their fatwas. Using a literary study approach that focuses on the results of fatwas produced by the two organizations, this study found that from the results of the development of dakwah of  both organization, there was a process of transformation of fatwas, especially on the issue of legal fatwas related to the attitudes of the two organizations towards women. Both mass organizations undergo a fatwa transformation from subordinating attitude into emancipatory decisions which support the role and rights of women in the public sphere.]

Abstract

In Indonesian society, marriage has legal dualism. Namely, marriage (which) should  be listed in the Religious Affairs Office (KUA) and the marriages were not recorded (Sirri marriage). In fact, if we examine more seriously, many Sirri marriages cause harm especially, on the part of women and children. And in fact, not the least negative effects caused by Sirri marriage. This paper discusses sirri marriage in the perspective of Islamic law and the National Marriage Law. Because sirri marriage not stated explicitly in both the Qur’an and hadith, hence, to determine the law (istinbat al-hukmi), jurists of Islamic law (in this case) do ijtihad whereby sirri marriage is categorized as al maslahat al murasalah, which refers to the maqasid al-shari’ah.  However, sirri marriage is actually problematic for several reasons. First, sirri marriage is not part of prophetic tradition. Because, the Prophet advocates and implements wedding party (walimah al-’Ursy) with aim to proclaim marriage to the public (i’lanun nikah). On the other hand, the recording of the marriage is the leader commands (Ulil Amri). Meanwhile, Allah and the Prophet ordered to obey the leader (Amri Ulil). Since the recording of the marriage will benefit Muslims (maslahah), then Muslims should stay away from harm (mudharat). Second, sirri marriage is not in accordance with the national law of marriage, because the point ‘marriage record’ does not exist in the concept of sirri marriage. Whereas, marriage registration set forth in Article 2, paragraph 2 of Law marriage, no. 1 of 1974 and article 2, paragraph 1, 2, 3 of Law no. 9 of 1975, the Code of Civil Law (KUHP) and the Compilation of Islamic Law (KHI).

Abstract

The debates over the degree of authority belong to women have been heavily developed on the ground of religious discourse. One of the most ctusial points is the leadership of women in mixed congregation where women and men are aprticipating in the prayers. The majority of Muslim scholars consider that women leadership in mixed congregation is out of question of contextulization reasoning of religious precept. On the one hand, the presence of Muhammad as the Prophet who conveyed the divine revelation has been seen as improving the status of women and their space as so equal to men as shoum clearly in surat An-Niso' (4): 124. On the other hand, however, there are also verses that claimed by scholars, which reduce women's rights, and there are also scholars who have denied women's access and rights to compete with men in good deeds (fastabiqul khairat). This article is specifically addressing and arguing for reinterpreting the right of women to lead mixed congregated prayers by ways of integrating dialectic discourse of Qur'anic verses and prophetic examplary actions.

Abstract

A Woman’s Right to Marry without a Guardian According to Imam Syafi’i and Imam Ja’Fari To marry without a guardian and the issue of the marriage guardian are legal marriage issues that always  arouse debate among Muslims. In classical literature, “it seems” women do not have the right to marry without a guardian. This paper examines whether women have the right to marry without a guardian and the  issue of guardians. This matter not explained explicitly or in detail by the Prophet resulting in a multiplicity  of interpretations. Religious leaders and schools of thought, as well as the State, discuss and examine these issues from a variety of perspectives. This paper explains the view of Imam Shafi’i and Iman Ja’fari, based on content analysis ond library-based research. This study looks firstly at patterns of thought and socio-cultural life according to Imam Shafi’i and Imam Ja’fari. Secondly, it discusses their views on the women’s right to marry without a guardian. Lastly, it explores the implications of their thought on the practice of women marrying without a guardian in Indonesia.

Abstract

The patriarchal culture that is gender biased has been proven to bring a negative effect in the harmony of human life. Men and women ideally must complete one-another and support each other in different ways. However patriarchal culture has made men became the main actors, dominant and hegemonic, and women became the figurant side, on the border and unable to express themselves. This 'sidedness' in the world of informational technology is one of the real facts in this problem. This article tries to prove how women's access to the technological world has been 'walled' since the beginning and how women are positioned only as a profitable object by exploiting their body and sexuality by technological practitioners. In the end of this article, the writer advises the need of a world-view patriarchal deconstruction, a cultural revolution, and a reformation of social structure as a way out of this problem.
