Abstract

Bullying has lately become a top issue, more commonly to school children, and the perpetrators are also underaged school youngsters. The aims of the study are to review category of bullying from criminal law and to analyze legal sanction for the perpetrator as well. This study administers normative research method by law and case approaches. The result of the study shows that every child has right to live and develop as regulated in Article 4 of Law no. 35 Year 2014 on juvenile protection. Bullying, therefore, cannot be justified. Bullying is categorized as criminal action as regulated in Article 71 Section (1) of Law No. 11 Year 2012 on juvenile court system. Perpetrator of bullying is sanctioned primary punishments which include criminal warning, conditional punishment, work training, coaching in institution, and imprisonment. Bullying akhir-akhir ini menjadi isu hangat umumnya dikalangan anak-anak sekolah dan pelakunya pun anak-anak sekolah yang di bawah umur. Tujuan studi ini untuk mengkaji kategori tindakan bullying dari aspek hukum pidana dan untuk menganalisis sanksi hukum bagi pelaku tindakan bullying. Riset ini menggunakan metode penelitian normatif dengan pendekatan perundang-undangan dan pendekatan kasus. Hasil studi menunjukkan bahwa setiap anak mempunyai hak untuk hidup dan berkembang sebagaimana diatur dalam Pasal 4 Undang-undang Nomor 35 Tahun 2014 Tentang Perlindungan Anak, karenannya tindakan bullying tidak dapat di benarkan. Tindakan bullying ini termasuk dalam kategori tindakan pidana seperti yang di tentukan dalam Pasal 71 ayat (1) Undang-undang Nomor 11 Tahun 2012 Tentang Sistem Peradilan Anak. Pelaku bullying dikenakan sanksi pidana pokok yang meliputi pidana peringatan, pidana dengan syarat, pelatihan kerja, pembinaan dalam lembaga, dan penjara.

Abstract

PTSL dilaksanakan berdasarkan Peraturan Menteri Agraria Dan Tata Ruang/Kepala Badan Pertanahan Nasional Nomar 35 Tahun 2016 tentang Percepatan Pendaftaran Tanah Sistematis Lengkap. Pendafaran tanah sendiri diamanatkan oleh Undang-Undang Nomor 5 Tahun 1960 tentang Peraturan Dasar Pokok-Pokok Agraria (UUPA), yang pada Pasal 19 ayat (1)-nya menegaskan bahwa untuk menjamin kepastian hukum, oleh Pemerintah diadakan pendaftaran tanah di seluruh wilayah Republik Indonesia menurut ketentuan-ketentuan yang diatur dengan Peraturan Pemerintah, Berdasarkan pemaparan di atas, penting dilakukannya penelitian mengenai : a. Bagaimanakah sistem pendaftaran hak atas tanah di Bali setelah adanya program Pendafaran Tanah Sistematis Lengkap (PTSL) ? b. Bagaimanakah proses serta peran Notaris/PPAT di dalamnya ?. Jenis penelitian ini merupakan penelitian hukum empiris yang meneliti data sekunder di awal penelitian dan dilanjutkan dengan meneliti data primer di lapangan, yaitu responden dari masyarakat secara langsung. Data primer dapat diperoleh secara langsung oleh peneliti dari sumber pertama. Sedangkan, data sekunder dapat diperoleh dari bahan–bahan kepustakaan, arsip–arsip, dokumen–dokumen yang terdiri dari bahan hukum primer dan bahan hukum sekunder yaitu karya ilmiah, hasil penelitian terdahulu, hasil karya dari praktisi hukum dan sejenisnya. Dari penelitian ini diperoleh hasil dan kseimpulan sebagai berikut : 1. Sistim negatif pendaftaran tanah adat di Bali dapat memberikan kepastian hukum bagi pemegang hak yang terdaftar di dalam daftar umum apabila Proses penyelidikan riwayat penguasaan tanah pada pendaftaran hak pertama kali mendapat bantuan masyarakat, diadakan kodifikasi mengenai lembaga kadaluwarsaTanah-tanah hak adat di Bali maupun hak-hak atas tanah adat secara umum dengan nama apapun, sebagaimana halnya hak-hak atas tanah lainnya, adalah merupakan obyek pendaftaran tanah, baik secara sistematis/sistematis lengkap, maupun secara sporadik. 2. Dalam proses pensertipikatan hak atas tanah adat (termasuk hak atas tanah adat di Bali) melalui pendaftaran tanah sistematis/ sistematis lengkap maupun sporadik, tidak ada peranan Notaris/PPAT didalamnya, sebab tidak diperlukan akta yang dibuat dihadapan/oleh Notaris/PPAT, kecuali untuk mengesahkan fotokopi dokumen sesuai dengan aslinya untuk fotokopi dokumen pendukung yang diperlukan atau untuk perbuatan hukum berupa pemberian hak guna bangunan atau hak pakai atas tanah hak milik. Terdapat adanya peranan PPAT dalam setiap perbuatan hukum berupa pemindahan hak atau pembebanan hak atas tanah, termasuk hak-hak atas tanah adat di Bali, karena perbuatan-perbuatan hukum tersebut harus dibuktikan dengan Akta PPAT untuk keperluan pendaftaran di Kantor Pertanahan guna penerbitan setipikatnya.

Abstract

Notary as a public official who has the authority to make an authentic notarial deed, performs the duties of his/her office in accordance with the provisions of the Law of the Notary Position. In addition to the authority to make an authentic notarial deed, a notary also has an obligation of keeping the confidentiality of the contents of the notarial deed that he or she made, pursuant to the Article 16 of paragraph (1) letter f of the Amended Law of the Law of Notary Position. Notary makes authentic notarial deed based on the provisions of the Articles 1320 and 1868 of the Indonesian Civil Code, as well as the provisions contained in the Law of Notary Position. One of their obligations is presenting instrumental witnesses in the reading of the notarial deed minimum of two (2) persons. Without the presence of the 2 (two) instrumental witnesses, then the notarial deed made by or before a notary has the privately made proofing. The problems in this study were to determine whether the instrumental witnesses have the obligation keep the confidentiality of the contents of the notarial deed, as the notaries do, and to find out the liability of the instrumental witnesses for the confidentiality of their notarial deeds that they signed. This study is a normative legal research which departed from the obscurity of the applicable norm on the provisions of the Law of the Notary Position on the instrumental witnesses related to their liability to disclosure the contents of the notarial deed. This study used the related statutory approach, literature books, and dictionaries as the legal materials. The results of this study indicated that the instrumental witnesses as one of the formal requirements in the process of making an authentic notarial deed who are also the integral parts of the notary, should have an obligation to keep the confidentiality of the contents of the notarial deed. This is to prevent the leakage of secrets related to the contents of the notarial deed that may be committed by the instrumental witnesses, as well as to protect the interests of the parties on the notarial deed. A less clearly-stated provision related to the instrumental witnesses in the Law of the Notary Position has resulted in any action taken by the instrumental witnesses to become one unity with the notary, or regarded as the own responsibility of the notary. In order to provide legal certainty and legal protection to the instrumental witnesses, as well as to protect the notaries in carrying out their office, the necessary arrangements regarding the obligations and responsibilities of the instrumental witnesses should be clearly specified in the Law of the Notary Position.

Abstract

Governor as the head of the province has the authority to regulate the allocation and use of assets held by the provincial government, including land management rights. The purpose of management rights titled land is to be given to a third party. This provision is based on the Decree of the Governor in form of land utilization permit. Furthermore, over that given land, the rights of land can be applied above it, for example Building Right Title. Problem that occur is if the Governor as concessionaires strip the utilization permit that has been granted, as in the case of Management Rights Titled Land No.2 with the Building Right Title Land No. 80 on behalf of PT. Abdi Persada Nusantara in Kesiman Petilan Village, Denpasar. What about the legal status of land rights that existed on the management rights titled land and the legal consequences of the burdening the liability right to management rights titled land after the revocation of the land utilization permit. This type of research in this thesis is a normative legal research, the research that seek answers by examining the problems of legal materials and the use of primary and secondary theoretical foundation as one of the characteristics of a normative study. The approach used in this study is the Regulation Approach, Legal Concepts Analysis Approach and the Case Approach, furthermore the discussion done by descriptive analysis way by describing and analyzing the results obtained from the legal materials, systematically arranged so that the conclusion can be obtained. Result of study of the prooblems studied is the legal status of land rights on management rights titled land that it’s utilization permit has been stripped by the concessionaires became abolished. Abolishment of the land rights led to liability rights does not lead to the abolishment of the secured debt. Receivables creditors still there, but no longer as claims that guaranteed specifically by the special position of the creditor (lender preferred)

Abstract

A notary is a public officer who given sufficient authority by the state to make an authentic deed. If a party feels aggrieved over the deed of a Notary, then the party can sue the notary with the charges of malpractice in an authentic deed, although the notary has been working in accordance with the standards of an authentic deed. On this basis, it is need a legal protection for the notary, in this case, made ??by the Notary Honorary Council (MKN) as provided for in the Article 66 of paragraph (1) of Law No. 2 of 2014 on the Amendment of Law Number 30 of Year 2004 on the Notary Position (UUJN-P). There are no certain regulations on MKN positions and the kinds of legal protection given by the MKN to the notary, giving rise to legal issues namely, what the standards or requirements in the process of making an authentic deed and what the legal protection of the Position of Notary in relations to the allegations of malpractice in the making of authentic deeds. This thesis research is a normative legal research, which departed from the vacuum of norm. The legal materials collection techniques used were the study of literature and the card system. The analysis of the legal materials was conducted by using descriptive techniques, interpretations and arguments associated with the theories and concepts of law which relevant to the issues. The research findings of the problem under study, namely, that in making authentic deeds, notary must always pay attention to the validity of the agreement according to the terms of Article 1320 of the Civil Law (the Civil Codes), the requirement of making authentic deeds (Civil Code of 1868), Law on the Notary Position, as well as the Notary Code of Ethics. While MKN position as the Administrative agencies should be established in the regions of (city or regencies) in order that MKN can quickly respond to the case and provide an appeal to the parties who are not satisfied with the decision of MKN.

Abstract

Notary as a public official the only one authorized to make authentic act of the deeds , agreements and determination required by a general rule or by the concerned desired to be declared in an authentic document , ensure certainty the date, saveing , all along the deed was not also be assigned or excluded to the officer or others . As a public official duties and notary work not only makes authentic act but also to register and certify (waarrmerken) letters under a hand. This research is empirical nature of this research is descriptive. Data studied were the primary data (primary data) and secondary data (Secondary data). Sembung research sites in the village. Data collection techniques are literature research and interview techniques . Non probality Sampling Sampling techniques . Data analysis method is a method of qualitative analysis . Waarmerken deed made under the deed of hand function are made under the hand guarantees about the date and the signatures of the parties concerned on the evidence. Deed under the hand that has obtained waarmerken of Notaries has the force of law under these conditions, the deed under the hand that received waarmerken of notary can assist judges in terms of evidence, due to the recognition of the signature , then the contents of the deed was regarded as the agreement of the parties , because the deed under the hand the truth lies in the signature of the parties to the recognition of the signature by the parties and to those who acknowledge his signature on the letter means he also recognizes the contents of the letter that is above his signature that the certificate is a proof of perfect .

Abstract

The phenomenon of online prostitution became a hot issue in Indonesia. Online Prostitution Article 27 paragraph (1) Jo. Article 45 paragraph (1) of the ITE Law, Article 296 of the Criminal Code, Article 506 of the Criminal Code, Article 2 paragraph (1) of Law No. 21 of 2007 concerning Eradication of Crime in Trafficking in Persons, and Article 30 Jo. Article 4 paragraph (2) Law No. 44 of 2008 concerning Pornography. However, in the article has not set explicitly against online prostitution service users. The aim of this study was to elaborate on the user settings prostitution service through online media and forms of criminal responsibility prostitution service users through online media. The method used is a normative legal research. This type of approach is used, among others: statue approach, conceptual approach, and comparative approach. The results of the study indicate that the formulation policy criminal liability for online prostitution service users has not yet been regulated in Indonesian legislation, from the results of a comparison with Sweden (Sex Purchase Act) also regulates the criminal liability of users of online prostitution services and should the rules in the future refer to Swedish law (sex purchase act). Fenomena prostitusi online menjadi suatu isu hangat di Indonesia. Prostitusi online Pasal 27 ayat (1) Jo. Pasal 45 ayat (1) UU ITE, Pasal 296 KUHP, Pasal 506 KUHP, Pasal 2 ayat (1) UU No. 21 tahun 2007 tentang Pemberantasan Tindak Pidana Perdagangan Orang, dan Pasal 30 Jo. Pasal 4 ayat (2) UU No. 44 tahun 2008 tentang Pornografi. Namun, dalam pasal tersebut belum mengatur secara eksplisit terhadap pengguna jasa prostitusi online. Tujuan studi ini ialah untuk mengelaborasi pengaturan pengguna jasa prostitusi melalui media online dan bentuk pertanggungjawaban pidana pengguna jasa prostitusi melalui media online. Metode penelitian yang digunakan adalah penelitian hukum normatif. Jenis pendekatan yang digunakan antara lain: pendekatan perundang-undangan, pendekatan konseptual, dan pendekatan perbandingan. Hasil studi menunjukkan bahwa kebijakan formulasi pertanggungjawaban pidana pengguna jasa prostitusi online saat ini belum di atur dalam peraturan perundang-undangan Indonesia, dari hasil perbandingan dengan Swedia (Sex Purchase Act) mengatur juga pertanggungjawaban pidana pengguna jasa prostitusi online dan sebaiknya aturan di masa mendatang mengacu pada hukum swedia (sex purchase act)

Abstract

The granting of power of attorney to sell the land rights as an instrument for the fulfillment of the obligations of the debtor in a loan agreement of a notarial deed may commonly be found in the everyday practice of the notaries. Power of Attorney to sell is used by the proxy to sell the land of the authorizer in the event that the authorizer (debtor) experienced defaults. The Civil Law Code and the Law No. 4 of 1996 on Mortgage do not stipulate the power attorney to sell as an instrument in the loan agreement. There are two legal contents analyzed from the vacancy of norms regarding the power of attorney to sell, namely: (1) how the arrangement of power of attorney to sell of the land rights as an instrument for the fulfillment of obligations on the loan agreement in the legislation on the guarantee law and (2) the legal effect of power of attorney to sell the land rights as an instrument for the fulfillment of obligations of the debtor in case of default under the loan agreements in connection with the execution of the law of guarantee. The type of research used in this thesis is a normative legal research with the statutory, concept and case approaches. Based on the research results, it was revealed that the power of attorney to sell is based on the agreement of the parties which make the basis of the principle of freedom of contract. The Power of Attorney Deed shall be valid unless otherwise it is canceled by the judge with a court ruling that has the binding legal force. The use the deed of power of attorney to sell is considered weak because the power of attorney to sell can not be used as a basis for executing security object between the grantor and the recipient of the power of attorney. Deed of power of attorney to sell is deemed not obtain legal certainty because at the time of registration of transfer of land rights, the power of attorney to sell can not be accepted by the local Land Registry Office. Responsibility for the grantor and the recipient of power of attorney is related to the obligations and rights of the grantor and the recipient of the power of attorney. As for the responsibility of the notary who made the deed of power of attorney to sell can be studied from three aspects, namely: (1). Civil responsibility; (2). Administrative responsibility; and (3). Criminal responsibility. Legal remedies that can be taken if the debtor is experiencing defaults can be done by way of a summons in advance without selling the rights of the land owned by the grantor of the power of attorney to sell (the debitor).

Abstract

There are many business activities in the tourism industries in Indonesia. One of them is the provision of services, specifically in Bali. The tourists, who are traveled to Bali, have a desire to invest. Practically, in the provision of services, there are many variants of the business which are not easy to be categorized as a services trading in tourism. It has been mixed with other business variants beyond the tourism services. One of its variants is the development services and the management of property. It was developed with the business scheme and managed with the management of property scheme. The problem is, the seller or the developer offer a tourism accommodation services. The other problem is that property, which has been developed, financed by the foreign buyer. The property is managed by the developer for the provision of tourism accommodation service purposes. Further, the owner of the property got an income from the property management. The parties of this investment model expect that income as a return of their investment. This business model is usually called the return on investment in the tourist accommodation trading services. The type of this research, which used for this thesis, is normative research. It’s researched from The Investment Constitution, the Tourism Constitution, The Construction Services Constitution and some of regulations related with the arrangement of the return on investment. This research was used material sources of law, which are primary legal materials, secondary legal materials and tertier legal material. The result of this research show that the rules about return on investment in the tourist accommodation trading services are not regulated explicitly. The regulation hasn’t been reached that return on investment activities. It causes lot of losses for the foreign investor. The government and the society also get same troubles.

Abstract

The purpose of this research is to reviewe and analyze the extent to which the applicable laws and regulations in Indonesia regulate the use of signatures change by the partys in making notary deeds and to review and analyze the legal consequences of the use of signatures change by the partys in making a notary deed. This research is a normative legal research, using two types of approaches, namely the statute approach and the conceptual approach. The results of this study show that there are various causes of changing signatures of party, but the laws and regulations that apply in Indonesia do not have articles that govern this. The validity of a signature is seen based on the acknowledgment to justify the person affixing the signature. A different or change signature is justified by law insofar as the signer affixing his signature confirms that it is his signature, so that the legal consequences of such notary deeds are still valid to be used as evidence of authentic writing that has the power of perfect proof law. Tujuan dari dilakukannya penelitian ini adalah untuk mengkaji dan menganalisis mengenai sejauh mana peraturan perundang-undangan yang berlaku di Indonesia mengatur mengenai penggunaan tanda tangan berubah-ubah oleh penghadap di dalam pembuatan akta notaris dan untuk mengkaji dan menganalisis mengenai akibat hukum dari digunakannya tanda tangan berubah-ubah oleh penghadap di dalam pembuatan akta notaris. Penelitian ini merupakan penelitian hukum normatif, dengan menggunakan dua jenis pendekatan yaitu pendekatan perundang-undangan dan pendekatan konseptual. Hasil penelitian ini menunjukkan bahwa ada berbagai penyebab terjadinya tanda tangan yang berubah-ubah dari penghadap, namun peraturan perundang-undangan yang berlaku di Indonesia tidak terdapat pasal yang mengatur mengenai hal tersebut. Keabsahan dari suatu tanda tangan adalah dilihat berdasarkan adanya pengakuan untuk membenarkan dari orang yang membubuhkan tanda tangan. Tanda tangan yang berbeda atau berubah-ubah dibenarkan oleh hukum sepanjang penghadap yang membubuhkan tanda tangannya tersebut membenarkan bahwa itu adalah tanda tangannya, sehingga akibat hukum terhadap akta notaris yang demikian adalah tetap sah untuk digunakan sebagai alat bukti tulisan otentik yang memiliki kekuatan hukum pembuktian sempurna.
