Abstract

The research was conducted to asses Article 81 and Article 81A of Government Regulation In Lieu of Law No. 1 of 2016 on the Second Amendment of Law No. 23 of 2002 on Children Protection which includes imposition of castration sanction in its substance materials. Such policy is based on many rapes and murders case of minors that happen cruelly nowadays. Based on three points of view, chemical castration is the effort of reducing sexual arousal addressed to the perpetrator in order not to reiterate the same action and to reduce crimes such as rape and other sexual offenses. Although this regulation has good aim in terms of the deterrent effect, but there is a human rights character code which is a non-derogable human rights stipulated in Article 28 paragraph (1) The 1945 Constitution of the Republic of Indonesia, one of which is so called right not to be tortured. The conclusion of this research is that the sanction of chemical castration violates human rights therefore constitutes an unconstitutional policy or in contrary to the 1945 Constitution of the Republic of Indonesia. The results of this study is also expected to provide a view on constitutional law in doing the judicial review before the Constitutional Court.

Abstract

Krisis multi dimensi dan perkembangan global yang cepat memicu disrupsi pada seluruh generasi, termasuk tingkah laku menyimpang yang terjadi dewasa ini, sehingga Pendidikan Pancasila dibutuhkan secara integratif dalam pendidikan nasional. Penelitian ini ingin mengkaji, menganalisa, dan mengukur kebijakan pemerintah terkait dengan Pendidikan Pancasila pada Sekolah Menengah Atas, bentuk pembelajarannya dalam menangkal ideologi transnasional, dan urgensi serta efektivitas Pendidikan Pancasila diajarkan pada Sekolah Menengah Atas di Bali. Penelitian ini menggunakan metode penelitian normatif-empiris dengan pendekatan perundang-undangan, pendekatan kasus, dan pendekatan analisis konsep hukum. Ketiga pendekatan ini untuk mendukung telaah sumber bahan hukum pada metode studi dokumen, juga dibantu dengan data penunjang melalui observasi dan wawancara pada lembaga terkait. Hasil penelitian ini menunjukkan bahwa kebijakan pemerintah terkait Pendidikan Pancasila harus dari dini dikenalkan dan diajarkan termasuk pada tingkatan Sekolah Menengah Atas untuk mewujudkan pendidikan integratif moral ketuhanan dan kemanusiaan. Pembelajaran pendidikan Pancasila pada Sekolah Menengah Atas dalam menangkal ideologi transnasional bagi pemuda dengan internalisasi Pancasila melalui pendidikan sebagai instrumen antisipatif dan preventif. Pendidikan Pancasila telah efektif diajarkan dalam pendidikan sekolah menengah atas di Provinsi Bali serta memiliki urgensi untuk dilakukan sesuai dengan tujuan pendidikan yang integratif dengan pembentukan karakter siswa.

Abstract

Freedom of the press stands as one of the fundamental pillars of democracy and human rights, serving as an essential mechanism for public oversight, transparency, and the dissemination of information. Although constitutionally guaranteed by the 1945 Constitution of Indonesia and reinforced through Law No. 40 of 1999 concerning the Press, the practice of press freedom in Indonesia continues to face substantial challenges, including intimidation, violence, and criminalization of journalists. This study aims to identify the various forms of intimidation and violence faced by journalists, analyze their implications for freedom of expression and human rights, and propose recommendations for strengthening legal protection mechanisms for the press in Indonesia. Employing a normative legal research method with statutory, conceptual, analytical, and case approaches, the study examines the relationship between legal norms and their practical implementation. Case studies, such as the assaults on journalists Wildan Pratama and Rama Indra during coverage of the protests against the revision of the Indonesian National Armed Forces Law (UU TNI), reveal the inadequacy of legal protection and the persistence of human rights violations in the journalistic field. The findings demonstrate that violence against journalists not only infringes upon individual rights but also undermines democratic governance and social justice. Therefore, this research emphasizes the necessity of reinforcing legal frameworks, implementing national journalist safety protocols, enhancing legal literacy among law enforcement, and fostering collaboration between the government, the Press Council, and civil society to create a secure, independent, and ethical media environment in Indonesia.

Abstract

This research uses normative research methods with a statutory approach, historical approach and conceptual approach. The results of this study are The urgency of traditional architectural arrangements in the governance of residential housing based on local wisdom in Bali Province is 1) realizing legal certainty in the implementation of residential housing in Bali Province; 2) realizing housing and residential areas in Bali Province with character; and 3) preserving local wisdom in Bali. Strategies for regulating traditional architecture in the governance of residential housing based on local wisdom in the province of Bali at the present time, including: 1) realizing the change in the status of Bali Province as a special region; 2) adjusting regulations in several fields related to residential housing, spatial planning, land, licensing and building architecture at the central and regional levels of the province of Bali; and 3) supervise the implementation of traditional architectural arrangements in the governance of housing and residential areas based on local wisdom in Bali Province.

Abstract

Issues relating to granting permanent legal force to decisions of the constitutional court immediately after they are pronounced in a plenary session open to the public are important to research for several reasons Firstly, it is very important for us to know the rationale for granting permanent legal force to decisions of the constitutional court given immediately after completion. pronounced in a public meeting open to the public. Second, understanding the permanent legal force of constitutional court decisions is also related to the question of why it is not possible to have legal efforts to correct constitutional court decisions if errors occur in terms of achieving legal certainty. Based on this, the question also arises as to whether the constitutional court's decision regarding this error will continue or not. Third, it is related to whether the legislator (positive legislator) can override the decision of the constitutional court. What is the rationale underlying the granting of permanent legal force to a Constitutional Court decision from the moment it is pronounced in a session open to the public? This research is normative legal research because there is a legal vacuum if the constitutional court's decision is contrary to the spirit of the 1945 Constitution. The importance of immediacy in granting permanent character to the constitutional court's decision, if viewed from the law in book aspect, is indeed the best choice. This is based on the following reasons. First, the Constitutional Court was formed to protect the purity of the Constitution with a more detailed interpretation. This interpretation will be used as a basis for resolving problems by certain authorities who are given direct authority by the Constitution. Therefore, it is appropriate that the interpretation is only carried out once, which is binding so that the decision must be placed at the first and final level where no effort can be made to cancel it. Second, apart from that, it must also be understood that the constitutional court as a constitutional court can resolve problems and provide legal certainty quickly by the principles of fast and simple justice.

Abstract

Background: The responsive-participatory approach in forming Regional Regulations involves democratic engagement, particularly the active participation of the community and direct stakeholders at all stages, as outlined in Law Number 12 of 2011. Objective: This participatory process enhances the effectiveness of Regional Regulations, as community acceptance, stemming from their involvement, is crucial for meeting legal needs rather than relying on enforcement coercion. Method: This study utilises normative legal research, applying laws through statutory and conceptual approaches. Results: The findings emphasise that a democratic political configuration fosters community involvement in drafting Regional Regulations, reflecting a democratic-populist legal agenda. Conclusion and Recommendations: It concludes that regulations developed without community input tend to be authoritarian and face rejection, whereas active participation fosters compliance with higher laws, supports law enforcement, and promotes democracy. Recommendations include the establishment of a Regional Regulation on Community Participation to strengthen legal clarity and commitment, ensuring that the community is involved in the legislative process through existing provisions.

Abstract

This study aims to analyze and examine the President's Veto Rights over draft laws submitted by the Timor Leste Parliament. In the administration of the Democratic Republic of Timor Leste, it is stated in Article 74 of the 2002 Constitution of the Democratic Republic of Timor Leste (RDTL) that the President of the Republic is the Head of State and the symbol of the guarantor of national independence and national unity as well as the smooth functioning of state institutions in a democratic manner. So that the power / authority of the state is held by the President. The research method used in this study is the normative legal research method, which examines and examines based on book reviews / literature reviews and law reviews. The results of the study show that based on Article 85 of the 2002 Constitution of the Democratic Republic of Timor Leste (RDTL) states that one of the authorities of the President of the Democratic Republic of Timor Leste is the veto right over Draft Laws. The veto right is the right to cancel decisions, provisions, draft regulations and laws, or resolutions. In order to improve and make effective the oversight function of the national parliament in fighting for the aspirations of the people of the Democratic Republic of Timor Leste to protect human rights, it is necessary to have limitations and criteria for the use of the President's veto power over draft laws.

Abstract

This study is driven by the ongoing challenges in royalty management arrangements for copyrighted songs and regional music, despite the existence of relevant regulations. In this context, the issues originated from the public’s limited understanding of copyright infringement, as well as a lack of awareness regarding the rights of songwriters and regional musicians to receive royalties. In some cases, songwriters and musicians resort to informal or underhanded agreements concerning the use of respective songs. Therefore, this study aims to thoroughly examine the royalty management policies for copyrighted songs and local music in Indonesia, to emphasize the urgency of royalty management in the sector, and to explore the issue from a human rights perspective. In order to achieve the stated objectives, a normative study approach was utilized, adopting both a legislative approach and legal concept analysis. The obtained results showed that royalty management policies for copyrighted songs and regional music were regulated under Government Regulation 56/2021, implemented through National Collective Management Institution (Lembaga Manajemen Kolektif Nasional/LMKN) and Collective Management Institution (LMK). The management of royalties is very important, as it provides benefits not only to creators and related stakeholders but also contributes to the development of music in society. Furthermore, royalty management, as an expression of economic rights, was recognized as part of ECOSOB human rights.

Abstract

Fokus utama penelitian ini adalah untuk memahami respon hukum terhadap pendudukan lahan ilegal oleh Gerakan Aceh Merdeka (GAM) di Aceh, khususnya dalam konteks perlindungan hak-hak individu, stabilitas hukum, dan upaya pemulihan perdamaian di wilayah tersebut. Penelitian ini bertujuan untuk mengidentifikasi dan menganalisis undang-undang yang mengatur kepemilikan tanah di seluruh Indonesia, dengan penekanan khusus di Provinsi Aceh, dan menyelidiki kasus-kasus yang berkaitan dengan pendudukan tanah oleh kelompok bersenjata yang berbeda. Penlitian ini menggunakan metode normatif dengan pendekatan analytical approach. Hasil menunjukkan bahwa tantangan hukum yang dihadapi dalam permukiman ilegal di Aceh, khususnya mengatasi kesulitan dalam membuktikan kepemilikan tanah di zona konflik dimana dokumen-dokumen penting sering hilang. Ancaman kekerasan dan intimidasi oleh kelompok bersenjata, seperti Gerakan Aceh Merdeka (GAM), yang mempersulit penegakan hukum.
