Abstract

The protection of children's rights is a fundamental aspect in the Indonesian legal system, as stipulated in Law Number 23 of 2002 concerning Child Protection. In this context, the fulfillment of child custody (hadhanah) is one of the crucial issues to be studied, especially in areas that have complex social and cultural dynamics such as Kudus Regency Indonesia. This study aims to analyze the effectiveness of legal implementation in ensuring the fulfillment of child custody in the region. Using legal research methods and qualitative approaches, data was obtained through structured interviews with 15 informants spread across 9 sub-districts in Kudus Regency Indonesia. The results of the study show that there is still a significant gap between the applicable legal norms and the reality in the field. Various cases of violence against children, economic exploitation, and neglect of basic rights such as access to education and health are still often found. Some of the factors that affect the effectiveness of child protection include low public awareness of the importance of children's rights, the lack of active role of local governments, and the limited family economy which has implications for the neglect of children's rights. Therefore, this study recommends increasing the intensity of legal socialization to the community, strengthening the role of child protection institutions, and optimizing child protection policies that are preventive and responsive. These findings are expected to be strategic considerations for policymakers, legal practitioners, and the wider community in strengthening the child protection system comprehensively in Kudus Regency Indonesia.Keywords: Child protection, children's rights, effectiveness, Kudus Regency. AbstrakPerlindungan hak anak merupakan aspek fundamental dalam sistem hukum Indonesia, sebagaimana yang diatur dalam Undang-Undang Nomor 23 Tahun 2002 tentang Perlindungan Anak. Dalam konteks ini, pemenuhan hak asuh anak ( hadhanah ) menjadi salah satu isu krusial yang menarik untuk dikaji, terutama di daerah dengan dinamika sosial dan budaya yang kompleks seperti Kabupaten Kudus, Indonesia. Penelitian ini bertujuan untuk menganalisis efektivitas implementasi hukum dalam menjamin pemenuhan hak asuh anak di wilayah tersebut. Dengan menggunakan metode penelitian hukum dan pendekatan kualitatif, data diperoleh melalui wawancara terstruktur dengan 15 informan yang tersebar di 9 kecamatan di Kabupaten Kudus, Indonesia. Hasil penelitian menunjukkan bahwa masih terdapat kesenjangan yang cukup signifikan antara norma hukum yang berlaku dengan kenyataan di lapangan. Berbagai kasus kekerasan terhadap anak, eksploitasi ekonomi dan pengabaian hak-hak dasar seperti akses pendidikan dan kesehatan masih sering ditemukan. Beberapa faktor yang mempengaruhi efektivitas perlindungan anak antara lain rendahnya kesadaran masyarakat akan pentingnya hak anak, minimnya peran aktif pemerintah daerah, dan terbatasnya perekonomian keluarga yang berimplikasi pada pengabaian hak anak. Oleh karena itu, penelitian ini merekomendasikan peningkatan intensitas sosialisasi hukum kepada masyarakat, penguatan peran lembaga perlindungan anak, dan optimalisasi kebijakan perlindungan anak yang bersifat preventif dan responsif. Temuan ini diharapkan dapat menjadi pertimbangan strategis bagi para pembuat kebijakan, praktisi hukum, dan masyarakat luas dalam memperkuat sistem perlindungan anak secara komprehensif di Kabupaten Kudus, Indonesia.Kata Kunci: Perlindungan anak, hak anak, efektivitas, Kabupaten Kudus.

Abstract

Child sexual abuse remains a pressing concern in Indonesia, with victims often experiencing deep and lasting trauma. Yet, the country’s criminal justice system largely focuses on punishing offenders, offering far less attention to safeguarding and supporting the rights and recovery of those who have suffered. This article aims to explore the role of the Victim Impact Statement (VIS) as a mechanism to promote victim-centered justice. This study adopts a normative legal research approach, drawing on statutory analysis, comparative review, and case study methods. Its primary legal sources include court rulings on child sexual abuse and key regulations, notably Supreme Court Regulation (PERMA) No. 1 of 2022 on Restitution and Compensation. Data are analyzed qualitatively to evaluate the implementation of restitution and the recognition of victim perspectives in legal proceedings. The findings indicate that restitution is essential in incorporating the victim’s voice into judicial decision-making. The study proposes a Victim Impact Statement (VIS) model designed to help both victims and judges convey and evaluate the effects of crime more effectively. It concludes with recommendations to better integrate VIS into Indonesia’s criminal justice system, moving toward an approach that is more victim-centered and aligned with the principles of restorative justice.

Abstract

The selection process for members of the General Elections Commission (KPU) and the Election Supervisory Body (Bawaslu) in Indonesia plays a strategic role in ensuring the integrity of electoral democracy. Although designed based on the principle of checks and balances, the dominance of the House of Representatives (DPR) in the final stages of the selection process opens up room for political intervention that threatens the independence of the election organisers. This article aims to examine the effectiveness of the current selection design and propose an alternative conceptual model in the form of a reverse mechanism selection, a reversal of the selection authority structure as an instrument for reconstructing a more independent selection governance system. The research method used is normative legal research, with a statutory approach and a comparative analysis of the selection mechanism for election organisers. The results indicate that the final authority held by the DPR without an independent oversight mechanism reduces institutional independence and increases the potential for politicization. Therefore, this article recommends a reconfiguration of authority through a reverse mechanism selection model, in which an independent Selection Team holds final decision-making authority, while the DPR is limited to nominative and administrative functions. This concept provides a conceptual contribution to strengthening the principle of independency of the election organisers and encourages legal reform to increase accountability and neutrality in the selection process.

Abstract

The urgency of this research is highly necessary in order to alter the paradigm of corruption criminalisation based on punishment towards recovery. The formulation of the problem in this research is whether the shift in the spirit of corruption criminalization from retributive justice to restorative justice can guarantee the realisation of national economic recovery towards the Indonesia Emas 2045 vision and how the reconstruction of restorative justice through the approach of categorizing state losses in the criminalization system in Indonesia. This research uses a normative legal research type that is prescriptive. The results of this study indicated that (1) The teachings of retributive justice in legal practice in other countries such as the Netherlands have been abandoned and adopted the teachings of restorative justice. This teaching is in line with the ideology of Pancasila, so it is very important to be applied in the corruption criminalization system in Indonesia. (2) Restorative justice reconstruction based on state loss categories includes: Category 1 state losses below 200 million plus 1/4, Category 2 state losses of at least 200 million to a maximum of 1 billion plus 1/3, Category 3 state losses of at least 1 billion and a maximum of 5 billion plus 1/2, Category 4 state losses of 5 billion but not more than 100 billion plus 2/3, Category 5 state losses above 100 billion plus 100%. This study concluded that the restorative justice categorisation approach in handling corruption cases will realize efforts to restore the national economy towards the Indonesia Emas 2045 vision.

Abstract

The phenomenon of Food Loss and Waste (FLW) is a problem with serious impacts on environmental, economic, and social aspects. This research aims to analyze the normative issues surrounding FLW in Indonesia in accordance with the mandate of Article 27 and 28H(1) of the 1945 Constitution, while also offering prescriptions on how Indonesian law should address the FLW issue. This research is a normative legal research, using a conceptual and comparative approach. The comparative approach involves analyzing legal systems in three jurisdictions: Europe, America, and Asia. Furthermore, the concept of smart regulation is used as a perspective to prescribe effective FLW regulations in Indonesia. The findings of this research show that Indonesia has demonstrated awareness of FLW through the National Food waste Agency (NFA), the legal draft on FLW and the revision of Food law in progress. However, the absence of specific regulations on FLW proves to be counterproductive to the current government priorities. Secondly, to address the FLW issue, a combination of Command and Control (CaC) instruments, economic instruments, and educational and informational strategies is highly recommended. Integrating these three instruments is expected to encourage all stakeholders—including the government, business actors, and the community—to contribute to solving the FLW problem. This recommendation is also supported by an analysis of FLW regulations in Europe, America, and Asia, which reveals that a combination of Command and Control (CaC) mechanisms, economic instruments, and education can effectively reduce FLW in these regions.

Abstract

The Reserve Component, a non-regular military unit in Indonesia, is envisioned as a complement to the Indonesian National Armed Forces (TNI) in national defense efforts. The establishment of the Reserve Component in Indonesia is based on the dual legal personality of its members. This dualism manifests in the legal personality status of Reserve Component members, which can shift between military and civilian statuses in an unstable manner. This dual legal personality of Reserve Component members apparently presents a looming derivative risk. This article aims to analyze the reasons behind the formulation and the problems faced by the dual legal personality of Reserve Component members. This research has never been conducted in Indonesia. This article utilises a socio-legal study that combines legal and civil-military approaches in social science studies. The legal approaches used as research tools in this article are statutory and conceptual. This article finds that the Reserve Component concept is based on the Total War doctrine, which is translated into the Total Defense System policy in Indonesia. The existence of this doctrine forms the basis for the formulation of the Reserve Component, which must have dual legal personality, making this dualism impossible to eliminate. In fact, the dual legal personality of Reserve Component members has resulted in several issues, including but not limited to ambiguity in court proceedings, civil-military friction, and even issues regarding the neutrality of Reserve Component personnel in general elections.

Abstract

The nature of private law is strongly embedded in dismissal cases. For this reason, human rights standards are rarely applied in the settlement of such cases in court. However, the Martinus Masa Dorita v. PT Musim Mas case demonstrated a different practice. Particularly in the court of first instance, the judges explicitly considered human rights law, resulting in a judgment that contrasted with the parties’ claims. In spite of the fact that the Supreme Court annulled the decision of the court of first instance, the presence of human rights argumentation in the journey of the case remains important to explore. By analyzing judges’ reasoning in the court decisions for the case, this doctrinal legal research developed a legal methodology for the application of human rights standards in dismissal cases. We found that the judges have made human rights standards work by reinterpreting pre-existing employment law provisions that govern employee-employer relations using an impact-oriented reasoning method. This work contributes to a greater understanding of how judges can put human rights law to work when developing their reasoning for dismissal cases. Based on the case, human rights-based reasoning enables judges to provide vigorous protection of workers’ human rights and deliver substantive justice. We argue that human rights considerations enable courts to create equilibrium in unequal employee-employer relations.

Abstract

The constitutional dilemma surrounding the authority of the Constitutional Court to review electoral laws during an ongoing election cycle reflects the complex tension between the protection of rights and the maintenance of legal order. The Constitutional Court’s judicial activism, particularly when issuing landmark rulings close to or during electoral stages, often intensifies what constitutional law scholars refer to as the counter-majoritarian difficulty—a legitimacy problem that arises when a non-majoritarian judicial body invalidates laws enacted by democratically elected institutions. In this context, the Purcell Principle, a judicial restraint doctrine developed by the United States. Supreme Court, offers an important framework to prevent last-minute changes to electoral regulations that may cause legal uncertainty and confusion among voters. However, directly transplanting this principle into Indonesia is problematic due to significant differences in legal systems, institutional structures, and the fragmented nature of its democratic processes. To address this challenge, this article proposes an adaptive concept called the limited Purcell principle, comprising four key pillars: (1) temporal limitation on the Constitutional Court’s rulings during the election period; (2) postponement of the implementation of rulings which have fundamental legal consequences; (3) exceptions to safeguard the constitutional rights of citizens; and (4) screening mechanisms during the preliminary examination phase. This model aims to strike a balance between protecting constitutional rights and ensuring electoral stability, while encouraging the Constitutional Court to exercise its constitutional mandate more prudently and proportionally within the framework of Indonesia’s constitutional democracy.

Abstract

This article investigates the crisis of public trust in Indonesia’s Constitutional Court, triggered by a series of controversial decisions that suggest the practice of abusive judicial review. It focuses on three pivotal rulings, Decision No. 90/PUU-XXI/2023, that collectively reveal a pattern of judicial behavior aligned with executive interests, undermining judicial independence and constitutional integrity. Utilizing a normative legal research method with statute, conceptual, and analytical approaches, the study critically examines how judicial overreach, ethical breaches, and procedural irregularities have contributed to institutional decay. The findings indicated that the Constitutional Court has shifted from its role as a counter-majoritarian institution to a political instrument, eroding legal certainty and democratic accountability. The involvement of justices in conflicts of interest, particularly in election-related cases, has intensified public skepticism and revealed systemic weaknesses in judicial appointment and oversight mechanisms. This paper argued that such decisions constitute a form of “abusive judicial review” that threatens Indonesia’s constitutional democracy. To restore judicial legitimacy, structural reforms are imperative, emphasizing transparent judicial recruitment, permanent ethical oversight bodies, and stronger civil society engagement. The article concluded that without substantial reform, the erosion of public trust may further delegitimize the Court as a guardian of the Constitution.

Abstract

Logico-empiricism emphasises the importance of empirical verification as a scientific criterion for distinguishing meaningful from meaningless statements. Although logico-empiricism has made significant contributions to the development of the philosophy of science and has been practically beneficial for every legal scholar, criticisms of the a variety of assumptions underlying logico-empiricism have emerged from several perspectives. Therefore, this article is important to write in order to: 1) explain and deepen the criticisms of logico-empiricism assumptions by focusing on the perspective of dogmatic legal science; 2) offer an alternative epistemology to address these criticisms. This study uses a conceptual approach supported by secondary data sources. The results show that there are six criticisms of the logico-empiricism assumptions of the logical positivism paradigm when viewed from the perspective of dogmatic legal science. These criticisms highlight the tendency of logico-empiricism to reduce legal complexity, limit the scope of explanation, generalise inappropriately, raise questions of objectivity, and ignore social, political, and societal dynamics in the formation and application of law. This critique also demonstrates the limitations of the logico-empiricist approach, necessitating a more inclusive and interdisciplinary alternative epistemology. Several alternative epistemologies proposed to address criticisms of logico-empiricism include hermeneutics, pragmatism, phenomenology, and falsificationism. It is also possible to integrate these various approaches to form a complementary methodological framework, which the author calls "critical-pragmatic hermeneutic phenomenology." This approach is advantageous because it is holistic, open to revision, contextual, practically useful, and respectful of human experience.
